1 STATE AUTHORIZATION: ONLINE DISTANCE EDUCATION STATE-BY-STATE SUMMARY Michigan State University (MSU) is obligated to comply with existing state laws regarding distance education. For purposes of this summary, distance education includes 100% online programs, online programs that require some on-the-ground experience, certificate programs, and non-credit programs and/or courses that will be delivered to students residing outside the state of Michigan. State laws regarding distance education vary state-bystate, and even program-by-program within a state. Consequently, compliance with state authorization requirements is an ongoing process and requires input and cooperation from MSU s colleges and departments. The chart on the following pages provides a summary of each state s requirements to offer distance education to its residents, an overview of the state s physical presence triggers, and other relevant information for offering distance education in the state. The chart also identifies whether MSU is authorized to offer only 100% online programs to residents of the state or whether some programs may also offer a field experience component. MSU is not authorized by Arkansas or Maryland to provide distance learning in either state. Residency - MSU will not offer certain online programs to students based on their residency at the time of application for admission to MSU. Furthermore, if a student s residency changes during his or her enrollment in an online program, depending on the requirements of the new state of residency, the student may not be able to continue in the program. Whether military personnel stationed outside the state of Michigan may enroll or continue in a MSU distance education program or not is based on where military personnel are stationed. MSU is not authorized to provide distance learning to residents or military personnel who reside or are stationed in Arkansas or Maryland. Licensure Issues - In addition to distance education authorization, programs in nursing, education, social work, counseling, allied health professions, veterinary medicine, etc. may require approval from separate licensing boards, depending on the state. Students that reside outside the state of Michigan who are considering a professional program should contact the appropriate Board in their state of residency prior to beginning a course of study. On-Ground or Field Experience refers to an internship, externship, clerkship, practicum, rotation, clinical, independent study, study away, mentoring, advising, proctoring and the like. Traditional Courses: Regulations also vary state-by-state with respect to traditional courses that take place outside the state of Michigan (internship, externship, clerkship, practicum, rotation, clinical, independent study, study away, mentoring, advising, proctoring and the like) and may not necessarily be the same as regulations regarding online distance education outline in the following chart. Coordinators: Please contact MSU s State Authorization Coordinator for clarification prior to approving an on-ground or field experience. State and Program Offerings Required State Authorization Physical Presence Triggers ALABAMA Contact MSU s State Authorization Coordinator for list of approved programs. The Alabama Commission on Higher Education requires purely (100%) online distance education programs to be authorized by the state, which requires individual programmatic review and approval of online distance education programs. For a list of the programs approved for Alabama, please contact MSU s State Authorization Coordinator. Because the Alabama Commission on Higher Education requires individual programmatic review, the physical presence component of online courses is not applicable here. College of Education - Must use the following disclaimer on all enrollment and marketing materials: State authorization to provide a program related to the preparation of teachers or other P-12 school/system personnel does not indicate eligibility for an Alabama certificate. Applicants for an Alabama certificate based on reciprocity must meet Alabama s test requirements and submit a valid, renewable professional educator certificate/license issued by another state at the degree level, grade level, and in the teaching field or area of instructional support for which an Alabama certificate is sought and for which Alabama issues a certificate. Applicants for Alabama certification in an area of administration must also document at least three years of full-time employment as an administrator in a P-12 school system(s). Alabama State Department of Education website College of Nursing must submit a letter of intent days in advance of any clinical learning experience taking place in the state of Alabama.

