1 Official Minutes A regular meeting of the Town board of the Town of Lima, County of Livingston and the State of New York was held at the Town Hall, 7329 East Main Street, Lima, New York, on the 3rd day of March 2011 at 7pm. Notice was printed in the Sentinel. PRESENT: Supervisor, Pete Yendell Councilwoman, Cathy Gardner Councilman, Bruce Mayer Councilman, Dan Marcellus Councilman, Bill Carey Town Attorney, Steve Kruk Town Clerk, Jennifer Shanks Highway Superintendent, Keith Arner Supervisor Yendell called the meeting to order at 7pm with the Pledge of Allegiance. Open Sealed Bids for 3 year Lawn Mowing Contract Yendell opened bids received for the lawn mowing contract. 2 Landscaping Done Right Lawn & Landscaping $ $ $ Discussion was held by the Board and it was agreed that all applicants be referred to committee where Keith Arner, Highway Superintendent and Pete Yendell, Supervisor will obtain references from potential companies with the lowest responsible bidder before making a final decision. Approval of Abstracts Supervisor Yendell asked if there were any questions regarding the abstracts. No discussion was held. General voucher s # totaling $16, and Highway voucher s # totaling $36, were approved as presented upon motion by Councilman Carey, seconded by Councilman Marcellus, the vote went as follows: Ayes: 5 Yendell, Gardner, Mayer, Marcellus, Carey Minutes The minutes of the February 3, 2011 meeting were approved on a motion by Councilman Mayer, second by Councilwoman Gardner the vote went as follows: Ayes: 5 Yendell, Gardner, Mayer, Marcellus, Carey Reports Received and Filed Supervisor Yendell noted he received the Supervisor s Report, Budget Report, CEO Report, and Ambulance Report for January & February. These reports will be filed in the Town Clerk s office. Code Enforcement Officer Luft informed the board that Bristol ID submitted an application for a site plan review to add 7600 square foot to their existing building. Bristol ID plans to have this addition completed by summer. This new addition will also create 45 new jobs. Highway Topics- Tree Plantings and Obstructions It was noted by Supervisor Yendell that questions were raised regarding the cutting down of trees on York Street. With that Supervisor Yendell read a Highway Law, 322 (2) that says: If such plantings do not constitute an obstruction pursuant to 319(1), then the duty of removal would be upon the superintendent of highways and the expense would be, a town highway charge. Also, if such plantings were obstructions under 319(1), but Page 2 of 6

3 had not been placed there either by or with the consent of the abutting property owners, then the cost of removal would seem to be a town highway charge. Supervisor Yendell hopes this section of law, also available for review at the Town Clerk s office, will clear up any questions residents may have. NYMIR Survey Recommendations-Computer use Supervisor Yendell asked the board to approve the new computer use policy, as recommended by the Town of Lima s insurance company, NYMIR. Upon motion by Councilman Mayer to adopt the computer policy and add to the policies and procedures annual review, seconded by Councilman Gardner, the vote went as follows: Ayes: 5 Yendell, Gardner, Mayer, Marcellus, Carey Regional Computer Recycling & Recovery Supervisor Yendell explained to the board that Regional Computer Recycling & Recovery recycles computers, televisions, small scale servers, monitors, keyboards, mice, fax machines, scanners, printers, VCRs, DVRs, portable digital music players, DVD players, etc., free of charge and asked if the Town of Lima should place a Regional Computer Recycling & Recovery box at the Town Highway barns to allow residents to dispose of these items at the annual spring clean-up. Everyone agreed and a notice will be published in the paper. Audit Committee Report Supervisor Yendell received conformation from the audit committee that books will be audited on Friday, March 11 th and a report will be available at the next regularly scheduled meeting, April 7 th. Resolution Supervisor Yendell asked the board to adopt Resolution # 4 of This Resolution recognizes the 150 th Anniversary of the Civil War Upon motion by Councilwoman Gardner to adopt Resolution #4 of 2011, seconded by Councilman Carey, the vote went as follows: Page 3 of 6 Resolution # 4 of 2011 Recognizing the 150 th Anniversary of the civil War WHEREAS, April 12, 2011 marks the 150 th anniversary of the attack on Fort Sumter and the beginning of the Civil War; and

