1 Environmental Public Health ORDER OF AN EXECUTIVE OFFICER UNFIT FOR HUMAN HABITATION ORDER TO VACATE To: Hunter Estates Housing Co-Operative Ltd. the owner And To: RE: All Occupant(s) of the following Housing premises: 315 Hunterhorn Lane NE Those housing premises located in Calgary, Alberta and municipally described as: 315 Hunterhorn Lane NE. WHEREAS I, an Executive Officer of Alberta Health Services, have inspected the above noted premises pursuant to the provisions of the Public Health Act, RSA 2000, c. P-37, as amended; AND WHEREAS such inspection disclosed that the following conditions exist in and about the above noted premises which are or may become injurious or dangerous to the public health or which might hinder the prevention or suppression of disease, namely: a. The house was cluttered with substantial amounts of garbage and miscellaneous objects. b. There are dried up cat feces and cat litter stored on the staircase leading towards the basement and on the basement floor under the staircase. c. The upstairs bedroom floor near the stairs was covered in soiled newspaper and dog feces. There were bags full of soiled newspaper and feces stored in the bedroom. d. The main floor bathroom toilet was leaking at the time of inspection. e. The main floor smoke detector did not have a battery installed. f. The top floor smoke detector was not working at the time of inspection. g. The floor behind and around the toilet was water damaged in the main floor bathroom. h. The baseboard behind the toilet was water damaged in the main floor bathroom. i. There were hasp locks installed outside of all the bedroom doors. j. The carpet throughout the house was heavily soiled. k. The stove had grease and debris built up and did not seem to be in a safe working condition. l. Caulking along the upstairs bathtub was water damaged. m. The enamel on the left corner of the bathtub was worn off and badly stained. n. The bottom panel under the kitchen sink was water damaged. AND WHEREAS such inspection disclosed that the following breaches of the Public Health Act and the Housing Regulation, Alberta Regulation 173/99, and the Minimum Housing and Health Standards exist in and about the above noted premises, namely: a. The house was cluttered with substantial amounts of garbage and miscellaneous objects. This is in contravention of section 5(2) of the Housing Regulation which states that: No person shall cause or permit any condition in housing premises that is or may become injurious or dangerous to the public health, including any condition that may hinder in any way the prevention or suppression of disease.

This is in contravention of section 5(2) of the Housing Regulation which states that: No person shall cause or permit any condition in housing premises that is or may become injurious or dangerous to the public health, including any condition that may hinder in any way the prevention or suppression of disease. c. This is in contravention of section IV(6)(c) of the Minimum Housing and Health Standards which states that: All plumbing fixtures shall be serviceable, free from leaks, trapped and vented to the outside. e. The main floor smoke detector did not have a battery. This is in contravention of section IV(12)(a) of the Minimum Housing and Health Standards which states that: Smoke alarms shall be operational and in good repair at all times. f. The top floor smoke detector was not working at the time of inspection. This is in contravention of section IV(12)(a) of the Minimum Housing and Health Standards which states that: Smoke alarms shall be operational and in good repair at all times. g. The floor behind and around the toilet bowl was water damaged in the main floor bathroom. This is in contravention of section III(1)(c) of the Minimum Housing and Health Standards which states that: Building materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced. h. The baseboard behind the toilet bowl was water damaged in the main floor bathroom. section III(1)(c) of the Minimum Housing and Health Standards which states that: Building materials that have been damaged or show evidence of rot or other deterioration shall be repaired or replaced. i. There were locks installed outside of all the bedroom doors. This is in contravention of section 5(2) of the Housing Regulation which states that: No person shall cause or permit any condition in housing premises that is or may become injurious or dangerous to the public health, including any condition that may hinder in any way the prevention or suppression of disease. j. The carpet throughout the house was heavily soiled. This is in contravention of section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. k. The stove had grease and debris built up and did not seem to be in a safe working condition. This is in contravention of section IV(14)(a)(i) of the Minimum Housing and Health Standards which states that: Every housing premises shall be provided with a food preparation area, which includes: a stove and a refrigerator that are maintained in a safe and proper operating condition. The refrigerator shall be capable of maintaining a temperature of 4 degrees C. l. Caulking along the upstairs bathtub was water damaged. This is in contravention of section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. m. The enamel on the left corner of the bathtub was worn off and badly stained. This is in contravention of section 5(2) of the Housing Regulation which states that: No person shall

This is in contravention of section III(5) of the Minimum Housing and Health Standards which states that: All walls, windows, ceilings, floors, and floor coverings shall be maintained in good repair, free of cracks, holes, loose or lifting coverings and in a condition that renders it easy to clean. AND WHEREAS, by virtue of the foregoing, the above noted premises are hereby declared to be Unfit for Human Habitation. NOW THEREFORE, I hereby ORDER and DIRECT: 1. That the occupants vacate the above noted premises on or before April 28, That the owner immediately undertake and diligently pursue the completion of the following work in and about the above noted premises, namely: a. Remove and dispose of all garbage and unnecessary miscellaneous objects from the house. b. Remove and dispose the cat feces and cat litter. Take precautions and wear proper personal protective equipment. Do not sweep or vacuum the feces and litter. Clean and sanitize the stairs and basement floor with 1 part bleach and 9 parts water. c. Remove and dispose of the bags, soiled newspaper, and dog feces in the bedroom. d. Remove and dispose of all carpeting and underlay throughout the house. Assess the subfloor for further damage. Replace with new materials. e. Remove and dispose all water damaged building materials in the main floor bathroom including flooring, baseboards, and subfloor. Replace with new materials. f. Clean and sanitize all remaining objects and surfaces with 1 part bleach and 9 parts water. g. Repair the toilet so that it is free from leaks. h. Install new batteries to all smoke detectors. Ensure that all smoke detectors are operating at all times. i. Remove all the locks from the outside of all the bedroom doors. j. Clean the stove and ensure it is in good working condition. Replace if necessary. k. Replace the caulking along the bathtub. l. Clean/scrub and disinfect the left corner of the bathtub and re-glaze the left corner. m. Replace the bottom panel under the kitchen sink. 3. That until such time as the work referred to above is completed to the satisfaction of an Executive Officer of Alberta Health Services; the above noted premises shall remain vacant and secure from unauthorized entry. 4. All work listed in paragraph 2 above must be completed to the satisfaction of an Executive Officer of Alberta Health Services by July 7, The above conditions were noted at the time of inspection and may not necessarily reflect all deficiencies. You are advised that further work may be required to ensure full compliance with the Public Health Act and regulations, or to prevent a public health nuisance.
