Jardine Lloyd Thompson Pty Ltd (JLT) is one of Australia s largest general insurance brokers, a group totally committed to service and the fulfillment of Our clients needs. The group offers a diverse range of products and services to all areas of industry and the wider community in all parts of Australia. The JLT Australian Business Number is The JLT Australian Financial Services Licence Number is Who Insures You This insurance Policy is underwritten by Thistle Underwriting Services Pty Ltd (TUS) who act on behalf of the insurer QBE Insurance (Australia) Limited, ABN , AFS Licence No In this Policy the insurer is called We, Us or Our. Policy Schedules Policy Schedules are a record of Your specific insurance covers. When You receive them, please check the Policy Schedules carefully and inform JLT immediately if You feel anything needs to be changed. In order that You always have a complete up-to-date record of Your cover, JLT will send You a new set of Policy Schedules whenever Your insurance cover is renewed or changed in any way. Policy Wording The Policy Wording details all the terms and conditions of cover. In certain cases, Additional Benefits, Definitions, Exclusions and Conditions have been included or varied to suit the requirements of Your circumstances. In these cases Endorsements are included with the relevant Policy Wording and are shown on Your Member Schedule. Product Disclosure Statement (PDS) The purpose of this PDS is to assist you to understand your insurance and to enable you to make an informed choice about your insurance requirements.the PDS sets out the significant features of the insurance policy including its benefits, risks and information about how the insurance premium is calculated. You also need to read the insurance policy wording which is covered in the section Your contract with TUS. This provides a full description of the terms, conditions and limitations of the insurance policy. This Product Disclosure Statement was prepared on 10 th November

4 Changes to this insurance policy Information which is not materially adverse to you is subject to change from time to time. Changes in insurance policy wordings will be communicated to you in several ways and these are: if a change would affect you adversely, you will be issued with a new insurance policy or a Supplementary Product Disclosure Statement; for minor changes which do not adversely affect you, information can be obtained by telephoning our toll free number ( ), or visiting our website at to find out what changes might have occurred; if changes have occurred we ll be pleased to provide you with a paper copy of them on request Cooling off period We will refund the premium you have paid for cover under this insurance policy if you cancel the insurance policy within 30 days of its commencement. To do this, you must advise us in writing and return the insurance policy and certificate of insurance to your nearest JLT office. You will not receive a refund if you have made or intend to make a claim under the insurance policy. Significant features and benefits Your sum insured may not be adequate The Policy provides replacement or reinstatement conditions for contents which means that claims are settled without contribution for age, depreciation or wear and tear. It is important that the sums insured you select cover the cost of replacing your contents on a new for old basis. The sums insured that you select must make allowance for owners improvements not covered by the Village, GST and any additional benefits that are included in the sum insured such as removal of debris. It is important that you read the sublimits in the terms and conditions for items such as works of art, items of jewellery and collections. If you have any of these items that will cost more than the sublimit to replace, then you will need to nominate them to ensure that they are covered for more than the sublimit. Costs The premium payable by you is shown in your Certificate of Insurance. The premium is payable either when the product is purchased or you may elect to pay it monthly. If you elect to pay monthly there is an additional fee. These amounts are shown on your current Certificate of Insurance. A cancellation fee may apply if you cancel your policy before expiry. Premiums and fees are subject to Commonwealth and State taxes which include the Goods and Services Tax and Stamp Duty which are shown on your Certificate of Insurance. 4