2 ALASKA (SARA) 100% online programs may be MSU is exempt from authorization in Alaska, as long as the online program has no physical presence component within the state of Alaska. The Alaskan regulations define physical presence as presence of a facility, faculty or staff within the state; for purposes of this definition, "faculty" and "staff" does not include site supervisors or mentors for local internships or practica, or adjunct personnel. Nursing Programs are not authorized in the state of Alaska. With prior approval, RN non-credit refresher course may be offered in Alaska. Please contact MSU s State Authorization Coordinator. All advertising in Alaska media, or specifically targeting Alaskan students must include the following disclaimer: Michigan State University is exempt from authorization requirements in the state of Alaska. Michigan State University s online distance education programs are exempt from authorization under AS14.48 because the program is online or distance delivered and does not have a physical presence in the state of Alaska. 20 AAC (a)(12) defines physical presence as presence of a facility, equipment, faculty or staff within the state. ARIZONA 100% online programs may be As a public institution, Michigan State University is not required to be authorized to offer online distance education programs as long as there is no physical presence in the state of Arizona. Physical presence does not include delivering online instruction to an Arizona resident or offering externships or clinicals. Nursing Programs Available to Arizona Residents: RN non-credit refresher course is permitted in Arizona. NOTE: Advanced practice nursing students may participate in clinical learning experiences as long as they have a valid RN license in Arizona. ARKANSAS No MSU programs may be offered in Arkansas. If you are considering offering an undergraduate away course or non-credit certificate program in Arkansas, contact MSU is not authorized to offer online distance education programs in the state of Arkansas. Not applicable. As of June 6, 2013, no new Arkansas students will be allowed to enroll in distance education programs offered by Michigan State University. Arkansas students who have previously taken MSU online distance education classes in the past may be permitted to continue (including life-long education courses). Each situation will be evaluated on a case-by-case basis before allowing the student to enroll. CALIFORNIA 100% online programs may be As a public institution, Michigan State University is exempt from approval by the California Bureau for Private Postsecondary Education. The California Bureau for Private Postsecondary Education does not have a definition of physical presence. Nursing Programs Available to California Residents: RN non-credit refresher course is permitted in California.

3 COLORADO 100% online programs may be The Colorado Department of Higher Education does not require purely online programs to be authorized. MSU is exempt from authorization in Colorado as long as MSU does not maintain a physical presence in Colorado. Physical presence is defined as establishing a physical location in the state for students to receive instruction, requiring students to meet in a location in the state for instruction purposes, and establishing an administrative office (including an address or a phone number) in the state. Physical presence is not triggered, solely, by educational experience arranged for an individual student, such as a clinical, practicum residency or internship. Nursing Programs Available to Colorado Residents: 1 RN non-credit refresher course is permitted in Colorado. 1 Worker s Compensation Requirement In accordance with Colorado s Workers Compensation Act 2012, students participating in clinical experiences in the state of Colorado must be covered by workers compensation. Please contact State Authorization Coordinator to coordinate coverage. CONNECTICUT 100% online programs may be The Connecticut Office of Higher Education does not require purely online programs to be authorized. Connecticut s regulations are undergoing revisions, which will address the physical presence definition. The regulations now in effect have no physical presence definition. Nursing Programs Available to Connecticut Residents: RN non-credit refresher course is permitted in Connecticut. NOTE: Preceptors assigned to Connecticut RN students must have BSN with a Connecticut license and at least two (2) years of experience in their chosen field. DELAWARE The Delaware Department of Education does not require purely (100%) distance education programs to be authorized. Delaware defines physical presence as classrooms and/or offices, internships, externships, field experiences, proctored exams or tests that are established by either the student or the institution. Nursing Programs are not authorized in the state of Delaware. RN non-credit refresher course may not be offered to Delaware residents. experience component may not be offered in Delaware. Notification Required MSU s State Authorization Coordinator is required to notify the Delaware Department of Education if a Delaware online distance education student is receiving federal financial aid.

