1 Report on Open Forum Justice and Governance in Post 2015 Development Agenda 22 September 2014, Open Society Foundation 224 W 32 nd Street, New York This meeting was held by INFID with collaboration of Beyond 2015, ADA, ADN with the support from Open Society Foundation, TIFA Foundations, and Office of Indonesia Special Envoy on MDGs. This event has the objective to highlight the importance of just and accountable governance in Post 2015 development goals such as proposed goal 16, and to link the local experiences of just and accountable governance in Indonesia and others international agenda and goals setting process. This meeting is also to facilitate in building strategic partnerships to maintain and strengthen a just and accountable governance in the inter governmental negotiations. There were total of 67 participants attending the event, with the composition of 14 participants from Governmental Bodies and 53 Participants from CSO networks. This event opened by Mr Sugeng Bahagijo as Director of INFID, and Ms. Betsy Apple as the representative of Open Society Foundation. The Keynote speakers are H.E Mr. Kuntoro Mangkusubroto, the Head of President s Delivery Unit for Monitoring and Oversight (UKP PPP) and H.E Ambassador Hahn Chong Hee from Republic of Korea. In panel session, the panelists are Mr. Leo Williams of Beyond 2015, H.E Prof Nila Moelok, the Head of Indonesia Special Envoy on MDGs, Mrs. Diani Sadiawati as the Representative from Ministry of Planning and Development of Indonesia, and Prof. Taekyoon Kim from Seoul National University of Republic of Korea. In his opening speech, Mr. Sugeng Bahagijo as director of INFID mentioned several key points including the objectives of the meeting and the importance of justice and governance within the process of building post 2015 development agenda. Ms. Betsy Apple also stated several key points on how to prepare the upcoming years by closing the gap between New York and countries, which are getting closer to people and demands. She also mentioned the importance of strengthening the intergovernmental negotiation as the process in consolidating Post Mr Kuntoro Mangkusubroto emphasized that governance is the foundation for prosperity and social justice and to tackle other issues such as climate change, poverty, and many more. He also mentioned that Indonesia proposes the governance as standalone goal for the peaceful and inclusive governance since it is crucial for the development process. In facing challenges, Mr Kuntoro stated that governance and justice are inline to Indonesia constitution, the challenges will be tackled by such new framework including improving public

2 services, such as LAPOR for complaint and improving the action against corruption. However, justice and governance can never succeed without the support from related stakeholders. In his speech, Ambassador Hahn Chong Hee stated that Republic of Korea believes that it is a meaningful progress that governance and justice are included as one of the 17 proposed goals of sustainable development goals. Ambassador Hahn gave his Keynote Speech He also mentioned 4 important points of justice and governance in development process. Firstly, governance is based on a shared vision and collective commitment in a community with a full respect of established practices and principles. Secondly, inclusiveness and interaction among multi stakeholders are prerequisite. Thirdly, governance should be people centered, and lastly governance as an enabler and end goal. He confirmed that Korea s economic growth and prosperity has been the fruit of good governance and effective institutions. By taking example of initial stage of Korea s economic development, there were strong political leadership commitments to overcome national poverty in Korean people. There were also large pool of capable technocrats translated this commitment into effective institutions across the society. He also added an example of Korean style governance such as social cohesion and inclusion, community ownership and visionary collaboration as social capital. During Panel Discussion, Mr. Leo stated that effective, legitimate, participatory governance, within and between countries, is an often repeated demand by people and their organizations, and can help ensure that the benefits of development are equally shared.

3 He also believes that just governance is crucial both national and globally. Nationally in terms of ensuring people s lives are governed by just, impartial and effective institutions, and globally in terms of monitoring frameworks for global agreements, accountability systems and global power sharing. Just governance is a concept which applies to all (governments, civil society, companies included). Mr. Leo Williams, on Panel Discussion Goal 16 is a good starting point and he strongly supports its inclusion in the post 2015 agenda. It is crucial that targets are fully measurable setting targets any another way would undermine efforts to track change. He also mentioned that Beyond 2015 just governance is built on six reinforcing dimensions: must be participatory, human rights centered, equitable, transparent, guarantee access to justice, rule of law and fight against corruption, accountable (and this is where we talk about accountability mechanisms). And on the issue of global governance, he mentioned that to ensure that global goals don t remain aspirational and unachieved, they must be aligned with and adapted to national policies, budgets, and local delivery. It must support, not undermine, national governance; also apply equity, participation, accountability, transparency. Global governance requires changes in environmental and economic global governance and this must not be forgotten. Issues that will need to be tackled at this level will include: Holding companies to account, especially for cross border activity. Governments need to have laws + policies to protect against human rights and environmental abuses by companies, to ensure they are responsible, accountable and transparent. Trade, aid and

4 financial architecture, includes illicit financial flows and new globally effective tax structures. This will necessitate more regulation of the financial sector and transnational corporations. In the next panel, Prof Nila as the representative of President Indonesia Special Envoy on MDGs mentioned highlighted the essentiality of ensuring access to justice and good governance. She also emphasized that a global goal of on justice and governance has the power to shape a country s own development agenda. To review the MDGs, she concerned on the deadline of MDGs yet most goals will not be achieved by countries. One among many problems of achieving MDGs was a gap that exists between countries and even within regions in country, especially in applying policies and strategies. The gap can be found in the lack of economic growth, inequality of income or ineffective policy making. Within the context of lesson learned and sharing Indonesia s experience, Prof Nila giving example on the ensuring justice and governance in the healthcare system in Indonesia. The challenges that Indonesia faces include the large population of 250 millions citizens and decentralization. Indonesia needs function, effective health system that allows the delivery to healthcare to all which is means rightfully managing allocated funds by providing quality healthcare equipment, increasing capacity of healthcare professional, and ensuring availability of medical record. She also stressed that transparency, accountability, and integrity are the foundations of a successful effort to achieve these necessities. From local (Indonesia Government) Mrs. Diani showed that Indonesia is piloting SDGs to share Indonesia experiences on justice and governance to global audiences. It is seen as exercises, not binding, however it sets argument on discussion and policy on governance and justice in development. The ministry of planning and development has included governance and justice in RPJM (National Development Framework) themes: Strong, sustainable and inclusive development base on evaluation of previous RPJM implementation and anti corruption strategy. She stated that (new) President Approval is needed to continue governance piloting (on justice and governance) and national anti corruption strategy. She believes that ministry of planning and development will contribute and play the central role in utilizing planning mechanism into national development strategy. From Republic of Korea, Professor Kim mentioned the big challenges in global governance. He stated that there is no clear enforcement mechanism. There are several suggestions including independent review on the mechanism related to international challenges. Data revolution is also necessary as a compliment of other data resources, but need to bear in mind that it has to be open resources. Within participant, there was Mr. Abdul Kholiq Arif, the Regent of Wonosobo, he shared some local government experience in implementing justice and governance in his region. Mr Kholiq also

5 mentioned on related achievement of MDGs in his region, Wonosobo, especially in exercising human rights. He said that the biggest challenge in realizing MDGs is the lack of access to justice and governance. He stated that public participation plays important role as justice and governance and important to achieving the MDGs and building post 2015 development agenda.
