9 cell phone distraction liability The Haggard Law Firm was responsible for obtaining the first verdict in the nation dealing with the issue of cell phone distraction in automobile accidents. In December 2001, our firm won a $21 million verdict in the case of Alicia Bustos, a 78-year-old woman who was a seat-belted passenger in a car that was violently struck at a Miami (Hialeah) intersection by a driver talking on his cell phone. The defendant was conducting a business call while driving in his capacity as a salesman for a lumber wholesale company. The woman was left with catastrophic injuries requiring permanent bedside care and she eventually passed away. The defendant had told attorneys that he was not using his cell phone just before the impact, but the lawyer team of Wm. Andrew Haggard and Michael Haggard proved otherwise after subpoenaing cell phone records. This influenced the jury s decision, and the result was the largest personal injury verdict in Miami-Dade County s history at that time. T H E H A G G A R D L A W F I R M 7

10 general personal injury We at The Haggard Law Firm devote a large percentage of our practice to the handling of virtually every type of general personal injury and tort situation. We have addressed almost every conceivable dangerous condition, including hazardous construction sites, dangerously designed stairways, scuba diving, dog bites and false arrest cases. CUQUEJO V. OLARTEGUIQ $12.5 million Settlement (Miami, Florida) Motorcycle Accident/Bad Faith/Personal Injury. Plaintiff Alfredo Cuquejo was traveling on his motorcycle to see his girlfriend when an approaching car made an illegal left hand turn. Mr. Cuquejo tried to avoid the collision, but there wasn t room. He hit and flew over a truck and landed across the intersection. He was left physically incapacitated due to a severe brain injury. PACHECO V. HARBOR COMMUNITIES, ET AL $3.5 Million - Settlement (Incident: Hobe Sound, Florida; Filed: Fort Lauderdale, Florida) Construction Accident/Building Collapse. A construction worker was seriously injured when a nineunit townhome building under construction collapsed during a concrete pour. The collapse was caused by a myriad of acts and omissions of various contractors, including the failure of the shell contractor to use adequate shoring. 8 T H E H A G G A R D L A W F I R M

11 liquor/bar liability The field of liquor liability is of increasing interest and importance in our community. Florida s dram shop statute is the state s response to the ever-increasing problem of minors and alcoholics who seriously injure themselves or others while intoxicated. Florida law provides that if establishments such as hotels, restaurants or bars knowingly serve minors or habitual abusers of alcohol, they may become liable for any injuries or damage resulting from that patron's intoxication. Partners Wm. Andrew Haggard and Jeannete Lewis devote much of their time to representing those individuals designated under Florida law to be victims of restaurant or bar negligence. Wm. Andrew Haggard has effectively litigated many significant liquor/bar liability cases in South Florida, including Fox v. The Clevelander, MacKean v. Flirts and Linnes v. Holiday Isle. The successful conclusion of these cases has clarified the responsibilities of establishments serving liquor. MARSHALL V. GENE S LOUNGE & RED BARON LOUNGE $1.3 million Settlement (Pensacola, Florida) Liquor/Bar Liability. Mr. Marshall and Ms. Robinson were out for a birthday celebration. After drinking for several hours at both the Red Baron Lounge and Gene s Lounge, both persons were asked to leave after a verbal altercation and proceeded to drive off in Ms. Robinson s car. No effort was made by Gene s Lounge to call a cab or make any alternate transportation arrangement. Ms. Robinson proceeded to drive off the roadway and strike a tree, partially ejecting Mr. Marshall, and leaving him a quadriplegic with both legs amputated. He was also rendered completely blind after encountering corrective surgery complications. Both Gene s Lounge and Red Baron Lounge knew of Ms. Robinson s alcoholism, but purposefully continued to serve her alcohol with disregard to the possible consequences of their actions. The case was settled for total policy limits. TROSPER V. GABY S LOUNGE $500,000 - Settlement (Fort Lauderdale, Florida) Liquor/Bar Liability. Sherry Ann Trosper was habitually addicted to alcohol based on the parameters of Florida's "dram shop" statutes. At 3:00 AM Sherry Ann Trosper, totally intoxicated, left Gaby s Lounge and in attempting to walk across a multi-lane street, was struck by a vehicle suffering permanent injuries. Gaby s Lounge knew or should have known that the quantity of alcohol served to Sherry Ann Trosper would render her intoxicated and incapacitated, and purposefully served her this quantity of alcohol. Gaby s Lounge either intended to get her intoxicated, or did so with reckless disregard and conscious indifference to the consequences, so as to be the equivalent of intentional misconduct. 12 medical malpractice Medical negligence or malpractice occurs when a physician or healthcare provider falls below the standard of care and either fails to do something that should have been done or does something that should not have been done with a resulting injury or death. Doctors and other healthcare providers must follow certain standards when caring for patients. While a simple mistake is not enough to constitute negligence, a death or injury caused by the failure to provide reasonably appropriate or common standards of care or the failure to diagnose an easily detectable illness may be malpractice. Our firm has earned a statewide reputation for it's experience in medical malpractice cases against physicians, hospitals and affiliated health care providers who have failed to render proper care to their patients. In addition to our legal team, the firm utilizes medical and scientific experts from across the country to assist us in providing quality representation to our clients in these complex cases. NEWMAN V. "SEVERAL LOCAL DOCTORS" & "ABC PHARMACEUTICALS" $2.225 Million - Settlement (Broward County, Florida) Medical Malpractice/Drug Error. While being treated for a heart condition and high cholesterol, the plaintiff's drug regimen was modified, by his treating physician, to include two drugs which were specifically contraindicated by the drug manufacturer. Soon after he began taking both medications, the plaintiff, 76, was seen by one of his physicians and complained of the classic symptoms associated with the combined use of the drugs and was ultimately hospitalized. None of the plaintiff's physicians recognized this drug error and therefore failed to discontinue use of the medications or order the necessary diagnostic tests to make the correct diagnosis. The plaintiff suffered multiple organ failure and died. RODRIGUEZ V. GONZALEZ-ABREU, M.D. C.A.C. CLINIC WESTCHESTER HOSPITAL $2 Million Settlement (Miami, Florida) Medical Malpractice. Hospital pathologist failed to properly diagnose urethral penile cancer from a biopsy specimen submitted from a meatotomy procedure. Ten months later, the Plaintiff had to undergo a total penectomy, and due to the cancer s metastasis, became terminal. 10 T H E H A G G A R D L A W F I R M

