1 TERMS AND CONDITIONS CIMB Spend & Be Rewarded Program Every mention of CIMB refers to CIMB Bank Berhad (13491-P). The Campaign Period 2. The CIMB Spend & Be Rewarded Program 2015 ( this Campaign ) shall run from 15 April 2015 to 30 June 2015, both dates inclusive ( Campaign Period ). 3. CIMB reserves the right upon giving adequate prior notice to change the duration and/or the commencement and/or expiry dates of the Campaign Period. Eligibility 4. This Campaign is open to all CIMB and Direct Access principal credit cardholders that hold credit card(s) issued by CIMB in Malaysia and who receive a short message service ( SMS ) from CIMB about this Campaign as an invitation to participate in this Campaign, EXCEPT for the following categories of persons: i) Permanent and/or temporary staff or employees of CIMB (including its subsidiaries and related companies) and their immediate family members (i.e. spouses, children, parents, brothers and sisters); and/or ii) Representative and/or agents (including advertising and promotion agents) of CIMB, VISA Worldwide Pte. Limited, a company registered in Singapore, having its office at 30, Raffles Place, #10-00, Chevron House, Singapore ( VISA ) and MasterCard Worldwide, a company organized under the State of Delaware, having its office and principal place of business at 2000 Purchase Street, Purchase, New York, NY , United States of America ( MasterCard ) (including their respective subsidiaries and related companies); and/or iii) Sole-proprietorships, Partnerships, Charitable/Non-profit Organizations/Societies, Corporate and Commercial Customers (hereinafter collectively referred to as the Eligible Cardholder ). Campaign Mechanics and Conditions 5. In the SMS from CIMB, Eligible Cardholders will be informed, amongst others, of: i) the minimum spending requirement on their CIMB credit card during the Campaign Period to be eligible for the cash rebate ( Cash Rebate ); ii) the exact Cash Rebate that the Eligible Cardholder can receive if the minimum spending requirement is met during the Qualifying Period; iii) the Campaign Period; and iv) where the terms and conditions can be obtained by the Eligible Cardholder. 6. Eligible Transactions for this Campaign will be the retail spending charged to any of the Eligible Cardholder s CIMB credit cards. 1

2 Retail spending shall mean purchase transactions for goods and services incurred for personal consumption and not for business purposes and shall not include betting or gaming transactions. For the avoidance of doubt the following transactions are also herein expressly excluded and shall not be treated as eligible retail transactions or retail spending:- (i) (ii) (iii) (iv) (v) (vi) Transactions made on CIMB Platinum BusinessCard; Transactions made on CIMB Partner Card; Quasi Cash transactions (example: betting and/or gaming transactions); Monthly instalments under any instalment payment facility provided by CIMB or any other banks; Payment of annual fees or service charges, delivery charges, cash payments, card replacement fee, government service tax, dispute charges, fraud charges or any other fees, charges or penalties whether imposed by CIMB or otherwise; and Cash advance/withdrawal/deposit transactions. Any determination by CIMB as to what constitutes retail spending shall be conclusive and shall not be challenged in any manner whatsoever. 7. Eligible Transactions are calculated based on the total consolidated (principal and supplementary/ies) credit cardholders spending. If the Eligible Cardholder has multiple CIMB credit card accounts, the Eligible Transactions made on all CIMB credit card by the principal credit card cardholder and his/her supplementary/ie(s) credit card cardholder(s) will be consolidated and will not be viewed individually to meet the respective Eligible Transactions within the Campaign Period. A l l t r a n s a c t i o n s o n a n y o f t h o s e C I M B c r e d i t c a r d s w i l l b e c o n s o l i d a t e d a n d n o t v i e w e d i n d i v i d u a l l y t o m e e t t h e r e s p e c t i v e s p e n d i n g o f t h i s C a m p a i g n. 8. The tracking of the Eligible Transactions is based on the transaction date (Malaysian Time). 