5 Privacy All companies in the QBE Group are committed to safeguarding your privacy and the confidentiality of your personal information. QBE collects only that personal information from or about you for the purpose of assessing your application for insurance and administering your insurance policy, including any claim made by you. QBE will only use and disclose your personal information for a purpose you would reasonably expect. We will request your consent for any other purpose. Without this personal information we may not be able to issue insurance cover, administer your insurance or process your claim. Our aim is to always have accurate and up-to-date information. When you receive a Policy Schedule, Certificate of Insurance, Renewal or other document from us, you should contact us if the information is not correct. QBE uses the services of a related company located in the Philippines to provide Call Centre sales and claims handling, accounting and administration services to QBE in Australia. QBE or our authorised agent may collect or disclose your personal information from or to: any person authorised by you; a mail house, records management company or technology services provider (for printing and/or delivery of mail and , including secure storage and management of our records). These companies may be located or the records stored using 'Cloud' technology overseas, including in India, Ireland, USA or the Netherlands; a financier whose name appears on your Policy Schedule (for the purpose of confirming the currency of your Policy or when you have a claim and the insured property is a total loss, to confirm if the financier has a current interest); an organisation that provides you with banking facilities (for the purpose of arranging direct debit or other payment transactions or confirming payments made by you to us); a financial services provider or our agent who is arranging your insurance (for the purpose of confirming your personal and insurance details); another person named as a co-insured on your Policy (for the purpose of confirming if full disclosure has been made to us); another insurer (to obtain confirmation of your no claim bonus or to assess insurance risks or to assist with an investigation); our reinsurer that may be located overseas (for the purpose of seeking recovery from them); a dispute resolution organisation such as the Financial Ombudsman Service (for the purpose of resolving disputes between QBE and you or between QBE and a third party); a company to conduct surveys on our behalf for the purpose of improved customer services; and an insurance reference bureau (to record any claims you may make upon us). In addition to the above, in the event of a claim, QBE or our authorised agent may disclose your personal information: to a repairer or supplier (for the purpose of repairing or replacing your insured items); to an investigator, assessor (for the purpose of investigating or assessing your claim); to a lawyer or recovery agent (for the purpose of defending an action by a third party against you or recovering our costs including your excess or seeking a legal opinion regarding the acceptance of a claim); to a witness to a claim (for the purpose of obtaining a witness statement); to another party to a claim (for the purpose of obtaining a statement from them or seeking recovery from them or to defend an action by a third party). Personal information (about you) may also be obtained from the above people or organisations. In addition we will: 5

6 give you the opportunity to find out what personal information we hold about you and when necessary, correct any errors in this information. Generally we will do this without restriction or charge; and provide our dispute resolution procedures to you, should you wish to complain about how we handle your personal information. TUS Privacy Policy can be viewed at The General Insurance Code of Practice QBE Insurance (Australia) Limited is a signatory to the General Insurance Code of Practice. The Code aims to: promote more informed relations between insurers and their customers; and improve consumer confidence in the general insurance industry; and provide better mechanisms for the resolution of complaints and disputes between insurers and their customers; and Complaints commit insurers and the professionals they rely upon to higher standards of customer service. We will do everything possible to provide a quality service to You. However, We recognise that occasionally there may be some aspect of Our service or a decision We have made that You wish to query or draw to Our attention. We have a complaints and dispute resolution procedure which undertakes to provide an answer to Your complaint within 15 working days. If You would like to make a complaint or access Our internal dispute resolution service please contact TUS in the first instance and ask to speak to the TUS Complaints officer. 6

7 Important notice to policyholders It is important to read/retain the following documents and keep them in a safe and convenient place: this document your current Certificate of Membership Remember to regularly review your insurance policy, particularly at renewal to ensure your insurance policy provides the cover that you currently need. Your Duty of Disclosure Before You enter into this contract of insurance, You have a duty under the INSURANCE CONTRACTS ACT 1984, to disclose to Us every matter that You know, or could reasonably be expected to know, is relevant to Our decision whether to accept the risk of the insurance and, if so, on what terms. You have the same duty to disclose these matters to Us before You extend, renew, vary or reinstate this Policy. Your duty, however, does not require disclosure of any matter that: reduces Our risk; is common knowledge; We know, or as an insurer should know; We indicate that We do not want to know. Non - Disclosure If You fail to comply with Your duty of disclosure We may be entitled to reduce Our liability under this Policy in respect of a claim or may cancel this Policy. If Your non-disclosure is fraudulent, We may also have the option of avoiding this Policy from its beginning Providing proof and safety of documents Please remember that it is important to keep the following documents in a safe and convenient place: your Insurance Policy booklet your current Membership Certificate/Insurance Schedule documents that support the value of the property you have insured with us, e.g. Valuation Certificates documents that prove ownership of your goods, e.g. receipts, user manuals/and or guides Preventing our right of recovery If you have agreed not to seek compensation from another person who is liable to compensate you for any loss, damage or liability which is covered by this policy, we will not cover you under this policy for that loss, damage or liability. Goods and Services Tax (GST) This policy has provision for payment of Goods and Services Tax: by you in relation to premiums by us in relation to claims 7

