1 CRAVEN AND PENDLE POOL LEAGUE CONSTITUTION 1. NAME 1.1. The organisation shall be known as CRAVEN AND PENDLE POOL LEAGUE, hereinafter referred to as the league. 2. OBJECTIVES 2.1 The league was formed for the purpose of playing competitive 8 Ball Pool in the Craven and Pendle pool areas at all levels of play for its members. The league shall consist of division(s) on a league basis, with the addition of knockout competitions as the committee may approve. 2.2 To provide a competitive league for all teams with the aims of providing suitable venues and a high standard of pool tables. 2.3 To adopt fair play and sportsmanship at all times. 2.4 Promotion and maintenance of the highest standards of competence in the game. 3. MANAGEMENT 3.1 The league Captains shall select a Management Committee at each AGM or ESM or EGM (see 6; 7 and 8) to undertake all league business, hereinafter referred to as the committee. 3.2 The committee shall consist of no less than three (3) members including a Chairperson, Secretary, and Treasurer, other positions can be decided on by the elected committee, as and when circumstances dictate. No more than two (2) members representing the same team will be allowed to sit on the committee. 3.3 In extraordinary circumstances the committee have the power to appoint a sub-committee, consisting of one captain from each team, to discuss and recommend a solution to any particular problem or, individual members because of their expertise, to complete any task which arises. A sub-committee would only sit for the duration of the particular problem or task. 3.4 The three main officers will hold office for at least one year (two seasons). For the purposes of continuity, no more than two members of the Committee may stand down at the end of any one season. 3.5 In exceptional circumstances, such as sudden illness, the committee will have the power to appoint any person to fill a vacancy that may occur during a season. The committee may also coopt any person whose appointment would be beneficial to the committee. 4. FINANCES
2 4.1 The League is a non-profit making organisation and therefore its predictable income will not exceed its expenditure, although it will always aim to have positive funds to meet its expenditure. 4.2 The league will endeavour to reimburse all reasonable expenses incurred by any member of the committee while conducting business on behalf of the league, such expenses to be approved by the committee. 4.3 No individual will be permitted to make a personal profit from League funds. All monies held by the league will, after deductions for legitimate expenses, be used for the benefit of all league members. 4.5 Two of the main officers will be responsible for the finances of the league ; all cheques must have two signatories in accordance with the bank mandate. The Treasurer will maintain adequate records of income and expenditure and at all times observe proper banking procedures. A maximum of three committee members can be signatories at any one time. 4.6 The Treasurer will produce regular balance sheets that will be available for inspection by members of the league. 4.7 The accounting year shall end on the last day of the month immediately preceding that in which the Annual General Meeting [AGM] occurs. 5. COMMITTEE MEETINGS 5.1 The committee shall hold meetings at intervals conducive to efficient management of league business. 5.2 At all Committee meetings three members of the committee shall constitute a quorum for the purpose of carrying on the business of the league. 5.3 At Committee meetings each member present shall be entitled to one vote except the Chairperson who will have the casting vote (if required). 5.4 Any member of the committee may call a meeting after giving forty eight [48] hours notice and reasons for doing so to the rest of the committee. A committee meeting will then take place within fourteen [14] days of notice. 5.5 Subject to this constitution, as amended at any Annual General Meeting [AGM] or Extraordinary General Meeting [EGM], the committee shall have full authority, to make any decision that, in their opinion, is deemed necessary or beneficial to the league members. 6. END OF SEASON MEETING [ESM] 6.1 The league will hold bi-annually an ESM near the end of each playing season for enrolment of teams for the coming season. The committee must inform members in good time of such meetings. 6.2 All teams enrolling must submit a list of named players. If there are any ineligibility issues that arise for individual players, then the team captain will be informed forthwith.
