("EPNG") hereby tenders for filing and acceptance by the Federal Energy Regulatory Commission ("Commission") the following tariff records to EPNG s, Third Revised Volume No. 1A ( Tariff ). Part II: Statement of Negotiated Rates Version Part II: Section 5.3 Mexicana de Cobre, S.A. de C.V. #FT3HK000 Version EPNG is proposing to update the Statement of Negotiated Rates in its Tariff to reflect the addition of a new negotiated rate transportation service agreement ( TSA ) between EPNG and Mexicana de Cobre, S.A. de C.V. ( Mexicana ). As discussed below, EPNG respectfully requests a waiver of the 30-day notice requirement to permit the tariff records to become effective on the proposed date of November 11, 2016, consistent with the effective date of the TSA. Reason for Filing General Terms and Conditions ( GT&C ) Section 4.18 of the Tariff allows EPNG and a shipper to agree to a service rate that varies from the minimum-to-maximum range provided on the Tariff s Statement of Rates. Recently, EPNG and Mexicana entered into a negotiated rate firm transportation service agreement TSA No. FT3HK000. The TSA reflects a term beginning November 11, 2016 and ending December 31, The TSA specifies a maximum delivery quantity of 9,000 Dth per day and an applicable negotiated reservation rate of $ per Dth per month. 1 1 EPNG separately records the quantity transported, billing determinants, rate components, surcharges, and revenues associated with a negotiated rate agreement to permit filing in the format required by Statements G, I, and J in future Section 4 rate case filings.

2 Federal Energy Regulatory Commission 2 November 9, 2016 Description of Filing TSA No. FT3HK000 reflects a negotiated reservation rate of $ per Dth per month applicable to quantities received and delivered at primary receipt and delivery points beginning November 11, 2016 and continuing through the contract termination date of December 31, TSA No. FT3HK000 also provides that this negotiated rate will be applicable to certain alternate receipt and delivery point combinations. Specifically, the awarded rate also applies to: 1) deliveries from any alternate receipt points included in STML SJN, STML ANA and STML PER to the delivery points of IWILCOXD and INN30PLA; 2) deliveries from the primary receipt points to the alternate delivery points of IWILCOXD and INN30PLA; and 3) deliveries from any alternate receipt points included in STML SJN, STML ANA and STML PER to the primary delivery point of DPG&ETOP up to the daily quantity specified by Maximum Quantity for the applicable month that will be specified in Exhibit A of the FTSA for the primary delivery point DPG&ETOP. Quantities in excess of 9,000 Dth per day will be assessed EPNG s maximum rate. Tariff Provisions EPNG is submitting the following tariff records pursuant to Subpart C of the Commission's regulations: Part II, Stmt of Negotiated Rates is modified to add TSA No. FT3HK000 to the Statement of Negotiated Rates. Part II, Section 5.3 describes a new conforming negotiated rate TSA with Mexicana. The negotiated rate of $ per Dth per month is applicable for the full term of the TSA and is not subject to the maximum or minimum reservation rate. 2 The proposed tariff record states the exact legal name of the shipper, the negotiated rates, the receipt and delivery points, the quantity of gas to be transported, the applicable Rate Schedule for the service, and the contract term. Procedural Matters Inasmuch as this filing is fully described herein, the statement of the nature, the reasons and the basis for the instant tariff filing required by Section 154.7(a)(6) of the Commission's regulations is omitted. In accordance with the applicable provisions of Part 154 of the Commission's regulations, EPNG is submitting an etariff XML filing package, which includes the following: a) a transmittal letter; and 2 In addition to the applicable reservation charges, Mexicana will pay all applicable commodity charges, fuel and lost and unaccounted for gas charges and all other applicable surcharges.
