1 The Amazing Refresh Challenge Contest Contest Rules and Regulations 1. The Amazing Refresh Challenge Contest (hereafter referred to as the Contest ) is held by Perfetti Van Melle (the Contest Organizers ). It will take place online from June 28, 2016, at 8:00 p.m. (ET) through September 20, 2016, at 11:59 p.m. (ET) (the Contest Period ). ELIGIBILITY 2. The Contest is open to all Canadian residents aged 13 years and over who have a Facebook account (you can create a Facebook account for free at Employees, representatives and agents of the Contest Organizers, any corporations, companies, trusts or other legal entities controlled by or connected to them, including their advertising and promotional agencies and suppliers of prizes, products and services related to this Contest, as well as their immediate family members (brothers, sisters, children, father, mother), legal or common-law spouse, and all persons with whom these employees, representatives or agents reside are not eligible to enter the Contest. HOW TO ENTER No purchase necessary. 3. To enter the Contest, you must: 3.1 During the Contest Period, visit (the Contest Website ). Click on Connect with Facebook to play then Connect. You will be redirected to the electronic entry form (the Entry Form ) on the Contest Website; 3.2 Make sure that the pre-filled information on the Entry Form is accurate. If not, make the necessary corrections; 3.3 Declare that you have read and accept all the Contest rules and regulations by checking the appropriate box and clicking on Play now ; 3.4 Every day during the Contest Period, you can play up to two (2) of the video games available on the Contest Website (approximately four to eight games). If you achieve the minimum result required, you will get one (1) entry in the Contest draws. If you reach the expert level as identified during the game, then you will receive an extra entry, for a total of two (2) entries. 3.5 Additional entries. There are two ways to earn entries in addition to those obtained through the online video games mentioned above.
2 3.5.1 Watch each episode of The Amazing Race Canada television program during the Contest Period, look for the Mentos gum and note where the gum appears. In the Question of the Week section (not available the week following the August 16, 2016, episode), correctly answer the question regarding where the Mentos gum appeared to get five (5) additional Contest entries. If you answer incorrectly, you can try again each day until the date and time of the next TARC episode (with a 24-hour waiting period between each try); If you correctly identified the place where the Mentos gum appeared for all of the eleven (11) episodes, then you ll receive 10 additional entries. 4. Limits. Entrants must comply with the following limits, failing which they may be disqualified: 4.1 Online video games: maximum of four (4) entries per person per day; 4.2 Correctly identifying where the Mentos gum appears during an episode: maximum of five (5) additional entries per episode, for a maximum total of 55 entries through this method; 4.3 Correctly identifying where the Mentos gum appears during every episode: maximum of ten (10) additional entries, to be awarded at the end of the Contest Period; 4.4 Maximum number of entries possible per person: 401 for the entire Contest Period; 4.5 Entrants with more than one address must use only one (1) address. The use of any device or method by any entrant in an attempt to obtain more than the above-mentioned maximum number of entries per person or to obtain them under multiple identities will result in that person s disqualification. PRIZES 5. In all, three (3) grand prizes and eleven (11) weekly prizes will be awarded, worth a total of $25, Grand prizes. Three (3) grand prizes will be awarded. Each grand prize has a total value of $6,500 and consists of a $5,000 gift certificate redeemable at Encore Voyages travel agency and $1,500 in spending money, which will be awarded to winners by cheque. The following conditions apply to each grand prize: 6.1 The gift certificate may only be used on a single occasion, unless otherwise stipulated by the gift certificate issuer. If the total value of the gift certificate
