2 Outside Group Meeting Attendance Records: Welcome to Drug Court This handbook is designed to answer questions, address concerns, and proved information about Drug Court. The main focus of the Drug court is to assist you, the participant, in improving your life and health by becoming free and clean of substance abuse. As a participant, you will be expected to comply with instructions given to you by the Judge and follow the treatment plan developed for you by your treatment team. This program is based upon the belief that addiction is a chronic and potentially fatal disease creating one of the most serious health and legal problems in the United States. The drug court team is committed to assisting you create a better and more stable life. The team will help assist you in finding employment, education and housing. Again, we welcome you! 3 Outside Group Meeting Attendance Records: 10 Program Outline The Kansas City Municipal Drug Court is an intensive courtsupervised comprehensive treatment program for persons who are charged in the Kansas City, Missouri Municipal Court who exhibit signs of a chronic and severe substance abuse problem. Admission to the program is a completely voluntary choice. You must plead guilty or have previously been found guilty and must accept a 180 day sentence at the Municipal Correctional Institution. After your acceptance to the program, you will be screened at MCI on the following Wednesday for inpatient treatment. If you are found appropriate for inpatient treatment, you will be transferred to a inpatient treatment facility for days. If you are found inappropriate for treatment, you will be brought back to court for appropriate action. Following the inpatient treatment, you will be brought back to court where the Judge will suspend the remainder of your 180 day sentence and you will be placed on probation for two (2) years. During the two years of probation, you will be supervised by the Drug Court Coordinator until completion of outpatient treatment. You will also be required to attend a minimum of one (1) outside group meeting per week, attend court as required by the team, follow all outpatient treatment, and any other directives from the Drug Court Coordinator, treatment counselor or the Drug Court Judge. 3
4 Court Dates: Drug Court Team Roles The Drug Court Team is comprised of the Judge, Prosecutor, Legal-Aid Attorney, and Drug Court Coordinator. The team meets every Thursday prior to court. During this meeting, the team discusses the progress of each participant including, drug testing results, attendance, participation and cooperation, employment, housing and other issues that may arise. Sanction and incentive decisions are made to respond to behavior since the last meeting. Each member of the team provides an important role in the treatment. Each member also has an important specific role to play ensuring the success of the program. Judge: The Drug Court Judge will preside over all Drug Court hearings and applies legal sanctions and incentives as appropriate. The Judge is committed to the program mission and goals, working as a lead partner to ensure its success. In the courtroom, the Judge will develop a personal, working relationship with you while monitoring your progress. Prosecutor: The Prosecutor reviews all of the cases to determine the legal eligibility into the Drug Court program. The Prosecutor attends weekly status review meetings to determine if the offender should be allowed to enter the program, appropriate sanctions/incentives for current participants, as well as, be present at Drug Court hearings. 4 9
5 Drug Court Rules: I understand that this program is completely voluntary. I will not violate the law. I will not use alcohol in any form. I will not use any drugs, legal or illegal. Before using any prescription or over-the-counter medications, I will get permission from my counselor. I agree to give random breath, blood, urine, hair or sweat samples for drug testing as requested. I understand that substituting, altering, or trying in any way to change my body fluids for purposes of testing will be grounds for sanctions. I will not leave inpatient treatment without staff authorization. I will be issued a general ordinance summons (GOS) for escaping custody. This new charge could carry an additional 180 day sentence at MCI. Stephanie can you describe what happens at MCI if they leave treatment when they come back I understand that I may not work as a confidential informant with any law enforcement agency while I am a Drug Court participant. I understand that I will not disclose or re-disclose any information about any other participant. I will attend a minimum of one (1) outside group per week. I will attend all outpatient groups and meetings as required by my counselor. I will attend all court dates as Ordered by the Judge. I will seek employment, job training and/or further education as requested by the Drug Court Team. I will seek stable, safe housing as requested by the Drug Court Team. I will follow all other program rules of which I am informed by the treatment providers or the Drug Court Team. 8 Legal Aid: The Legal Aid attorney advises the eligible defendant as to the nature and purpose of the drug court, the rules governing participation, the consequences of abiding or failing to abide by the rules and how participating or not participating in the drug court will affect the interest of the defendant. The Legal Aid attorney further explains all the rights that you temporarily or permanently relinquish and gives advice on alternative courses of action discussing the long-term benefits of sobriety and a drug-free life. Drug Court Coordinator: The coordinator is responsible for overall administrative coordination, management and supervision of drug court functions and processes. The coordinator, in cooperation with treatment providers, will provide case management of all drug court participants, and will gather and distribute weekly progress information to all drug court team members at weekly staffings. The coordinator will help explain drug court program to interested offenders at MCI. The coordinator will also act as a resource for participants in finding housing, employment, obtaining birth certificates, identification, etc. 5
6 Drug Court Phases Assessment Phase: Get sentenced to 180 days at MCI by Municipal Court Judge Sign contract and release of information 1 hour Intake Assessment with Drug Court Coordinator at MCI Case Management Appointment Treatment Team Staffing Wait at MCI for treatment bed to become available Level I: Go to assigned treatment facility for day Inpatient Substance Abuse Treatment Court Appearance the Thursday before you are to complete treatment or on Thursday if that is the day you leave Completion of Active Phase I Certificate Levels II and III: Enter Outpatient Treatment-Level II Attend all outpatient groups and individual appointments Attend all Appointments with Case Manager or Drug Court Coordinator, and other referral appointments Attend Drug Court on Thursdays at 1:30 p.m. in Courtroom G as Ordered Attend a minimum of one (1) outside group per week Receive incentives and sanctions as appropriate Completion: Final court appearance with Judge Locascio Completion of Active Phase II Certificate Congratulations!! 6 Consequences of Behavior Critical to the success of your participation are prompt incentives that encourage and reward your compliance requirements and progress in recovery and prompt sanctions that discourage and interrupt your non-compliance and failure. The team will determine in weekly staffings, from all information available to or obtained, what are appropriate incentives or sanctions based upon consideration of the nature and degree of your compliance or noncompliance, the status of your recovery, your history of compliance and recovery and what will most reasonably and effectively promote your recovery and success in completing drug court requirements. Possible Incentives: Recognition by Judge and team Certificates of completion Bus passes Birth certificate/state identification Gift cards Decreased court appearances Clean and sober life Possible Sanctions: Return to jail to complete 180 day sentence Loss of good time/work parole at MCI A charge of Escape if you leave inpatient treatment Increased court dates Additional number of outside group meetings Community service Repeat a phase of treatment Termination from program 7