8 Paying your premium You may pay your premium by cash, cheque or credit card. However, if you use a cheque or credit card which is dishonoured this policy will not operate at all. This means you will not be covered in the event of a claim. Reinstatement of sum insured after a claim We will reinstate your contents sum insured following a claim unless that claim exhausted the sum insured. In the event of a total loss the cover on the exhausted section will end. Your contract with TUS Your Insurance Protection for Contents & Personal Property for VillageWISE is a contract between you (the insured) and us (TUS). In return for payment of your premium, we will provide you with the cover set out in this policy. This insurance covers events happening between the dates shown as the period of insurance on the Membership Certificate/Insurance Schedule. Your insurance commences and concludes at 4.00pm local time on the dates shown. Your current Membership Certificate /Insurance Schedule is the most recent certificate we give you. We will give you a current Membership Certificate / Insurance Schedule: after you have paid your premium and we agree to cover you when any of the terms and conditions that apply to your policy are changed when we offer you renewal Your contents are insured with TUS if a sum insured is shown for contents on the current Membership Certificate/Insurance Schedule. 8

9 Definitions Some words have a special meaning in this insurance policy: Accidental damage Collection Fixture means any breakage or form of destruction, but does not include wear and tear or damage caused by tenants or their visitors means a group of individual items, pairs or sets which are of a similar type and which, when grouped together, take on a greater value than the sum of the individual items, pairs or sets values means any item which is permanently attached or fixed to the structure of your home Flood Guest Home improvements Incident Site Sum insured You and your Your family means "the covering of normally dry land by water that has escaped or been released from the normal confines of any of the following: a lake (whether or not it has been altered or modified); a river (whether or not it has been altered or modified); a creek (whether or not it has been altered or modified); another natural watercourse (whether or not it has been altered or modified); a reservoir; a canal; a dam." means a visitor temporarily visiting or temporarily living with you at the site for up to 30 consecutive days are any permanent additions in or around your home that add to the cost of rebuilding or repairing it. 10 Contents Cover What contents means Your contents are those items that are not permanently attached or fixed to the structure of your home at the site shown on the Membership Certificate / Insurance Schedule. Contents are divided into two categories: General contents Special items of contents (valuables) General contents a) Property which belongs to you or for which you are responsible while it is at the situation. b) Household goods, furniture, furnishings and clothing. c) Household goods including pianos and organs and portable domestic appliances. d) Potted plants kept in the home e) Money, cheques, stamps and other negotiable instruments, limited to $1,500 in total f) Title deeds, documents, and manuscripts we will only cover the cost of replacing the document g) Fixtures and home improvements in your home unit which are not covered by a body corporate or strata title policy or your Village Occupancy Contract h) Free standing swimming pools that can be moved from the site together with their accessories i) Accessories or spare parts for motor vehicles, motor cycles, trailers or watercraft that are contained in your home at the site but excluding accessories or spare parts that are in or on any motor vehicle, motor cycle, trailers or watercraft limited to $1,000 in total j) Computer hardware and software limited to $5,000 in total. Please note stored data or its restoration cost is limited to $750. k) Property used in surgery or office limited to $15,000 in total. l) If you live in a strata title building, the internal paintwork, wallpaper and any fixture or structural improvement within or attached to that residence which the Body Corporate is not required by law to insure m) If you are a tenant, landlord s fixtures and fittings for which you are legally liable and fixtures and n) Fittings installed by you for your own use o) Golf buggies, motorcycles up to 125 cc. engine capacity, garden equipment, ride on mowers motorised wheelchairs, gofers, or minibikes p) Canoes, surfboards, surf skis or sailboards and any watercraft not exceeding 3 metres in length and 10 horsepower q) Goods that you use for earning an income while they are at your situation for which you would normally receive a taxation deduction for these limited to $1,000 in total r) Bicycles, but limited to $5,000 in total s) Tools of trade and equipment used for a business activity (not home office or surgery equipment) $3,000 10

11 Special items of contents (Valuables) The following are special items and have limits of $3,000 per item, set, pair or collection and in total 20% of the sum insured for any one loss. 1. Jewellery, watches, items containing gold or silver, precious stones 2. Works of art, pictures, tapestries, Persian or similar rugs or carpets, curios, antiques, furs, collections, documents, musical instruments (other than pianos or organs) If we have agreed to provide more than $3,000 worth of cover for each item, set, pair, or collection, they will be listed on your current Membership Certificate/ Insurance Schedule. What contents does not mean 1. Fish, birds or animals of any description 2. Trees, shrubs and any other plant life (other than potted plants kept on your site) 3. Any caravan or trailer 4. Motorised vehicles other than in (n) above 5. Watercraft including jet skis other than in (o) above 6. Aircraft or their accessories (other than a non-pilotable model aircraft) 7. Accessories or spare parts of motor vehicles, caravans, trailers, aircraft or watercraft while they are in or on the motor vehicle, caravan, trailer, aircraft or watercraft 8. Photographic and video equipment and musical instruments or musical equipment used for earning income 9. Any property illegally in your possession 10. Commercial or retail trade stock 11. Cash takings relating to your trade, business or profession Excess - the amount you have to pay if you have a claim Your financial contribution if you have a claim is known as the excess. The excess amount that you will have to pay when you make a claim is shown on your Membership Certificate/ Insurance Schedule. In the case of damage caused to your home by an earthquake or tsunami the excess to be paid is $300. This is the maximum excess you will have to pay and replaces any other excess indicated on your Membership Certificate/Insurance Schedule. All loss, destruction or damage occurring within a period of 72 hours of the earthquake or tsunami is regarded as the one earthquake. 11

