9 Why UAS? UAS operations are particularly effective for missions that are dangerous or dull Humans not put at risk Continuous operations Operations with UAS often cost less than using manned aircraft 15

10 Where are UAS Operating? UAS are operated in most classes of airspace Flight over populated areas must be approved on a case-by-case 16

11 The Role of FAA FAA is a Regulator Assures the safety of all aircraft, people, and property FAA is a Service Provider Ensures the safety and efficiency of the National Airspace System and international airspace delegated to U.S. Successful UAS Integration requires BOTH roles 17

12 FAA Authority U.S. airspace is public space 49 U.S.C (a)(1) UAS are aircraft subject to regulation 49 U.S.C (a)(6); 14 CFR 1.1; PL , 336 An aircraft is any device used for flight. UAS must comply with regulations that apply to all aircraft Some state and local laws may impact UAS 18

13 Types of UAS Operations Public Operations Civil Operations (including Section 333) Type Governmental Non-hobby Compensation for Hire Requirements Must verify Public Aircraft Operator eligibility and be issued a Certificate of Waiver or Authorization (COA) Rules Detailed in COA Self-certification of crew and equipment Examples Federal Agencies State and Local Entities Must be granted Exemption AND Certificate of Waiver or Authorization (COA), or Special Airworthiness Certificate (Restricted Category and Experimental) and COA Detailed in COA Operational conditions and limitations outlined in exemption Operating limitations in special airworthiness certificate Industry Manufacturers Section 333 petitioners Hobby or Recreational Hobbyist Must comply with Section 336 of FAA Modernization and Reform Act of 2012 Must register if the aircraft is more than 0.55 lbs. Must operate for hobby/recreation only, in visual line-of-sight, generally under 400, avoid manned aircraft, and fly according to community-based safety guidelines Members of Community- Based Organization General Public 19

15 Proposed Small UAS Rule Currently in DRAFT Notice of Proposed Rulemaking (NPRM) Published to Federal Register on February 23, 2015 Public comment period concluded on April 24, 2015 Produced approximately 4,500 public comments Expected to be finalized late spring

16 Proposed Small UAS Rule: Major Provisions Must see and avoid manned aircraft UAS must be first to maneuver away if collision risk arises Must discontinue flight in event of presenting a hazard to other aircraft, people or property Must assess risks presented by: Weather conditions Airspace restrictions Location of people May not fly over people, except those directly involved with the operation Flights limited to: 500 feet altitude 100 mph Must avoid airport flight paths and restricted airspace areas Must obey any FAA Temporary Flight Restrictions (TFRs) 22

17 Micro UAS Rulemaking Advisory Rulemaking Committee (ARC) of industry stakeholders delivered final report to FAA April 1st Report outlines four small UAS categories for operations over people Defined primarily by level of risk of injury posed Subject to the restrictions of proposed part 107 Category 1 = 250 grams or less Category 2, 3, 4 = impact energy thresholds based on industry-consensus test methods 23

18 Focus Area Pathfinder Program Purpose: Identify the safety mitigations that can lead to expanded access for UAS and inform future rulemaking Approach: Work with industry partners to gain operational approval for key UAS operations and establish a repeatable process Three Focus Area Partners: CNN UAS in visual line of sight, urban/over people Precision Hawk UAS in extended visual line of sight, rural BNSF Railways UAS beyond visual line of sight, rural 24

19 UAS Detection Initiative Growing concerns about potentially unsafe small UAS operations The FAA co-leads an interagency group with DHS to research counter-uas technology In October 2015, the FAA entered into an agreement with CACI International to test their detection technology Expanded in May 2016 to include Gryphon Sensors, LitEye, and Sensofusion 25

20 New World for Recreational Aircraft New entrants into the model aircraft community Aircraft may be purchased at a hobby shop or online for a few hundred dollars Many new modelers have little or no aviation experience, may not know the law (Sec. 336) or FAA model aircraft guidelines (AC 91-57A): Avoid manned aircraft Remain within visual line of sight Fly only for hobby/recreation 26

21 UAS Registration Requirement Registration requirement effective Dec. 21 Small UAS > 0.55 lbs. flown outside must be registered Full details available at: /registration 27

22 Report Unsafe UAS Activity! While flying or at the airport: Report the sighting to Air Traffic Control Report to ATC or FAA Safety Hotline ( ) once on the ground Note the location, altitude, and characteristics of the aircraft Anywhere else: Call local law enforcement Report to FAA Safety Hotline ( ) Be as detailed & specific as possible Location, altitude, direction, pictures, videos, etc. 28

23 Current Safety Concerns Unsafe UAS Operations Reports from pilots in flight of UAS operations near airports/manned aircraft Greater awareness has led to better reporting Each report is investigated and documented Reports of UAS flying during sporting events TFR FDC NOTAM 4/3621 issued to restrict all aircraft operations around major sporting events, stadiums seating 30,000 people TFR specifically cites UAS as aircraft Reports of UAS flying over wildfires TFRs around West Coast wildfires restrict UAS operations So what are we doing about this? 29

25 Law Enforcement s Role State and local Law Enforcement Agencies (LEAs) are often in the best position to deter, stop, and investigate unsafe or unauthorized UAS operations. Law Enforcement guidance is available at: /law_enforcement 31