3 7. ANNUAL GENERAL MEETING [AGM] 7.1 An AGM will be held each year at the same time as the first ESM each year. The AGM will proceed as follows: Matters arising from last AGM s minutes:- -Chairpersons Report - Secretary s report -Treasurer s report - Other members reports - Amendments to Constitution and General League Rules -Alterations to League Fees -Any other business - Election of Committee 7.2 Any registered member within the league is eligible for election onto the committee provided they are proposed by a captain and seconded by any other league registered member. 7.3 Any member of the league can charge the committee to give full account of any action taken by them during the season. 7.4 The committee must inform members of the time and venue of the AGM in good time. 7.5 Any member wishing to add any item to the agenda, or make a nomination for the committee, or a request as in 7.3, must notify the Secretary, in writing, at least seven [7] days prior to the meeting. 8. EXTRAORDINARY GENERAL MEETING [EGM] 8.1 An EGM may be requested at any point during a league season. The request must be made from any four [4] teams of the league on application to the committee. Any request for an EGM must be put in writing and sent to the league Secretary stating the reason(s) and must contain four [4] signatures of current team captains. 8.2 An EGM has the full power of an AGM. Any decision that has resulted from an EGM may not form the basis of request for another EGM. Appeals will not be considered under any circumstances. If a particular issue makes calling an EGM necessary, the committee has such power to convene such a meeting without a call from a group of Captain s, or if circumstances reduce the committee such that a committee cannot be achieved. 8.4 The league constitution rules may only be changed by a majority vote at an AGM or EGM. Any proposals for rule changes must be included on the agenda.
4 8.5 If a vote of no confidence in the committee is proposed, seconded and carried, then a new committee shall be voted on at the EGM. 9. BALLOTS 9.1 All ballots will be conducted by a show of hands, or a roll call. 9.2 The following people will be entitled to one vote each at the AGM or EGM:- -Other than the Chairperson, elected members of the committee present, only if they are a team Captain and representation is not already made by their team. -All team representatives, although only one representative from any team affiliated to the league in the season previous to the meeting will be allowed one vote. 9.3 Proposals will be carried by the higher number of votes cast. 9.4 In the event of a tied vote during voting for the committee, an already elected member, (i.e. Chairman) may make a casting vote. 9.5 In a tied vote on any other decision, the Chairman will make the casting vote. 9.6 The committee will not have the power of vote at any general meeting, except if the member is a captain, or where allowed in rules 9.4 and LEAGUES AND COMPETITIONS 10.1 The league shall run competitive fixtures twice a year known as Summer and Winter seasons, each season being run independently of the other The league shall run competitive knockouts of a type and at dates, to be defined by the committee Membership shall be open to all clubs and public houses in the Craven and Pendle areas by invitation. Consideration shall be given to any request by a venue to enter a team at enrolment prior to the start of a season The committee reserve the right to refuse membership to any team or individual, if for any reason they consider that granting membership shall be detrimental to the league All competitions endorsed by the league will be played under the rules voted in by the AGM or ESM. These will be based on the old EPA Rules amended with rule changes adopted from World Eight ball Pool Federation Rules (WEPF) The committee shall have the right to alter any procedural rule that they decide necessary. The committee will issue copies of all current relevant rules to member teams Teams will only be allowed to add new squad players after the first half of the season if they sign them on to the match score card on the night. Team knockout games will require players to have played in two (2) previous league fixtures.
5 10.8 In team competitions the league will provide trophies for all players nominated by the team captain. Trophies will be provided for the winners and runners-up in league divisions, team K.O. Cup and for other such merits and competitions that the committee have organised All perpetual trophies must be returned to the league secretary at the ESM. Any trophies lost must be replaced in full and any damage to trophies must be repaired to the leagues satisfaction At the end of a season if teams are level in points the highest number of match wins will take precedence. Should this also be level the highest number of frames won will prevail, however, if this is also level a play-off will take place to determine the overall winner. 11. GENERAL RULES 11.1 The General Rules are a set of rules for the basic administration of match nights, but do not constitute Playing Rules The General Rules may be added to, deleted or amended at the sole discretion of the committee Members may make suggestions for the alteration of the General Rules, at any committee meeting. Such alterations do not require the vote of a General Meeting. 12. PLAYING RULES 12.1 The Playing Rules are the rules governing the conduct of play for the duration of each match The Playing Rules are governed by the captain s vote during ESM or AGM or EGM and otherwise may not be changed by the league. The old EPA Rules create the framework and individual WEPF Rules may be voted in prior to the start of each season as long as the Committee has been informed by request prior to the meeting so that they can be added to the Agenda for discussion and voted on by the team captains present at the meeting When a correct interpretation of the rules, cannot be given by the match night referee s, a referee appointed by the committee may be approached to give their interpretation of the rules and settle any dispute concerning the rules Where the decision of a referee appointed by the committee is not conclusive, then in the spirit of the game, a re-rack of the frame should be played out Disputes with regard to match nights may be brought before the committee, providing notification is made in accordance with procedure in the General Rules. 13. ENROLMENTS AND REGISTRATION 13.1 League enrolment fees are due at each ESM; this procures entry to the commencing league season All teams must have a representative present to enrol and register a list of named players, who will participate in the registered team.