12 Basis of Settlement We will pay the cost of repairing or replacing your contents when in the home or on the site when loss or damage occurs. This cover includes contents for which you are legally responsible. Under this policy we may choose either to: repair or replace the contents pay you the reasonable cost of repairing or replacing the contents, or pay you the sum insured We will not deduct an allowance for depreciation when making a payment for loss or damage. The replacement of floor coverings will be limited to the room, hall, or passageway where the loss or damage occurs. What you are insured against We will cover you for Accidental loss or damage to your contents, but not loss or damage caused by tenants or their visitors. We also cover you against the following: A. Loss or damage caused by electrical motor burnout (limit $2,000 for any one loss) We will cover you for damage caused by mechanical or electrical breakdown, including damage caused by an electric current to any domestic electric motor, in any appliance forming part of the contents. But we will not pay for costs which can be covered under guarantee B. Frozen and refrigerated food spoilage (limit $1,000 in total) If your contents are insured by this policy, we will cover you for loss or damage to frozen and/or refrigerated food (up to $1,000 total) which becomes unfit for consumption due to: breakdown or failure of the refrigeration unit; accidental failure of a public electricity supply to your situation; escape of refrigerant or fumes; power supply authority ceasing to supply electricity to the situation for commercial reasons; or switching/turning the electricity supply off at your home. We seek your cooperation by doing whatever you can to prevent the spoilage of food. 12

13 Contents where a maximum limit applies The maximum we pay on the following contents items is shown below. (You may obtain higher limits by having any of these items except (e) specified on your schedule. We pay up to the amount specified.) Works of art, pictures, tapestries rugs, antiques, items of jewellery gold or silver articles, furs, watches collections of any kind Office or surgical equipment used by you or your family in your or their own business in the home Accessories, or spare parts of motor vehicles, caravans, trailers and watercraft NOT in or on the motor vehicle, caravan, trailer, or watercraft and are contained within your building at your site $3,000 per item, set, pair or collection and in total 20% of the sum insured for contents for any one loss $15,000 in total $2,000 in total Bicycles $1500 limit any one bicycle $5,000 in total Money $1,500 Goods that you use for earning an income excluding office and surgery equipment Computer hardware and software but excluding stored data or data restoration cost Potted plants Open Air limit (includes structures that are not fully enclosed at the site). For loss or damage by Storm or Theft Data stored on any computer, computer disk or tape (including the costs of restoring the data) Hearing Aids $5,000 in total $5,000 in total Up to $200 for any one plant and up to $1,500 in total $5,000 in total $750 in total $2,500 any one aid, and $5,000 per pair 13

14 Additional benefits We pay the following additional benefits as part of your sum insured for contents. Illegal use of credit card, financial transaction card or personal cheque If your credit card, financial transaction card or Personal Cheques are lost or stolen during the period of insurance shown on your Membership Certificate /Insurance Schedule, we pay up to $1,000 towards any legal liability you incur from its unauthorised use. We do not pay if: the card/cheque does not belong to you or your family, or you have not complied with the card issuers or financial institutions requirements, or the unauthorised user of the card or cheque is someone living at the site Guests contents If this policy insures your contents, we also insure contents up to $1,000 in total belonging to any visitors temporarily living with you at the site shown on the Membership Certificate/Insurance Schedule for up to 30 consecutive days. We do not pay: for visitors contents that are insured under another policy for any cash or negotiable instruments Replacement of locks and keys We pay up to $1,000 to replace or alter locks and keys to your home which are damaged or stolen from anywhere in Australia. Change of site If this policy insures your contents and you are moving into a new home within Australia, we insure your contents at both sites for a maximum of 45 days. The maximum we pay at each site will be the proportion of the sum insured that the value of the contents at that site bears to the total value of the contents at both sites. You must tell us of your new address within 45 days of first moving to it. Transit cover If you are moving you or your family s contents by land to a new home within the same state or territory in Australia in which you and your family are living, then we will pay the reasonable cost of replacing or repairing the contents up to $2,000 or 20% of the sum insured (whichever the greater) if they are damaged or destroyed by: fire collision or overturning of the conveying vehicle carrying your contents 14