4 DISTRICT OF COLUMBIA experience components may not be The District of Columbia Education Licensure Commission of the Office of the State Superintendent of Education has determined Michigan State University is not required to be licensed at this time, as long as there is no physical presence in the District of Columbia. The District of Columbia s definition of physical presence Establish, keep, or maintain any facility or location in the District, or to establish, keep, or maintain any facility or location organized or chartered in the District wherefrom or through which education is offered or given, or educational credentials are offered or granted, and includes contracting with any person, group, or entity to perform any such act. Nursing Programs are not authorized in the District of Columbia. RN non-credit refresher course may not be offered to District of Columbia residents. MSU has been granted Conditional Exemption to offer undergraduate offcampus short study courses and internships in the District of Columbia. FLORIDA experience components may not be The Florida Department of Education, Commission for Independent Education, does not require purely (100%) distance education programs to be authorized. Florida s laws require authorization for any institution operating in the state (defined as: By any means or device, facilitating in this state any part of a scheme to offer a degree, diploma or credit, or any activity connected with the administration, promotion, recruitment, placement, instruction, fee collection or receipt, or any other function of a purported independent postsecondary educational institution, other than periodic and customary contact with the institution s own alumni. Title XLVIII, Section (14). Nursing Programs are not authorized in the state of Florida. NOTE: Out-of-state faculty engaged in the supervision and teaching of Florida licensed nurses, regardless of the method, require a Florida nursing license as well. RN non-credit refresher course is permitted in Florida. GEORGIA 100% online programs may be As of June 10, 2013, the Georgia Non-Public Postsecondary Commission has determined Michigan State University is not required to obtain a certificate of authorization, as long as the MSU does not maintain a physical presence in the state of Georgia. An institution must obtain a certificate of authorization from the Nonpublic Postsecondary Education Commission if it engages in at least one of the following activities: 1. The institution maintains a telephone number with a Georgia area code; 2. The institution maintains a postal address with a Georgia zip code; 3. The institution markets and/or recruits Georgia students via any means of media which originates in Georgia; 4. The institution maintains an Internet URL which originates in Georgia or utilizes an ISP which is based in Georgia; or 5. The institution provides payment reportable for income tax purposes via either a W-2 or Form 1099 to any individual resident of the State for any purpose directly associated with the institution s Georgia students. Nursing Programs Available to Georgia Residents: RN non-credit refresher course is permitted in Georgia. As long as student and preceptor are appropriately licensed in Georgia, there is no need to seek approval.

5 HAWAII 100% online programs may be The Hawaii Post-Secondary Education Authorization Program does not require authorization for programs offered exclusively through online education. The Hawaii Post-Secondary Education Authorization Program defines physical presence as having a physical location in the state or having an administrative office in the state. Nursing Programs are not authorized in the state of Hawaii. RN non-credit refresher course is permitted in Hawaii. IDAHO 100% online programs may be The Idaho State Board of Education does not currently require any institution lacking a physical presence inside the state to register. As of July 1, 2011, only brick and mortar operations in Idaho qualify as physical presence. Nursing Programs Available to Idaho Residents: RN non-credit refresher course is permitted in Idaho. ILLINOIS 100% online programs may be As of August 29, 2013, the Illinois Board of Higher Education has granted continuous approval to MSU, as long as MSU does not maintain a physical location within the state of Illinois. Programs and courses offered in Illinois must not exceed the minimum physical presence criteria established by the Illinois Administrative Code, which includes the requirement that MSU present evidence that the institution will offer ten percent or less of coursework, as measured by academic credits, for a degree program in the State of Illinois, or evidence that the institution is offering degrees through one hundred percent asynchronous versus synchronous online instruction from an out-of-state site or sites. Nursing Programs Available to Illinois Residents: RN non-credit refresher course is permitted in Illinois. INDIANA 100% online programs may be As of May 20, 2014, the Indiana Commission for Higher Education has granted Michigan State University status as an out-of-state institution with no physical presence in Indiana authorized to enroll and offer online instruction or distance education to Indiana residents delivered from a campus in another state in accordance with Indiana Administrative Code IC until May 19, The Indiana Commission for Higher Education/Indiana Board for Proprietary Education considers any of the following activities to constitute a physical presence in the State of Indiana: On-going occupation of a physical location for instructional purposes; Maintenance of an administrative office to facilitate instruction; Short courses with more than 20 classroom hours, or equivalent thereof; A portion of a full-term course, more than two meetings and more than six clock hours that takes place in a setting where the instructor or students physically meet; or Experiential learning opportunities, such as a clinical, practicum, residency or internship that have more than 10 students from your institution physically and simultaneously present at a single field site. Nursing Programs Available to Indiana Residents: RN non-credit refresher course is permitted in Indiana. 