1 F & A FEDERAL CREDIT UNION IMPORTANT: RETAIN FOR YOUR RECORDS VISA CREDIT CARD AGREEMENT AND FEDERAL TRUTH-IN-LENDING DISCLOSURE STATEMENT EFFECTIVE December 18, 2008 In this Visa Credit Card Agreement and Federal Truth-In-Lending Disclosure Statement ( Agreement ) the words YOU, YOUR, and YOURS mean each and all of those who apply for or use the Card and/or VISA Credit Card Account. WE, US, and OUR mean F&A FEDERAL CREDIT UNION. CARD means the Low Rate Visa, Rewards Visa, Traditional Visa, Collegiate Visa, Visa Gold and/ or Visa Classic) issued to you and any duplicates and renewals we may issue. ACCOUNT means your Low Rate Visa, Rewards Visa, Traditional Visa, Collegiate Visa, Visa Gold and/ or Visa Classic Account with us. By requesting and receiving, signing, using orpermitting others to use the Card and/or Account issued to you by us, you agree to be bound by the terms and conditions as set forth herein and any amendments thereto. AUTHORIZATION AND PAYMENT: You authorize us to pay and charge your Account for all Purchases, Cash Advances, and/or Balance Transfers made or obtained by you or anyone you authorize to use your Card or Account. You will be obligated to pay all such Purchases, Cash Advances, and/ or Balance Transfers charged to your Account whether resulting from: (1) actual use of your Card or Convenience Checks; (2) mail order or telephone, computer, or other electronic Purchases, Cash Advances, and/or Balance Transfers made without presenting the Card; or (3) any other circumstance where you authorize a Purchase, Cash Advance, and/or Balance Transfer, or authorize someone else to make a Purchase, Cash Advance, and/or Balance Transfer, to your Account (collectively, authorized charges ). You promise to pay us or to our order in U.S. Dollars with an instrument drawn on a financial institution in the United States at our office or at the address set forth on your periodic statement, all authorized charges on the terms and at the rates set forth herein plus any FINANCE CHARGES assessed on your Account and any other charges and fees which you may owe us under the terms of this Agreement. Payments will continue until you have paid in full the Account Balance. FINANCE CHARGE: The FINANCE CHARGE for the billing cycle will be the sum of three (3) components: Foreign Transactions Fee: The first (1st) component of the FINANCE CHARGE is the Foreign Transactions Fee. Purchases, Cash Advances, and credit transactions made in foreign currencies are subject to a Foreign Transactions Fee FINANCE CHARGE of 1% or 0.8% of the amount of the Purchase, Cash Advance, or credit transaction which is posted to the Account during the billing cycle. Periodic Rate for Purchases and Cash Advances: The second (2nd) component of the FINANCE CHARGE is the monthly periodic FINANCE CHARGE for Purchases and Cash Advances. The initial monthly periodic rate used in calculating the FINANCE CHARGE for Purchases and Cash Advances is the Monthly Periodic Rate for Purchases and Cash Advances applicable to your Account set forth in the Rate Table (the corresponding for Purchases and Cash Advances applicable to your Account is set forth in the Rate Table) that accompanies this Agreement and is incorporated herein by this reference as though set forth in full. The monthly periodic rate for Purchases and Cash Advances is determined by dividing the for Purchases and Cash Advances by 12. There is no transaction fee for Cash Advances. Balance Transfers Fee: The third (3rd) component of the FINANCE CHARGE is the monthly periodic FINANCE CHARGE for Balance Transfers. The initial daily periodic rate used in calculating the FINANCE CHARGE for Balance Transfers is the Monthly Periodic Rate for Balance Transfers applicable to your Account set forth in the enclosed Rate Table (the corresponding for Balance Transfers applicable to your Account will be disclosed to you with any promotional offer you receive). The monthly periodic rate for Balance Transfers is determined by dividing the ANNUAL PERCENTAGE RATE for Balance Transfers by 12. MINIMUM MONTHLY PAYMENT DUE: Every month, you must pay at least the Minimum Monthly Payment Due by the Payment Due Date shown on your monthly statement. By separate agreement, you may authorize us to automatically transfer the Minimum Monthly Payment Due from your Credit Union share or checking account. You may, of course, pay