15 Cover for contents away from the site We will give you and your family limited cover for loss or damage to contents away from the site in Australia & New Zealand if: they are owned by you, and you are legally responsible for them We will pay up to 20% of the sum insured if contents suffer loss or damage covered by the policy. We will not cover you or your family for the following contents while they are away from the site: computers or tools of trade We pay the following additional benefits in addition to your sum insured for contents. Relocation expenses In addition to the sum insured, we will pay for those out-of-pocket expenses which you incur if we decide you cannot live in your home. Your out-of-pocket expenses include: temporary accommodation to a home, unit or flat of a similar standard excluding cost of meals and other expenses that would normally be incurred had the loss not occurred removing, storing, and returning the contents of your home This cover is available only if: you live in your home permanently, and your home suffers loss or damage covered by the policy We will pay for your out-of-pocket expenses for the reasonable time taken to rebuild or repair your home but not for more than 12 months from the time of the damage. Automatic reinstatement of sum insured The benefit applies to the sums insured for unspecified contents as shown on the Membership Certificate/Insurance Schedule. Following payment of a claim other than a claim for total loss the sums insured will be reinstated unless you request otherwise. Compensation for death We will pay $10,000 to the legal representative of the deceased person in the event of death to you or a member of your family normally living with you as a direct result of physical injury caused by loss or damage at the site. We do not pay in any one period of insurance more than $10,000 in total under this additional benefit. Modifications to the home If this policy insures: the home and it is your principal place of residence; or the contents if the home is a strata title residence and it is your principal place of residence; or the contents if you are a tenant and you or a member of your family normally living with you are permanently and totally disabled* as a direct result of a claim payable under this policy and occurring at the site, 15

16 we pay up to $10,000 for the cost incurred by you in modifying your home or in relocating you to a suitable home. *Permanent Total Disablement means: total paralysis of both legs and a part of or the whole of the lower half of the body; or total paralysis of both legs and both arms which continues for a period of 12 months and after that time is considered to be of indefinite duration Legal defence costs We will pay or reimburse you for your legal fees, costs, and expenses which you reasonably incur in legal proceedings initiated against you by a third party (and defended by you) but only where the proceedings are commenced in Australia during the period of insurance. The maximum we pay is $5,000 for any one claim or series of claims arising from the same cause or event. We do not pay or reimburse you for proceedings or claims related to: fines, penalties, punitive damages claims by family members including spouse, ex-spouse, partner, or ex-partner claims relating to divorce, separation, child visitation, maintenance, property disputes, your business activities dishonesty, intentional violence, misconduct defamation or slander facts or occurrences, occurring prior to the commencement of the policy which you knew or ought to have known at the time of commencement of this policy legal proceedings initiated, threatened or commenced prior to the commencement of this policy any workers compensation legislation, industrial award or agreement, or statutory accident compensation scheme or compulsory third party insurance criminal prosecution Exploration costs / location escaping liquid Where we pay for damage caused by liquid escaping from any fixed basin, shower base, or other fixed apparatus, fixed tanks, or fixed pipes used to hold or carry liquid, we will not pay for: damage resulting from the breakdown of grouting or sealer over a period of time allowing for seeping under tiles which results in the lifting of tiles, nor for damage caused over a prolonged period of time. Guard or security services We will pay up to $500 for fees or charge incurred for guard or security services for all claims under this policy in relation to the one occurrence Veterinary expenses When your contents are insured by this policy we will pay up to $300 for reasonable veterinary expenses for your domestic pet, injured as a result of a road accident. 16

