1 1. Policy Statement 1.1 As a Housing Association, Bournville Village Trust believes it is always unacceptable for a child or young person to experience abuse of any kind and recognises its responsibility to safeguard the welfare of all children and young people, by a commitment to practice that protects them. 1.2 Every Child Matters published in 2006 provides guidance and an expectation that agencies will work together to safeguard and promote the welfare of children. While Local Authorities are charged with establishing Safeguarding Boards, safeguarding is everyone s responsibility. Housing Associations, particularly frontline staff, can contribute significantly to preventing child abuse. The observant eye of someone carrying out a repair, reading a meter or conducting a home visit to discuss a tenancy can often pick up the earliest signs of potential abuse or neglect. Early reporting can significantly reduce the risk of escalating abuse and ensure that appropriate preventative measures can be put in place. 1.3 We recognise that: The welfare of the child/young person is paramount. All children, regardless of age, disability, gender, racial heritage, religious belief, sexual orientation or identity, have the right to be protected from all types of harm or abuse. Working in partnership with children, young people, their parents, carers and external agencies is essential in promoting young people s welfare. 2. Scope/Purpose of the Policy 2.1 To provide protection for the children and young people who receive Bournville Village Trust services, including the child relatives of adult service users, and all other children that come into contact with the Trust. 1
2 2.2 To provide staff and volunteers with guidance on procedures that they should adopt in the event that they suspect a child or young person may be experiencing, or be at risk of, harm. 2.3 Bournville Village Trust is a complex organisation conducting a wide range of activities. However, as mentioned above, safeguarding is everyone s responsibility. Therefore, this policy covers the responsibilities of Bournville Village Trust Trustees, staff and volunteers We will seek to safeguard children and young people by: Valuing them, listening to and respecting them. Recruiting staff and volunteers safely, ensuring all necessary checks are made. Sharing information about child protection and good practice with children, parents, staff and volunteers. Sharing information about concerns with agencies who need to know, and involving parents and children appropriately. Providing effective management for staff and volunteers through supervision, support and training. 3. Key Procedural Details 3.1 What is Child Abuse? Child abuse is when a child or young person suffers harm as a result of physical cruelty, emotional cruelty, sexual abuse or neglect by an adult. In many cases, the child will suffer more than one kind of abuse at a time, such as neglect and physical abuse, or sexual and emotional abuse. 3.2 Types of Abuse PHYSICAL abuse includes hitting, shaking, burning, poisoning, throwing, suffocating and anything else that causes physical harm to a child or young person. 2
3 EMOTIONAL abuse involves the persistent emotional ill-treatment of a child or young person, which could cause long lasting ill-effects on the child s emotional development. It can involve telling a child or young person that he/she is worthless or unloved, causing him/her to feel frightened or in danger (for instance, through witnessing violence), or exploiting and corrupting a child. SEXUAL abuse involves enticing or forcing a child to take part in sexual activities (whether or not the child or young person is aware of what is happening) or encouraging a child to behave in inappropriate ways. This can include both physical and non-physical contact. It may involve a child looking at, or taking part in, the production of pornographic materials, or watching sexual activities. NEGLECT involves the persistent failure to meet a child s basic physical or psychological needs which may result in damage to the health and development of the child or young person. It can involve failing to provide food, clothing or accommodation or failing to get medical help when needed. 3.3 What To Do If You Are Concerned Concerns may arise from an actual disclosure from a child or young person, from observations whilst on a visit to the home or if a resident brings a child with him/her to the office, or from the behaviour of a staff member which may suggest he/she is not a suitable person to care for children. 3.4 Responding to a Disclosure from a Child/Young Person Keep calm. Do not be shocked. Listen to the child or young person. Accept what you hear without passing judgement. Do not investigate. 3
4 Do not make promises. Offer support and understanding, explaining that you cannot keep it secret and what may happen. (This gives them the choice to continue telling or to stop.) Reassure the child or young person that he/she was right to talk to you. Write down your conversation dates, times, facts, who was involved, observations, and use actual words used if possible. Avoid asking questions. Seek clarification if necessary, but do not ask any leading questions. Complete the separate INTER-AGENCY REFERRAL FORM (BIRMINGHAM), TELFORD AND WREKIN PRE-REFERRAL FORM, or REFERRAL FORM (WORCESTER) available in due course, ensuring that you have the following information: Name(s), address, date(s) of birth of the child/children or young person/people, parent s/carer s name and contact details, name of the person against whom the complaint has been made, names of any witness to the incident (if appropriate). Report to the Designated Person for Safeguarding and Child Protection as soon as possible (contact immediately if you believe the matter is urgent) and keep your line manager informed. Keep notes of your conversation with the Designated Person and any advice given. Sign and date notes and keep them in a confidential file. Act on the advice given. This may be for you or the Designated Person to make a referral to the appropriate Local Safeguarding Board. 3.5 Reporting an Observed Concern There are various things which could raise such concerns, such as a bruise or mark, unusual behaviour by the child or how a significant adult behaves to a child. As above, complete the separate INTER-AGENCY REFERRAL FORM (BIRMINGHAM), TELFORD AND WREKIN PRE-REFERRAL FORM, or REFERRAL FORM (WORCESTER) 4
