1 Request for Proposals Removal of Underground Diesel Tank Proposals Due: prior to 1:00pm on May 27, 2015 Section 1: General Information A. requests proposals for the removal of a 15,000 gallon underground diesel storage tank and associated lines at the main campus in Salisbury, MD. The award will be made to the most responsive and responsible bidder. B. This solicitation implies no obligation on the part of the College. reserves the right to accept or reject any and all proposals in whole or in part, or to waive any technicality it deems in the best interests of the College. C. Point of Contact a. The sole point of contact for this IFB is the Director of Purchasing and Auxiliary Services. Only information communicated by the Director of Purchasing and Auxiliary Services shall be deemed the official position of the College. Allison Canada phone: fax: acanada@worwic.edu b. Should any bidder be in doubt as to the meaning of the scope of work, or should any discrepancy or omission be found, he/she shall notify Allison Canada in writing, by . All bidders will be notified in writing by means of addenda of any responses to Requests for Information. The College will not be responsible for any oral or telephone explanations of contract documents. c. It is the Bidder s sole responsibility to ensure receipt of all Addenda. It is highly recommended that the Bidder check the College s website for all posted Addenda prior to submitting their bid. All Addenda shall become part of the contract documents. D. Pre-Proposal Meeting and Tour a. A pre-proposal meeting and tour will be held at 1:00pm on May 20, 2015 in the Hazel Center, room 216. This meeting is not mandatory, however all bidders are strongly encouraged to attend. A campus map is available at b. No allowances shall be made to the successful contractor at a later date for additional work required because of his/her failure to inspect the site. Proposals Due: prior to 1:00pm. 2 E. Due Date a. Sealed proposals must be received prior to 1:00pm on May 27, 2015 to be considered. Proposals may be submitted at any time prior to this date and time. Late proposals will not be considered and will be returned to the bidder unopened. b. Proposals must be delivered in a sealed envelope with RFP: Removal of Underground Diesel Tank written in the lower front left corner. c. Deliver to: Allison Canada, C.P.M. Room AAB-108, Business Office Campus Drive Salisbury, MD F. Evaluation Criteria a. Proposals will be scored by a committee based upon the following evaluation criteria: i. Ability to meet the full project scope of work. Quality of approach as outlined in bidder s submitted Proposal. Contractor s qualifications. ii. Ability to mobilize and meet deadlines as indicated in Section 2: Special Conditions, Schedule. iii. Cost. Price proposal must remain valid for one hundred eighty (180) calendar days and must remain firm for the duration of the term of the contract. iv. References are positive including performance and service ratings. 1. Three (3) references must be provided on the Proposal Agreement form. 2. All three (3) references must be for projects of similar scope and size which have been completed within the past three (3) years. 3. Consideration will be given to any previous performance for the College as to the quality of service and with regard to the contractor s ability to perform. b. Proposal Agreement is completed in full and is signed. The company representative s signature on the Proposal Agreement form indicates that all information on the bid is true and correct. Proposals returned without this form fully completed may be rejected. G. Payment Terms a. The evaluation for award will be made on the basis of Net 30 days. Payment discounts, if offered, will be taken when appropriate and will be considered in the evaluation for award. b. is a tax supported institution and is exempt from sales tax. An exemption certificate will be provided upon request. H. Prospective bidders who have received this document from a source other than Wor-Wic Community College s Business Office should immediately contact Allison Canada, Director of Purchasing and Auxiliary Services at and provide their name and mailing address in order that amendments to the Request for Proposals or other communications can be sent to them. Any prospective bidder who fails to notify the Director of Purchasing and Auxiliary Services with this Proposals Due: prior to 1:00pm. May 27, 2015 Page 2 of 9