9. Eligible Cardholders that fulfil the Campaign requirements can enjoy Cash Rebate stated in the respective SMS during the Campaign Period. 10. To participate in this Campaign, the Eligible Cardholder must meet the minimum spending requirement as specified in the SMS for Eligible Transactions during the Campaign Period and follow the Campaign mechanics to qualify for the Cash Rebate. 11. All Eligible Transactions by the Eligible Cardholder performed on any and/or all of the Eligible Cardholder s CIMB credit cards and transactions by his/her supplementary credit card cardholders during the Campaign Period shall automatically be tracked for the purpose of meeting the requirement in 5(i) above. 2

3 Selection Criteria of this Campaign 12. Only the principal Eligible Cardholder is eligible to the Cash Rebate under this Campaign. 13. At the time of the receipt of the Cash Rebate(s) by the Eligible Cardholders, the principal CIMB credit card account(s) of the Eligible Cardholders MUST NOT be delinquent, and/or be invalid or cancelled within CIMB s definition, otherwise the Eligible Cardholder will be disqualified from participating or from receiving the Cash Rebate(s). 14. The Cash Rebate will be credited into the principal Eligible Cardholder s CIMB credit card account within six (6) to eight (8) weeks from the end of the Campaign Period stated in the SMS. The Cash Rebate will be credited to the Eligible Cardholder s highest type of principal CIMB credit card account. 15. The Eligible Cardholder who is entitled to receive the Cash Rebate(s) will receive a notification via SMS from CIMB that the Cash Rebate(s) has been credited to his/her respective CIMB credit card account. The Cash Rebate(s) amount will also be reflected in the Eligible Cardholder s subsequent month s credit card statement after the crediting of the Cash Rebate. General Terms and Conditions 16. CIMB reserves the right to suspend, cancel, terminate or withdraw this Campaign in whole or part, by giving the Eligible Cardholders adequate prior notice. For the avoidance of doubt, suspension, cancellation, termination or withdrawal of this Campaign shall not entitle the Eligible Cardholders or his/her supplementary/ie(s) credit cardholders to any claim or compensation against CIMB for any losses or damages suffered by the Eligible Cardholders or his/her supplementary/ie(s) credit cardholders as a direct or indirect result of the act of suspension, cancellation or termination. 17. CIMB reserves the right upon giving adequate notice to vary (whether by addition, deletion, modification, amendment, or otherwise howsoever) ( the Amendment ) any of the terms and conditions herein. Notification to the Eligible Cardholders in respect of the Amendment shall be effected at CIMB s absolute discretion through any one of the following means of communication, namely, by ordinary mail to the Eligible Cardholders last known address or by posting a notice regarding the Amendment at each of CIMB s branches or by effecting an advertisement regarding the Amendment in one newspaper of CIMB s choice, or via CIMB s website and the Amendment shall be deemed as binding as from the date of notification of the Amendment or from such date as may be specified by CIMB in the notification. 18. CIMB shall not be liable to any party, including the Eligible Cardholder and his/her supplementary/ie(s) credit cardholders, for any loss or damage of whatsoever nature suffered by the Eligible Cardholder or any party (including but not limited to any injury or death, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party) arising, in relation to the participation or non-participation in the Campaign including arising 3

