1 Shaping attitudes Challenging injustice Changing lives Factsheet Personal Independence Payment Revised April 2014 In 2013, the Government introduced a new benefit, Personal Independence Payment (PIP), to replace Disability Living Allowance (DLA) for eligible people aged Like DLA, PIP is designed to cover extra costs disabled people have as a result of their disability, and to help them lead full independent and active lives whether they are in employment or not. Why is the Government getting rid of DLA? The Government decided that the current application process for DLA was too complicated and had inconsistent results. There were also concerns that people were given DLA indefinitely and never had their eligibility or need re-assessed over time. The Government say that PIP has a more objective assessment which reflects a person s changing needs. This will mean that some claimants will have their entitlement reviewed more regularly. The Government want to focus PIP and the new highest rate of support on those with greatest needs. They are also trying to achieve a 20% cut in the current cost of DLA. How will PIP be paid? Like DLA, you could be eligible for PIP even if you are in work. The level of any savings you might have will not matter, as long as you meet the eligibility criteria. Your PIP payments would also not affect any other meanstested benefit you might get (for example, income-based Employment and Support Allowance). PIP has two components: the mobility component the daily living component (this replaces the care component under DLA) NAT (National AIDS Trust) is the UK s leading charity dedicated to transforming society's response to HIV. 2 However, whereas DLA had three rates of the care component (low, middle and high) both the mobility and daily living components of PIP will be paid at just two rates: standard and enhanced. The daily living enhanced rate of PIP will be the same as the higher rate care component of DLA. The standard rate of the daily living component will be set at middle rate DLA care component. The mobility rates of PIP will be equivalent to DLA rates. PIP will continue to be a non-means tested, non-taxable benefit, uprated in line with the Consumer Price Index. PIP rates (As of 7 April 2014*) Daily Living Enhanced Rate = per week (severely limited ability to carry out daily living activities) Daily Living Standard Rate = per week (limited ability to carry out daily living activities) Mobility Enhanced Rate = per week (severely limited mobility) Mobility Standard Rate = per week (limited mobility) *rates will be updated annually, in April. While PIP rates have been kept equivalent to DLA, it is important to remember that as anyone on DLA must go through a new assessment for PIP they will not necessarily be found eligible for the same level of support. How long will my PIP award last? One of the key differences between DLA and PIP is how long your PIP award will last and how often your award will be reviewed by DWP. Most PIP awards will be fixed-period for a specific number of years. Shorter-term awards will last up to two years. Longer-term awards will last between five and ten years. A small number of people will get ongoing awards. Towards the end of your fixed-period award, you will be invited by DWP to re-apply for PIP. Your fixedperiod PIP award will not be automatically renewed when it comes to an end you will need to make a fresh application for PIP before your award runs out, or you could lose your benefit. In addition, the DWP may in some cases get in touch with you before the end-date of your fixed-period award (or at any point during an ongoing award) to check that your circumstances are still the same. If this happens, the DWP will send you another PIP assessment form which you will need to fill out. How will PIP be assessed? There is a new assessment for PIP. Unlike the DLA assessment, this will, in most cases, involve a face-toface interview with an independent healthcare professional (HCP). The assessment will be carried out by an HCP working for either Capita or Atos (the Government-appointed assessment providers) depending on where in the country you live. You are able to request an assessment in 2
3 your home or at a local centre, depending on your health needs. The assessment will ask about your ability to carry out twelve key daily activities, as a measure of the barriers that you may face in your day-to-day life. The format of the assessment questions is quite similar to the Work Capability Assessment (WCA), which is used to assess claimants for Employment and Support Allowance. As with the WCA, PIP claimants will be given a score at the end of their assessment, which will indicate whether or not they are eligible for the benefit. Information from the claimant s doctor or other relevant people, such as support workers, will also be collected and used in making the decision (see also Will I need to get a doctor s note for my application? ). If you do not agree with the decision of your PIP claim, you can ask for it to be reconsidered. If you disagree with the outcome of the reconsideration, you can then appeal your decision. Will I need to get a doctor s note for my application? When applying for PIP, you will