13 negligent security We at The Haggard Law Firm have undertaken several cases involving the failure to provide adequate security resulting in the victim suffering severe injuries and/or death. Establishments such as bars, restaurants, flea markets, shopping centers, nursing homes, banks, hotels and apartment buildings have all been subjects of successfully litigated negligent security claims. By representing individuals permanently injured in cases stemming from negligent security, we believe that we are taking an active role in making the community safe for the public. In November 2007, attorneys Michael Haggard and Wm. Andrew Haggard successfully obtained a $102.7 million verdict in a negligent security case thought to be the largest verdict of its kind in the country. On July 31, 2002, Sami Barrak was a patron at Tootsie's Cabaret, which was a tenant at the Sierra Shopping Center owned by Report Investment Corporation. Mr. Barrak and a friend were leaving the establishment when the friend returned to retrieve an item left inside. As Mr. Barrak sat waiting in his car for his friend to return he was approached by an unknown person who attempted to rob him at gunpoint. After a brief exchange of unknown words, the assailant shot Mr. Barrak in the neck and left, rendering Mr. Barrak a ventilator-dependant quadriplegic. The jury found that Report Investment Corporation, Inc., owned and managed the property and therefore had the duty to maintain it in a reasonably safe condition commensurate with the activities conducted on the property in order to prevent harm to its business invitees. At the time of the shooting, there was only one guard on duty to observe and report any crimes that might occur in and around Tootsie's Cabaret. Report Investment Corporation provided no security and admitted they had never spent one dollar on security or safety. There had been a reported 26 violent crimes on the same property during the seven years prior to Mr. Barrak's incident. Mike helps give victims the tools and resources to help build their lives. He gives them a sense of justice by convincing a judge or jury to hold those responsible accountable, and gives victims and their families comfort that another family won't have to go through this same tragedy because they had an advocate like Mike Haggard. 14 Sami Barrak (Before) Mike is my lawyer and since 2002 he has taken care of my case and we've become friends. We have a good relationship and the case went well. Sami Barrak (After) Client Sami Barrak In November 2008, attorneys Douglas McCarron and Michael Haggard received an $8 million verdict on behalf of the Garcia family. Starsky Garcia was criminally assaulted and mortally wounded in the parking lot of The Arbors Apartment Complex on December 9, He was visiting a friend s apartment and was walking to his car in the apartment complex parking lot when we was shot and killed. He was only 27-years-old. Most recently, attorneys Christopher Marlowe, Michael Haggard and Jason Brenner obtained a $1.6 million verdict in a hard fought battle for client Amanda Slone. 15 incredible journey where defendant Cornerstone Residential Management, which is one of the largest commercial property management companies in the country, brutally attacked Amanda Slone's story and her family's background in trying to secure a court victory. Attorneys Wm. Andrew Haggard and Douglas McCarron were able to obtain a $2 million settlement for the family of Bryan Pata, a standout University of Miami football player who was tragically shot in the parking lot of his apartment complex in Miami. Tens of thousands of Americans are injured each year as a result of negligently designed or defectively manufactured products. We have represented clients injured by products such as pool pumps, defective tires, football helmets, shoulder pads, beverage bottles, food products and orthopedic bone implants. Products liability litigation deters businesses and corporations from putting dangerous products into consumers hands. In many ways, such litigation works better then government regulatory and study groups to quickly remove dangerous products from the marketplace, and compel redesign in compliance with stricter safety standards. Sta.Rite Industries We focus on creating a safer consumer environment by protecting the public s right to use and encounter products designed and made in conformity with strict standards and in fighting to obtain tougher standards when the defective nature of a product becomes known. PETERSON V. STA-RITE INDUSTRIES $104 Million Verdict (North Miami, Florida) Product Liability / Pool Pump Entrapment. A teenage boy was trapped underwater by the suction of a pool pump and nearly drowned. The jury found that product defects in the P2R singlehorse-power suction pump, manufactured and distributed by Sta-Rite Industries, Inc, was responsible for the accident causing the victim to suffer irreversible brain damage. It was found that the pump was unsafe and that Sta-Rite Industries made no effort to change its design to make it less dangerous or to warn distributors about risks it created for swimmers. The $104 million verdict is the largest single personal injury jury verdict awarded in Florida s history. 14 T H E H A G G A R D L A W F I R M