3 information assumes complete responsibility in the event that they do not receive communications from the College prior to the IFB due date. I. The College is committed to a policy of non-discrimination and equal opportunity in all procurement activities, to the end that College purchases shall be solicited and entered into without regard to the race, color, religion, sex, marital status, age, handicap or national origin of any bidder, prospective bidder, vendor or contractor. Section 2: Special Conditions A. All bidders responding to this RFP must be professional contractors experienced in the removal of underground storage tanks, have been in business and regularly engaged in providing such services for a minimum of five (5) years, have experience with projects of similar scope and size, and be currently licensed and insured in the area where the work is to be performed. Failure to provide such proof may result in the bidder being determined to be non-responsive and not eligible for contract award. B. Warranty a. Complete warranty information must be included with the bid and indicated on the Proposal Agreement. C. Schedule a. The College s anticipates notice from the MD Department of the Environment that the tank and associated lines must be removed. However, in the event that MDE allows these gas and instrument lines to be abandoned in place, removal estimates for these lines should be bid as a separate cost on Section 4: Proposal Agreement. It is expected this notice will be received in May or June 2015 and the thank removal work shall begin July 1, Upon notice from Wor- Wic Community College to the awarded contractor of the actual work start date, the contractor must complete the scope of work within four (4) weeks. b. Job schedules must be coordinated and agreed upon with the designated College representative. c. The College will be operating on its normal schedule during the project. Work shall be performed during normal working hours of Monday Friday at 8:00A.M. 4:30 P.M. No overtime shall be included. d. All scrap material must be removed from the site by the contractor at the end of each work day. D. The College reserves the right to clarify information submitted in a proposal to determine whether an error has been made or whether a waiver of formality, informality or technicality is appropriate. E. The College may make investigations as are deemed necessary to determine the ability of a contractor to provide the work as specified herein. F. The contractor shall take all necessary precautions for the safety of employees on the job and shall comply with all applicable provisions of municipal, state, and federal safety laws and building codes to prevent accidents or injury to persons on or about, or adjacent to, the premises where the work is performed. a. At all times, the contractor shall provide and maintain barriers in an effective manner to prevent any and all injuries. Proposals Due: prior to 1:00pm. May 27, 2015 Page 3 of 9
4 b. Prior to the start of work, a meeting will be held at the College to review and agree upon all safety procedures. G. Compensation, Liability and Property Damage Insurance a. The firm and each subcontractor shall purchase and maintain such insurance as will protect the firm(s) and the College from claims under worker s compensation acts and other employee benefit acts, from claims for damages because of bodily injury, including death, and from claims for damages to property and clean-up which may arise out of or result from the firm s operation under the Contract, whether such operations are by the firm, any subcontractor or anyone directly or indirectly employed by any of them. This insurance shall be written for not less than the following coverage: i. Worker s Compensation and Occupational Disease Statutory. ii. Employer s Liability (including Occupational Disease) Coverage minimum $500,000. iii. Comprehensive General Liability, including Operations, Contractual, firm s Protective Liability and Completed Operations Coverages occurrence - $500,000/$1,000,000 for bodily injury, $1,000,000 for property damage, or $1,000,000 combined single limit. iv. Comprehensive Automobile Liability covering firms owned, non-owned and hired vehicles used in the performance of the work - $500,000/$1,000,000 for bodily injury, or as required by law, whichever is the greater, and shall include contractual liability insurance as applicable to the firm s obligations as covered in this section. v. Any other appropriate insurance that may be required to properly protect the firm, subcontractor and the college in the final contract award. b. Certificates of such insurance shall be submitted to the Director of Purchasing and Auxiliary Services prior to the first scheduled work date. Without in any way limiting the generality or beneficiaries of the foregoing, this insurance certificate shall specifically mention Wor-Wic Community College as additional insured on the policy. i. The certificates must show the type, amount, class operations, effective dates and date of expiration of policies within ten (10) days from receiving the Notice to Proceed. Such certificates shall substantiate the following statement: The insurance covered by this certification shall not be canceled or materially altered, except after thirty (30) days written notice has been received by the College. c. Contractor shall not commence work under the contract until it has obtained all required insurance and until such insurance has been approved by the College. Contractor shall not allow any subcontractor to commence work until all similar required insurance has been obtained and approved. Approval of insurance