2 more frequently, pay more, or pay the Account Balance in full, and you will reduce your periodic FINANCE CHARGE by doing so. If you do not meet the Minimum Monthly Payment requirements three (3) times from May 1st to April 30th each year, your account and credit history will be reviewed and your may be adjusted in accordance with the enclosed Rate Table based upon your current FICO score. In addition, you must pay any amount on your monthly statement listed as Past Due and any Late Charge. Lastly, at anytime your Account Balance exceeds your Credit Limit, you must pay the excess as well as any Over Limit Charge. You understand and agree that any payment made by you will be applied in the following order: (a) unpaid fees and charges, if any; (b) unpaid periodic FINANCE CHARGES due on both Purchases and Cash Advances; (c) unpaid periodic FINANCE CHARGES due on Balance Transfers; (d) outstanding balances of Balance Transfers; (e) current Balance Transfers; (f) outstanding balances of Purchases and Cash Advances previously billed; and (g) current Purchases and Cash Advances. If two or more transactions are posted on the same day, your payment will be applied first to the smaller of them. MINIMUM MONTHLY PAYMENT: For Traditional Visa, Collegiate Visa and Visa Classic: The Minimum Monthly Payment due will be either: (a) three percent (3%) of your Account Balance, or $10, whichever is greater; or (b) your Account Balance if it is less than $10. MINIMUM MONTHLY PAYMENT: For Low Rate Visa, Rewards Visa and Visa Gold : The Minimum Monthly Payment due will be either: (a) two percent (2%) of your Account Balance, or $10, whichever is greater; or (b) your Account Balance if it is less than $10. LATE CHARGE FOR COLLEGIATE VISA, TRADITIONAL VISA AND VISA CLASSIC: If your Minimum Monthly Payment is not received by the Payment Due Date, we will charge a Late Charge of five percent (5%) of the monthly payment due or $20, whichever is less, but no less than $1. On Low Rate, Rewards Visa and Visa Gold cards (7), if your Minimum Monthly Payment is not received by the Payment Due Date, we will charge a Late Charge of $20. LATE CHARGE FOR LOW RATE VISA, REWARDS VISA AND VISA GOLD: If your Minimum Monthly Payment is not received by the Payment Due Date, we will charge a Late Charge of $20. OVERLIMIT CHARGE: You will be charged an Overlimit Fee of $20.00 with respect to any charge that causes the Account Balance to exceed the Credit Limit by more than three percent (3%). HOW TO COMPUTE THE PURCHASE BALANCE, CONSISTING OF TRANSACTIONS RELATED TO PURCHASES OF PROPERTY AND SERVICES, UPON WHICH PERIODIC FINANCE CHARGES ARE ASSESSED: Average Daily Balance (including new purchases). To avoid incurring an additional Periodic FINANCE CHARGES on the balance of Credit Purchases reflected on your monthly statement and on any new Credit Purchases appearing on your next periodic statement, you must pay the New Balance shown on your statement on or before the Payment Due Date. The Periodic FINANCE CHARGES for a billing cycle are computed by applying the Monthly Periodic Rate to the Average Daily Balance of Credit Purchases, which is determined by dividing the sum of the daily balances during the billing cycle by the number of days in the cycle. Each daily balance is determined by adding to the Previous Balance of Credit Purchases any new Credit Purchases posted to your Account and subtracting any payments as received and credits as posted to your Account, but excluding any unpaid FINANCE CHARGES. You have a 20 day grace period from the close of the statement period to pay the New Balance without incurring additional FINANCE CHARGES. If the New Balance is not paid in full during this grace period, FINANCE CHARGES will be assessed using the Average Daily Balance method as explained above. HOW TO COMPUTE THE ADVANCES BALANCE (CONSISTING OF TRANSACTIONS RELATED TO CASH AND OTHER ADVANCE TRANSACTIONS EXCLUDING BALANCE TRANSFERS) UPON WHICH PERIODIC FINANCE CHARGES ARE ASSESSED: Average Daily Balance (including new advances). The Periodic FINANCE CHARGES for a billing cycle are computed by applying the Monthly Periodic Rate to the Average Daily Balance of Cash Advances, which is determined by dividing the sum of the daily balances during the billing cycle by the number of days in the cycle. Each daily balance of Cash Advances is determined by adding

3 to the Previous Balance of Cash Advances any new Cash Advances as of the transaction date or the first day of the billing cycle in which the Cash Advance posted, whichever is later, and subtracting any payments as received and credits as posted to your Account, but excluding any unpaid FINANCE CHARGES. There is no grace period for Cash Advances. HOW TO COMPUTE THE BALANCE TRANSFER BALANCE UPON WHICH PERIODIC FINANCE CHARGES ARE ASSESSED: Average Daily Balance (including new Balance Transfers). The Periodic FINANCE CHARGES for a billing cycle are computed by applying the Monthly Periodic Rate to the Average Daily Balance of Balance Transfers, which is determined by dividing the sum of the daily balances of Balance Transfers during the billing cycle by the number of days in the cycle. Each daily balance of Balance Transfers is determined by adding to the Previous Balance of Balance Transfers any new Balance Transfers as of the transaction date or the first day of the billing cycle in which the Balance Transfer posted, whichever is later, and subtracting any payments