6 IOWA State and Program Offerings Required State Authorization Physical Presence Triggers Contact MSU s State Authorization Coordinator for list of approved programs. The Iowa College of Student Aid Commission has approved MSU s authorization of certain programs through September 20, For a list of the programs approved for Iowa, please contact Because Iowa law requires registration with the Iowa College of Student Aid Commission for online programs, the physical presence component of online courses is not applicable here. REQUIRED DISCLAIMER Required in all Michigan State University Catalogs, Enrollment, and Marketing Materials: Michigan State University is registered with the Iowa College Student Aid Commission. None of Michigan State University s online distance education programs offered to Iowa students lead to licensure or endorsement in the State of Iowa. Iowa Code Section 261.9(1)(g) requires schools to maintain a special policy concerning institutional charges for members of the National Guard or reserve members of the U.S. Armed Forces, or the spouse of such a member if the member has a dependent child, when the service member or spouse must withdraw from the school because the service member has been called to active state or federal military duty or service. Michigan State University will work with any student affiliated with the U.S. Armed Forces, including member s of the National Guard, who is called to active duty (includes the spouse of a deployed service member in its definition of affiliation with the U.S. Armed Forces). Upon receipt of an official copy of military orders and based on what is in the best interest of the student, Michigan State University will permit a student to drop all or a portion of the student s courses with a full refund of tuition and fees, allow a student to complete courses early if feasible, or issue an incomplete grade and allow the student to complete coursework at a later time. Prior notification is required only if MSU will be compensating a third party to provide instruction to a student in the State of Iowa: A letter of intent must be submitted to MSU s State Authorization Coordinator by the student s program director or program coordinator 90 days prior to any field-based activity (internship, externship, practicum, away program, field experience, etc.) occurring in the state of Iowa. Prior notification is applicable to both undergraduate and graduate courses and programs. Please contact State Authorization Coordinator to obtain the necessary form. The Kansas Board of Regents has granted Michigan State University a certificate of approval to offer certain online distance programs in the state of Kansas, as long as MSU does not maintain physical location within the state of Kansas through December 19, For a list of the programs approved for Kansas, please contact MSU s State Authorization Coordinator. The Kentucky Council on Postsecondary Education has licensed Michigan State University to offer certain online distance education programs in the state of Kentucky, as long as there is no physical presence. For a list of the programs approved for Kentucky, please contact Physical presence in Kansas is determined by reviewing whether an institution has an actual brick and mortar location in Kansas, is conducting direct marketing to Kansas residents (e.g. radio, television, newspaper, magazine, direct mail, and/or telephone ads directed at Kansans), providing education to a number of Kansans who remain in Kansas while receiving such education, etc. Physical Presence Physical presence exists when instruction originates from or is delivered within the state of Kentucky utilizing mentors, proctors, teachers, trainers, counselors. Nursing Programs Available to Kansas Residents: RN non-credit refresher course is permitted in Kansas. MSU CON faculty are not required to have Kansas professional licensure if teaching online programs only. Education Programs - The following programs are not authorized in the state of Kentucky: Education (MA) Special Education (MA) Teaching and Curriculum (MA) Applied Behavior Analysis in Special Education (Graduate Certificate) Nursing Programs are not authorized in the state of Kentucky. RN non-credit refresher course may not be offered to Kentucky residents. LOUISIANA Programs with *field experience components may not be If you are considering offering an undergraduate away course in Louisiana, please contact MSU s State Authorization Coordinator. The Louisiana Board of Regents has licensed Michigan State University to operate and offer 100% online distance education programs in the state of Louisiana from April 22, 2015 to April 22, Physical Presence exists when a course is physically delivered in the state of Louisiana and/or requires a sitebased learning activity (e.g. clinical experience, internship, student teaching, practicum, field-based experience, etc.); any face-to-face contact with others; if students are observed, assisted and/or evaluated by supervisors, preceptors, coaches, teachers, principals, or any other individual in the state of Louisiana. Nursing Programs are not authorized in the state of Louisiana. RN non-credit refresher course may not be offered to Louisiana residents. REQUIRED DISCLAIMER Required in all Michigan State