4 Enrolment Contract Overseas Students CRICOS No D To comply with the Overseas Student National Code 2007 and The Education Services for Overseas Students Act 2000, MLC School (CRICOS NO 02328D), as a CRICOS Provider, is required to enter into a Written Agreement with the guardian/student (if over 18) or the student s parents. This agreement must be signed by the student s parents or guardian as it formalises the student s enrolment at MLC School. TERMS and CONDITIONS OF ENROLMENT No student, under any circumstances, will be permitted to reside either alone or with other students Students from Pre-Kindergarten to Year 8 must live with their parents Students in Year 9 to Year 10 not living with their parents must have an appointed guardian who is over the age of 25 years and who will take guardianship responsibilities according to the MLC School Guardian Agreement may reside with a Department of Immigration and Border Protection (DIBP) approved relative (see application form for list of suitable relatives) who is over the age of 25 years may reside in an approved Home stay with a responsible adult who is over the age of 25 years. Where a student resides in Home stay. Home stay incurs an inspection fee at enrolment. MLC School reserves the right to inspect the accommodation to ensure it is in the best interests of the student Any change in accommodation and/or welfare arrangements must be reported to and approved of by the school BEFORE the change occurs. Change in Home stay accommodation will require an inspection of the new location and will incur an inspection fee billed to the tuition fees Guardian/parents must inform the school where and with whom the student will spend their vacation time Students must maintain a satisfactory attendance of at least 80%. Under Section 19 of the ESOS Act if attendance falls below 80% MLC is obliged to report this to DIBP Students must attend their first educational provider for six months before seeking an alternative provider The student must attend ESL Club in the school Independent Learning Centre at least one afternoon a week from pm if recommended by the Head of Year The student must have Private Health Cover for the duration of their enrolment at MLC School. This can be arranged by the school and is included in the table of fees below The student must maintain a satisfactory commitment to her studies The student must abide by the school s Code of Conduct and Uniform Code as outlined in the School Diary At the discretion of the Principal a student that is in serious breach of the rules or otherwise engaged in conduct that is prejudicial to MLC School or its students or staff may be excluded permanently or temporarily from the school. No refund of fees will be granted in these circumstances The School reserves the right to amend its academic and other programs at any time without notice to parents. This may include the discontinuance of teaching subjects and other programs As a condition of enrolment, and in addition to the above, the student agrees to abide by all School Policies and regulations for the duration of their enrolment. These policies can be found on the MLC School Community Website. 5 Enrolment Contract Overseas Students CRICOS No D REFUND POLICY MLC School s offer of a place is contingent upon payment of the $A225 application fee, the non refundable Enrolment fee of $A3400 and the non-refundable Overseas Student levy of $A2000 Tuition fees are payable one term in advance. Fees must be paid within 14 days of receipt of invoice otherwise an administration fee of $A75 will be charged A student will be prevented from commencing a new term if fees from the previous term remain unpaid, unless a satisfactory explanation is given and approved, in writing, by the Principal or the Head of Finance, Systems and Administration Tuition fees DO NOT include laptops, uniforms, textbooks, camps or excursions REFUNDS 1. The Application Fee, enrolment fee and overseas student levy are non-refundable. 2. The school will refund within 28 days all tuition fees paid where the student produces evidence that the application made by the student for a student visa has been rejected by the Australian Immigration authorities. 3. The school will refund within 28 days of the receipt of written notification of cancellation by the student (or parent (s)/legal guardian tuition fees paid by or on behalf of the student less the amounts to be retained as agreed and detailed below. 4. (a) If written notice is received up to four weeks prior to commencement of the course, the school will be entitled to retain an administration fee. (b) If written notice is received less than four weeks prior to commencement of the course 70% of one term s tuition fees will be refunded. (c) A term s notice to the Principal is required for a student to be withdrawn from the school once she has commenced. If such notification is not received by the school at the commencement of the term prior to the proposed date of exit one full term s fees will be due and payable. 5. You are required to make your request for a refund in writing, signed by you, to the Principal MLC School. 