as received and credits as posted to your Account, but excluding any unpaid FINANCE CHARGES. There is no grace period for Balance Transfers. Adding your Purchases FINANCE CHARGES (if any), Cash Advances FINANCE CHARGES and your Balance Transfer FINANCE CHARGES will determine your total FINANCE CHARGE for the billing cycle. The combination of periodic FINANCE CHARGES, Cash Advance Fee, Foreign Transactions Fee, and Balance Transfer Fee will not exceed the ANNUAL PERCENTAGE RATE permitted under applicable law. Actual FINANCE CHARGES will be shown on your monthly Statement. CREDIT LIMIT: We will establish a Credit Limit for you. You will not let the Account Balance exceed this Credit Limit. You agree to advise us of any change in your financial condition that may affect your creditworthiness. You may request an increase in your Credit Limit, but our Credit Committee or loan officer must approve Credit Limit increases. PURCHASES, ADVANCES, AND BALANCE TRANSFERS: You may make purchases and request advances and Balance Transfers in accordance with then current loan policies up to your Credit Limit. You understand and agree that all purchases and other transactions requested by you or anyone you have permitted to use the Card(s) and/or Account are subject to our approval. PROMOTIONAL RATE OFFERS: At our discretion, we may offer you a promotional for all or any part of the unpaid balance, Balance Transfer or future transactions. The period of time for which the promotional applies may be limited. Any applicable promotional ANNUAL PERCENTAGE RATE, the corresponding periodic rates, and the period of time during which they are in effect will appear on the offer. Any promotional rate offer will be subject to the terms of the offer and this Agreement. TRANSACTION FEE FOR BALANCE TRANSFERS: If you have obtained a Balance Transfer through the use of a Convenience Check or by other means, we may assess a Balance Transfer Fee of 2% not to exceed $ The Balance Transfer Fee may cause the ANNUAL PERCENTAGE RATE on the billing statement on which the Balance Transfer first appears to exceed the nominal. REPLACEMENT CARD FEE: Except as prohibited by law, you will be charged a Replacement Card Fee as set forth in our Schedule of Fees and Charges for all cards issued other than the standard re-issue card or for imprinting errors. DOCUMENT FEE: If a copy of any monthly statement, sales draft or similar document is provided by us at your request (other than in connection with a billing error inquiry), a Document Fee may be imposed by us on your Account as set forth on our current Schedule of Fees and Charges. USING THE CARD: To make a Purchase or obtain an Advance, there are two alternative procedures that may be followed. One is for you to present the Card or Card number to a participating Visa plan merchant, to us, or to another financial institution, and sign or authorize a sales or Cash Advance draft. The other is to complete the transaction by using your Personal Identification Number (PIN) in conjunction with the Card in an Automated Teller Machine or other type of electronic terminal that provides access to the Visa system. To make a Balance Transfer, there are two alternative procedures that may be followed. One is for you to call us at between the hours of 9:00 am to 4:00 pm, Monday through Friday, and tell us your

4 Account number, the amount of the Balance Transfer, and the name of the creditor and the account number from which you wish the Balance Transfer amount to be transferred to your Account with us. The other is to complete the transaction by making a Convenience Check payable to the creditor in the amount of the Balance Transfer (see Additional Terms Applicable to Convenience Checks. The effective date of the Balance Transfer is the date that we receive your request for the Balance Transfer or, if you send a Convenience Check directly to someone, the effective date is the date we receive the check for payment. You understand and agree that if you request and we process a Balance Transfer, you may lose the right to dispute the balance owed to the other creditor after the Balance Transfer transaction. Your Card and/ or Account may not be used directly or indirectly for: (1) any illegal activity or transaction; or (2) any gambling, gaming, betting, or similar activity or transaction. Further, you may not utilize your Card and/ or Account for the purchase of any goods or services on the Internet that involve gambling, gaming, betting, or any similar transaction or activity. Such transactions include, but may not be limited to, any quasi-cash or online gambling transaction, any electronic commerce transaction conducted over an open network, and any betting transaction including the purchase of lottery tickets or casino gaming chips/checks or off-track betting or wagering. However, in the event that a charge or transaction described in this paragraph is