4 1. INTRODUCTION. THESE TERMS OF REFERENCE ARE FOR SOLICITATION OF A SUITABLE INVESTING FIRM TO DESIGN, BUILD AND OPERATE PLANTS FOR DESALINATION OF SEAWATER FOR MOMBASA COUNTY. THE TOR SETS OUT THE BACKGROUND, THE OBJECTIVES OF THE PROJECT, SCOPE OF WORKS AND OUTPUTS EXPECTED FROM THE PROJECT THE TORS ALSO PROVIDES FOR THE REQUIREMENT IN RESPECT TO TECHNICAL CAPACITY AND MANDATORY REQUIREMENTS. 2. BACKGROUND: The Water Supply in Mombasa County is 48,000M 3 per day against a demand of 180,000M 3 per day, experiencing a Water Supply deficit of almost 73% and competition for water supply from stressed water sources; Baricho Water fields, Marere Springs, Mzima Spring and Tiwi Boreholes which are located far way and outside the County. Rationing is the order of the day. This scenario made the County to come up with a proposal for a Desalination project to address water supply related challenges at both the urban and rural areas of the County. The County is rich of sea water which if exploited could supplement the deficit or improve accessibility by far. Desalination project target installation of desalination plants at various sites within the County before the end of 2017 and this would need an input of an experienced investing firm to design, develop and operate the desalination plant. The daily amount of desalinated water is estimated at 270,000m 3 ; (70,000m3/day for Likoni, 100,000m3 /day for West Mainland and 100,000m 3 /day for the North Mainland) depending on the consumption and hydraulic capability of the distribution network. 4
5 2.1 MAP OF MOMBASA COUNTY: The map is showing 65km 2 of sea water within the County with the capacity of supplying thrice of the present and future water demand PROJECT OBJECTIVES To fill the gap of the water demand in the County which is currently at 70%. To fulfill the water demand for the residents of the County currently at 180,000m 3 per day. 2,3 OBJECTIVES OF THE ASSIGNMENT To ensure the proposed project is professionally Sited, Planned, Designed, Implemented and Operated according to the approved procedures, quality and standards. 5
6 To ensure all required documents, agreements and approvals from relevant authorities are acquired for execution of the task. To ensure a workable Agreement for a Water Purchase Contract is made between the developer and the service provider taking into consideration the tariff guidelines and regulations in the country. To ensure proper documentation before and during implementation of the project PROJECT DESCRIPTION: The project targets various sites spread within the County with specific focus to West Mainland, North Mainland and South Mainland. Each project site will consist of an intake from the Sea Water/Beach Well, intake pipeline, a desalination plant, pumping units, a rising main to elevated storage tank and a distribution pipeline to a connection point with the existing county network. The project will be implemented under a DBOT arrangement where the developer will fund, implement and operate the whole system. The developer shall prepare the site, build desalination plants, install the pipelines up to the connection point with the existing County network, intakes, pumping units. The developer will also connect the electricity system of the plants to the National Grid. Elevated storage tanks are used to feed the desalinated water into the existing network. The firm shall sign a Water Purchase Agreement with the County Government of Mombasa/Mombasa Water & Sewerage Corporation and takes care of full operation as stated in the agreement to supply quality water for the term of contract. The firm shall be responsible of the following: Chemicals treating water for domestic use. Enhancement of Raw and drinking water quality. Legal/Regulator obligations and acquiring of all the permits/approvals. 6
7 Training and Bench marking for County/MOWASCO staff. O&M of the system up to the connection point. The recruitment of the firm will be done according to principles of PPP. 4.0 STAKEHOLDERS OF THE PROJECT: The following institutions will play a key role in the project: S/NO STAKEHOLDER ROLE 1 Department of Planning, Planning and Land/site issues Land & Housing 2 Department of Transport Civil works standards and approvals and Infrastructure 3 County Inspectorate Security 4 Sub-County Admin. Planning, Co-ordination and site identification 6 MOWASCO Data Information and Site identification 7 WRMA Permits, Data and any other related Authorities. 8 NEMA Environmental and Social issues. 9 VEI Consultant Sharing Information. 10 MW&I Sharing of information and resource mobilization. 11 WASREB Tariff Regulation/Approvals and setting water and sanitation standards ROLES: 5.1. CLIENT: Shall identify the sites, manage and coordinate the whole task FIRM: Shall provide all Resources including Funds, Equipment and Transport required to undertake all the tasks stated herein. The firm shall work closely with the Technical unit of the County Department of Water, MOWASCO and VEI and report to the Chief Officer on all contractual issues. 7
8 Shall deliver the reports as required. Shall Plan, organize, fund, implement and operate the project, as assigned. Shall organize and conduct monthly meetings with County Department & MOWASCO on the progress REQUIREMENTS FOR THE ASSIGNMENT: 6.1. FIRM: To have necessary Capacities and reliable knowledge in Planning, Design, Implementation and Operation of Desalination projects. Similar experience of at least 5 years in Planning, Design, Implementation and Operation of a Desalination projects KEY STAFF: Team Leader Must be a Registered Water/Civil Engineer (or master level in water and desalination plants),with at least 5 years experience in management and similar works, with specific reference to: seawater desalination plants; Preparation of PPP contract. Environmentalist Registered and with at least 5 years experience. GPS Specialist with at least 5 years experience. Civil /Water Engineer Registered with at least 5 years experience. Electro-Mechanical Engineer with at least 5 years of experience. Socio-Economist and financial specialist with at least 5 years experience with the PPP projects, with specific reference to assessing financing conditions of PPP contracts. 7.0 CONTRACT PERIOD: The task will commence on signing the contract and is estimated to take a period of maximum of 18 months to accomplish the task. 8
9 8.0 SCOPE OF THE SERVICES: a. Carry out a feasibility study for a desalination project that will have four plants spread in the four regions/ zones of the County and prepare a comprehensive report that will adequately guide the realization of the project. The study shall include specific tasks defined here in as part of the ToR. b. Identify, locate the proposed four seawater /beach wells intakes which are well protected against the tides and pollution, Desalination Plants sites and take GPS co-ordinates of each site and indicate all the sites on the map of the County. One site for each region of the Mombasa County.ie NMLD, WMLD, ISLAND and SMLD. c. Prepare Detailed Design, Technical Drawings, Bill of Quantities, Layout & work plans for each site recommended. The plant capacity for each of the four sites should be equal to its Demand Supply gap. d. Undertake a desk study and data collection of the available relevant information on the proposed desalination project. e. Obtain relevant permits and approvals from the Authorities as required for the project. f. Undertake an ESIA and ensure compliance with NEMA regulations/guidelines. g. Carry out a sea water analysis of the valid parameters for each site, risk analysis of future polluters and make necessary recommendations out of the analysis in line with the proposed project. h. Prepare a workable, legally acceptable Water Purchase Agreement (WPA) between the firm and the service provider subject to renewal. i. Determine the, effective bulk water supply tariff at the production and retail sites. j. Prepare a business and Cash flow plans for the best economical operating period. Bench marking values of SWRO cases should be included. k. Prepare a financial model and effective period on which the proposed project shall be both economically viable and of beneficial interest between the client and the firm. 9
10 l. Organize for public participation and stakeholder s dissemination workshops at a convenient venue and to be funded by developer. m. Construct 3 No. Desalination Plant Systems as per the design. 9.0 GENERAL REQUIREMENTS FOR REPORTS All reports must be submitted in English Review and giving of comments for the draft reports shall be within 1 (One) Week. Final reports shall be submitted within 1 (One) week after drafts reports are reviewed.
