2 Leave a gift in your Will and continue helping our Armed Forces family live on. I want my Will to reflect the ways I have tried to make a difference to the world during my lifetime. I want it to reflect the beliefs and values I ve lived by, and the causes that are closest to my heart. That s why, after I ve made sure my loved ones are taken care of, I ll be leaving a gift to The Royal British Legion and ensuring that our Armed Forces family is cared for as well. The Legion is there for serving and ex-service men and women, young and old, and their families. Everyone we help has a unique story to tell that shapes their needs and we do all we can to meet those needs, whether that s by providing practical help around the home, specialist care following an injury, or careers support and advice after they leave the Forces. Many of the people we help will need us for the rest of their lives, and it would be very hard to help them without gifts in Wills. Legacies are such a critical part of our income; if we know we can rely on our supporters in the future, it means we can promise to always be there for those who need us today. And, as I hope this booklet will show you, even a small portion of your estate could make an invaluable, life-changing difference. I don t believe there s a finer tribute I could pay those who ve fought so bravely for us than to leave a gift to the Legion. By doing so, I can continue helping Service men and women, veterans and their families to live on, even after I m gone. Will you join me? Making a Will is the best way to ensure that the people you care about most will be taken care of after you ve gone. It s a good way to make sure your wishes are met and can also give your loved ones much less to worry about at what can be a very stressful and emotional time. Leaving a gift in your Will to the Legion is also a wonderful way to safeguard the future of all those who need the Legion s help serving members of the Armed Forces, veterans of all ages and their families. As just a small token of our appreciation, the name of every person who leaves a gift in their Will to the Legion is recorded in the Book of Remembrance, on permanent display in our London headquarters. Three types of legacy. If you decide to leave a gift to the Legion in your Will, there are three main types of gift to choose from. You ll find the specific wording that should be used for each at the back of this booklet. Plus, there is more detailed information on writing your Will online at /willguide 1 A specific legacy is a gift of a particular item such as books, paintings, antiques or jewellery. 2 A pecuniary legacy is a gift of a specified sum of money. 3 A residuary legacy is where a person leaves a percentage of their estate for distribution after all expenses have been paid and other legacies have been made. One of the advantages of this type of legacy is that you are less likely to need to update your Will in the future if circumstances change (because, for example, 1% of your estate will always be 1% of your estate).

3 You could help support the whole Armed Forces family for years to come. The Royal British Legion is the UK s biggest Armed Forces charity. We provide lifelong support to serving members of the Armed Forces, veterans of all ages and their families. And we want to ensure that every single one of them can count on our support, for as long as they need it. That s why we need you. A gift in your Will can help us continue supporting all those who ve served from World War Two veterans to young men and women who have returned home from Afghanistan or Iraq wounded, injured or sick. A gift in your Will could help us provide financial advice, including debt management, help claiming benefits and with unexpected expenses....help wounded, injured or sick personnel at The Battle Back Centre (Lilleshall) and our Personnel Recovery Centres....give returning Service personnel education, retraining opportunities and careers advice via our Civvy Street service....offer practical support to individuals and families following a bereavement, including help throughout the coroner s inquest process....help ex-service people claim the pensions they are entitled to and offer free representation at War Pensions appeal tribunal hearings....care for elderly ex-service people and their dependants at six Care Homes in locations around the country....provide a handy van service for people who are unable to carry out small repairs and minor alterations in their homes....run seaside Break Centres where Service families can enjoy a much-needed break away together. When you re injured, a lot is taken from you. You could help other guys like Cassidy get their confidence back. Cassidy Little is a stand-up comedian, actor and Royal Marine, serving with 42 Commando in Plymouth. He s also an amputee. Cassidy was seriously injured by an IED blast in Afghanistan in 2011 an explosion that took his right leg, shattered his left, detached one of his retinas and fractured his pelvis. His road to recovery has been very long, A gift in your Will could help more brave young men and women like Cassidy to live on. You could help provide a life-changing week of sport and adventure for 800 veterans every year at The Battle Back Centre (Lilleshall). You could help fund more projects like Bravo 22 Company which aim to improve confidence and self esteem. You could help provide careers advice and support to Service leavers as they adjust to civilian life. and he is still attending Headley Court as part of his rehabilitation. But he is making incredible progress and in 2012, was nominated to carry the Olympic Torch. Thanks to supporters like you, Cassidy had the chance to take part in Legion-sponsored project Bravo 22 Company, which saw 30 wounded, injured and sick Service personnel create and perform a play based on the lives of the actors taking part. Having new goals to work towards, and the chance to learn new skills, has been an immense help to all of the actors throughout their recovery. You can read more about the Legion s work online at

