3 A Brief History of Special Education Rights 1 A Brief History of Special Education Rights 1965 Title VI was added to the Elementary and Secondary Education Act, establishing the Bureau of Education for the Handicapped. Today, this is the Office of Special Education Programs (OSEP) Two Supreme Court decisions took the position that students with disabilities have an equal right to education as non-disabled students Section 504 was enacted, protecting people with disabilities from discrimination based on their disabilities The Family Educational Rights and Privacy Act (FERPA) was passed, giving parents access to personally identifiable information collected by a school district about their children The Individuals with Disabilities Education Act (IDEA) (formerly known as The Education for All Handicapped Children) was passed, mandating that all school districts must provide a free and appropriate public education (FAPE) in the least restrictive environment (LRE) to students with disabilities.

4 A Brief History of Special Education Rights 2 A Brief History of Special Education Rights 1990 The Americans with Disabilities Act (ADA) was passed, including the adoption of Section 504 regulations as part of the law IDEA was reauthorized and required that students with disabilities be included on state and district assessments, and required that general education teachers be on the IEP team IDEA was reauthorized and required more accountability and data regarding outcomes. Districts were also required to provide interventions for students to separate academic deficits from true disabilities.

5 The ABCs of Special Education Law 3 The ABCs of Special Education Law IDEA says that states must ensure that a free appropriate public education (FAPE) is made available to all children with specified disabilities within a certain age range. Education is to be provided in the least restrictive environment (LRE). IDEA defines the requirements of the LRE as, in general: To the maximum extent appropriate, children with disabilities, including children in public or private institutions or other care facilities, are educated with children who are not disabled, and special classes, separate schooling, or other removal of children with disabilities from the regular educational environment occurs only when the nature or severity of the disability of a child is such that education in regular classes with the use of supplementary aids and services cannot be achieved satisfactorily. 6 The Evolution of the LRE 4 The Evolution of the LRE The least restrictive environment (LRE) is individual to each student depending on his or her needs. It is a continuum that ranges from a student being placed in the most inclusive to the most restrictive environment as follows: General education classroom with no additional support needed General education classroom with consultative, co-teaching, or supplemental scaffolding support to the general education teacher General education classroom for most of the day, but receiving specialized instruction in a resource room for certain areas Special education classroom for most of the day, but attending certain general education classes depending on capabilities Special education classroom full-time, but in a general education school Separate school for students with special needs At home or as part of a hospital instruction program For today s students a generation of digital natives the online world is increasingly the natural environment for students. Even young children prefer to be plugged in to learn and to socialize. Online special education offers students ways to participate in less restrictive environments in more meaningful ways, often keeping them from moving to a more restrictive one. It also gives students the same opportunity for online learning as their general education counterparts.

As technology innovations continue to offer new ways to support students in special education, administrators, educators, and other IEP team members should continually educate themselves about support options for students. Students have seen success in recent years using technology such as: Assistive Technology (AT) devices and applications Augmentative and Alternative Communication (AAC) applications Online related services, including online speech therapy, occupational therapy, behavioral interventions, and mental health services Online special education instruction Online services offer an additional advantage to special education departments struggling to find skilled, credentialed professionals to meet their students needs. Environment Services can be provided one-on-one or in small groups for reading, writing, math, and life skills/functional living. Special education teachers from PresenceLearning will use either general education instructional materials linked to the grade-level standards that the student is using in class, or will work with the school team to develop materials to meet a replacement curriculum. Our special education teachers communicate and coordinate with the student s on-site support team.
