Our diverse experience and hands-on knowledge give us the unique ability to develop creative solutions for lawyers. Winning Lawyers... Consulting Experts Consultants with expertise in psychology, law, sociology and anthropology blend the demands and structure of the law with the art and science of understanding and communicating with the jury. Identifying Problems... Creating Solutions Comprehensive case analysis and pretrial research reveal the landmines in your case. Our team develops a strategy minimizing the weaknesses and maximizing the strengths of your case. Talking to Lawyers... Connecting with Jurors Experience in the courtroom teaches us that jurors are concerned about relationships and people more than legal jargon. Our job is to help lawyers develop the human side of the case and to communicate, really communicate, with jurors.
3 Our Services FOCUS GROUPS: Two or more panels of participants, demographically similar to the venire, consider case facts, witnesses, and exhibits. Their discussions are moderated and videotaped. We analyze the data and make recommendations. An informative, costeffective tool for identifying themes, key issues, and strengths and weaknesses of a case. MOCK TRIALS: Multiple panels of mock jurors who, for one to three days, are exposed to comprehensive case presentations before deliberating to a verdict. Deliberations are taped, and mock jurors are interviewed. Our analytical report discusses the deliberation dynamics and key issues, strengths, and weaknesses that should be addressed before taking a case to trial. The more rigorous design used for mock trials enhances the power of the research. ATTITUDE SURVEYS: A powerful tool for investigating attitudes of potential jurors in a given jurisdiction through a large-scale telephone survey. Especially useful for estimating case outcome, deriving themes, and identifying deselection criteria. We develop the questionnaire, supervise administration, perform statistical and qualitative analyses, report the results, and assist in weaving the information into your case presentation. CASE ANALYSIS: Insightful, in-depth analysis of your case by our team of lawyers and social scientists regarding key facts and issues provides more than just a fresh, outside perspective. This process helps you focus on the human dynamics of your case, and assists in developing the tactics and strategies that most appeal to jurors. THEME DEVELOPMENT: An effective theme focuses jurors on important case issues and prevents them from becoming lost when complex facts confront them. We identify and develop the themes that will resonate with jurors. WITNESS PREPARATION: Using psychological, sociological, and communications theory approaches, we analyze witnesses performance to identify confusing messages, ambivalent cues, and poor communication techniques. VOIR DIRE: Identify undesirable jurors using well-conceived questions derived from our wide experience and database of questions. SUPPLEMENTAL JUROR QUESTIONNAIRES: Juror questionnaires supplement standard voir dire in high-profile cases and complex litigation, or litigation involving sensitive issues. We use social science methodology to assist attorneys in creating questionnaires that increase the probability that potential jurors will fully and honestly disclose pertinent information about themselves.
4 Our Services continued JURY SELECTION: Experienced attorneys consider jury selection to be among the most important aspects of any trial. We use social science techniques to help identify individuals likely to be positively or negatively predisposed towards a case. OPENING STATEMENT: Psychological factors can enhance your rapport with the jury. Weaving potent case themes into your opening statement captures jurors interest. We help you craft an effective opening statement that will quickly connect with jurors on an emotional as well as cognitive level. CLOSING ARGUMENT: When you have told the story well, persuasion is the result. Telling the story in your closing argument is a form of art that you can learn with the help of our understanding of psychological and dramatic techniques. OBSERVATION AND MONITORING: Assists in providing an objective perspective regarding case progress, using insights derived from social science principles. Especially useful when attorneys are involved in highly stressful, difficult litigation. POST-VERDICT JUROR INTERVIEWS: Extremely useful when confronted with a series of cases involving similar fact patterns, witnesses, or legal theories. Through the use of proven interview techniques, we investigate how actual jurors viewed the strengths and weaknesses of your case and report their suggestions regarding their decision-making process and how your case might have been improved. IN-HOUSE SEMINARS: Tailored to fit individual needs. Taught by experts. Topics include crafting artful voir dire, jury selection strategies, witness preparation, informative opening statements, and persuasive closing arguments. The emphasis is on maximizing your effectiveness in litigation through the application o social science in the courtroom. COURTROOM VISUALS: A growing body of research demonstrates that courtroom visuals, though often neglected, are one of the most important aspects of any attorney s case presentation. We assist you in testing the impact of demonstrative evidence, constructing effective visuals, and securing professional assistance in creating computergenerated graphics for the courtroom.