4 WHEREAS, the sesquicentennial of this event is cause for commemoration and reflection in an appropriate manner befitting this hallmark event in American history; and WHEREAS, more than 3,000 men from Livingston County left their families and work behind to answer the call for duty for the preservation of the Union between ; and WHEREAS, many soldiers lost their lives or returned to this area suffering the effects of the war and its aftermath having served courageously for the Union cause; and WHEREAS, men, women, and children on the home front also endured tremendous hardship and contributed generously to benefit their communities and the Union cause; now, therefore, be it RESOLVED, that in observance of the four-year 150 th anniversary of the Civil War, the Lima Town Board in patriotic tradition, recognizes the importance of honoring all those from Livingston County who served in battle and on the home front during this war and acknowledges the immeasurable sacrifices that helped to preserve freedom. Dated at Lima, New York March 3, Individual Announcements Wi-Fi Connection at the Lima Town Hall Councilman Marcellus gave Supervisor Yendell an itemized list that specified materials needed for a wi-fi connection at the Town Hall. The quote was for $ This would allow wireless access for public and private networking. Motion by Councilman Mayer not to exceed $1000 on router for wi-fi system in the Town Hall, utilizing funds from the buildings appropriation, seconded by Councilman Carey, the vote went as follows: Nay: 0 Code Revitalization Councilman Mayer said he has not yet spoken with Tom Ponwall in reference to putting the Town of Lima Codes online at no charge. Councilman Mayer will follow-up. Attorney Kruk told the board he has spoken with Mr. Salvage of Monroe County Water Authority, in reference to supplying Mr. Cintineo with water. Mr. Kruk stated Mr. Savage gave no official answer as of yet, but will be getting in touch with Mr. Kruk after he reviews his specific request and he completes some research. An update should be available for the April 7 th meeting. Attorney Kruk suggested the Town complete a public hearing for both Local Law # 3 and # 4 at the April 7 th meeting. Upon motion by Councilman Gardner to publish a public hearing for Local Law # 3 of 2011 concerning authorization of alternate member of joint planning board to act in place of a regular board member and Local Law #4 of 2011 Page 4 of 6

5 requiring the identification of alternate members of the Zoning Board authorized to act in matters before the board, seconded by Councilman Mayer, the vote went as follows: Highway Superintendent Arner distributed a handout showing the differences between the Kenworth bid and the State Contract bid for the Mack truck. Superintendent Arner noted the State contract for the Mack doesn t offer just the dump body, their proposal was for a dump body with a conveyor in the bottom of it, and this is not as per specifications. He also indicated there are several other items that do not meet his specifications. The listing was prepared by Mr. Arner to substantiate his choice of purchasing the Kenworth truck over the Mack. Motion by Councilwoman Gardner to purchase the Kenworth at $180,877, seconded by Councilman Carey, the vote went as follows: Highway Superintendent Arner asked if he could sell salt to the Village crew, as they have utilized their allowance for the year. Following board discussion of available options to accommodate the Village request, Councilwoman Gardner made a motion that if the Village runs out of salt that they may use town salt, up to 50 ton, but they must replace it by August 2011, seconded by Councilman Mayer, the vote went as follows: Councilwoman Gardner distributed handouts for board review. These documents were: draft zoning revisions for the Agricultural & Farmland Protection Plan Project, draft Agricultural Advisory Committee Local Law, and safe frontage requirements. Councilwoman Gardner asked that board to review these documents and contact her with any questions. Councilwoman Gardner explained a drawing distributed to the Town Board that was created by Kathy Wood, Landscape Architect. The drawing shows potential plants, trees, etc., that may tidy up the front of Town Hall and keep maintenance to a minimum. Discussion was held and everyone agreed with the concept and agreed to spend the majority of the $1,000 budgeted in the beautification fund for this project. We cannot spend the entire budget as we use those funds for other materials, such as the wreaths during purchased during the holiday season. Page 5 of 6