17 pool drowning accidents Drowning is the leading cause of death for young children in Florida and many other states. Thousands of children have died or suffered serious brain damage because of defective pool gates and fences, defective pumps and defective drains in pools. While we have represented families in cases dealing with various safety lapses, the issue of ill-maintained pool gates and fences are a particular concern to us, because so many children drown here in South Florida every year. We at The Haggard Law Firm have developed a national and international niche representing people injured or killed as a result of dangerous swimming pool drains and negligent supervision and maintenance of pool safety barriers. We have gained notoriety in this area of personal injury law by winning two jury trials that resulted in two verdicts in excess of $100 million each. In total, the law firm has obtained over $255 million in verdicts and settlements in pool drowning and entrapment cases. Loren Hinton (Before) In January 2003, partners Michael Haggard and Wm. Andrew Haggard won a $100 million verdict in the case of a toddler who nearly drowned in her apartment complex pool because she gained access to the pool area through a broken pool gate (Hinton v Adams Street Corp). In August 2003, the firm made history again when partners Michael Haggard and Robert Parks won a $104 million verdict in a case where a boy got trapped underwater by the suction of a defective and unsafe pool pump (Peterson v. Sta-Rite). Both verdicts involved irreversibly brain damaged children and are considered to be the largest in Florida s history. I can sum up my experience in one word: caring. The attorneys and staff really saw to our needs and took care of us. You can't ask for more. They were totally on top of everything and we are still so grateful and appreciative. It was a tough situation, but we got through it with their support. Loren Hinton (After) The bill was named for Virginia Graeme Baker, the 7-year-old granddaughter of former Secretary of State James Baker III who drowned in 2002 when pulled underwater by a hot-tub drain. The Haggard Law Firm represented the Baker family and achieved a confidential settlement in Virginia. Representing victims of drowning accidents in pools and in swim parks is a significant concern in national and international jurisdictions. Successful outcomes for the families we represent can go a long way toward protecting children and families in the future, both in the United States and abroad. HINTON V ADAMS STREET CORP $100 Million Verdict (Hollywood, Florida) Premises Liability / Near-Drowning. A toddler sustained irreversible brain damage after nearly drowning in her apartment complex pool. The owners of the apartment complex were found negligent for not repairing a broken gate around the pool area and not securing the pool area with the proper pool fencing. The apartment complex manager admitted at trial that he knew the gate had been destroyed for some time. The $100 million verdict is one of the largest single personal injury jury verdicts awarded in Florida s history. BAKER V. STA-RITE INDUSTRIES Amount Confidential Settlement (Alexandria, Virginia) Drowning/Suction Entrapment. While attending a family graduation party, the 7-year-old granddaughter of former Secretary of State James Baker drowned in the pool/spa in the backyard. The forceful suction of the spa pump at the bottom of the whirlpool, entrapped and held the girl underwater causing her to drown. This is one of several suction entrapment cases where the defendant was negligent in manufacturing an unsafe and defective pool/spa pump. This was the identical pump involved in the Peterson case listed above. 16 T H E H A G G A R D L A W F I R M

19 premises liability Serious injuries and even death often result from negligently designed or maintained premises and unsafe environments. When an owner of a property or business invites a member of the public onto his/her premises, as a guest or patron, the owner has a responsibility to keep the premises safe for use. Premises liability refers to a situation where an individual is injured on the property or premises owned or maintained by someone else. The property owner or party responsible for maintaining the property may be held legally responsible, or liable, for that person s injuries if the injuries were the result of a dangerous condition that existed on the property. Property owners and businesses have a duty to provide a safe environment for people on their property. If they fail to do so and someone is injured in result, they may be held liable for the injured person s medical expenses, pain and suffering and lost wages. We at The Haggard Law Firm have successfully represented families in a wide variety of premises liability cases against private businesses and homes and public institutions, including beatings and muggings in parking lots; injuries on construction sites; accidents in common areas, and slip and fall accidents. JOHN DOE V. ABC APARTMENT COMPLEX & JANE DOE DRIVER $1.875 million Settlement (Miami, Florida) Bicycle Accident/Automobile Accident/Negligent Design of Apartment Parking Lot. John Doe (a 6-year-old) was riding his bicycle in the ABC Apartment Complex and was stuck by an automobile exiting the complex. As a result of the accident, John Doe suffered orthopedic injuries. The case was brought against the driver for negligence and the apartment complex for negligent design of its parking lot and for failure to have any traffic control devices that would assign the right-of-way.