approved and processed, you will still be responsible for such charges. ELECTRONIC FUND TRANSFER: In the event a use of the Card or the Account number of the Card constitutes an Electronic Fund Transfer, the terms and conditions of your Electronic Services and Wire Transfers Disclosure and Agreement with you shall govern such transactions to the extent the Electronic Services and Wire Transfers Disclosure and Agreement expands or amends this Agreement. RECURRING PAYMENTS: The use of your Account to make preauthorized electronic recurring bill payments constitutes an Electronic Fund Transfer. You may be able to place a stop payment on a preauthorized electronic recurring bill payment in accordance with the terms of our Electronic Services and Wire Transfers Disclosure and Agreement. Any such stop payment order is subject to a fee as disclosed in our Schedule of Fees and Charges for each stop payment order you give. A stop payment/revocation order does not release you from the obligation to pay for goods and services purchased from merchants. PREPAYMENT OR IRREGULAR PAYMENTS: Though you need only pay the Minimum Monthly Payment Due, you understand that you have the right to repay your Account Balance at any time without penalty. You also understand and agree that you will only be charged FINANCE CHARGES to the date you repay your entire Account Balance. You may make larger payments without penalty and this may reduce the total amount of FINANCE CHARGES that you will repay. If you pay more than the Minimum Monthly Payment Due in any month and there is still a balance due, you must continue to make Minimum Monthly Payments in future months. Any partial payment of your Account Balance will not advance your next payment due date(s). You understand and agree that any payment that (a) delays or (b) accelerates the repayment of your Account Balance will (a) increase or (b) decrease your Monthly Periodic FINANCE CHARGE. PAYMENTS BY AUTOMATIC TRANSFER: If you request payment by automatic transfer, you understand and agree that no payment can or will be made if there are insufficient or uncollected funds in the designated sub-account to make the scheduled loan payment. Should this event occur, you understand and agree that you will not be released from making the payment. Any automatic transfer you have requested will remain in effect until you cancel it in writing or the Account Balance is paid in full. We may cancel this service at our discretion. DEFAULT: You will be in default if: (1) you do not pay on time or in the proper amount(s); (2) you fail to live up to any of the terms of this Agreement; (3) your creditworthiness is impaired; or (4) you die, become insolvent, or are the subject of bankruptcy or receivership proceedings. In the event of any action by us to enforce this Agreement, you agree to pay the costs thereof, reasonable attorneys fees, and other expenses. You understand and agree that FINANCE CHARGES at the as permitted under this Agreement will continue to accrue until you repay your entire loan. ACCELERATION AND COLLECTION COSTS: Upon your default, you understand and agree that we have the right to temporarily or permanently suspend any and all

5 Account and Card privileges and/or we may demand immediate payment of the Account Balance, FINANCE CHARGES, late charges, overlimit fees, and our collection costs, reasonable attorneys fees, and court costs (collectively, collection-related charges ). You understand and agree that you will be subject to FINANCE CHARGES (at the applicable Monthly Periodic Rate), late charges, overlimit fees, and collection-related charges under the terms disclosed in this Agreement, until you repay your entire Account Balance. RESPONSIBILITY: You agree to repay us according to the terms of this Agreement for all Purchases, Advances, Balance Transfers, FINANCE CHARGES, late charges, and overlimit fees, if any, arising from the use of the Account by you or any other person you permit to use the Account, even if that person exceeds your permission. You cannot disclaim responsibility by notifying us, although we will close the Account if you so request and you will return all Cards to us. Your obligation to pay the Account Balance continues even though an agreement, divorce decree, or other court judgment to which we are not a party may direct you or one of the other persons responsible to pay the Account. Any person using the Account and/or Card is jointly and severally responsible with you for charges he or she makes; but if that person signs the Card, he or she becomes a party to this Agreement and is also responsible for all charges on the Account, including yours. The Cards remain our property and you must recover and surrender to us all Cards upon our request and/or upon termination of this Account. UNAUTHORIZED USE: You may be liable for the unauthorized use of the Card and/or the Account. You will not be