by the College shall not relieve or decrease the liability of the firm. d. Any and all subcontractors hired by the firm shall be required to carry appropriate insurance as required by the quote and also, such policies shall name the firm as an additional insured on such subcontractor s policies. Bidder shall assume full responsibility for any and all damages, or claims of damage, for injury to persons, property, or equipment which may result from any service performed under this contract. Section 3: Scope of Work A. requests proposals for the removal of a 15,000 gallon underground storage tank (UST) and associated lines from the tank to the building. The site is located on the West side of the Hazel Center boiler room. Proposals shall include detail of all labor, parts, materials, any and all necessary tools and equipment to perform the scope of work and the expected duration of the removal project activity. B. At a minimum, submitted proposals will provide specific detail that is associated with the following tank removal phases: a. Excavation of Underground Tank (UST). i. Removal and disposal of asphalt/concrete overburden over tank. ii. Erection of barricades and signage around excavation site in accordance with state and federal regulations. iii. Excavate area around tank to facilitate UST removal. iv. Monitor level of explosive vapors during UST excavation and tank removal. v. UST will be purged and inerted before being lifted out of the hole and examined for leakage. b. Sampling, removal and disposal of material remaining in UST. i. Current Veeder Root measurements indicate that there are approximately 647 gallons of diesel remaining in the tank. ii. UST contents will be removed, sampled and disposed of in accordance with state and federal regulations. The cost of removal, sampling and disposal of contents will be submitted via change order to the designated College representative for approval. c. Tank Dismemberment and Disposal i. Monitoring for explosive vapors will be conducted during tank dismemberment. ii. Arc cutting activities during tank dismemberment will be shielded from outside view. There is an adjacent daycare facility. iii. Any residual leakage encountered during dismantlement will be contained and disposed of in accordance with governmental regulations. d. Soil Sampling i. Soil sampling will be conducted during excavation to determine whether storage tank contents have leaked into adjacent soil. ii. If soil sampling reveals contamination, the removal and disposal of contaminated soil will be conducted in accordance with established state and federal regulations. Contractor will ensure contaminated soil does not leach during temporary storage and handling. Contractor will provide disposal documentation of contaminated materials. iii. Contractor will coordinate UST construction site MDE inspections as required. Notify the designated College representative when MDE inspector is on-site. e. Excavation Site Restoration and Asphalt Repair Proposals Due: prior to 1:00pm. May 27, 2015 Page 5 of 9
6 i. Refill excavated area with clean fill and at least 6 inches of crushed stone. ii. Tamp fill area in preparation for asphalt application. iii. Lay asphalt to a finished compressed depth of 4 inches. iv. Level asphalt pad maintaining original surface height. C. Contingencies and Change Orders a. Changes to the scope of work for this project need to be approved in advance of performing the work described in a change order. The following situations might be encountered during the tank removal process and would require a change order (including estimated additional cost) be submitted to and approved by the designated College representative. i. Soil Contamination: If soil sampling results reveals that the contents of the tank have leaked into the surrounding soil, the cost of contaminated soil removal and disposal and replacement of same with clean fill will require the submission and approval of a change order before work on the contaminated soil can commence. ii. Sheet Shoring: Although it is not anticipated that shoring will be required during tank removal, in the event that the size, the depth, or wall stability of the hole requires shoring, a change order detailing the cost of the shoring will be submitted to the designated College representative for approval. iii. Dewatering: In the event that the hole fills with water during the construction process and needs to be emptied before construction can continue, a change order detailing the cost of the dewatering needs to be submitted to and approved by the designated College representative before dewatering work is initiated. iv. Re-Routing of Existing Utilities: In the event that the excavation encounters existing utilities, an estimate of additional costs needs to be submitted for approval to the designated College representative before the re-routing of utilities is initiated. D. Lead-time must be indicated in Section 4: Proposal Agreement. Please indicate how quickly your staff can mobilize after receipt of a Purchase Order from the College.