6 13.3 Only fully paid up teams will be entitled to enter any competitions organised by the league Entry to the league will be limited at the discretion of the committee, in order to achieve a suitable format of fixtures for the season The following rules apply: -Existing league teams that pay the enrolment fee on, or before the ESM will be re-entered in to the league. Where places are available within the league at the ESM, new teams present at the meeting, may be invited to enter the league, subject to payment of fees at the meeting. -Existing and new teams, who have not paid their fees by the ESM, may be invited to re-enter or join the league and pay enrolment fees subsequent to the meeting, where places are still deemed to be available within the league. -All teams enrolling in the league shall pay The league reserves the right to refuse entry to any team to the league, for any reason If a team changes its home venue it is the team captain s responsibility to inform the committee who will, in turn make available the new venue details for other teams to have access to via the website. 14. LEAGUE FEES AND FINES 14.1 League fines are due and payable at General Meetings, unless otherwise decided by the committee Teams or players not paying fees when required may face fines and/or suspension at the discretion of the committee League fees and fines shall be levied at a rate decided by an AGM or EGM, (except where stated). The rates will stand until the next AGM or EGM or ESM Teams still owing fees or fines at the end of any season during which the fees or fines have been accrued will be suspended from the league. 15. DISCIPLINE AND DISPUTES 15.1 Individual members or teams within the league must wholly adhere to: -The Constitution -The General League Rules 15.2 Failure to do so may result in the player or team facing a fine at a rate decided on by the committee and or suspension for an undefined period. Listed sanctions are referenced in the General League Rules.
7 15.3 All members, having joined the league are deemed to have read and understood both the league Constitution and the league General Rules, as ignorance will not constitute a defence in the event of a complaint or disciplinary measure Members who are asked to attend a disciplinary meeting shall receive notification in person or by letter In the event of a disciplinary complaint being upheld the committee reserve the right to suspend, fine or expel any individual or team for breach of these rules or any other rule that the committee makes at any future time, or for an act deemed to have brought the league into disrepute. Any member or team will be afforded every opportunity to defend themselves or explain themselves to the committee Any member excluded from the league for inappropriate behaviour on licensed premises or for any other reason, will have a standard one season ban applied. After the ban period, they must re-apply to the committee to re-join, before assuming the ban has been lifted. The committee will notify the player of the outcome after a committee meeting has taken place Any team expelled from the league will forfeit the whole of any subscriptions paid for the current year, and any rights accorded to them as members of the league All arrears owed to the league must be paid by the commencement of a season for the team to be eligible to play in that season Any member may request the committee to mediate in any dispute they may have with any other member or team within the league. Any decisions reached by the committee will be final and binding on all parties Teams and players expelled from the league will forfeit any right to any trophies Any league matters dealt with by the committee, once resolved, are final. Under no circumstances will an appeal be accepted, regardless of any new evidence The league will not enter into any legal dispute with any member of the league for any reason whatsoever. 16. GENERAL 16.1 The committee s decision on any aspect not covered by the General Rules or Constitution is final, unless voted upon at an AGM or EGM or ESM Once elected to committee, neither the committee nor individual committee members have the power to make any decision that is likely to affect the democratic process, or constitution of the league. Neither are they able to make any decision which would allow a committee member (or members) to gain financially from being on the committee. Nor make any decision that is prejudicial to the well-being of the league or its members Any such decisions must have the majority vote of the Captains of the league. Any such act would mean dismissal from the committee.
8 16.4 The Committee are empowered to seek and negotiate such finance, sponsorship or credits as may be required for the administration of the league providing the following condition is met:- 16.5Any financial decisions must be authorised by a majority vote of the Executive Committee, who may authorise individuals to act on their behalf. 17. INTERPRETATION OF THE CONSTITUTION 17.1 The interpretation of this constitution is vested in the Chairperson. WRITTEN 03/11/14