liable for unauthorized use that occurs after you provide notification by calling (800) , or when we receive notice in writing at 2625 Corporate Place, Monterey Park, CA , of the loss, theft, or possible unauthorized use. In any case, your liability for unauthorized use will not exceed $ Your liability may be lower in cases of Visa Credit Card fraud in accordance with current Visa U.S.A., Inc. Operating Regulations. LIEN ON SHARES: If you have voluntarily agreed to a lien on shares in your Visa Application, you understand and agree that if you are in default on the Account, we may impress and enforce a lien on all shares (except IRA accounts) then on deposit needed by us to repay the Account Balance in accordance with the Federal Credit Union Act 1757(11) and our Bylaws. PLEDGE OF SHARES: If you have signed a separate Share Pledge Agreement, you understand and agree that you are pledging, under the Uniform Commercial Code, shares now on deposit in your regular share account(s). You understand that you must, at all times, keep a sum equal to your Credit Limit on deposit in your regular share account(s) until you repay your entire Account Balance and the Account is terminated. You understand and agree that this security interest will cover future Purchases and Advances under this Agreement. If you default, we may apply these shares to repay your loan in accordance with federal or other law. You understand that the quoted above does not take into account the amount pledged in your regular share account(s). MEMBERSHIP REQUIREMENT: You understand and agree that you must be and remain a member in good standing with us to be eligible for continuing Account and/or Card privileges, including future Purchases and Advances. You also understand and agree that we may suspend the Account and/or Card privileges during any period in which you do not maintain your membership with us. TRANSACTION SLIPS: Your monthly statement will identify the merchant, electronic terminal or financial institution at which transactions were made, but sales, Cash Advance, paid Balance Transfer checks, credit or other slips cannot be returned with the monthly statement. You agree to retain the copy of your Balance Transfer checks and such slips furnished at the time of the transaction in order to verify your periodic statement. We may make a reasonable charge for any photocopies of slips you request. PLAN MERCHANT DISPUTES: We are not responsible for the refusal of any plan merchant or financial institution to honor the Account and/ or Card. We are subject to claims and defenses (other than tort claims) arising out of goods or services you purchase with the Card only if you have made a good-faith attempt but have been unable to obtain satisfaction from the plan merchant, and (a) your purchase was made in response to an advertisement we sent or participated in sending to you; or (b) your purchase cost more than $50.00 and was made from a plan merchant in your state

6 or within 100 miles of your current mailing address. Any other dispute you must resolve directly with the plan merchant. FOREIGN TRANSACTION: Purchases, cash advances, and credits made in foreign currencies will be billed to your Account in U.S. dollars. The conversion to U.S. dollars will be made in accordance with the Visa operating regulations for international transactions. Such regulations provide for either a 0.8% currency exchange fee for single currency international transactions (transactions made internationally without a currency conversion) or 1% currency exchange fee for multicurrency international transactions (transactions made internationally that require a currency conversion), which is added to the amount of the purchase, cash advance, or credit and retained by Visa. Transactions conducted in U.S. Military bases, Territories, Embassies or Consulates will not be subject to the 0.8% currency exchange fee. The exchange rate between the transaction currency and the billing currency used for processing international transactions is a rate selected by Visa from the range of rates available in wholesale currency markets for the applicable central processing date, which rate may vary from the rate Visa itself receives, or the government-mandated rate in effect for the applicable central processing date. The conversion rate may be different than the rate on the day of the transaction or date of the posting of the Account. When a credit to the Account does not fully offset a charge to the Account due to changes in the rate, you are responsible for the difference. RETURNS AND ADJUSTMENTS: Merchants and others who honor the Account and/or Card may give credit for returns or adjustments, and they will do so by sending us a credit slip, which will be posted to your Account. If your credits and payments exceed what you owe us, we will hold and apply this credit balance against future Purchases and Cash Advances, or