10 DOT/OST Application Process Two kinds of common carrier authority: Foreign Air Carrier Permit (49 U.S.C , sometimes called a 402 permit ) Exemption (49 U.S.C ) DOT can process both applications simultaneously under recent streamlining procedures

16 Wet Leasing and Code Sharing

17 Wet Leasing Wet lessee must hold underlying authority (scheduled or charter) in the markets involved The airline physically operating the aircraft needs underlying charter authority The airline physically operating the aircraft also needs DOT/OST prior authorization for: -- any wet lease in a fifth freedom market for the wet lessor -- any wet lease of more than 60 days duration

19 DOT-FAA Code Share Safety Program If a foreign carrier plans to carry a U.S. carrier code: The foreign carrier must be from an IASA Category I country and hold requisite DOT/OST economic authority The U.S. carrier must have conducted a safety audit of the foreign carrier The FAA must have reviewed the audit report and found it acceptable

23 IASA Requirement United States Department of Transportation (DOT) requires a safety recommendation from FAA as a part of the processing of the economic authority for foreign carriers to conduct code shares or operate to the US in their own right. The IASA program is a mechanism for FAA to determine that a civil aviation authority is in place and is providing proper safety oversight in accordance with international standards. This information is part of the basis of a recommendation which FAA is required to return to the DOT. 24 IASA Program Goals Meet the statutory requirements of Congress and the FAA in regards to aviation safety. Meet expectations of the traveling public. Facilitate tangible changes in aviation safety oversight. Facilitate compliance with applicable International Civil Aviation Organization (ICAO) aviation safety standards. 25 IASA Background Congressional hearings in 1991 Began by an informal visit Found either no or a minimal safety program This prompted more visits to any country whose carriers made application for economic authority for service to the U.S. By 1994, a significant number of countries were identified as not complying with their obligations under ICAO. 26 Under IASA Phase 2 In cases of pending economic applications or periodic validations the FAA may use one or more methods to make a determination by: on-site visit; a questionnaire self-assessment; or use of factual findings. 27 Periodic Validation Re-establish the country category at least every two years. Within two years of the last assessment or periodic evaluation, information will be reviewed by the responsible Flight Standards International Field Office to determine if reassessment of current category may be necessary. 28 Re-evaluation on Demand The FAA may re-evaluate any country with carriers with authority to code share or operate to the U.S. when there is reason to question whether a country is in compliance and is discharging its international aviation safety obligations. 29 Sovereignty/responsibility Continued compliance with international safety standards is an obligation for each sovereign State as a signatory to the Chicago convention on civil aviation. The FAA's responsibility for correction of noncompliance with international standards is limited directly to its U.S. regulatory obligations. 30 Observations Safety concerns continue to exist regarding noncompliance with ICAO requirements for safety oversight. There are successes: Several Category 2 countries have moved to Category 1. Other countries have current plans to move to Category 1. Some countries have returned to Category 2. Other countries may not meet requirements in the foreseeable future. 32 Positive Change As a result of the IASA program, we have seen tangible improvements in the level of aviation safety oversight in several countries. These improvements will normally result in changes to both a country s foreign and domestic aviation operations. FAA continues to support the International Civil Aviation Organization (ICAO) Universal Safety Oversight Program (USOAP) and related activities such as the ICAO GSI training program. 36 TSA Requirements Each Foreign Air Carrier operating to the United States is assigned an International Principal Security Inspector (IPSI) The IPSI is the primary contact between TSA and non-u.s. Air Carriers regarding any security matter In the case of all-cargo air carriers, a TSA Cargo Specialist may be assigned to oversee some of your cargo security procedures

38 TSA Requirements Security Program Requirements Passenger or passenger/cargo air carriers are issued a Model Security Program based on Appendix 15 to the ICAO Security Manual Procedures must be implemented for each departure to, from, within the United States The air carrier will be issued Emergency Amendments (EAs) --- additional security procedures put in place based on threat conditions EAs apply to flights to, from, and within the United States

39 TSA Requirements The MSP and EAs include security procedures and standards for training, contingency planning, cargo security, baggage control, etc. The TSA expects air carriers to implement various security procedures, including but not limited to: Guarding and searching aircraft Screening of service personnel Some of these duties and procedures may be contracted to an authorized and qualified security representative

40 TSA Requirements Security Program Implementation At non-u.s. locations where flights depart directly to the United States, TSA expects that air carriers will ensure full compliance with all TSA regulations and policies The air carrier must coordinate with local authorities to implement required TSA procedures In many cases outside of the U.S., the security procedures will be implemented by the local airport authority, civil aviation authority, or Ministry of Interior (police) forces

41 TSA Requirements Security Program Implementation If at anytime the air carrier cannot perform any required security duty or is informed by a government agency either inside or outside the United States that the required security procedures cannot be met, the air carrier must immediately contact its assigned IPSI

42 TSA Actions for Start-Up Two defining questions: Does the Foreign Air Carrier already fly to the United States? Is the departure airport already a Last- Point-of-Departure (LPD) for flights to the United States?

44 New Carrier The TSA office will contact the FAA Flight Standards office responsible for issuing 14 CFR Part 129 Operations Specifications As soon as FAA confirms the carrier is likely to be issued operations specifications, TSA will provide all required security documents to the air carrier for review and implementation When an air carrier is ready to implement all of the TSA security requirements, contact the TSA IPSI

45 New Carrier The carrier will need: Signed statement agreeing to use the applicable sections of the ACISP or MSP and EAs when operating flights in US airspace Implementation procedures for the no fly and selectee lists, cargo screening procedures, and the MCL

47 Existing Carrier 90 days prior to the projected first flight, notify the IPSI of the planned operations Provide continuing updates to the IPSI regarding any changes to the schedule

49 New LPD The Transportation Security Administration Representative (TSAR) will contact the appropriate civil aviation authorities to discuss TSA procedures Two visits will be scheduled: 30 days prior to projected first flight One- to two-day survey If significant security concerns are noted, further visits and action may be necessary prior to service commencing 90 days after first flight: Comprehensive airport assessment, based on ICAO Annex 17 Comprehensive air carrier inspection, based on MSP and EAs

51 Existing LPD The TSAR will work with the civil aviation authorities to discuss TSA procedures If the last airport assessment was less than one year prior to projected first flight: TSAR will visit within 15 days after first flight 90 days after first flight, TSA will conduct a comprehensive air carrier inspection, based on MSP and EAs

52 Existing LPD If the last airport assessment was more than one year prior to projected first flight, two visits will be scheduled: 30 days prior to projected first flight One- to two-day survey If significant security concerns are noted, further visits and action may be necessary prior to service commencing 90 days after first flight: Comprehensive airport assessment, based on ICAO Annex 17 Comprehensive air carrier inspection, based on MSP and EAs

53 Once each year: Follow-Up Activities Comprehensive air carrier inspection to evaluate compliance with MSP and EAs Meetings between TSAR and civil aviation authorities to exchange information and review national civil aviation security program (NCASP) Once every one to three years (depending on assistance requests and previous observations): Comprehensive on-site airport visit to review ICAO Annex 17 Standards and Recommended Practices implementation