5 available in due course. Outline the concern and ensure that this is factual and dated. It is good practice to keep a chronological record of concerns and actions. Discuss with your line manager and contact Bournville Village Trust s Designated Child Protection lead. Do not delay if your manager is not available. It is important to act as quickly as possible. Act on the advice given. This may be for you or the Designated Person to make a referral to the appropriate Local Safeguarding Board. 3.6 Responding to an Allegation of Abuse Against, or a Cause for Concern About, a Trustee, a Member of Staff or a Volunteer This may include failure to respond appropriately to a child, neglecting some children in favour of others or a failure to respect parental wishes. Do not discuss the allegation/concern with the individual concerned. Raise the allegation/concern with your line manager or the Designated Person for Safeguarding and Child Protection. The allegation/concern will be discussed by the line manager and the Designated Person All such allegations will be investigated and there are three possible outcomes: 1. It is agreed there is no case to answer. 2. It is agreed that there is concern but that it does not constitute a safeguarding/child protection issue. It will be dealt with by the line manager and may include using disciplinary procedures. 3. It is agreed that the concern does constitute a safeguarding/child protection concern and needs to be referred to the appropriate Safeguarding Board. 5
6 4. Bournville Village Trust s Commitment to Safeguarding 4.1 Bournville Village Trust will abide by existing regulatory requirements, legislation and best practice guidance. We will also act in accordance with the procedures of the relevant Local Safeguarding Board. 4.2 Bournville Village Trust will ensure all staff, Trustees and volunteers are appropriately trained in safeguarding procedures, making use of multi-agency training opportunities where possible, and ensuring that appropriate links are made with other policies, including Safeguarding Vulnerable Adults, Domestic Violence and Anti-Social Behaviour. We are aware that there are significant correlations between child abuse, domestic violence and ASB and, therefore, responses need to be joined up. 4.3 Bournville Village Trust will assign an appropriate, designated senior manager for Safeguarding (child protection) and ensure appropriate links are made and maintained with local safeguarding boards. We will also provide champions who will raise awareness of abuse and what to do about it throughout the Trust. 4.4 Bournville Village Trust will ensure that all new staff are appropriately recruited; that those who are likely to be working with children and young people obtain an enhanced Criminal Records Bureau check; and, from November 2010, are registered with the Independent Safeguarding Authority. We will also register for updates relating to the new safeguarding database. 6

Resident Involvement 6.1 We will ensure any amendments to the policy will be made in consultation with all relevant residents groups. 7. Equality & Diversity 7.1 This policy applies to everyone involved with Bournville Village Trust and covers all the children with whom we come into contact, reflecting our commitment to ensure that they are protected from harm. 7.2 In accordance with our commitment to this, we will ensure that this policy and associated documentation is available in a range of formats and languages. We will also ensure 7
8 appropriate arrangements are in place for communicating with our customers who have special needs such as people with sight, hearing and learning difficulties. 7.3 We will not treat anyone less favourably than anyone else because of: Gender or marital status. Sexual orientation. Colour or race: this includes ethnic or national origin or nationality. Disability. Religious or philosophical or political beliefs, or trade union affiliation, or Other unjustifiable factors, for example language difficulties or age. 7.4 This policy has been made subject to an Equality Impact Assessment, the results of which have been made available on the Bournville Village Trust Intranet and are also available on request from the Business Improvement Unit at Bournville Village Trust. 8. Value for Money 11.1 We consider value for money to be the balance between efficiency, effectiveness and economy. This means achieving low costs, high productivity and successful outcomes for our customers and we will endeavour to apply this in all activities. 12. Monitoring & Review 12.1 Monitoring Arrangements 9
10 Bournville Village Trust will monitor all reported cases of abuse and report quarterly on the numbers of reported incidents, departments and whether complaints have been upheld or not. This will enable us to see any patterns or particular areas, teams etc. where abuse is more or less prevalent and enable us to review the reasons for this as part of our culture of continuous improvement Targets Bournville Village Trust will ensure that all reported concerns are investigated and reported to the relevant safeguarding authority as appropriate Key Performance Indicators 100% investigation of all allegations Customer Satisfaction Surveys Feedback will be sought from our safeguarding colleagues and, where appropriate, from any individuals with whom we have worked Review This policy will be reviewed bi-annually unless amendment is prompted by a change in legislation, operational requirements or customer feedback. 10
11 BOURNVILLE VILLAGE TRUST SAFEGUARDING CHILDREN FLOW CHART Abuse is suspected or discovered Assess the immediate situation Is the person in immediate danger? No Yes Is the manager you report to possibly involved in the alleged abuse? Make the situation as safe as possible. Contact emergency services No Yes Inform manager immediately. Discuss concerns. (If manager unavailable, inform Designated Person for Safeguarding) Inform Designated Person for Safeguarding Is it agreed that abuse is still suspected or has occurred? No Yes Consider other options. Decide action that will be taken. Document all details. Complete Inter-Agency Referral Form and pass to Designated Person for Safeguarding who will inform local Safeguarding Board. Ensure all actions fully recorded. 11