if it is $1.00 or more, refund it on your written request or automatically after six (6) months. SURRENDER OF CARD(s): The Card(s) remain our property; and, if we request, you must surrender to us all Card(s) we issued on your Account. LOST OR STOLEN CARDS AND CONVENIENCE CHECKS: You will notify us AT ONCE if you believe that your Card, Account Number, PIN, Convenience Checks, or any combination of these has been lost or stolen, or if you believe that an electronic fund transfer has been made without your permission using information from a Convenience Check by immediately calling us at (323) or toll free at (800) For 24-hour card service call (800) Telephoning is the best way of keeping your possible losses down. A written notification to us should follow your telephone call. You understand that your total liability to us shall not exceed $50.00 for any Account and/or, Card, transactions resulting from the loss, theft or other unauthorized use of the Account and/or, Card, that occurs prior to the time you give notice to us. Such liability does not apply when the Account and/or Card is used to make an electronic transfer. PAYMENTS MARKED PAID IN FULL : We may accept checks, money orders, or other types of payment marked paid in full or using other language to indicate full satisfaction of any indebtedness, without being bound by such language or waiving any rights under this Agreement. Full satisfaction of indebtedness shall be accepted by us only in a written agreement, signed by an authorized representative. AUTOMATIC OVERDRAFT AUTHORIZATION: We may clear any overdrafts from your Checking account by an advance from your Account in the amount of the overdraft, subject to the terms of this Agreement. If you are not eligible for overdraft protection, your checks may be returned unpaid. All overdrafts are treated as cash advances. DELAY IN ENFORCEMENT: We can delay enforcing any of our rights under this Agreement without losing them. GOVERNING LAW: You understand and agree that this Agreement is made in California and shall be governed by the laws of the State of California to the extent that California law is not inconsistent with controlling Federal law. You also understand that California s choice of law rules shall not be applied if that would result in the application of non-california law. INTEGRATED DOCUMENTS: Any separate sheet of paper labeled Additional Disclosure Federal Truth-in-Lending Act, which is delivered together with this Agreement, is an integrated part of this Agreement. CHANGE OF TERMS: This Agreement is the contract which applies to all transactions on the

7 Account even though the sales, cash advance, balance transfers, credit or other slips you sign or receive may contain different terms. You understand and agree that we may amend, modify, add to, or delete from this Agreement any of its terms and conditions, including the method of application and the amount of FINANCE CHARGE, effective as to the Account Balance outstanding and any subsequent Advance, by mailing a notice of the change to you at your last known address. You also understand that any such notice will be mailed at least fifteen (15) days prior to the effective date of the change as required by federal or other law. Notice of a change in terms is required, but may be sent as late as the effective date of the change where the change has been agreed to, in writing, by you. CREDIT INFORMATION: You authorize us to investigate your credit standing when opening, renewing or reviewing your Account, and you authorize us to disclose information regarding your Account to credit bureaus and other creditors who inquire of us about your credit standing, to the extent authorized by law. TERMINATION: We may terminate this Agreement upon adverse reevaluation of your creditworthiness or your default. Either you or we may terminate this Agreement for other good cause. In no event shall any termination relieve you of your obligation to repay the entire Account Balance. You agree to return all Cards issued to you or any party designated by you. CHANGE OF NAME, ADDRESS, EMPLOYMENT STATUS: You understand and agree that you must report to us any change in your name, address, or employment status. ACCURACY OF INFORMATION: The information provided in your request for credit (Application) is accurate and you will notify us in writing immediately if there is a change in your financial condition. We may retain the Application. You understand that it is a violation of Section 1014, Title 18, US Code to make false statements or overvalue security for the purpose of influencing the action of any federally-insured credit union. We may gather credit and/or employment information we deem necessary and appropriate from time to time and we may give information concerning our credit experience with you to others. COPY RECEIVED: You acknowledge receipt of a copy of this VISA Credit Card Agreement