University Catalogs, Enrollment, and Marketing Materials: Michigan State University is currently licensed by the Board of Regents of the State of Louisiana. Licenses are renewed by the State Board of Regents every two years. Licensed institutions have met minimal operational standards set forth by the state, but licensure does not constitute accreditation, guarantee the transferability of credit, nor signify that programs are certifiable by any professional agency or organization. MAINE experience components may not be Maine Office of Higher Education does not require purely 100% online programs to be authorized. Physical presence means an owned, leased, rented or provided facility, within Maine, where education and/or training is provided to students for a fee. Physical presence also includes periodic visits to Maine-based students by the school s faculty/representatives and/or the activity of Maine residents who have been hired to serve as solicitors or agents on behalf of the school. Nursing Programs are not authorized in the state of Maine. RN non-credit refresher course may not be offered to Maine residents.

8 MARYLAND No MSU programs may be offered in Maryland. MSU is not authorized to offer online distance education programs in the state of Maryland. Not applicable. As of May 16, 2013, no new Maryland students will be allowed to enroll. Maryland students who were enrolled in distance education classes in July 2013 may be permitted to continue. Each situation will be evaluated on a case-by-case basis before allowing the student to enroll. If you are considering offering a noncredit certificate program in Maryland, contact MSU s State Authorization Coordinator. MASSACHUSETTS experience component may not be offered in Massachusetts. Purely (100%) distance education programs delivered wholly online and do not include a practicum, clinical, internship or any other onthe-ground experience, do not require approval by the Massachusetts Board of Higher Education. Out-of-state institutions seeking to enroll Massachusetts residents in online programs may fall under the purview of the Massachusetts Board of Higher Education if they require the following activities in Massachusetts as part of the curriculum: internships, externships, clinical residencies, mentorships, shadowing experience, student teaching experiences, etc. Nursing Programs are not authorized in the state of Massachusetts. RN non-credit refresher course is permitted in Massachusetts. MICHIGAN Michigan State University is a public university, operating in good standing, which is exempt from licensure or program approval by the State of Michigan Department of Licensing and Regulatory Affairs.

9 MINNESOTA Contact MSU s State Authorization Coordinator for list of approved programs. The Minnesota Office of Higher Education requires the authorization of 100% online programs. Michigan State University has received approval to offer certain online distance education programs in the state of Minnesota. Permitting a student to complete an internship, externship, field experience, or clinical practicum organized by the institution does constitute physical presence in the state of Minnesota. Nursing Programs are not authorized in the state of Minnesota. RN non-credit refresher course may not be offered to Minnesota residents. Note: MN nursing licensure required by MSU faculty. REQUIRED DISCLAIMER Required in all Michigan State University Catalogs, Enrollment, and Marketing Materials: Michigan State University is registered as a private institution with the Minnesota Office of Higher Education pursuant to sections 136A.61 to 136A.71. Registration is not an endorsement of the institution. Credits earned at the institution may not transfer to all other institutions. REQUIRED STUDENT NOTIFICATION: Minnesota students enrolling in any program shall be notified if graduates of the program in which they are enrolling qualify to sit for any licensure, licensure exam, third party certification, third party certification exam, or similar credential related to the program s field of study. This notice shall be clearly stated and given regardless of whether or not the license, certification, or other credential is required for entry into the student s chosen field of study or occupation. MISSISSIPPI 100% online programs may be The Mississippi Commission on College Accreditation does not regulate out-of-state institutions offering program exclusively online. Physical Presence - Currently, internships or externships do not trigger physical presence in the state of Mississippi. Nursing Programs Available to Mississippi Residents: RN non-credit refresher course is permitted in Mississippi. MISSOURI experience components may be Michigan State University has complied with Missouri state requirements to offer online distance education programs in the state of Missouri and is authorized to provide distance education to Missouri residents as well as student recruitment, advertising, and other related activities such as clinical and practicum experience through October 31, Physical Presence - 6 CSR Any person or location within the state of Missouri where, from, or through which an institution operates for the purpose of conducting an activity relating to postsecondary education. Location is defined to include any address, physical site, electronic device, or telephone number within or originating from within the boundaries of the state of Missouri. Physical presence shall also mean a formally scheduled instructional interaction organized by or through a school taking place between two (2) or more students and/or instructors within the state of Missouri. Nursing Programs Available to Missouri Residents: RN non-credit refresher course is permitted in Missouri.