4 I am always very grateful for everything the Legion does. I would recommend the Legion to anyone. Private William Bill Speakman was awarded the Victoria Cross the first to be invested by Queen Elizabeth II for his bravery in the Korean War. His company was depleted and outnumbered. But despite injuries to his shoulder and leg, he rounded up six of his comrades and led a series of charges against North Korean and Chinese soldiers. It worked, keeping the enemy at bay long enough for his regiment to withdraw safely. Bill is now 85 years old, and we are continuing to offer him the care and support a true hero deserves. We recently helped him relocate to Cornwall after doctors recommended the move to help with his osteoarthritis and we ve been able to pay for an electric scooter to help him get around. Your gift could help the Legion continue giving a generation of heroes like Bill the care they deserve. You could help our handy van service carry out home repairs for older veterans so they can keep their homes safe and secure. You could help us run our six Legion Care Homes for elderly veterans, which aim to help them live full, independent lives for as long as possible. You could help pay for our Admiral Nurse service, which provides advice and support to the people who care for those with dementia. Sam Curtis has been in the Army since 2003 and was deployed on his third tour of Afghanistan in September He and his wife Lisa have four children under 13. Until last year, they had never been away on holiday as a family. The Legion was able to offer them a week s stay at Byng House, one of our seaside Break Centres, just before Sam was deployed. The whole family loved their time away and Sam went off to Afghanistan with some fantastic memories to treasure, and some great photos too! Byng House is a really friendly and welcoming place, says Lisa. The staff couldn t do enough for us. There were family barbecues, magic shows and discos for the children. We really couldn t have asked for a better time. We had our first-ever family holiday thanks to the Legion. You could give more families like the Curtises some muchneeded time together. Your gift could support other young Service families just like the Curtises. You could give children of Service men and women the chance to enjoy an action-packed seven-day Adventure Break. You could help provide benefits and money advice to the family of a man or woman who has recently returned from Service. You could help a Service man or woman to adapt their family home after returning home injured. 5 My husband Sean was my hero. I ll never forget him and I Il always remember the support the Legion s given me since his death. Amanda and Sean Binnie had only been married for six months when he was killed during a patrol in Helmand province, Afghanistan. He was just 23 years old. The gift you pledge today will support tomorrow s heroes. It s thanks to people like you that the Legion was there to offer Amanda emotional and practical support in the months and years that followed Sean s death. And every November since, she has taken great comfort in planting a small wooden Tribute at one of the Legion s five Fields of Remembrance across the UK. She has also dedicated an Everlasting Poppy to Sean at our Never Forget Memorial at the National Memorial Arboretum. The Legion helped me come to terms with my loss and I know they ve done a lot for others like me who have lost a loved one, says Amanda. Remembering Sean by planting a Tribute or a poppy is a truly fitting way for me to keep his memory alive. Your gift could support a bereaved family at one of the most difficult times in their lives. 6 Gifts in Wills: your questions answered. The Royal British Legion s Legacy Manager, Liz Fredericks, answers some of the most frequently asked questions about making a Will and leaving a gift to The Royal British Legion. MOD If I leave a gift in my Will to the Legion, can I have a say in how it s used? You can but often, the more helpful thing to do is to leave your gift to The Royal British Legion s general charitable purposes. This is because we always want to make absolutely sure that the gifts we receive are used where they are most needed, and it can be hard to predict which areas we will need to focus on in the future. Having said that, the wishes of valued supporters like you are incredibly important to us. So if you tell us which area of our work you d like your gift to support, we ll make every effort to ensure that happens. Do I have enough money to leave a gift in my Will? Short answer yes! Every gift we receive from our supporters, however large or small, is so very important to us and makes a significant contribution to helping the Armed Forces family. Even as little as 1% of your estate could help us support serving and ex-service men and women and their families, while still ensuring your loved ones are provided for. What will it cost? It might not be as much as you think. It generally costs between 100 and 300 for a simple Will. The cost