4 from any non-receipt or delayed receipt by the selected Eligible Cardholder of the SMS notification. 19. These Terms and Conditions shall be read in conjunction with the prevailing cardholders Terms and Conditions and shall prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional materials advertising the Campaign. 5 Terma-terma dan Syarat-syarat CIMB Spend & Be Rewarded Program Setiap sebutan CIMB merujuk kepada CIMB Bank Berhad (13491-P). Tempoh Kempen 2. Kempen CIMB Spend & Be Rewarded Program 2015 ( Kempen ini ) akan bermula dari 15 April 2015 ke 30 June 2015, termasuk kedua-dua tarikh ( Tempoh Kempen ). 3. CIMB menyimpan haknya apabila memberikan notis yang mencukupi terlebih dahulu untuk menukar tempoh dan/atau permulaan dan/atau tarikh tamat Tempoh Kempen. Kelayakan 4. Kempen ini adalah terbuka kepada semua pemegang kad kredit prinsipal CIMB dan Direct Access yang memegang kad-kad yang dikeluarkan oleh CIMB di Malaysia dan menerima satu servis mesej singkat ( SMS ) dari CIMB berkenaan Kempen ini sebagai jemputan untuk menyertai Kempen ini. KECUALI kategori orang yang berikut: i) Kakitangan atau pekerja-pekerja tetap dan/atau sambilan CIMB (termasuk subsidiarinya dan syarikat-syarikat berkenaan) dan ahli-ahli keluarga terdekat mereka (iaitu pasangan, anak, ibubapa, abang dan kakak); dan/atau ii) iii) Wakil dan/atau agen-agen (termasuk agen-agen pengiklanan dan promosi) CIMB, VISA Worldwide Pte. Limited, sebuah syarikat yang didaftarkan di Singapura, dengan alamat di 30, Raffles Place, #10-00, Chevron House, Singapore ( Visa ) dan MasterCard Worldwide, sebuah syarikat diperbadankan di bawah Negeri Delaware dengan alamat dan tempat perniagaan utama di 2000 Purchase Street, Purchase, New York, NY , United States of America ( MasterCard ) (termasuk subsidiari mereka dan syarikat berkenaan masing-masing); dan/atau Pemilik tunggal, Perkongsian, Kebajikan/Organisasi Bukan Keuntungan/Persatuan, Pelanggan Korporat dan Komersil (selepas daripada ini secara kolektif merujuk sebagai Pemegang Kad Yang Layak ). Syarat-syarat dan Mekanik Kempen 5. Dalam SMS daripada CIMB, Pemegang Kad Yang Layak akan dimaklumkan, antara lain: i) keperluan perbelanjaan minimum pada kad kredit CIMB semasa Tempoh Kempen untuk layak kepada rebat tunai ( Rebat Tunai ); ii) Rebat Tunai yang tepat yang Pemegang Kad Yang Layak boleh menerima sekiranya keperluan perbelanjaan minimum dipenuhi semasa Tempoh Kempen; 5

6 iii) iv) Tempoh Kempen; dan di mana terma-terma dan syarat-syarat boleh diperolehi oleh Pemegang Kad Yang Layak. 6. Transaksi Layak untuk Kempen ini adalah perbelanjaan runcit yang dicajkan ke mana-mana kad kredit CIMB Pemegang Kad Yang Layak. Perbelanjaan runcit bermakna transaksi pembelian untuk barangan dan servis tertanggung untuk penggunaan peribadi dan bukan untuk perniagaan dan tidak termasuk transaksi pertaruhan atau perjudian. Bagi mengelakkan was-was, transaksi-transaksi berikut adalah secara ekspres dikecualikan dan tidak akan dianggap sebagai transaksi perbelanjaan yang layak atau transaksi runcit:- (i) (ii) (iii) (iv) (v) (vi) Transaksi yang dibuat pada Kad Perniagaan CIMB Platinum; Transaksi yang dibuat pada Kad Perkongsian CIMB; Transaksi Tunai Kuasi (contohnya: transaksi pertaruhan dan/atau perjudian); Ansuran bulanan di bawah kemudahan pembayaran ansuran yang disediakan oleh CIMB atau mana-mana bank lain; Pembayaran yuran tahunan atau caj perkhidmatan, caj penghantaran, pembayaran tunai, fi penggantian kad, cukai perkhidmatan kerajaan, caj pertikaian, caj fraud atau yuran-yuran, caj-caj atau penalti-penalti yang lain samada dikenakan oleh CIMB atau sebaliknya; dan Transaksi pendahuluan/pengeluaran/deposit tunai; Apa-apa penentuan oleh CIMB sebagai apa transaksi perbelanjaan runcit adalah konklusif dan tidak boleh dicabar dalam mana-mana cara sekalipun. 7. Transaksi Layak adalah dikira berdasarkan kepada jumlah penyatuan (prinsipal dan tambahan) perbelanjaan pemegang kad kredit. Sekiranya Pemegang Kad Yang Layak mempunyai pelbagai akaun kad kredit CIMB, Transaksi Layak yang dibuat pada semua kad kredit oleh pemegang kad kredit prinsipal dan pemegang kad kredit tambahan akan disatukan dan tidak akan dilihat secara individu untuk memenuhi Transaksi Layak dalam Tempoh Kempen. S e m u a t r a n s a k s i p a d a m a n a - m a n a k a d k r e d i t C I M B a k a n d i s a t u k a n d a n t i d a k a k a n d i l i h a t s e c a r a i n d i v i d u u n t u k m e m e n u h i p e r b e l a n j a a n m a s i n g - m a s i n g K e m p e n i n i. 8. Pengesanan Transaksi Layak adalah berdasarkan pada tarikh transaksi (Waktu Malaysia). 9. Pemegang Kad Yang Layak yang memenuhi keperluan Kempen boleh menikmati Rebat Tunai yang dinyatakan dalam SMS masing-masing semasa Tempoh Kempen. 10. Untuk menyertai Kempen ini, Pemegang Kad Yang Layak mesti memenuhi keperluan perbelanjaan minimum sebagaimana yang dinyatakan dalam SMS bagi Transaksi Layak semasa Tempoh Kempen dan mengikuti mekanik Kempen untuk layak kepada Rebat Tunai. 6

