5 Inwerkingtreding laatste nieuws DAILY COLLECTION OF MARITIME PRESS The Finnish Government proposed on 16 June 2016 that the President of the Republic adopt the international convention for the management of ships' ballast water, Finland s Ministry of Transport and Communications says in a press release. It was also proposed that the President would ratify acts that lay down the provisions on the entry into force of the convention. Ratificatie Finland is onderweg. 6 Ballast water exchange or performance Two standards for the purity of managed ballast water D-1 Exchange Standard efficiency of at least 95 % volumetric exchange (sequential method) pumping-through three times the volume of a tank (flow-through method, D-2 Performance Standard less than 10 viable organisms per cubic meter greater than 50μm less than 10 viable organisms per millilitre smaller than 50μm and greater than 10μm limited number of indicator microbes such as cholerae

7 Exceptions Ballast water management exceptions 1. the uptake or discharge of Ballast Water in emergency situations; 2. the accidental discharge resulting from damage to a ship provided that all reasonable precautions have been taken unless the owner, company or officer in charge wilfully or recklessly caused damage; 3. the uptake and discharge of Ballast Water avoiding pollution incidents from the ship; 4. the uptake and subsequent discharge on the high seas of the same Ballast Water 5. the discharge of Ballast Water and Sediments from a ship at the same location where the whole of that Ballast Water and those Sediments originated and provided that no mixing with unmanaged Ballast Water and Sediments from other areas has occurred. 7 Ministry of Infrastructure and the Environment 8 September 2016

8 Ballast Water Management Plan Each ship shall have on board and implement a Ballast Water Management plan. plan shall be approved by the Administration taking into account Guidelines developed by the IMO The Ballast Water Management plan shall be specific to each ship and shall at least: 1. detail safety procedures for the ship and the crew 2. provide a detailed description of the actions to be taken to implement the Ballast Water Management requirements 3. detail the procedures for the disposal of Sediments at sea and to shore; 4. include the procedures for coordinating shipboard Ballast Water Management that discharge to the sea with the authorities of the State into whose waters such discharge will take place; 5. designate the officer on board in charge of ensuring that the plan is properly implemented; 6. contain the reporting requirements for ships provided for under this Convention; 7. be written in the working language of the ship. If the language used is not English, French or Spanish, a translation into one of these languages shall be included. 8 Ministry of Infrastructure and the Environment 8 September 2016

9 Ballast water record book Each ship shall have on board a Ballast Water record book that may be an electronic record system, Ballast Water record book entries shall be maintained on board the ship for a minimum period of two years in the event of other accidental or exceptional discharge of Ballast Water not otherwise exempted by this Convention, an entry shall be made in the Ballast Water record book describing the circumstances of, and the reason for, the discharge. Each operation concerning Ballast Water shall be fully recorded without delay in the Ballast Water record book. 10 IMO herstel van vertrouwen in Ballaster verdrag Er zijn de laatste jaren een aantal stappen genomen die het vertrouwen in het verdrag hebben hersteld. Deze afspraken overlappen deels met jouw voorstellen! De afspraken zijn onder andere: Er is een soepeler inwerkingtredingschema afgesproken voor bestaande schepen. Er is een proefperiode van twee jaar afgesproken, waarin overtredingen door kinderziektes niet worden bestraft. 11 Wanneer ballastwater behandelingsinstallatie? Als verdrag na 31 december 2016 in werking treedt: Ballastwater behandelingssysteem op alle nieuwe schepen Ballastwater behandelingssysteem bij first renewal survey op bestaande schepen. 13 Test period sampling Once the International Convention for the Control and Management of Ships' Ballast Water and Sediments, 2004 enters into force, a trial period will be initiated where port State control can further trial the approaches in the circular to ensure they are practical and fit for purpose. The trial period would be for 2 to 3 years following entry into force of the Convention. Prior to completion of the trial period, port States would refrain from applying criminal sanctions or detaining the ship, based on sampling. The results of the trial will be reviewed by the Committee and when appropriate the trial should be halted or extended. The system should incorporate a self-monitoring system in accordance with the Guidelines 13 Ministerie van Infrastructuur en Milieu 8 september 2016

Hiervoor is een correspondentiegroep ingesteld. 16 Ballast Water exchange Ballast Water exchange D-1: at least 200 nautical miles from the nearest land and in water at least 200 metres in depth, If that is not possible on a voyage: as far from the nearest land as possible, and in all cases at least 50 nautical miles from the nearest land and in water at least 200 metres in depth. 17 Ballastwater wisselgebieden Subject: Designation of Areas for Ballast Water Exchange in the North Sea To the IMO secretariat I want to inform you that North Sea countries, Belgium, Denmark, France, the Netherlands, Sweden and the United Kingdom have designated Areas for Ballast Water Exchange in the North Sea. These exchange areas have been subsequently endorsed by the OSPAR Commission in June Norway has implemented parts of the Ballast Water Management Convention (Regulation D-1; the exchange standard) in its national regulations which entered into force on 1 July Three exchange areas have been designated within Norway s exclusive economic zone (EEZ). The Ballast Water Management Convention, G14 Guidelines on Designation of Area s for Ballast Water Exchange, recommends that parties intending to designate areas for ballast water exchange under Regulation B-4.2 should communicate this intention to the organization prior to the implementation of the designated ballast water exchange areas. The identification, assessment and designation of the proposed ballast water exchange areas were done taking into account the relevant guideline of the Convention: Guidelines on Designation of Areas for Ballast Water Exchange (G14). Annex 1 and 3 include information on the designation of areas for ballast water exchange, including the precise geographical coordinates of the areas. 18 Vrijstellingen 1 A Party or Parties, in waters under their jurisdiction, may grant exemptions to any requirements to apply regulations B-3 or C-1, in addition to those exemptions contained elsewhere in this Convention, but only when they are:.1 granted to a ship or ships on a voyage or voyages between specified ports or locations; or to a ship which operates exclusively between specified ports or locations;.2 effective for a period of no more than five years subject to intermediate review;.3 granted to ships that do not mix Ballast Water or Sediments other than between the ports or locations specified in paragraph 1.1; and.4 granted based on the Guidelines on risk assessment developed by the Organization. 18 Ministerie van Infrastructuur en Milieu 8 september 2016
