The TGO Board Representatives (1) Government (5 representatives) Review and Monitoring office Ministry of Natural Resources and Environment (Permanent Secretary) Office of Natural Resources and Environmental Policy and Planning Department of Alternative Energy Development and Efficiency Office of Transportation and Traffic Policy and Planning Thailand Greenhouse Gas Management Organization (2) Private sector experts (5 Representatives) energy expert business administrative expert forestry expert industrial expert technology expert

7 Approval Procedure for CDM-PoAs in Thailand Re submit 1. Submit application documents to TGO 1. C/ME submits application documents to TGO as follows C/ME Incomplete 2. Initial Screening (20 working days) Complete Consideration by Sub-committee of TGO Board Concerned agencies* Recommendation Max. 180 days (1) Request form for C/ME approval and relating evidences of Juristic person and experts (2) PoA-DD (3) CPA-DD of Initial CPAs (4) PoA report (consisting PoA description and the environmental & sustainable development framework) (5) IEE-SD Report of Initial CPA or EIA Report (If required by Environmental Law) (6) CDs Not Approved Approval by TGO Board Approved Issuance of Letter of Approval 2. Review and Monitoring office of TGO checks the completeness of the application documents within 20 working days 3.1 TGO send documents to relevant agencies. At this stage, the relevant agencies are requested to assess the project eligibility. Note : * Concerned agencies such as - Department of Industrial Works, Ministry of Industry - Department of Alternative Energy Development and Efficiency, Ministry of Energy - Department of Livestock Development, Ministry of Agriculture and Cooperatives. 3.2 Sub-committee of TGO Board considers the C/ME qualification and the proposed program based on SD criteria.

Initial Screening (20 working days) 3.2 Consideration by Sub-committee of TGO Board Complete Approval by TGO Board Approved Issuance of Letter of Approval 3.1 Concerned agencies* Recommendation Max. 180 days TGO board makes the final decision to approve or reject the program. LoA signed by the Permanent Secretary of the Ministry of Natural Resources and Environment sends to C/ME.

CPA Monitoring Plan 6. Plan for Coordinating with TGO 7. Qualification and function of C/ME 5. IEE-SD Report of the initial CPA according to TGO guideline/ EIA (if required by environmental law) 1. Introduction 2.Project Description 3.Existing environment 4.Initial environmental impact evaluation and sustainable potential 5.Mitigation measures to prevent environmental impact
10 Approval Criteria for Issuing LoA for CDM-PoAs Qualification of juristic person apply to C/ME Sustainability and Environmental impact of PoA and Initial CPAs
11 Qualifications of the Coordinating/Managing Entity (C/ME) 1. Juristic Person Type (1) Governmental Agency/University/Agency under Supervision of the Government or (2) Thai Juristic Person established under Thailand s Law or (3) Foreign Juristic Person established under Thailand s Law (must obtain a license/certificate to operate business from the Department of Foreign Business Development, Ministry of Commerce, Thailand) or (4)Foreign Juristic Person established under Foreign s Law which its branch located in Thailand (must have the branches office located in Thailand and obtain a license/certificate to operate business from the Department of Foreign Development, Ministry of Commerce, Thailand)
12 Qualifications of the Coordinating/Managing Entity (C/ME) 2. There are at least 2 experts in C/ME and the experts must have at least 3 years related experiences. 3. Both entity and experts have related experience in 4 areas including (1) Development of CDM projects (2) Coordinating and managing the projects under the program/group of projects (3) Providing trainings on CDM projects (4) Having experience in operating the same type of the proposed project (Ex: Experience in Biogas is required to be C/ME for Biogas Project )
13 Sustainability and Environmental impact of CDM-PoAs PoA Report Environmental & Sustainable Development Framework (E&SD-Framework) proposed by C/ME Eligibility criteria Environmental Preventive & Mitigation Measures based on SD criteria Approval Criteria The Completion, Suitability and Sufficiency of the environmental measures proposed by C/ME in the E&SD-Framework IEE-SD Report of Initial CPA/ EIA Initial CPAs All Project Activities under Initial CPAs (Sustainable Development criteria : SD criteria) 4 Categories 24 Indicators Evaluation by TGO (Scoring) -1 Negative impact to the area 0 No impact to the area, or equivalent to the baseline scenario +1,+2 Positive Effect on the area, or shows contribution to the surrounding area of the project Approval Criteria - Approved E&SD-Framework will be used as the guideline for implementation of the next CPA. All projects activities under Initial CPA meet SD-criteria Total Score is positive and Score of each category is positive

15 Sustainable Development Criteria Scoring -1 indicates Negative impact to the area 0 indicates No impact / equivalent to the baseline scenario +1, +2 indicates Positive impact to the area, or shows contribution to the surrounding area of the project The proposed CDM project will be evaluated that it contributes to sustainable development in Thailand only if the score of each category and the total score is positive.

23 Issues & potential Solution 1. For the cross border-poa which the initial CPA is not located in Thailand, the information in PoA-DD and initial CPA DD located in other host country is not sufficient to evaluate the environmental impact and sustainability of PoA in Thailand. - It may be required to submit the Environmental and Sustainable Development Framework of the PoA and/or have the initial CPA in the host country. 2. In the case of PoA covering with many technologies but submitting only one technology for the initial CPA (for example, PoA is the renewable energy program consisting with solar power, hydro power, biomass power, biogas power etc., and C/ME submits the solar power as the first CPA. It is very difficult to evaluate the environmental impact and sustainability of the PoA and first CPA. - To ensure sustainability of the PoA and give DNA more confidence to issue LoA, Thai DNA determines that C/ME must propose the E&SD Framework of every technologies for consideration. - To facilitate the approval process, Thai DNA is now in the process to develop the examples of E&SD Framework for the biogas, biomass, solar power, hydro power projects.
24 Issues & potential Solution 3. The revocation of the C/ME in case the C/ME makes up the information or discontinues the PoA. - Thai DNA keeps the right to revoke the permission of C/ME or change the C/ME for that registered PoA, respectively.
