7 Washington D.C. & Baltimore s top rated lawyers in 2014 legal trends Lawmakers and lawyers in the nation s capital examined cases that touched on subjects ranging from religious exemptions for the Affordable Care Act to the criminal penalties for marijuana possession. Meantime, the U.S. Justice Department collected the largest-ever settlement from a U.S. automaker. Washington D.C. & Baltimore law 2014 Supreme Court Hears Challenge to Affordable Care Act In March, the United States Supreme Court heard a challenge to a provision of the Affordable Care Act in a case with the potential to greatly impact the federal health care law. In Sebelius v. Hobby Lobby Stores, Inc., Hobby Lobby Stores, a privately owned crafts supply chain based in Oklahoma, argued that a provision in the Affordable Care Act violates the company s constitutional right to religious freedom. The Act requires forprofit companies to include Food and Drug Administrationapproved contraceptive options in the health insurance plans they provide to employees. The law does include exceptions to the contraception mandate. But those exceptions apply only to churches and religiously affiliated non-profits, such as schools and hospitals. Hobby Lobby, which is Christian-owned, argued that exceptions to the contraception mandate should be made for for-profit businesses, as well. One major point of contention for Hobby Lobby is the inclusion of forms of birth control that some religious groups consider equivalent to abortion, such as the so-called morning after pill. According to the U.S. Solicitor General, Donald Verrilli Jr., federal and state laws don t consider these particular forms of contraception to be abortion. During oral arguments, Justice Elena Kagan questioned whether other medical procedures, such as blood transfusions or vaccines, would be at risk. There are quite a number of medical treatments that could be religiously objected to, she said. Everything would be piecemeal, nothing would be uniform. Justice Anthony Kennedy, who is expected to be the swing vote in the case, also posed questions about the implications of the law: How would we consider the rights of employees? The employees may not believe in the religious beliefs of the employer, he noted. In an amicus brief supporting Hobby Lobby s case, the Thomas More Law Center stated that a victory for the craft company would protect companies from being forced, under threat of ruinous government fines, to fund products and services that violate their sincerely held religious beliefs. Since February 2012, more than 70 other for-profit companies have challenged the contraceptive mandate in court. Sebelius v. Hobby Lobby Stores, Inc. marks the first time the court has considered a case related to the Affordable Care Act since it upheld its passing in to law in Toyota Pays Record-Breaking $1.2 Billion Settlement After a four-year criminal probe into Toyota Motor Corporation s activities, the United States Justice Department announced that the automaker would pay a $1.2 billion settlement. It is the largest such penalty ever levied against an automaker. The settlement came as a result of the investigation s finding that Toyota concealed and intentionally minimized important safety issues with its vehicles to both government regulators and consumers. Safety defects in certain Toyota and Lexus models caused cars to accelerate uncontrollably, which resulted in at least five deaths. According to the 1966 Motor Vehicle Safety Act, car and truck manufacturers must notify the public if they find defects or safety problems with their vehicles. In 2000, Congress modified the act to add criminal penalties for automakers that did not comply. This was the first federal criminal case to rely on the auto safety law. The National Highway Traffic Safety Administration rules would have limited the maximum fine to $66 million. So the Justice Department also pursued a wire fraud charge against the company to up the ante. Public safety organizations claimed the settlement as a victory. It means at the highest levels of the auto company, they have to worry about going to jail if they don t report a defect, Joan Claybrook, former president of the nonprofit Public Citizen, told Reuters. Entering this agreement, while difficult, is a major step toward putting this unfortunate chapter behind us, said Christopher P. Reynolds, chief legal officer for Toyota Motor North America. Toyota must still contend with hundreds of pending private lawsuits related to the defects. My hope and expectation is that this resolution will serve as a model for how to approach future cases involving similarly situated companies, Attorney General Eric Holder said in a news conference. One similarly situated company is General Motors. It is currently under investigation for continuing to sell vehicles with faulty ignition switches, a defect that contributed to more than a dozen deaths. 8 Washington D.C. & Baltimore s top rated lawyers in 2014 when you ve been injured at Sea if you ve been injured at sea or on the water while working for your employer, you may have to file a claim under the Jones Act and general maritime law to be paid for your injuries. Most injuries at sea or on the water aren t covered by state workers compensation laws unless the injury occurs within the territorial waters of a state. who is a Seaman under the jones act and general maritime law? To qualify for coverage under the Jones Act, you must meet the following requirements: The vessel that you were injured on must be in navigation at sea or in a body of water that is connected to interstate or international commerce. You must spend a substantial part of your work time on board the vessel. A variety of workers may qualify for coverage under the Jones Act, including fishermen, cruise ship workers, and