asked to provide the details of a health or care worker who can best explain how your disability affects your daily life. This might be your HIV consultant, specialist nurse, GP or support worker. Provide the contact details of the person who is most able to support your claim. It is a good idea to make sure that whichever health or care worker you list is aware of how HIV affects your daily life and ability to get around. The assessment will not be looking at what diagnosis you have, but rather how any conditions you have create barriers to certain activities. These are the activities which are described on your application form for PIP the most relevant medical evidence would relate directly to these. Due to current delays in the PIP assessment process (see below), it might also be helpful to provide any medical evidence you already have, when applying for your claim. This might be a report from your consultant or letter from your support worker. However, you should not delay making your claim in order to get this evidence it is the responsibility of the DWP and the assessment providers to get all the information they need. If you do provide the details of your GP, the DWP will pay them a small amount to provide the report about your health. Only GPs are offered this payment. But importantly, it is not up to you to pay any doctors for medical evidence just submit anything relevant you already have to hand. How long will the assessment process take? As of April 2014, the DWP stated that the average length of a PIP claim, from start to finish, was weeks. This is much longer than the 10 weeks which the assessment process was originally expected to take. The DWP will provide updated estimates on current waiting times when you apply for the benefit. Process and key dates for implementing PIP The Department for Work and Pensions will no longer accept new claims for DLA from anyone aged 16 to 64. Anyone who needs help with paying for the extra daily living and mobility costs of having a disability now needs to apply for PIP. For people who are already receiving DLA, there will be a phased rollout. DLA recipients do not need to take any action until they are contacted by DWP. From October 2013: Some people who claim DLA are invited to claim PIP. This means they will have to undergo the PIP assessment. If the claimant does not respond and take part in the process then their benefits will be at risk. There is no automatic transfer from DLA to PIP. 3
4 The first people who will be invited to claim PIP are: Anyone with a fixed-period DLA award which expired on or before 17 March Anyone who reports a change in their condition or circumstances which could affect their current rate of DLA. (Or where someone else reports a change in your circumstances to DWP). Young people who have been claiming DLA as a child and will soon be turning 16. This reassessment process will have a staggered rollout across the UK. The areas which are currently affected (as of April 2014) are: Dumfries and Galloway Darlington Wales Edinburgh Harrogate West Midlands Galashiels Lancaster East Midlands Motherwell York East Anglia Carlisle DWP has produced a postcode map showing where reassessments are being rolled out and which provider (Atos or Capita) operates in your area. Further announcements on the geographical rollout of the DLA to PIP reassessment process will be made in From October 2015: All remaining DLA recipients will be invited to make a claim for PIP. This includes people who are on indefinite DLA awards. The DWP will randomly select those recipients of DLA who have an indefinite award or a fixed-period award, and tell them what they need to do in order to make a PIP claim. There is no automatic transfer from DLA to PIP, so people currently claiming DLA will need to make a new PIP claim when invited by DWP or lose their benefits. However, whilst a new PIP claim is being made DLA will continue to be paid for all claimants until the decision on PIP has been communicated to the claimant. By October 2017: All current DLA recipients will have been invited to claim PIP. How will my current DLA claim be affected? NAT, alongside other disability charities, campaigned to delay the compulsory reassessment process for people with existing DLA awards, including those with indefinite and lifetime DLA awards, to allow more time for the new benefit and assessment process to bed in. On this occasion, we are pleased to say the Government listened, and postponed the migration process from DLA to PIP for those with indefinite and lifetime DLA awards until October 2015 at the earliest. People who have indefinite DLA awards based on special rules around terminal illness will have their reassessment left towards the end the reassessment timetable. If you have a fixed-period DLA award, or if your circumstances change, then instead of having a new DLA assessment you will be invited by DWP to make a PIP claim. You will then be assessed under the new rules to see if you are eligible for PIP. Given PIP is a new benefit and subject to a new assessment process there is no guarantee that existing claimants will be found eligible or that they will be eligible for the same level of support they received with DLA. 4