3 is not used on a single occasion, the winner will not be entitled to receive the balance as a credit or reimbursement. 6.2 The gift certificate is valid for a period of one year following the date of issue. If the gift certificate is not used during this period, the winner will not be entitled to a credit or reimbursement. 6.3 The gift certificate is subject to all applicable restrictions and conditions stipulated on the gift certificate itself or that may be provided to the winner by the prize supplier. 7. Weekly prizes. Eleven (11) weekly prizes will be awarded during the Contest Period. Each weekly prize will consist of $500, awarded to winners by cheque. DRAWS 8. A random draw will take place at the offices of the agency in charge of administering the Contest, in Montreal, on the following dates: 8.1 Grand prizes: On September 21, 2016, after the weekly draw, three (3) eligible entries will be selected at random from among all entries registered during the Contest Period. 8.2 Weekly prizes: During the Contest Period, every Wednesday at 10:00 a.m. (ET), from July 6, 2016, to September 21, 2016, inclusively, with the exception of August 17, 2016, one (1) eligible entry will be selected at random from among all entries registered during the Contest Period, up to 11:59 p.m. the day before the draw. 9. Odds of winning. The odds of an entrant being selected for a grand prize depend on the number of entries registered during the Contest Period. In the case of the weekly prizes, the odds depend on the number of entries registered before the deadline for each draw. 10. Prize limits. There is a limit of one (1) weekly prize and one (1) grand prize per person and per household during the entire Contest Period. AWARDING OF PRIZES 11. To be declared a winner, an entrant must: 11.1 Be reached by phone or , at the sole discretion of the Contest Organizers, within ten (10) days following the draw Complete and sign the declaration and release form (the Release Form ) to the effect that they have fulfilled all the requirements of these Contest rules, which will be sent to them by by the Contest Organizers, and return the
4 signed Release Form so that the Contest Organizers receive it within ten (10) days of its receipt by the entrant Correctly answer the mathematical skill-testing question on the Release Form Upon request and within a reasonable timeframe, provide a piece of identification with a photo. 12. Failure to comply with one of the conditions outlined in these Contest rules, to be reached or to return the Release Form within the given deadline, or the selected entrant s refusal to accept his/her prize, will result in the entrant s disqualification. In such an event, the Contest Organizers may, at their sole discretion, cancel the prize or hold a new draw for that prize until an entrant is selected and declared a winner. 13. Within two (2) to four (4) weeks following receipt of the duly completed and signed Release Form, the Contest Organizers will mail the prize to the winner. GENERAL TERMS AND CONDITIONS 14. Verification. Contest Entry Forms and Release Forms are subject to verification by the Contest Organizers. Any Contest Entry Form or Release Form that is, as the case may be, incomplete, illegible, mutilated, fraudulent, registered or sent late, or that contains an invalid address, bears an incorrect answer to the mathematical skill-testing question, or is otherwise non-compliant will be rejected and will not entitle the entrant to an entry or a prize, as the case may be. 15. Disqualification. The Contest Organizers reserve the right to disqualify anyone or cancel one or more Entry Forms of anyone who enters or attempts to enter this Contest by any means contrary to these rules and regulations or in any manner deemed unfair to other Contest entrants (e.g. entries exceeding the authorized limit). This person may be reported to the appropriate legal authorities. 16. Conduct of the Contest. Any attempt to deliberately sabotage the Contest Website, Facebook pages and/or any other related site, or to disrupt the legitimate operation of the Contest, represents a violation of applicable laws. Should such an attempt be made, the Contest Organizers reserve the right to reject all of the entrant s Entry Forms and seek damages to the fullest extent permitted by law. 17. Acceptance of prize. Prizes must be accepted as described herein and may not, in whole or in part, be substituted for another prize, transferred to another person or, in the case of a grand prize gift certificate, exchanged for cash, except as provided in the following section. 18. Substitution of prizes. In the event that it would be impossible for the Contest organizers to award a gift certificate as described herein, they reserve the right to award a prize of the same nature and equivalent value, or, at their sole discretion, the cash value of the prize as stated herein.
