2 2 Minutes of the Open Sessions of the North Carolina Medical Board Meeting October 17-18, The, meeting of the North Carolina Medical Board was held at the Board's Office, 1203 Front Street, Raleigh, NC The meeting was called to order at 9:03 a.m., Wednesday, October 17, 2007, by H. Arthur McCulloch, MD President. Board members in attendance were: Janelle A. Rhyne, MD, President Elect; George L. Saunders, III, MD, Secretary; Ralph C. Loomis, MD, Treasurer; Donald E. MISCELLANEOUS Presidential Remarks Dr. McCulloch commenced the meeting by reading from Governor Easley s Executive Order No. 1, the ethics awareness and conflict of interest reminder. No conflicts were reported. Fiscal Year 2008 Budget The Executive Committee approved the Fiscal Year 2008 budget at the September 2007 meeting at which time a copy of the budget was provided to Board Members for review and/or discussion. Motion: A motion passed that the Fiscal Year 2008 budget be approved as presented. Dr. Jablonski s Visit to Ireland Dr. Jablonski reported on his recent vacation to Ireland where he met with Dr. John Hiller, President of the Medical Council of Ireland. He also distributed copies of a report by the royal College of Surgeons in Ireland titled Managing Complaints about Doctors: Stakeholder Perspectives of the Role of the Medical Council in Ireland. Posting Malpractice Payment Reports Online
3 3 The new law requires the Board to post malpractice payment information online pursuant to rules approved by the Board. The Committee discussed several different options. It was agreed that members of the Executive Committee would meet with representatives of interested organizations during the next two months and report back to the full Board in November. (September 2007) The Board continues to meet with representatives of interested organizations. Ms. Robinson will meet with the North Carolina Academy of Physician Assistants; Dr. Saunders will meet with the Old North State Medical Society and Dr. Jablonski will meet with the North Carolina Osteopathic Medical Association. After these meetings rules will be drawn up at the November Board Meeting for a vote during the December Board Meeting. MINUTE APPROVAL Motion: A motion passed that the September 19-21, 2007, Board Minutes are approved as presented. ATTORNEY S REPORT HEARINGS Alford, Glen, MD Wilkesboro, NC Dr. Alford was charged with 6 counts of prescribing to close family members, requesting samples from a pharmaceutical company for personal use and self-prescribing Lisinopril. October 17, 2007 hearing was continued Dr. Alford was not represented by counsel. The Board was represented by Brian Blankenship Augustus, Carl Trent MD Dr. Augustus was charged with failure to comply with his Consent Order and with conversion of an insurance check from BCBS. October 17, 2007 hearing was continued to present a proposed Consent Order. Dr. Augustus is represented by Cressie Thigpen. 4 4 Dr. Bahadori applied for reinstatement of his license after it was made inactive by the Board in April 2006 as a result of a Consent Order executed in January The Board denied Dr. Bahadori s application in November October 17, 2007 hearing continued to February Dr. Bahadori was represented by Mike Weddington. The Board was represented by Marcus Jimison. Balentine, Kerry, MD Shelby, NC Dr. Balentine was charged with unprofessional conduct for continuing to prescribe to a patient after the physician-patient relationship was terminated and improper billing. October 17, 2007 hearing continued. Dr. Balentine was represented by Jim Wilson The Board was represented by Marcus Jimison. Bowman, James Thomas MD Denial Dr. Bowman's application for reinstatement of his medical license was denied. The denial was based on his past history with the Board, the requirement of an intensive reentry period and possibly further training since he has not practiced medicine since 2002, his criminal history, and his probation violation in October 17, 2007 hearing was continued to February 20, 2008 Dr. Bowman was represented by Alan Schneider. The Board was represented by Katherine Carpenter. Bray, Anthony, MD Burlington, NC Dr. Bray was charged with failing to comply with his April 2006 Consent Order with the NC Board, specifically that he did not comply with the terms of the January 2006 DEA Memorandum of Agreement. October 17, 2007 hearing was continued. Dr. Bray was not represented by counsel. The Board was represented by Brian Blankenship. Clark, Richard, MD West Memphis, AR Out of State Dr. Clark was charged based on a Consent Order signed with the Arkansas Board restricting his practice to the prison system.

