1 ISTITUTO NAZIONALE DI FISICA NUCLEARE CONSIGLIO DIRETTIVO DELIBERAZIONE N Il Consiglio Direttivo dell Istituto Nazionale di Fisica Nucleare, riunito a Roma in data 29 novembre 2013 alla presenza di n. 32 dei suoi componenti su un totale di n. 34; - premesso che con deliberazione n del 27 marzo u.s. il Consiglio Direttivo di questo Istituto ha approvato lo schema di Contract Agreement for the Design and Development Services between the European Spallation Source AB and INFN for the Accelerator Design, relativo alla partecipazione dell Istituto nelle fasi di progettazione e costruzione dell acceleratore e allo sviluppo di servizi presso l infrastruttura denominata European Spallation Source, per gli anni 2011 e 2012, per ricerche nel campo della scienza dei materiali con sorgenti di neutroni; - tenuto conto che la sottoscrizione del predetto Accordo si è resa necessaria al fine del riconoscimento dell attività sinora svolta dall INFN come contributo in-kind al Progetto; - considerato che su richiesta di ESS si rende ora necessario sottoscrivere un Addendum I atto a coprire la fase di pre-construction di ESS per il periodo con l aggiunta di ulteriori Work Schedules al predetto Contract Agreement; - visto lo schema di Addendum I to In-Kind Contribution Agreement for the pre-construction phase between INFN and ESS AB, allegato alla presente deliberazione e di essa parte integrante; - preso atto che l approvazione di tale documento non comporta per l Istituto oneri finanziari aggiuntivi oltre quelli già sostenuti nell ambito delle assegnazioni per il progetto ESS per gli anni 2013 e 2014; - vista la lettera del Group Leader dell In-Kind Management Group di ESS, Gàbor Németh, del 30 ottobre u.s.; - su proposta della Giunta Esecutiva; - con n. 32 voti favorevoli; DELIBERA E approvato lo schema di Addendum I to In-Kind Contribution Agreement for the preconstruction phase between INFN and ESS AB, allegato alla presente deliberazione e di esso parte integrante. 2 Addendum 1 to In-kind Contribution Agreement (for the pre-construction phase ) between European Spallation Source ESS AB and Istituto Nazionale di Fisica Nucleare

3 1(6) Addendum 1 to Contract Agreement for Design and Development Services, Accelerator Design, (the Agreement ) signed on 18 May 2013 between: (1) European Spallation Source ESS AB, Reg. No , a limited liability company incorporated under the law of Sweden, having its registered office in Lund, Sweden ( ESS AB ); and (2) Istituto Nazionale di Fisica Nucleare, a governmental organization organised under the law of Italy, having its registered office at 40, Via E. Fermi, Frascati, Italy (the Contractor ). The Parties have agreed the following: This Addendum 1 forms an integral part of the Agreement and it should be regarded as an addition to Schedule 1 within the meaning of Clause 3.1 of the Agreement. This Addendum does not replace or cancel previous Scope of Works, but it merely supplements them. All terms and conditions in the Agreement and General Conditions of Contract (Schedule 3 of the Agreement) remain unchanged and in full force and effect, unless specifically revised below. Schedule 2 (Financial Matters) of the agreement shall not apply to this Addendum. In the event of any discrepancy or inconsistency between provisions of any of the Contract Documents, they shall be given priority in the following order: (1) This Addendum, (2) The Contract agreement, (3) Schedule 3 (General Conditions of Contract). 1. DELIVERABLES AND TIME SCHEDULE The Contractor shall provide the following additional contributions under Schedule 1: a. Deliverables Delivery Deadline Site preparation for the installation of the PS-ESS at INFN-LNS, Catania, with all conventional facilities needed, according to the ESS requirements. Purchase and test of insulating transformer, demineralizer, high voltage insulators and platform. Purchase and test of microwave components, according to the Technical Design Report and following updates. Purchase and test of the EMI-protected racks for the power supplies and ancillary instrumentation, cabling and operational tests of supplies and instrumentation. Purchase and test of equipment able to ensure HV safety and EMI protection. Purchase and test of the magnetic system, according to the Technical Design Report and following updates. Purchase and test of the power supplies for the magnetic system, of the high voltage power supplies Purchase and test of the gas input system. Purchase and test of the mechanical components needed to connect the vacuum pumping units and the vacuum gauges (provided by ESS AB) to the Proton Source. Purchase and test of the extraction