construction workers who work on vessels or barges. How do i establish a maritime injury CaSe? You re entitled to compensation if an unseaworthy condition on board the vessel caused your injury. A condition is unseaworthy if the vessel, the crew, or the vessel s appliances are not reasonably fit for their intended purpose. This can occur if: A piece of equipment is defective. The crew is inadequately trained. The number of persons assigned to complete a task is inadequate. You can also establish a case if you can show that your employer was negligent in causing the injury. This includes: Not following a safety statute. Not providing adequate equipment or saftey gear for a job. Failure to provide adequate medical treatment after an injury. what CompenSation may i ColleCt? You re entitled to what s called maintenance, cure, and unearned wages if your disability or injury occurred, was aggravated or manifested itself while you were in service of the vessel. A showing of negligence or unseaworthiness isn t required. Maintenance is the reasonable amount required to cover your expenses in obtaining room and board ashore after an injury. Cure is the cost of obtaining reasonable medical treatment for an injury. Unearned wages are wages that you would have earned until the end of the voyage but for your injury. They expect that they will feel better after the device is used, not worse. But sometimes medical devices may be defective or used for unintended purposes, which can make medical problems worse or even create new ones. One of the most important means of protecting the environment is the use of environmental permitting programs. These programs regulate activities that may have a harmful effect on the environment. 13 Congress has oversight of District laws, and this new measure puts local law in conflict with federal statutes. House Speaker John Boehner has said that Congress will look at the new law. Congress has not used its power to invalidate a District law for 20 years. Continued from page 9 of the drug and lessening penalties for public and private consumption. The new legislation marks a significant departure from the District s previous approach. Under earlier law, possession of an ounce or less of marijuana was a criminal offense punishable by six months in jail or a $1,000 fine. Under the new law, possession of the same amount would be a civil offense with a $25 penalty. Public consumption of the drug would still be a misdemeanor offense, but the penalty would be lowered from a $1,000 fine or six months in jail to a $500 fine or 60 days in jail. Seventeen states have similar laws in place. The measure passed in March with a 10-1 vote. D.C. Mayor Vincent Gray later signed it into law. I am proud that we are taking a big step to address and correct that injustice, said Councilmember Tommy Wells, an advocate for the bill. I am not an advocate for the use of marijuana in public or private, but an end to the criminalization and disenfranchisement of majoritively African American D.C. residents. A 2013 study by the Washington Lawyers Committee showed that D.C. has the highest marijuana arrest rate in the nation, with African Americans making up 90 percent of those arrested. Georgetown Student Who Made Ricin in Dorm Room Must Remain in Jail Pending Trial, Judge Rules Georgetown University student Daniel Milzman, 19, was arrested after law enforcement officials found ricin, a biological toxin, in a desk drawer in his dorm room. Milzman s lawyers asked that he be admitted to an in patient psychiatric treatment program for two weeks, arguing that the college sophomore was depressed and intended to use the potentially lethal substance to kill himself. In late March, U.S. District Court Chief Judge Richard W. Roberts reversed a lower court s order and ruled that Milzman must remain in jail pending trial. Danny Onorato, Milzman s defense attorney, argued that the D.C. jail was ill-equipped to handle suicidal inmates. Onorato also claimed that Milzman hoped to hide his suicidal plans from his friends and family. But according to court filings, prosecutors contend that Milzman may have intended to poison a fellow Georgetown student with whom he d been romantically involved. Milzman had been directing hurtful Facebook posts to the other student, with messages like, You are the worst person in the world, and, You would be more useful to the world if you were chemically dis-incorporated and the elements that composed your body were sold to laboratories. In his ruling, Roberts noted a March 17 conversation Milzman had with a friend during which he appeared definitely a threat to someone, according to prosecutors. The friend reported Milzman to Georgetown counseling services, which notified police. Judge Roberts also noted that Milzman was inspired by the television show Breaking Bad, in which ricin is used to harm others rather than as a method of suicide. In his ruling, Roberts noted that Milzman may pose a threat to the community and that his ability and determination [to make the toxin] reflects the seriousness of the danger to others should he be released. PERLIN OBTAINED A $2.1 MILLION VERDICT on behalf of a carroll county client following an improperlyperformed hiatal hernia repair. the client has endured more than nine surgeries as a result of the fact that her surgeon improperly used synthetic mesh and wrapped it around her esophagus during the procedure. unlike other available meshes, synthetic mesh runs the risk of eroding into surrounding structures, which is exactly what happened to this client, who has mesh eroding in her esophagus. she is now required to undergo frequent procedures in which a gastroenterologist sticks a laser down her throat to cut away the eroding mesh. the case was tried to successful verdict in the circuit court for Baltimore county.