and Federal Truth-in-Lending Disclosure Statement and agree to and accept its terms. You are responsible for all authorized use of your Convenience Checks. You may not use your Convenience Checks to pay any amount that you owe us pursuant to this Agreement. PERIODIC STATEMENTS: Your monthly statement will show you an itemization of the Convenience Checks posted to your Account during the billing cycle. Convenience Checks paid by us will not be returned to you with your monthly statement. RETURNED CHECK FEE: We will charge a fee per returned check, which will be billed to your Account if your Convenience Check(s) cannot be paid. This fee is set forth in our current Schedule of Fees and Charges. STOP PAYMENT: Provided such request is timely so that we shall have a reasonable opportunity to act upon it under our rules, you may order a stop payment on a Convenience Check drawn on your Account, other than one that has been guaranteed. If you give us a stop payment orally, the order shall be valid for only fourteen (14) days thereafter, unless confirmed in writing. Written stop payment orders will remain in effect only six (6) months unless renewed in writing. You have the burden of establishing the fact and amount of loss resulting from payment contrary to a binding stop payment. We will charge a

8 fee per Convenience Check when you place a stop payment on your Convenience Check(s) which will be billed to your Account. This fee is set forth in our current Schedule of Fees and Charges. SURRENDER OF CONVENIENCE CHECKS: Convenience Checks are our property; we reserve the right to revoke them at any time. You agree to return them at our request. YOUR BILLING RIGHTS: (Keep this Notice for future use.) This notice contains important information about your rights and responsibilities under the Fair Credit Billing Act. NOTIFICATION IN CASE OF ERRORS OR QUESTIONS ABOUT YOUR MONTHLY STATEMENT: If you think your monthly statement is wrong, or if you need more information about a transaction on your monthly statement, you must write to us on a separate sheet at the address listed on your monthly statement. You should write to us as soon as possible. We must hear from you no later than 60 days after we sent you the first monthly statement on which the error or problem appeared. You can telephone us, but doing so will not preserve your rights. In your letter, you should give us the following information: Your name and account number. The dollar amount of the suspected error. Describe the error and explain, if you can, why you believe there is an error. If you need more information, describe the item you are not sure about. If you have authorized us to pay your credit card statement automatically from your Share or Checking account, you can stop the payment on any amount you think is wrong. To stop the payment, your letter must reach us three (3) business days before the automatic payment is scheduled to occur. YOUR RIGHTS AND OUR RESPONSIBILITIES AFTER WE RECEIVE YOUR WRITTEN NOTICE: We must acknowledge your letter within 30 days, unless we have corrected the error by then. Within 90 days, we must either correct the error or explain why we believe the monthly statement was correct. After we receive your letter, we cannot try to collect any amount you question, or report you as delinquent. We can continue to bill you for the amount you question, including FINANCE CHARGES, and we can apply any unpaid amount against your Credit Limit. You do not have to pay any questioned amount while we are investigating, but you are still obligated to pay the parts of the monthly statement that are not in question. If we find that we made a mistake on your monthly statement, you will not have to pay any FINANCE CHARGES related to any questioned amount. If we did not make a mistake, you may have to pay FINANCE CHARGES, and you will have to make up any missed payments on the questioned amount. In either case, we will send you a statement of the amount you owe and the date that it is due. If you fail to pay the amount that we think you owe, we may report you as delinquent. However, if our explanation does not satisfy you and you write to us within 10 days telling us that you still refuse to pay, we must tell anyone we report you to that you have a question about your statement. And, we must tell you the name of anyone we reported you to. We must tell anyone we report you to that the matter has been settled between you and us when it finally is. If we do not follow these rules, we cannot collect the first $50.00 of the questioned amount, even if your monthly statement was correct. SPECIAL RULE FOR CREDIT CARD PURCHASES: If you have a problem with the quality of property or services that you purchased with a credit card, and you have tried in good faith to correct the problem with the merchant, you may have the right not to pay the remaining amount due on the property or services.
