1 I. HYDROTECHNICAL FACILITIES Appendix No. 1 to the Directive No. 41/2008 dated GENERAL RULES FOR THE USE OF THE PORT OF GDYNIA AUTHORITY S.A. PORT INFRASTRUCTURE 1. Duties of the user of the facility. In order to properly maintain the facilities, the user is obliged to perform the duties mentioned below: 1.1. maintenance of the utilized areas in winter and summer: snow and black ice removal, cleaning and sweeping, as well as maintaining the efficiency of lighting in accordance with the provisions of the Maritime Administration; 1.2. providing access to the used property for the committee checks established by the owner 1.3. adjustment of the fixed assets of the Port of Gdynia Authority S.A. to the physical and chemical properties of the handled bulk goods. 2. Operation of hydro technical constructions. In the case of operation of marine structure in accordance with its intended function, the user must follow technical and utility parameters of the structure laid down in the technical documentation filed in the Department of Hydro-technical Structures The most important parameter - the permissible load of the object and width of the zone in which it is applicable - is given on the information boards located within the area of the building. 3. Operation of the hydro-technical object in a manner other than specified in section "2" of these rules. In the case of change in the existing technology of operation of the whole marine facility or its part into the technology non-compliant with the intended function, referred to in section 2: 3.1. the user, who signed a tenancy or lease agreement with the Port of Gdynia Authority S.A. is required to: provide the technical expert opinion developed by the designer who holds unlimited building license in hydro- engineering, which would allow for such change and define the terms of its implementation. Expert opinion shall be assessed by the Department of Hydro-technical Structures of the Port of Gdynia Authority S.A. - further process depends on the outcome of the expert opinion; provide additional supervision in respect of the compliance of each transhipment operation with the expert opinion carried out by an independent person who holds unlimited building license in hydro- engineering. 2 In order to confirm this fact the of Chief Dispatcher Department of the Port must be provided with a supervisor's statement on the acceptance of the supervision of the above transhipment operations (along with a photocopy of the above mentioned building license and the instrument proving current membership in the competent Chamber of Civil Engineers); notify the relevant departments of the Port of Gdynia Authority S.A. - Chief Dispatcher Department of the Port and the Department of Hydro-technical Structures - 3 working days before the scheduled transhipment operations. The notification should include important technical data affecting the transhipment with reference to the relevant technical expert opinion. Relevant documents evidencing the establishment of the supervision over the operation must be filed to the Chief Dispatcher Department of the Port. Upon receipt of the above mentioned opinions and documents of the Chief Dispatcher Department of the Port gives its consent to carry out the transhipment operation In the case of carrying out cargo handling operations by the operator who does not have a signed rental or lease agreement with the Port of Gdynia Authority S.A., such operator is additionally obliged to provide: declaration on the acceptance of the liability by the person authorized to represent the user, to comply with the technological process (design assumptions) indicated in the technical expertise / design and to cover the costs of repairing any damage to the buildings and the cost of removing any damages caused by their operations in the area of the Port of Gdynia Authority S.A.; the above declaration shall be filed with the Chief Dispatcher Department of the Port. Failure to submit the above mentioned document is tantamount to a refusal to give a consent by the Main Dispatcher Department of the Port to carry out the transhipment operation; the report on the technical condition of the building before the transhipment operations and documentation of possible damage to the building after each transhipment operation (after a site visit by a person listed in section ) approved by the representative of the Department of hydraulic structures of the Port of Gdynia Authority SA The removal of damage to the buildings found upon the comparison of the two documents should be made based on the commitments set out in section Failure to provide the report on the technical condition of the hydro-technical structure before the scheduled transhipment operation is tantamount to a refusal by of the Chief Dispatcher Department of the Port; 4. Temporary exclusion of infrastructure facilities from operation Port of Gdynia Authority SA reserves the right to periodically shut down the operation of individual buildings in order to perform the necessary inspections, repairs, renovations, etc., or in order to carry out the tasks related to the current investments. The term of works and the shut down area of the building will be agreed with respective operators in advance, if possible. 5. Construction work carried out by the operator. 