17 What you are not insured against Loss, liability, injury or damage caused by: 1. a deliberate or criminal act by you or another person who is acting with your express or implied consent; 2. lawful confiscation, delay, destruction, detention, nationalisation, requisition or seizure; 3. nationalisation, requisition, destruction of or damage under the order of any Government Authority; 4. directly or indirectly by tree lopping or felling by you or another person who is acting with your express or implied consent; 5. anything which your tenant or licensee is responsible for under the terms of their lease, licence or similar agreement, when you are the landlord of: a. your home at the situation (when contents cover applies); 6. any event that does not occur within the period of insurance. 7. storm, rainwater or wind to: retaining walls, free standing walls, fences or gates not constructed of brick, concrete, masonry or stone 8. erosion, subsidence, landslide or earth movement other than as a direct result of explosion earthquake escaping liquid and occurring no more than 72 hours after the event 9. the action of the sea, high water, tidal wave 10. water entering the home through an opening made for the purpose of alterations, additions, renovations or repair 11. inherent defects, structural defects, faulty workmanship, faulty design or any gradual process 12. wear, tear, rust, corrosion, depreciation or gradual deterioration 13. mold, mildew, algae, atmospheric or climatic conditions (other than storm) 14. settling, shrinkage or expansion in buildings, foundations, walls or pavements 15. the removal or weakening of supports or foundations for the purpose of alterations additions, renovations or repair 16. damage to swimming pools or similar structures caused by hydrostatic pressure 17. loss of, or damage to electronic equipment or data caused by electronic or mechanical derangement or malfunction or by a virus, or processing error 18. any consequential loss other than that specifically provided by this policy 19. any process of cleaning involving the use of chemicals 20. vermin, insects, wildlife 21. an animal kept by you or your family 22. the deliberate application of heat or for loss of damage caused by fire to any item designed to 17

18 withstand the application of heat 23. tree roots 24. impact damage to paths, driveways, or underground services by the weight of any vehicle 25. the breakage of sporting equipment whilst in play or use 26. storm or rainwater to trees, shrubs or plants. 27. breakage of musical instruments while being used for their designed purposes or used in a business or for professional use Theft or attempted theft: 1. by persons who live in your home, or have entered your home or the site with your consent or the consent of a person who lives in your home War, Terrorism & Radioactivity 1. Loss, damage, destruction, death, injury, illness, liability, cost or expense of any nature directly or indirectly caused by, contributed to by, resulting from, arising out of or in connection with any of the following, regardless of any other cause or event contributing concurrently or in any other sequence to the loss: a. War, invasion, acts of foreign enemies, hostilities or warlike operations (whether war be declared or not), civil war, rebellion, revolution, insurrection, civil commotion assuming the proportions of or amounting to an uprising, military or usurped power, or b. Any act(s) of Terrorism that is directly or indirectly caused by, contributed to by, or in any way involves or is connected with biological, chemical, radioactive, or nuclear pollution or contamination. c. For the purpose of this exclusion, an act of terrorism includes any act, or preparation in respect of action, or threat of action designed to influence the government de jure or de facto of any nation or any political division thereof, or in pursuit of political, religious, ideological or similar purposes to intimidate the public or a section of the public of any nation by any person or group(s) of persons whether acting alone or on behalf of or in connection with any organisation(s) or government(s) de jure or de facto, and which: involves violence against one or more persons, or involves damage to property, or endangers life other than that of the person committing the action, or creates a risk to health or safety of the public or a section of the public, or is designed to interfere with or to disrupt an electronic system. d. Radioactivity or the use, existence or escape of any nuclear fuel, nuclear material, or nuclear waste or action of nuclear fission or fusion. 2. This Policy also excludes any loss, destruction, damage, death, injury, illness, liability, cost or expense of any nature directly or indirectly caused by, contributed to by, resulting from or arising out of or in connection with any action taken in controlling, preventing, suppressing, retaliating against, or responding to or in any way relating to 1, 2 or 3 above. 18

19 Optional covers Personal property Personal property consists of the following items: Jewellery, watches, furs, gold and/or silver articles, precious stones Photographic Equipment, video cameras, telescopes, binoculars Portable computers and mobile phones Musical instruments and associated equipment Hearing Aids (considered as individual items and not a pair) and Spectacles Wheelchairs, Gofers and Minibikes Bicycles and sporting equipment Cover is provided for your Personal Property items noted on your Membership Certificate / Insurance Schedule anywhere in Australia or New Zealand. Worldwide cover is limited to a period not exceeding 90 days. Automatic cover is provided for Unspecified Personal Property up to $3,000 per item, set or pair up to a maximum $5,000 or 20% of the Contents Sum Insured (whichever is the greater) in total for any one event. You can specify personal property items for amounts greater than $3,000 per item, set or pair by supplying a current (not more than two (2) years old) valuation certificate or purchase receipt showing the replacement value The amount of specified and unspecified Personal Property will be shown in your Membership Certificate / Insurance Schedule. In addition to What you are Not Insured Against under contents, we will not pay for loss or damage due to: a. the action of light or atmospheric conditions b. any process of cleaning, repairing, altering, restoring, or renovating the item c. scratching, denting, or breakage of musical instruments d. electronic or mechanical breakdown or failure. Further, we will not pay for: e. articles used for professional purposes f. breakage of sporting goods and musical instruments while being used for their designed purpose g. damage to watches or time pieces by overwinding, denting, or internal damage In respect of Bicycles, we will not pay for: damage caused to tyres by punctures, bursts, road cuts, or by application of brakes loss, damage, or destruction occurring whilst your bicycle is being used in any form of competition. 19