Collins, Paul, MD Pembroke, NC Dr. Collins was charged with violating his May 2007 Consent Order with the Board based on allegations of continued substance abuse. Dr. Collins has surrendered his medical license October 17, 2007 hearing was continued for the board to consider a proposed Consent Order Dr. Collins was represented by Mary Wells. The Board is represented by Marcus Jimison. 10/2007 BOARD ACTION: Reject proposed Consent Order Corley, Charles, MD Kennesaw, GA Out of State Dr. Corley was charged based on action taken by the Georgia Medical Board where Dr. Corley agreed not to practice medicine in Georgia without written approval based on charges issued against him for child molestation, enticing a child and sexual battery of a minor. October 17, 2007 hearing was continued for the Board to consider a proposed Consent Order Dr. Corley was represented by Page Pate. The Board was represented by Todd Brosius. 10/2007 BOARD ACTION: Accept proposed Consent Order Crummie, Robert Gwinn MD Rutherfordton, NC Dr. Crummie was charged with unprofessional conduct for a history of alcohol abuse. HEARING: October 18, Dr. Crummie was represented by Jim Wilson. The Board was represented by Marcus Jimison. 10/2007 BOARD ACTION: Phase I: 1. Did Dr. Crummie commit unprofessional conduct? Yes. 2. Was Dr. Crummie unable to practice medicine with reasonable skill and safety within the meaning of G.S (a)(5)? No.
6 6 Phase II: 6 month suspension; 5 months stayed; maintain a 5 years PHP contract to be in force within 30 days; abide by PHP recommendations in a timely manner; and informal interview in 4 months. (Timing to be negotiated by counsels and approved by the President) Dickson, Robert Trulock MD Kinston, NC Dr. Dickson was charged with unprofessional conduct for departure from or failure to conform to the standards of acceptable and prevailing medical practice with regard to 5 patients. October 17, 2007 hearing continued to February 20, 2008 Dr. Dickson is represented by Mike Weddington. The Board is represented by Marcus Jimison. Dubey, Subu, MD River Forest, IL Denial Dr. Dubey s application was denied based on his 2002 felony conviction. The Board revoked his medical license in March 2005, based on the felony conviction. Hearing held October 17, Dr. Dubey is not represented by counsel. The Board is represented by Katherine Carpenter. 10/2007 BOARD ACTION: Deny Motion for Continuance. Uphold Board s denial. Fields, Jason, MD Wilmington, NC Dr. Fields was charged with being unable to practice with reasonable skill and safety based on his continued substance abuse. Dr. Fields has surrendered his medical license. Case resolved with execution of a pre-authorized Consent Order Dr. Fields was represented by Jim Wilson. The Board was represented by Marcus Jimison. Flechas, Jorge, MD Hendersonville, NC Dr. Flechas was charged with practicing below the standard of care in North Carolina. October 17, 2007 hearing was continued to December 14, Dr. Flechas was represented by Jim Wilson. The Board was represented by Katherine Carpenter.
7 7 Gernert, John, MD Orlando, FL Out of State Dr. Gernert was charged based on action taken by the Florida Medical Board, issuing MD a public letter of concern and a fine for performing wrong-side surgery. HEARING: October 17, Dr. Gernert was not represented by counsel. The Board was represented by Todd Brosius. 10/2007 BOARD ACTION: Issue a Public Letter of Concern mirroring Florida s action Harron, Ray, MD Bridgeport, WV Out of State Dr. Harron was charged based on action taken by the Texas Board, which ordered Dr. Harron to not practice in Texas, not renew his license and not reapply for a Texas license based on allegations related to Silica/Silicosis litigation. October 17, 2007 hearing was continued Dr. Harron was not represented by counsel. The Board was represented by Todd Brosius. Hooker, Timothy, MD Danville, VA Out of State Dr. Hooker was charged based on action taken by the Virginia Board which suspended his medical license for a period of not less than eighteen months. HEARING: October 17, Dr. Hooker was not represented by counsel. The Board was represented by Brian Blankenship. 10/2007 BOARD ACTION: Indefinite Suspension Howard, Charles, MD Springfield, KY Out of State Dr. Howard was charged based on action taken by the Kentucky Board. The Kentucky Board entered an Emergency Order of Suspension as the result of Dr. Howard being indicted by the Washington Circuit Grand Jury for first degree rape, being indicted by the Washington Circuit Grand Jury for first degree sexual assault and two separate complaints. October 17, 2007, hearing was continued Dr. Howard was not represented by counsel. The Board was represented by Brian Blankenship.
