15 92.4% of gay men experienced discrimination. Sexual orientation identified as main reason for discrimination: general reason (70.7%) and specific reason (61.3%). Someone in their neighbourhood (46.7%) and bystander/passer-by (42.7%) identified as the persons who discriminated against MSM. Most gay men (63.8%) reported being discriminated against while on the road. Verbal abuse was the main type of discrimination experienced by 82.7% of MSM. 15
16 Re denial of access to services, most MSM (75.0%) reported being denied police assistance. More persons who did nothing about the discrimination experienced (60.0%) than those who did (36.0%). The primary reasons given for inaction: couldn t be bothered (45.5%); didn t feel it would go anywhere (22.7%); and didn t know I could do anything (20.5%). Main actions taken to address discrimination were verbal responses (55.6%) and telling a friend (29.6%). 16

18 Determine the existence of anti-discrimination policies, the extent to which these have been implemented and provide a measure of protection for key populations. Support the anti-discrimination legislation initiative of the Ministry of Labour through the provision of supporting mechanisms and structures which will augment its implementation once enacted. Develop and implement Know Your Rights campaigns or programmes for MSM and Right to Respect campaigns for the general population which could be executed by the NHAC and its partners in government or civil society. Create and provide safe spaces for MSM & key populations 18

20 The UNAIDS publication, The Status of HIV in the Caribbean states: Leadership is needed to Remove punitive laws and diminish stigma and discrimination. Laws that perpetuate stigma and discrimination and fuel the spread of HIV are not in the national interest. 20

Underreporting of HR violations Not aware of rights Believe they cannot even rely on police (citing anti gay remarks from a policeman during a bus crawl and stones hurled at kadooment flag bearer. 23
24 Article 2(1) & 26 prescribe nondiscrimination standards for States. Under Article 2(1) the State undertakes to respect and ensure to all individuals within its jurisdiction the rights recognised by the Covenant, without distinction of any kind 24
