13 Observations Producer Operator shall take into consideration observations made by the Inspector indicated in the FLO-Cert certification letter. The follow up of observation is voluntary and is not explicitly inspected in the next inspection. 13
14 Conditions Conditions shall be follow up by the producer. The fulfilment of the conditions is inspected in the next inspection and non fulfilment may lead to a corrective action. Conditions may be related to non compliances with progress requirements as set out in the FLO Fairtrade standards, further improvements of minimum requirements as set out in the FLO Fairtrade standards, non compliances with guidance documents of FLO e.v. (e.g. Joint Body Guidance Document), and non compliances with FLO Fairtrade standard policies. 14
15 Pre Conditions The pre-conditions are valid one calendar year after the certification decision is made, however may be lifted as soon as the pre-condition is fulfilled. Pre-Conditions may be related to non compliances with minimum requirements as set out in the FLO Fairtrade standards, non compliances with guidance documents of FLO e.v. (e.g. Joint Body Guidance Document), breaches of the Operator Contract with FLO-Cert, and non compliances with FLO-Cert standard policies. 15
16 Corrective Actions Corrective Actions must be fulfilled within a given deadline. The deadlines are between 3-9 month. Non fulfilment of a corrective action may be lead to a suspension of the certificate. Corrective Actions may be related to non compliances with minimum or progress requirements as set out in the FLO Fairtrade standards, non compliances with guidance documents of FLO e.v. (e.g. Joint Body Guidance Document), breaches of the Operator Contract with FLO-Cert, and non compliances with FLO-Cert standard policies. 16
17 Suspension of Certificate As a final sanction level, the certificate of a Producer Operator may be suspended based on a Further non compliance of a standard requirement due to non fulfilment of a corrective action; or Non compliance with a major minimum requirement of the Fairtrade standard. As a consequence of a suspension, the Producer Operator is not allowed to trade under FLO Fairtrade conditions for all the products the Producer Operator is certified for. Existing trade contracts can be fulfilled by the Producer Operator. The suspension may be lifted after fulfilment of the given corrective actions. 17
18 Decertification As a final stage of non compliance with standard requirements, Producer Operator may be decertified. As a consequence of a decertification, the Producer Operator is not allowed to trade under FLO Fairtrade conditions. The Producer Operator is allowed to fulfil existing trade contracts within the next 6 month. New contracts are not allowed to be issued. According to the FLO-Cert Corrective Action SOP, Producer Operators may appeal against the FLO-Cert decision within two weeks. 18
19 Communication of Cert Decisions The producer receive a copy of the certification report, a certificate and the certification letter. PBU is informed about all certification decisions issued by FLO-Cert and is responsible for the organisation of the information flow to the Liaison Persons if applicable. NIs are informed actively about Certification Decisions via the Internal Pages. In the case of SUSPENSION: Producer, National Initiatives, PBU, Trade Certification and the Inspectors are pro-actively informed about the Suspension and the high risk of a Decertification. Trade Certification is responsible to inform the Trader part of the respective supply chain about the Suspension and the high risk of Decertification. 19