6. Where a student s enrolment is cancelled for any of the following reasons, a cancellation fee of 100% of the current term s fee is applicable. (a) Failure to maintain satisfactory course progress (visa condition 8202) (b) Failure to maintain satisfactory attendance (visa condition 8202) (c) Failure to maintain approved welfare and accommodation arrangements (visa condition 8532) (d) Failure to pay course fees (e) Any behaviour identified as resulting in enrolment cancellation for breach of the MLC School Code of Conduct 7. Any refund of tuition fees approved will be sent to the person with whom this written agreement has been entered. Refunds are not authorised in Australia unless authorised by parents. Refunds will be paid to the person who enters into the written agreement. 8. If a student becomes an Australian resident during the course of studies (ie. has a change of visa status), there will be no adjustment to the fees paid for the remainder of the calendar year. 9. Any default by the school will be covered by the provisions of the SOS Act 2000 and the ESOS regulations 2001 (as amended). These include: (f) If for any reason the school is unable to offer a course, a full refund of fees paid will be made within 14 days of notification of course cancellation. (g) If for any reason the school is unable to continue offering a course after commencement, a full refund of fees paid will be made within 14 days of notification of course cancellation. 10. This agreement and the availability of complaints and appeals processes, does not remove the right to take further action under Australia s consumer protection laws. Privacy Policy Information is collected on this form and during the enrolment of the student in order to meet our obligations under the Education Services For Overseas Students Act 2000 and the National Code 2007, to ensure student compliance with the conditions of their visas and their obligations under Australian Immigration laws generally. The authority to collect this information is contained in the Education Services For Overseas Students Act 2000, the Education Services For Overseas Students 2001 and the National Code of Practice for Registration Authorities and Providers of Education and Training to Overseas Students Information about you collected on this form and during your enrolment can be provided in certain circumstances to the Australia Government and designated authorities and, if relevant, the Tuition Assurance Scheme and the ESOS Assurance Fund manager. In other instances information collected on this form or during your enrolment can be disclosed without your consent where authorised or required by law. For more information please refer to the MLC School Privacy Policy. 3
6 Enrolment Agreement CRICOS No D Guardian Agreement CRICOS No D ENROLMENT AGREEMENT This agreement and the availability of complaints and appeals processes does not remove the right of the student to take action under Australia s consumer protection laws. Terms and Conditions of Enrolment I have completed the MLC School Application form and confirm I have received information from MLC School regarding conditions of enrolment which include: That the regulations and procedures are satisfactorily observed in all respects That the student attends all compulsory events as designated by the school That the student conforms to the disciplinary authority of the Principal and those to whom authority may be delegated That the student continue to make satisfactory progress with her studies That the school terms of payment of all tuition and other educational fees are observed I/We as parent(s) of the student as guardian acting on behalf of the parents of the student accept the conditions of enrolment set out on this form together with the Guardian Agreement if applicable. As a guardian of an MLC School Overseas Student you must fulfil all requirements set out below. Be at least 25 years of age Be an Australian citizen/permanent Resident or holder of a current Guardian Visa and show evidence of this Speak and understand English Be readily available to discuss matters of concern with both the school and parents Reside permanently in Australia and inform the school if travelling overseas or interstate Attend school functions and events that concern the student ie. Parent/Teacher Interviews, Speech Day/Night Ensure that the student attends the full academic year which includes the first and last day of each term and special events Communicate information to the student s parents Show interest in and monitor the academic progress of the student Notify the school of student absences Inform the school of any change to address or contact details Immediately notify the school, in writing, should for any reason the guardianship role be terminated At all times encourage the student to participate fully in school activities and to satisfy all school requirements Certify that you are not related in any way to any agent who has referred this student to MLC School I, Student Name Signed Date of ADDRESS accept the responsibility as guardian for Student'S FULL NAME Parent/Guardian Name Signed Date I have read, understood and agreed to the MLC School requirements for guardians as outlined above.