Semua Transaksi Layak oleh Pemegang Kad Yang Layak yang dilaksanakan di atas mana-mana dan/atau semua kad kredit CIMB Pemegang Kad Yang Layak dan transaksi oleh pemegang kad kredit tambahan semasa Tempoh Kempen akan secara automatik dikesan untuk tujuan memenuhi keperluan dalam 5 (i) di atas. Kriteria Pemilihan Kempen ini 12. Hanya Pemegang Kad Yang Layak prinsipal yang layak kepada Rebat Tunai di bawah Kempen ini. 13. Pada masa penerimaan Rebat Tunai oleh Pemegang Kad Yang Layak, akaun prinsipal kad kredit CIMB Pemegang Kad Yang Layak MESTI TIDAK bermasalah dan/atau tidak sah atau dibatalkan dalam definisi CIMB, sekiranya tidak, Pemegang Kad Yang Layak akan dibatalkan dari menyertai atau menerima Rebat Tunai. 14. Rebat Tunai akan dikreditkan ke akaun prinsipal kad kredit CIMB Pemegang Kad Yang Layak dalam tempoh enam (6) hingga lapan (8) minggu selepas pengakhiran Tempoh Kempen yang dinyatakan dalam SMS. Rebat Tunai akan dikreditkan ke akaun prinsipal kad kredit CIMB jenis tertinggi Pemegang Kad Yang Layak. 15. Pemegang Kad Yang Layak yang berhak menerima Rebat Tunai akan menerima notifikasi melalui SMS dari CIMB bahawa Rebat Tunai telah dikreditkan ke akaun kad kredit CIMB masing-masing. Amaun Rebat Tunai akan ditunjukkan dalam penyata kad kredit Pemegang Kad Yang Layak pada bulanan berikutnya selepas pengkreditan Rebat Tunai. Terma-terma dan Syarat-syarat umum 16. CIMB menyimpan haknya untuk menggantungkan, menghentikan, membatalkan atau menarik balik kesemua atau sebahagian dari Kempen ini dengan memberikan notis yang mencukupi terlebih dahulu kepada Pemegang Kad Yang Layak. Bagi mengelakkan keraguan, penggantungan, pemberhentian, pembatalan atau penarikan balik Kempen ini tidak melayakkan mana-mana Pemegang Kad Yang Layak atau pemegang kad kredit tambahan untuk sebarang tuntutan atau pampasan terhadap CIMB untuk apa-apa kerugian atau kerosakkan yang dialami oleh Pemegang Kad Yang Layak atau pemegang kad kredit tambahan secara langsung atau tidak langsung akibat daripada penggantungan, pemberhentian atau pembatalan. 17. CIMB menyimpan haknya apabila memberikan notis yang mencukupi untuk mengubah (samada penambahan, pemotongan, modifikasi, pindaan atau walau apa jua sebaliknya) ( Pindaan ) mana-mana terma dan syarat di dalam ini. Notifikasi kepada Pemegang Kad Yang Layak berkenaan Pindaan boleh dibuat oleh CIMB atas budi bicara mutlak melalui salah satu cara komunikasi berikut, di antaranya, melalui mel biasa kepada alamat terakhir yang diketahui Pemegang Kad Yang Layak atau dengan mengeposkan notis berkenaan Pindaan pada setiap cawangan CIMB atau dengan mengiklankan di satu suratkhabar pilihan CIMB atau melalui laman web CIMB dan Pindaan tersebut adalah dianggap sebagai mengikat pada tarikh notifikasi Pindaan atau dari tarikh yang boleh dispesifikasikan oleh CIMB di dalam notifikasi. 7

CIMB tidak akan bertanggungjawab kepada mana-mana pihak, termasuk Pemegang Kad Yang Layak dan pemegang kad kredit tambahan, untuk apa-apa kehilangan atau kerosakkan dalam apa jua yang dialami oleh Pemegang Kad Yang Layak atau manamana pihak (termasuk tetapi tidak terhad kepada mana-mana kecederaan atau kematian, kehilangan pendapatan, keuntungan atau nama baik, langsung atau tidak langsung, sampingan, akibat, teladan, punitif atau ganti rugi khas mana-mana pihak) yang tertimbul berkenaan dengan penyertaan atau bukan penyertaan di dalam Kempen ini termasuk tiada penerimaan atau penerimaan lambat notifikasi SMS oleh Pemegang Kad Yang Layak yang terpilih. 19. Terma-terma dan Syarat-syarat ini akan dibaca bersama-sama dengan Terma-terma dan Syarat-syarat semasa pemegang kad dan akan mengatasi apa-apa ketidaksejajaran terma-terma, syarat-syarat, peruntukan-peruntukan atau representasi-representasi di dalam mana-mana bahan promosi yang mengiklankan Kempen ini.