5 19. Limit of liability: use of the prize. By entering this Contest, entrants selected for a prize release the Contest Organizers, any corporations, companies, trusts or other legal entities controlled by or connected to them, their advertising and promotional agencies, and their employees, representatives and agents (the Beneficiaries ) from all liability for any damages they may suffer in accepting or using their prize. 20. Limit of liability: prize supplier. All entrants selected for a grand prize acknowledge that from the moment they are awarded their gift certificate, all obligations related to it are the responsibility of the supplier of the gift certificate. 21. Contest Website. The Contest Organizers do not guarantee in any way whatsoever that the Contest Website or Contest Facebook page, or any other site related to the Contest, will be accessible or functional without interruption throughout the entire Contest Period or that it will be free of any errors. 22. Limit of liability: operation of the Contest. The Beneficiaries are not liable for any faulty computer components, software or communications line, the loss or lack of a communications network, or for faulty, incomplete, incomprehensible or erased computer or network transmissions that may limit or prevent an entrant s participation in this Contest. The Beneficiaries are also not liable for any damages or losses incurred, directly or indirectly, in whole or in part, from downloading any Internet page, software or other item, or from the transmission of any information related to entering this Contest. 23. Changes to the Contest. Subject to what is otherwise provided in these rules, the Contest Organizers reserve the right to cancel, terminate, modify, or suspend this Contest, in whole or in part, at their sole discretion, in the event that any unauthorized human intervention or any other occurrence corrupts or adversely affects the administration, security, impartiality, or operation of the Contest as outlined herein. 24. Termination of participation in the Contest. In the event the computer system is unable to register all Contest entries during the Contest Period for any reason whatsoever, or participation in the Contest must be terminated, in whole or in part, before the date indicated herein, the Contest Organizers will proceed with the draw, at their discretion, from among the entries duly registered during the Contest Period or, if applicable, those registered up to the date of the event that put an end to Contest participation. 25. Prize limit. In no event shall the Contest Organizers be required to award more prizes than indicated in these Contest Rules or to award a prize otherwise than in compliance with these Contest Rules. 26. Limit of liability: entering the Contest. By entering this Contest or attempting to do so, all persons release the Contest Organizers from all liability for any damages that could arise from entering or attempting to enter the Contest.
6 27. Authorization. By entering this Contest, all entrants selected for a prize and, in the case where an entrant selected for a prize is a minor, their adult parent or guardian, authorize the Contest Organizers and their representatives to use, if required, their name, photograph, likeness, voice, city of residence, and/or statement in connection with their prize for advertising purposes, without compensation of any kind. 28. Communication with the entrants. No communication or correspondence will be exchanged with the entrants in this Contest other than in accordance with these Contest rules or at the initiative of the Contest Organizers. 29. Personal information. Entrants personal information collected for the purpose of the Contest will only be used to administer the Contest. No commercial or other communications unrelated to the Contest will be sent to entrants unless they have otherwise agreed to receive such communications. 30. Property. Release Forms are the property of the Contest Organizers and will not be returned to the entrants under any circumstances. 31. Identification of the entrant. For the purposes of these rules and regulations, the entrant is the person who is the authorized holder of the Facebook account used to enter the Contest, and it is to this person that the prize will be awarded if the entrant is selected and declared a winner, subject to section 34 below. 32. Minor entrant. In the event that an entrant selected for a prize is a minor, an adult parent or legal guardian must sign the Release Form and accept the prize in his/her name in order for the selected entrant to be declared a winner. 33. Contest Organizers decision. All decisions of the Contest Organizers or their representatives regarding this Contest are final and without appeal, subject to any decision of the Régie des alcools, des courses et des jeux du Québec on any matter under its jurisdiction. 34. Disputes. For Quebec residents: disputes regarding the organization or conduct of a promotional Contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any dispute regarding the awarding of a prize may be submitted to the Régie for the sole purpose of helping the parties reach a settlement. 35. Severability of these sections. If a section in these Contest rules is declared or found to be illegal, unenforceable, or void by a court of law, then that section will be void. However, all other sections not affected will be applied as permitted by the law. 36. Language. In the event of any discrepancy between the French and English versions of these rules and regulations, the English version will prevail. 37. Facebook platform. This Contest is not controlled or sponsored by Facebook. Any questions, complaints or comments regarding this Contest must be submitted to the Contest Organizers, and not Facebook. Facebook, as well as its affiliates, directors,
7 officers, agents and employees cannot be held liable for any claim resulting from, or with respect to, the conduct of this Contest. By entering this Contest, all entrants agree to comply with the terms and conditions of use, contracts and other policies, and/or guidelines regarding the Facebook platform, and release the Contest Organizers, any corporations, companies, trusts or other legal entities controlled by or connected to them, their advertising and promotional agencies, and their employees, agents and representatives from all liability for any damages they may suffer due to the use of this platform.