Educational institutions offering exclusively online distance education courses or programs with no physical presence in the state of Nebraska are not required to seek authorization. Physical Presence Permitting a student to complete an internship, externship, practicum, field, or clinical experience organized by the institution does not constitute physical presence in the state of Montana. Physical presence does not include: An educational experience arranged for an individual student, such as a clinical, practicum, residency, or internship; or any of the following: Course offerings on a military installation solely for military personnel or civilians employed on such installation; Course offerings in the nature of a short course or seminar if instruction for the short course or seminar takes no more than 20 classroom hours; or Courses offered online or through the United States mail or similar delivery service which do not require the physical meeting of a student with instructional staff. Nursing Programs Available to Montana Residents: RN non-credit refresher course is permitted in Montana. Nursing Programs Available to Nebraska Residents: RN non-credit refresher course is permitted in Nebraska. NEVADA Nevada s Commission on Postsecondary Education does not require purely (100%) online programs to be authorized. Physical presence includes a student completing an internship, externship, field experience or clinical practicum organized by the institution or the student. Nursing Programs are not authorized in the state of Nevada. RN non-credit refresher course may not be offered to Nevada residents. experience components may not be NEW HAMPSHIRE New Hampshire Department of Education does not require purely (100%) distance education programs to be authorized. Physical presence means an actual physical location for instructional purposes, maintaining an administrative office including a mailing address or phone number, or face-to-face advising, mentoring, supervision, testing, or instruction taking place in New Hampshire. Nursing Programs are not authorized in the state of New Hampshire. RN non-credit refresher course may not be offered to New Hampshire residents. experience component may not be offered in New Hampshire.

11 NEW JERSEY 100% online programs may be experience component may be offered in New Jersey (see physical presence triggers). Out-of-State institutions (see N.J.A.C. 9A:1-5) that wish to offer credit-bearing distance learning with a physical presence in New Jersey must first be licensed by the Commission, with advice from the Presidents Council, to offer specific courses or degree programs. Physical presence means that an entity offers creditbearing courses from or conducts some portion of the learning experience at a location established in New Jersey by the entity, whether established directly or under the auspices of another entity or an institution. N.J.A.C. 9a: If a distance learning program requires a clinical or internship component for a certain degree, such a component will not meet the above-referenced definition of physical presence so long as the following two criteria are met: 1. The student-supervised relationship is conducted on a one-to-one basis (e.g. no group review sessions or other gatherings); and 2. The supervisor is not a permanent employee of the institution. Nursing Programs are not authorized in the state of New Jersey. RN non-credit refresher course may not be offered to New Jersey residents. Note: The use of an on-the-ground proctor does constitute physical presence in New Jersey. NEW MEXICO 100% online programs may be experience component may not be offered in New Mexico. New Mexico s Higher Education Department does not require registration of public out-ofstate institutions offering correspondence courses. Presence in the state is defined as offering courses, programs or degrees on site or from a geographical site in New Mexico or maintaining an administrative, corporate or other address in the state. Authorization is required for programs with an internship or clinical component having more than 10 students in the component at one time. Nursing Programs are not authorized in the state of New Mexico. RN non-credit refresher course is permitted in New Mexico.