20 Legal liability What is legal liability? We will pay all sums provided by this policy which you shall become legally liable to pay by way of compensation arising from any circumstance which results in : (a) (b) the death of, or bodily injury to any person the loss of or damage to property due to an occurrence during the period of insurance within Australia & New Zealand. An occurrence includes continuous or repeated exposure to substantially the same general conditions. We regard all death, bodily injury or loss or damage to property arising from one original source or cause as an occurrence. When we will pay If you have insured your contents and live in a rented building, we will pay the amount you have to pay as owner of your contents, or occupier of the residence. If you have insured your contents and you own part of a residence that has been subdivided, we will pay the amount you have to pay as owner of your contents or occupier of your part of the residences. We will not pay for any occurrence that happens in any common areas of the residence. If you have insured your contents we will pay the amount you have to pay for an occurrence that happens, anywhere in the world. This does not include the amount you have to pay because you are the owner or occupier of the residence. What we will pay (a) (b) (c) We pay up to $20,000,000 for any one occurrence. We do not pay more than this amount in total under all policies we have issued to you which cover the same liability. In addition to this amount, we pay legal costs for which we have provided prior written approval. Additional Benefits These additional benefits apply only when the Policy insures your contents in your primary residence. Liability for Vehicles We will pay the amount you become legally liable in Australia & New Zealand to pay arising from the ownership, custody or use of any vehicle which is a type that is not required to be registered by law any motorised wheelchair, golf buggy or ride on mower any domestic trailer not attached to a vehicle 20

21 We also insure you or any member of your family against claims for: death or bodily injury caused by you or your family solely as a result of you or your family being passengers in a registered vehicle death or bodily injury caused by any registered vehicle if the occurrence causing the death or bodily injury takes place at the site We do not insure you or your family if you or your family are entitled to be wholly or partly insured by any compulsory statutory insurance or accident compensation scheme, or would have been, but for failure to register the vehicle or to apply for cover under the scheme or to comply with a term or condition of the scheme if you or your family are entitled to be wholly or partly protected by any other policy of insurance which specifically covers the vehicle, (except where this exclusion would contravene Sect 45 of the Insurance Contracts Act 1985). Liability cover for tenants and strata titles owners If you are either a tenant or a strata title holder we will cover you against legal liability for claims that arise as a result of incidents: occurring in your home or on the site, or for which you are liable as owner or occupier of your home or the site The incident which gives rise to the claim must cause: bodily injury, death, or illness to a person other than you or your family, or damage to property other than your home or any property which you or your family own or are legally responsible for If you are a tenant we will cover you for loss or damage you cause to any property owned by your landlord left in your home for your use. Any person residing with you, other than a boarder or a tenant, cannot claim against your liability cover. Liability for Committee Members We will pay the amount you become legally liable in Australia to pay for an alleged or actual act or omission arising out of your position as a committee member of a sporting or social club. We will not pay if you receive any payment or remuneration of any kind in excess of $1,000 per year for holding the position. The most we will pay under this additional benefit in any one period of insurance is $10,000. We do not insure you or your family against liabilities arising from 1. Penalties, fines or awards of aggravated, exemplary or punitive damages made against you. 2. Ownership, custody or use of a motor vehicle, motor cycle, mini bike, aircraft, jet ski, or watercraft, other than: a. provided for under Additional Benefit Liability for vehicles, b. model or toy aircraft, 21