8 8 Jellinek, Lawrence, MD Santa Barbara, CA Out of State Dr. Jellinek was charged based on action taken by the California Board based on evidence that he had two convictions for driving under the influence and his admission that he had used cocaine. HEARING: October 17, Dr. Jellinek was not represented by counsel. The Board was represented by Todd Brosius. 10/2007 BOARD ACTION: Indefinite Suspension Lowe, James Edward MD Dr. Lowe was charged with practicing below the standard of care and improper billing with regard to his treatment of six patients. A proposed Consent Order was presented to resolve this case. Dr. Lowe was represented by Jonathan Charleston. The Board was represented by Todd Brosius. 10/2007 BOARD ACTION: Accept proposed Consent Order MacDonald, Carolyn, MD Fayetteville, NC Dr. MacDonald was charged with unprofessional conduct for allowing untrained personnel to perform medical tasks, pre-signing prescription pads, prescribing medications without examining patients, and abruptly closing her practice. October 17, 2007 hearing was continued for the Board to consider a proposed Consent Order Dr. MacDonald was represented by Jim Wilson. The Board was represented by Todd Brosius. 10/2007 BOARD ACTION: Accept proposed Consent Order MacKoul, Paul, MD McLean, VA Out of State-District of Columbia Dr. MacKoul was charged based on action taken of the District of Columbia Medical Board reprimanding Dr. MacKoul on allegations that he failed to disclose adverse actions to the DC Board. HEARING: October 17, 2007
9 9 Dr. MacKoul was not represented by counsel. The Board was represented by Katherine Carpenter. 10/2007 BOARD ACTION: Reprimand STAFF INSTRUCTION: Flag file for review if MD reapplies. Manusov, Eron, MD West End, NC Dr. Manusov was charged with engaging in inappropriate prescribing and unprofessional conduct by having an affair with a patient s wife. October 17, 2007 hearing was continued for the Board to consider a proposed Consent Order Dr. Manusov was represented by Seth Cohen. The Board was represented by Marcus Jimison. 10/2007 BOARD ACTION: Reject proposed Consent Order. Accept Consent Order with 30 day active suspension Mbadiwe, Chukwuemeka, MD Monroe, NC On September 29, 2006, the Board charged Dr. Mbadiwe based on action taken by Union Regional Medical Center revoking his privileges to perform endoscopic procedures and restricting his privileges to perform laparoscopic procedures. Panel Hearing: June 20, 2007 Final Arguments: Continued from October 17, 2007 to December 14, 2007 Dr. Mbadiwe was represented by U. Wilfred Nwauwa. The Board was represented by Brian Blankenship PANEL RECOMMENDATION: Phase I The Panel found that Dr. Mbadiwe committed unprofessional conduct by failing to conform with standards of acceptable and prevailing medial practice and that Dr. Mbadiwe lacked professional competence to practice medicine and surgery specifically endoscopic and laparoscopic procedures. Phase II Indefinite Suspension. McGhee, James, MD Charlotte, NC Dr. McGhee was charged with unprofessional conduct based on evidence that he engaged in a sexual act with a patient. October 17, 2007 hearing was continued Dr. McGhee was represented by Jocelyn Singletary.

Mullen, Joseph, MD Shelby, NC Dr. Mullen was charged with unprofessional conduct based on evidence that he accepted monies for prepaid services and abruptly closed his office without giving patients notice or providing for continuity of care. October 17, 2007 hearing was continued to February 20, Dr. Mullen was represented by Ray Owens. The Board was represented by Marcus Jimison. Nash, Will Light, MD Sylva, NC On February 2, 2007, the Board charged Dr. Nash with unprofessional conduct for failing to adequately diagnose and treat Patient A, and failing to record accurate and adequate information in the medical record. October 17, 2007 hearing was continued to December 14, 2007 Dr. Nash was represented by Jim Williams. The Board was represented by Katherine Carpenter. 6/2007 BOARD ACTION: Reject proposed Consent Order STAFF INSTRUCTION: Suggestions for a Consent Order: Reprimand, limited # of patients per day (10-20), Informal Interview with Dr. Sathiraju & Dr. Jablonski; and must take an EKG course. Rosenburg, Mark, MD Ellisville, MO Out of State Dr. Rosenberg was charged based on action taken by the Ohio and Kentucky Boards relating to his guilty plea on misdemeanor counts of receiving and retaining stolen property and a guilty plea on one felony count of receiving stolen property. October 17, 2007 hearing was continued to February 20, 2008 Dr. Rosenberg was not represented by counsel. The Board was represented by Marcus Jimison. Smith, Michael, MD Nags Head, NC Dr. Smith was charged unprofessional conduct based on evidence that he had poor charting and inappropriate prescribing for three patients/family members. A motion passed to close the session to prevent the disclosure of information that is confidential pursuant to sections 90-8, 90-14, 90-16, and (a) of the North Carolina General Statutes and not considered a public record within the meaning of Chapter 132 of the General Statutes and to preserve attorney/client privilege. A written report on one cases was presented for the Board s review. The specifics of this report are not included as these actions are not public information.