does go up for a complex Will so we always recommend asking your solicitor for an estimate in advance. I ve already made my Will how can I change it? You can keep your Will up to date either by writing a new one, or amending your existing Will using a document called a codicil. A codicil doesn t replace your Will, so you should always keep both documents together. And remember, if your circumstances change then your Will can quickly become out of date or even invalid, so please make sure it s as accurate as it can be. What if I m acting as an executor of a Will? If you are executing a Will that includes a gift to the Legion, please contact our Legacy Team and they will be happy to guide you through the process. What to do next. If you re making a Will for the first time We strongly advise making an appointment with a solicitor. Before your appointment, make a list of all your assets, including any savings, investments, and your possessions and have a think about the people and causes you would like to benefit from your estate. If you plan to remember the Legion. If you plan to leave us a gift, please let us know. We would love to thank you personally, and knowing you re planning to do so also means we can plan more effectively for the future. Pecuniary Legacy (with expression of wish). I give the sum of [ ] pounds ( ) free of inheritance tax to The Royal British Legion (Registered Charity No: ) of Haig House, 199 Borough High Street, London SE1 1AA absolutely and I request The Royal British Legion but without imposing any binding trust or legal obligation to use the legacy for [ ] and the receipt of the Honorary Treasurer or the proper officer for the time being of The Royal British Legion shall be a complete discharge to my executors. Pecuniary Legacy (index linked). 1. I give to The Royal British Legion (Registered Charity No: ) of Haig House, 199 Borough High Street, London SE1 1AA absolutely for its general charitable purposes free of inheritance tax such sum ( the Legacy ) as shall be produced by multiplying [ ] pounds ( ) by the index figure in the Retail Prices Index for the month immediately preceding my death and dividing the product by the index figure for the month in which my Will is executed and the receipt of the Honorary Treasurer or the proper officer for the time being of The Royal British Legion shall be a complete discharge to my executors. 2. If the Retail Prices Index shall have been replaced by another official index, and/or if the basis of computation of the Retail Prices Index or such other index shall have been altered, my Trustees shall have discretion to determine the amount of the Legacy in accordance with such formula as seems to them just and reasonable in the circumstances. 3. If there shall be no such index in existence at my death, the Legacy shall be [ ] pounds ( ) increased by simple interest of [ ] per cent per annum from the date of execution of my Will until the date of my death. Residuary Legacy (general charitable purposes). I give [ ] (%) of the residue of my real and personal estate to The Royal British Legion (Registered Charity No: ) of Haig House, 199 Borough High Street, London SE1 1AA absolutely for its general charitable purposes and the receipt of the Honorary Treasurer or the proper officer for the time being of The Royal British Legion shall be a complete discharge to my executors. Residuary Legacy (with expression of wish). 8 Other information to note. Lasting Powers of Attorney. None of us knows whether or not we will lose mental capacity. It is possible, however, to plan for this eventuality by making a Lasting Power of Attorney (LPA) and choosing who you would like to act on your behalf if you no longer have capacity. An LPA is a legal document whereby a person (the Donor) gives another person or persons (the Attorney) authority to make certain decisions on the Donor s behalf. There are two types of LPA, a property and affairs power for financial decisions, and a health and welfare LPA for decisions about welfare and medical issues. If you want further information about LPAs, then you should consult your solicitor. Inheritance Tax (including transferable nil rate band and 36% tax rate). Inheritance tax is generally chargeable on a person s assets if they are worth over the threshold of 325,000 (the nil rate band). The usual tax rate is 40%. Gifts to spouses (and civil partners) and charities, such as The Royal British Legion, are free from inheritance tax. In addition spouses and civil partners can share their nil rate bands so that the second to die can have a nil rate band of up to 650,000. In April 2012, the government also introduced a reduced rate of tax of 36% which applies to all estates where a person gives 10% or more to charity. Your solicitor will be able to advise you on your potential inheritance tax liability. Expressions of Wishes. It is most helpful for legacies to be left to The Royal British Legion s general purposes to ensure that your legacy can be directed to the project with most need and to keep all of our services up and running. It is therefore preferable not to restrict the legacy to a particular service or property, for example, as these may change over the years to adapt to meet the needs of our beneficiaries. If you have a preference as to where your legacy is spent, then we would encourage you to state this as an expression of wish so that, if the particular service or property is no longer in existence at the date of your death, then the legacy can be spent on the charity s other vital work.
