Mr. Dedmon will cover the basic concepts in the complex qui tam scheme responsible for more than $3 billion in civil recoveries in 2012 and outline the developing theories involving quality of care issues under the Act that practitioners may encounter, including attempts to use CMS regulations and guidance as the basis for establishing the standard of care. 6 FACULTY FACULT Y D. Jennifer Andreou, a partner at Plunkett Cooney LLP in Mount Clemens, Michigan, focuses on the defense of health care professionals and facilities. Ms. Andreou is the practice group leader of the firm s medical liability trial team. She has been recognized as a Super Lawyer and was a Woman in the Law honoree. Ms. Andreou has tried more than 60 cases to verdict. Chad P. Brouillard, an attorney at Foster & Eldridge LLP in Cambridge, Massachusetts, represents health care providers and institutions in civil litigation and administrative matters. He speaks and publishes on electronic health records liability, e-discovery, and health care technology liability and has testified before the Office of the National Coordinator for Health Information Technology on these issues. Kevin E. Clark is a partner with Lightfoot Franklin & White LLC in Birmingham, Alabama. His general civil defense litigation practice emphasizes product liability, personal injury, toxic torts, consumer fraud, insurance sales practice litigation, and employment discrimination. Mr. Clark is a past chair of DRI s Toxic Torts and Environmental Law Committee. Ty E. Dedmon is a partner at Bradley Arant Boult Cummings LLP in Birmingham, Alabama. He represents health care clients in both personal injury and commercial disputes. Mr. Dedmon represents physicians, nurses, and hospitals in medically complex professional liability actions. He defends health care industry clients against fraud and abuse claims involving secondary payer reimbursement, pricing fraud, drug utilization, and employment practices. Robin B. Fried is the director of risk management, legal counsel at Rady Children s Hospital San Diego. An attorney, she was a medical malpractice law firm associate and assistant chief counsel at the California Department of Managed Care before entering the risk management field. Before law school, she held various hospital nursing management positions. Ms. Fried is a member of the American Health Lawyers Association and the American Society for Healthcare Risk Management. Robert B. Gibson, a partner at Heidell Pittoni Murphy & Bach LLP, manages its White Plains, New York, office. He represents major teaching hospitals and individual physicians in medical malpractice actions. Mr. Gibson has been selected for inclusion in New York Super Lawyers and has earned Martindale-Hubbell s AV Preeminent rating in the field of medical malpractice. Nancy E. Gregor has focused on health law for more than 30 years, representing state administrative agencies, hospitals, medical staffs, and providers as a Maryland assistant attorney general, in private practice, and as in-house counsel at the Johns Hopkins Health System in Baltimore. Much of her practice has been devoted to matters involving physicians and other providers with privileging, licensing, and civil or criminal issues. Alex J. Hagan, a partner with Ellis & Winters LLP in Raleigh, North Carolina, focuses on medical, hospital, and commercial laboratory defense, as well as business and product liability litigation. He represents software manufacturers, automobile manufacturers, pharmaceutical companies, and medical device manufacturers. Mr. Hagan has been selected by Best Lawyers in America for medical malpractice and personal injury defense. He is the vice chair of DRI s Medical Liability and Health Care Law Committee. Morris L. Jensby is the vice president of risk management at CHG Healthcare Services Inc. in Salt Lake City. CHG is a nationwide health care staffing company, which provides physicians, nurses, and allied health professionals for temporary and permanent positions through the United States and its territories. Previously, Mr. Jensby was the general manager for Hamlin & Burton Liability Management Inc. Patrick J. Kearns is an attorney with Wilson Elser Moskowitz Edelman & Dicker LLP in its San Diego office. His trial practice focuses on defending medical, dental, and legal professionals in malpractice litigation and in state licensing board matters. Mr. Kearns was named Outstanding New Lawyer in 2008 by the San Diego Defense Lawyers. He is the program chair for this seminar. Kimber J. Lantry, J.D., CPCU, ARM, serves as executive vice president, healthcare of Hudson Insurance Group in Napa, California, where he directs the retail medical malpractice insurance operations insuring hospitals, physicians, and other health care providers. He has 37 years of insurance industry experience, all of it concentrated in health care professional liability. Mr. Lantry has worked for Fireman s Fund, the Doctors Company, NORCAL, and Marsh & McLennan. David M. Lechuga, Ph.D., the director of the Neurobehavioral Clinic & Counseling Center in Lake Forest, California, focuses on patients with neurological impairments. He is board certified by the American Board of Professional Psychology in both clinical and rehabilitation psychology, and board cer- 4