22 c. a surfboard, sailboard or surf skis, and d. watercraft less than 4 metres long and not powered by a motor, or powered by a motor less than 10 horsepower. 3. Use of a caravan or trailer when the caravan or trailer is attached to a motor vehicle or motor cycle. 4. Death or bodily injury to you, or any member of your family who normally lives with you, or any other person who normally lives with you. 5. Death or bodily injury to any person you employ and that injury arises from their employment with you. 6. Damage to or loss of property that belongs to you, or any member of your family who normally lives with you, or any other person who normally lives with you. 7. Damage to or loss of property that belongs to any person you employ and that damage or loss arises from their employment with you. 8. Damage to or loss of property that is in your control, or the control of any member of your family who normally lives with you, or any other person who normally lives with you. 9. Any disease that is transmitted by you, or any member of your family who normally lives with you. 10. Any business, profession, trade or occupation carried on by you. This does not include being a committee member of a sporting or social club provided that you do not receive more than $1,000 per year for holding this position. We do not consider the following to be a business for the purpose of this exclusion: the renting of your residence(s)s at the situation for residential purposes, and casual babysitting carried on by you anywhere in Australia. 11. The use or presence of asbestos, or in connection with the use or presence of asbestos. 12. Alterations, repairs, renovations or additions to your residence that cost more than $100, Any agreement or contract you enter into. We will pay for your liability if you would have been liable without the agreement or contract. 14. Gaining a personal profit or advantage that is illegal. 15. A conflict of duty or interest. 16. Any act or omission that is dishonest, fraudulent, criminal, wilful or malicious. 17. Any loss that can be reimbursed by your sporting or social club. 18. Any alleged or actual act or omission committed, or alleged to have been committed, prior to the commencement of the policy 22

23 General Conditions Changes You must tell us as soon as possible if circumstances occur, or if changes or alterations are intended or made which increase the risk of loss, damage or injury. Unoccupancy If you leave your home unoccupied for more than 160 consecutive days, you must tell us and obtain our written agreement for cover to continue. If you do not do so, the cover for home and contents is limited to lightning, thunderbolt and earthquake for the period in excess of 160 consecutive days during which you have left the home unoccupied. The period of 160 consecutive days is calculated from the date when you last occupied the home, regardless of the commencement or renewal date of the policy. Other interests You must not transfer any interests in this policy without our written consent. All persons entitled to any benefit under this policy are bound by the terms of this policy. We insure those interests you notify to us when we issue cover, or which are notified to us during the currency of this policy, and which we agree to insure. How to make a change to this policy If you want to make a change to any information on your current Membership Certificate / Insurance Schedule, you are required to notify JLT in writing. The change becomes effective when we tell you we agree to it by giving you a new Membership Certificate/ Insurance Schedule. Cancelling this policy TUS can cancel this policy at any time but only in accordance with Sections 59 and 60 of the Insurance Contracts Act We will be entitled to retain premium for the period during which the policy has been in force. You may be required to pay an administration fee if you cancel this policy. If you have a total loss or we settle your claim by paying the full sum insured, this policy will come to an end and no refund of premium is due to you. Credit provider s rights Credit provider means a licensed credit provider, e.g., a bank, building society, or credit union. If there is any credit provider we have the option of choosing to make a payment to this party. 23

24 Claims Your responsibility when making a claim At the time of an event giving rise to a claim, it is your responsibility to advise JLT by telephone on or in writing as soon as is reasonably possible but within 30 days and promptly provide any information requested. A claim form will be sent to you when you advise of the claim. Please complete and return this form promptly. Make a report to the police following any claim for theft, attempted theft, malicious acts, or accidental loss. Do not admit that you are at fault or make any attempt to settle or defend a claim. Do not authorise any repairs without authority from JLT. Any letters, notices, or legal documents you receive which relate to the event are to be forwarded to JLT immediately. If we pay a claim under your policy we may take possession of damaged property and deal with it in a reasonable manner. If TUS pays the full sum insured, this policy will come to an end and no refund of premium is due to you. Circumstances where TUS may refuse to pay a claim We may refuse to pay a claim or may cancel this policy in the following circumstances: you are not honest in any statement made in relation to a claim your buildings are not watertight or structurally tight or not maintained in a good condition which includes having appropriate security you do not take appropriate care to protect your contents against initial loss or damage or further loss or damage once the initial loss has occurred you do not immediately make a report to the police if you suspect or should have suspected that: - something has been stolen from your home - someone has acted maliciously in relation to your home or to something in it if you make admissions, settle, attempt to settle, or defend any claims without TUS agreement What you must tell TUS in writing We may also refuse a claim or may cancel this policy, or do both, if you alter or remove all or part of any wall, foundation, roof, or structural component of your home, or build a new structure at the site your home or part of it is let or used for the purposes of a business, trade, or profession As a protection for all Policyholders we will take legal action against any person who makes a fraudulent claim. TUS has the right to recover any money it has paid. We shall have the full discretion as to the manner in which this recovery will be made. We may decide to take legal action in your name. Your full cooperation will be needed to ensure the best possible outcome. If any of your actions at the time of the claim are contrary to the action specified in this policy and these actions increase the difficulty in resolving your claim or cost of the claim, then we will be entitled to not pay the claim or reduce your compensation. 24