3 II. ROADS, YARDS AND BUNKERS 1. Duties of the user of the facility. In order to properly maintain the facilities the user is obliged to perform the duties listed below: 1.1. maintenance of the utilized areas in winter and summer: snow and black ice removal, cleaning and sweeping 1.2. providing access to the used property for the committee checks established by the owner 1.3. adjustment of the fixed assets of the Port of Gdynia Authority S.A. to the physical and chemical properties of the handled bulk goods; 2. Passage of oversized vehicles. Passage of oversized vehicles must be notified in writing each time to the Port Security Department. The notification must include the following information: a) date and time of passage, b) length and width of the oversized vehicle, c) proposed route, d) registration number and make of the oversized vehicle, e) name of the driver and the number of their identity card, f) information on the pilot vehicle i.e.: registration number and make, name of the driver and the number of their identity card. Notification must be filed at least 3 working days before the planned date of passage. Having consulted the Chief Dispatcher Department of the Port, the Department of Hydrotechnical Structures and services of appropriate terminal where the passage is planned, the Port Security Department shall authorize the passage setting the relevant conditions. 3. Erection of structures on the yards. In the case of erection of high weight elements on the yards, at least 3 days in advance before the planned installation, the Department of Hydro-technical Structures must be provided with the technical decision (the technical opinion, expertise) issued by an authorized designer or an expert, which defines the technological process and conditions for safe conduct of work in compliance with Art. 71 of the construction Law, as well as the maximum load during the construction and the proposed temporary traffic organization in the case of traffic restrictions on the traffic routes. 4. Temporary exclusion of the roads and yards from operation. Port of Gdynia Authority S.A. reserves the right to periodically exclude individual buildings from the operation in order to perform the necessary inspections, repairs, renovations, etc., or in order to carry out the tasks related to the current investments. 4 The term of works and the excluded area will be agreed with the respective operators in advance, where possible. 5. Construction work carried out by the operator. III. RAILWAY FACILITIES 1. Duties of the object user. All users of the rail transport are required to perform the duties listed below: 1.1. comply with the provisions of the "Rules of railway transport operation on the tracks of the Port of Gdynia and tracks of PKP Gdynia Port railway station, to the extent necessary to support the individual groups of the Port of Gdynia tracks", the extracts of which were published on the Port of Gdynia Authority SA website, laying down general rules in the territory of PGA SA and relating to the operation of rail transport; 1.2. maintenance of the utilized areas in winter and summer: snow and black ice removal, cleaning and sweeping; 1.3. providing access to the used property for the committee checks established by the owner 1.4. adjustment of the fixed assets of the Port of Gdynia Authority S.A. to the physical and chemical properties of the handled bulk goods; 1.5. in the case of the handling terminal - development of the "Regulations of point-of-loading handling", which upon the approval by the Port of Gdynia Authority S.A. shall regulate the rail transport within the specific terminal. Such regulations must take into account the existing situation on the quay and be agreed with the other users of the quay. 2. Extraordinary cargo handling. The posts for loading extraordinary cargo - exceptionally heavy and oversized - are located at the Czech Quay and Polish Quay. Access to these posts: a) to the Czech Quay via track No. 421, b) to the Polish Quay via track No. 547, 543, 531, 533. The aforementioned cargo may be transported via other tracks only after drawing up an expert opinion prepared at the request of an interested user, which would clearly show that the specific cargo of a certain weight, or exceeding the structure gauge by a certain value, can be safely transported to the indicated place at the quay, and that it will not threaten the safety of the quay construction, nor the surface on which it is to be placed. 5 Such expert opinion should be delivered to the Main Dispatcher Department of the Port of Gdynia Authority S.A. at least 3 working days before the planned shipment and approved by the port services (Main Dispatcher Department of the Port, Department of Hydraulic and Technical Structures). Main Dispatcher Department of the Port issues the consent for the transit of extraordinary cargo after the fulfilment of the above requirements. The user is also required to submit a declaration to the Main Dispatcher Department of the Port, signed by a person authorized to act on behalf of the user, on the compliance with the agreed technological process and that it would cover any damage that may occur during the execution of the notified operation. Failure to submit the abovementioned document is tantamount to a refusal to give a consent by the authorize the Main Dispatcher Department of the Port for the transport of the extraordinary cargo. 3. Temporary exclusion of tracks and turnouts from the operation. The Port of Gdynia Authority S.A. reserves the right to exclude individual tracks and turnouts from the operation in order to carry out planned inspections, overhauls, repairs resulting from the annual survey of the railway infrastructure, emergency repairs or for carrying out the tasks related to the current investments.