7 tified in neuropsychology by the American Board of Professional Neuropsychology. Dr. Lechuga has testified as an expert witness in over 40 trials and 100 depositions. Minnesota and Wisconsin. He has been recognized by his peers as a Top 100 Lawyer and Super Lawyer in Minnesota Law & Politics. Ed Lynch is senior vice president of business development for the MagMutual Insurance Company in Atlanta. Mr. Lynch has more than 25 years experience in professional liability insurance on both the intermediary and company sides of the business, almost exclusively in health care. He has served as director of the national health care practice of a large insurance brokerage and risk management firm. Frank M. McClellan, Professor of Law Emeritus at Temple University Beasley School of Law in Philadelphia, teaches courses on bioethics, medical malpractice, torts, and a law and medicine writing seminar. An expert on health disparities, bioethics, and medical malpractice law, he has published law review articles on health care law, tort law, and civil rights, and an award winning book, Medical Malpractice: Law, Tactics and Ethics. Ted J. McDonald III is a founding partner of Adam & McDonald PA in Overland Park, Kansas. Mr. McDonald specializes in defending long-term care and assisted living facility claims for major providers of health care services throughout the country. He is the immediate past chair of DRI s Medical Liability and Health Care Law Committee, and a former member of DRI s Governance Committee. Cathlin Vinett Mitchell, RN, BSN, CCM, CRRN, Cm, is the owner of Care Management Consultants Inc. in Brentwood, Tennessee, which employs 18 full-time registered nurses who specialize in management of catastrophic injuries. The company has over 20 years experience managing spinal cord injuries, brain injuries, multiple traumas, amputations, and burns. Ms. Vinett Mitchell has testified in over 100 trials. Maithilee K. Pathak, Ph.D., J.D., a trial consultant with R&D Strategic Solutions in Atlanta, has worked on a variety of civil and criminal cases, including malpractice, tort, contracts, product liability, fraud, antitrust, and domestic terrorism. Utilizing her social psychology and legal background, Dr. Pathak has developed trial and voir dire strategy, prepared witnesses, and conducted research in how jurors make sense of complex evidence to solve cases. Stephen O. Plunkett, a shareholder with Bassford Remele PA in Minneapolis, represents nursing home and assisted living facilities in the Midwest. He is a member of DRI s Law Institute and a former chair of DRI s Medical Liability and Health Care Law Committee. Mr. Plunkett is admitted to practice in Constantine S. Raphtis, D.O., is a board certified obstetrician/gynecologist in Saint Clair Shores, Michigan. He is the president and CEO of one of the most active medical practices in Michigan. Dr. Raphtis is a passionate educator on issues important to women s health and is a national speaker on breast and ovarian cancer syndrome. Stephen M. Schexnayder, M.D., is the chief of pediatric critical care and vice chief of staff at Arkansas Children s Hospital in Little Rock, and professor of pediatrics and internal medicine at the University of Arkansas for Medical Sciences. Past national chair of the American Heart Association s Pediatric Resuscitation Subcommittee, Dr. Schexnayder is an editor of the last three editions of the PALS course. Steven R. Schwegman, a shareholder with Quinlivan & Hughes PA in St. Cloud, Minnesota, is admitted to practice in Minnesota and Wisconsin. He represents physicians, nurses, hospitals, and nursing homes, and has tried more than 110 jury trials. He is a former DRI board member and a diplomate in ABOTA. Mr. Schwegman was selected as a Super Lawyer by Minnesota Law & Politics. Ethen R. Shapiro is a shareholder at Hill Ward Henderson in Tampa, Florida, in the firm s litigation group. His focus is on medical malpractice, hospital liability, the defense of nursing home and long-term care facilities, pharmaceutical liability, and professional liability. Mr. Shapiro is the program vice chair for this seminar. Todd W. Smyth, a founding partner of Smyth Whitley LLC in Charleston, South Carolina, focuses on the defense of the health care industry. He represents physicians, drug and medical device manufacturers, pharmacies, nursing homes, and assisted living facilities. Mr. Smyth is the chair of DRI s Medical Liability and Health Care Law Committee. He is listed in Best Lawyers in America for medical malpractice law. Jodi V. Terranova, a partner with Wilson Elser Moskowitz Edelman & Dicker LLP in Washington, D.C., is admitted to practice in Maryland, Virginia, New Jersey, and the District of Columbia. She represents physicians, nurses, hospitals, and nursing homes at trial and before state licensing boards. She was selected by Super Lawyers as a Rising Star in 2013 for medical malpractice. 8 GENERAL INFORMATION GENERAL INFORMATION CLE/CLAIMS ADJUSTERS ACCREDITATION This seminar has been approved for MCLE credit by the State Bar of California in the amount of hours, including 1 hour of ethics credit. Accreditation has been requested from every state with mandatory continuing legal education (CLE) requirements. Certificates of attendance will be provided to each attendee. Attendees are responsible for obtaining CLE credits from their respective states. Application has been made for continuing education for claims adjusters. Credit availability and requirements vary from state to state; please check the DRI website at dri.org for the latest information for your state. REGISTRATION The registration fee is $755 for members and those who join DRI when registering and $985 for nonmembers. The registration fee includes course materials, continental breakfasts, refreshment breaks, networking receptions, and access to the DRI app. If you wish to have your name appear on the registration list distributed at the conference and receive the course materials in advance, DRI must receive your registration by February 28, 2014 (please allow 10 days for processing). Registrations received after February 28, 2014, will be processed on-site. REFUND POLICY The registration fee is fully refundable for cancellations received on or before February 28, Cancellations received after February 28 and on or before March 7, 2014, will receive a refund, less a $100 processing fee. Cancellations made after March 7 will not receive a refund, but the course materials on CD-ROM and a $100 certificate good for any DRI seminar within the next 12 months will be issued.