system. Purchase and test of the PS-ESS support at the same axis height as in the ESS Accelerator Tunnel. Fabrication of the Proton Source body and of any mechanical component needed to operate the source. Assembly of the components yet available, described in 1) to 4) in the testbench site at INFN-LNS. Plasma production tests including the preparation of the plasma diagnostics necessary for the beam characterization. Deliverables Delivery Deadline 8 9 Site preparation for the installation of the LEBT of the PS-ESS prototype at INFN-LNS, Catania, with all conventional facilities needed, according to the ESS requirements. Purchase and test of the mechanical components needed to connect the vacuum pumping units and the vacuum gauges (provided by ESS AB) to the LEBT. Purchase of two solenoids and of the steerers, according to the Technical Design Report and following updates. Purchase of the power supplies for the solenoids and steerers and of the electronics components needed to interface them to the Control System provided by ESS AB. Purchase and assembly of the LEBT support at the same axis height as in the ESS Accelerator Tunnel. 10 Installation of the diagnostics provided by the Beam Instrumentation team of ESS AB. 11 Purchase and test of the LEBT chopper, including the electronics to drive it. Preparation of the documents related to the assembly of the components above cited in the testbench site at INFN-LNS. 30/11/ /11/ /8/ /12/ Definition of the final interfaces and related documents. 31/12/2014 b. Design, purchasing and installation of magnetic measurement system at INFN-LNL for complete PMQ characterization. Construction and assembly of three complete DT prototypes with PMQ, with BPM and with steerer. Installation of DT prototypes in Linac4 DTL prototype. 31/10/ /10/ Design and construction of a movable tuner. 31/10/ Modification of the test stand used for IFMIF in order to test ESS components. Tests of DT and tuner at nominal power and duty cycle (the DTL prototype developed by CERN and INFN- LNL will be used). c. FINANCIAL MATTERS The provision by the Contractor of the work and services under this Addendum, and the assumption and performance of all other obligations by the Contractor under this Addendum, is an in-kind contribution by the Government of Italy under the Government Agreement. Consequently, ESS AB shall not pay any direct consideration to the Contractor under this Addendum. Any amounts specified in this Addendum are the amounts attributed by ESS AB and the Contractor to the Contractor s work and services under this Addendum and the amounts for which the Contractor requires funding. The in-kind contribution value to be credited to the Government of Italy as a result of this Addendum shall be determined in accordance with the in-kind valuation framework agreed between the Government of Italy and the other ESS partner states. Only the activities that are specified above qualify as in-kind contribution. For the avoidance of doubt, other activities such as travel and lodging costs, travel time, waiting time and other non-working time shall not qualify as in-kind contribution and will not be compensated by ESS. In order to certify the value of the in-kind contribution, the Contractor shall, as part of the performance of the deliverables, document all the items which are necessary to certify the value. All relevant supporting documents which certify the value of the in-kind contribution shall be presented to ESS AB with the project reports to be submitted by the Contractor. 3. REPORTING The Contractor is responsible for carrying out the Project Results in a timely manner, fully in accordance with the time schedule referred to above. During the performance of the Project Results, the Contractor shall submit to the ESS AB monthly progress reports containing: I. the status of the Project Results since the preceding report; II. the progress expected to be made in the next following period and any other pertinent issues related to the Project Results; III. performance measured against the timetable and budget as set out in the Time Schedule and Project Results including the value consumed in the last period and those for the coming period in accordance with the Monthly Status Report. The Contractor shall issue a final written report to the ESS AB within four (4) weeks of the earliest occurrence of the following: (a) completion of the Project Results, or (b) the expiration of this Addendum, or (c) prior termination of this Addendum. Such report shall include a comprehensive summary of the contributions made, works and services undertaken and Project Results achieved.