12 NEW YORK experience components may be offered as long as they are not clinical in nature or involve professional licensure (e.g. education, nursing, social work, counseling psychology, allied health professions, etc.). The NYSDE Office of Higher Education does not require approval if the institution: Communicates electronically with students in New York State (e.g., by computer or broadcast) in ways that do NOT involve an instructional site or an organized group activity; Advertises in New York State media; Recruits students, e.g., at college fairs, job fairs, or trade shows; Conducts alumni activities in the State, such as alumni clubs. Physical Presence The New York State Board of Regents, through the State Education Department s Office of Higher Education, considers an institution to have a physical presence in New York State if it does one or more of the following things: Operates an instructional site (a physical site at which instruction is given by a faculty member to a group of students) in New York State. The fact that the instruction at that site is given through an electronic medium (e.g., satellite delivery, videotape) rather than through an instructor physically present in the room, does not change the fact that it is an instructional site. Sponsors organized activities within the State that are related to the academic program (e.g., advising, mentoring, study groups, examination administration). Has a representative, whether paid or not, acting on its behalf within the state to arrange or conduct instructional or academic support activities. This would include a commercial vendor acting on behalf of the institution, or a New York higher education institution providing services to students of the outof-state-institution. Places students in clinical internships related to certain licensed professions (e.g., nursing, mental health counseling, respiratory therapy, etc.), the practices of which are typically restricted to licensed persons or students enrolled in educational programs approved or registered by the Department. Nursing Programs are not authorized in the state of New York. RN non-credit refresher course is permitted in NYS. Section 224 of New York State Education Law and Section 3.56 of the Rules of the NYS Board of Regents states that, an out-of-state/foreign institution seeking to offer one or more programs in part or in whole in New York State must secure prior consent of the Board of Regents ( Permission to Operate ). Proposed full or partial programs are subject to New York State program registration standards according to the proposed scope and duration of operations in New York State. The Associate Provost for Academic Services is responsible for processing any applications for Permission to Operate. The annual application period to obtain Permission to Operate occurs from January 1 through February 1 of each year, and applications will only be accepted during this period. Note: Student teaching does not constitute physical presence and is permissible in NYS.

13 NORTH CAROLINA experience component may not be offered in North Carolina. The North Carolina Board of Governors does not require purely (100%) online programs to be authorized. An institution undertakes post-secondary degree activity in North Carolina when it commences the activity by: a. Use of employees or agents within North Carolina; or b. Transmission, presentation, or dissemination of information over or through electronic equipment that is located in North Carolina and owned, leased, rented, licensed, or otherwise reserved for use by the institution; or c. Use of real property or facilities that are located in North Carolina and owned, leased, rented, licensed, or otherwise reserved for use by the institution; or d. Agreement with a third party to transmit, present or disseminate information on behalf of the institution through any of the means described in a, b or c, above. Nursing Programs are not authorized in the state of North Carolina. RN non-credit refresher course may not be offered to North Carolina residents. An internship or externship may not constitute physical presence, but field experience, clinical practicum and student teaching organized by the institution or the student will be considered physical presence. OHIO 100% online programs may be OKLAHOMA Michigan State University has been granted approval by the Ohio Board of Regents to offer the following online distance education programs that contain an on-ground component: The Oklahoma State Regents for Higher Education does not require authorization for purely (100%) online distance education programs. Permitting a student to complete an internship, externship, practicum, field, or clinical experience organized by the institution does constitute physical presence in the state of Ohio. Individual program or course review and approval is required by the Ohio Board of Regents. Use of Ohio-based instructors, mentors and/or proctors is permitted, as long as they operate under the direct supervision of the program director. If instruction takes place in the state of Oklahoma, internships, externships, field experiences, or clinical practicums are considered physical presence. Criteria: MSU does not have and does not intend to have a physical presence in the State of Oregon, which can include a branchy campus, administrative office or use of an Oregon-based address; and MSU Does not conduct and does not intend to conduct local advertisement and recruitment in the state that would specifically target Oregon students, such as ads in local media, marketing of any kind or recruiting based in the State; and The degree programs offered by MSU do not include a component in which the student is required to complete an internship, externship, mentoring, practicum, clinical placement, etc., or any other onsite placement at a location in the State of Oregon. Nursing Programs are not authorized in the state of Oregon. RN non-credit refresher course may not be offered to Oregon residents. PENNSYLVANIA Contact MSU s State Authorization Coordinator for list of approved programs. The Bureau of Postsecondary and Adult Education of the Pennsylvania Department of Education has approved Michigan State University to offer online degree and certificate programs to students in the state of Pennsylvania, as long as MSU does not maintain a physical location within the state. Michigan State University has been approved to offer master s level programs and the onground components of the Biomedical Laboratory Operations, Master in Public Health, and Nursing programs. Because the Bureau of Postsecondary and Adult Education of the Pennsylvania Department of Education requires individual programmatic review, the physical presence component of online courses is not applicable here. Nursing Programs Available to Pennsylvania Residents: RN non-credit refresher course is permitted in Pennsylvania. RHODE ISLAND 100% online programs may be Rhode Island Board of Governors for Higher Education does not require purely (100%) distance education programs to be authorized. According to the Rhode Island Board of Governor s policy on distance learning, a physical presence would be established if the institution maintains or sends within the borders of Rhode Island employees or paid representatives whose purpose is to conduct any activities, including, but not limited to the following: recruitment of students, advising of students, offering courses or programs, administration of examinations. Therefore, if the internship, externship, field experience, or clinical practicum organized by the institution involves an employee or paid representative of the institution, that institution must seek approval to operate. Nursing Programs Available to Rhode Island Residents: RN non-credit refresher course is permitted in Rhode Island.

PRIOR NOTIFICATION - All Programs and Courses A letter of intent must be submitted to MSU s State Authorization Coordinator by the student s program director or program coordinator days prior to any field-based activity (internship, externship, practicum, away program, field experience, etc.) occurring in the state of Texas. Maintaining or advertising a Washington location, mailing address, telecommunications number or internet server for any purpose or any other function of a degree-granting institution, other than contact with the institution's former students for any legitimate purpose related to their having attended. Nursing Programs are not authorized in the state of Washington. RN non-credit refresher course may not be offered to Washington residents. Permitting a student to complete an internship, externship, practicum, field, or clinical experience does constitute physical presence in the state of Washington. WEST VIRGINIA experience component may not be offered in West Virginia. The West Virginia Higher Education Policy Commission does not require purely (100%) distance education programs to be authorized. Physical presence means an institution, wherever domiciled or having its principal place of business, employs in West Virginia any person or persons for the purpose of administering, coordinating, teaching, training, tutoring, counseling, advising, recruiting, or any other activity on behalf of the sponsoring organization. Such activity would include advertising, promotional material, or public solicitation in any form that targets West Virginia residents through distribution or advertising in the State. In addition, the institution has physical presence in West Virginia if it delivers, or plans to deliver, instruction in West Virginia, and receives assistance from any other organization within the state in delivering the instruction, such as, but not limited to, a cable television company or a television broadcast station that carries instruction sponsored by the institution. Nursing Programs are not authorized in the state of West Virginia. RN non-credit refresher course may not be offered to West Virginia residents. Permitting a student to complete an internship, externship, practicum, field, or clinical experience does constitute physical presence in the state of West Virginia.
