3 President s Message Hello everyone and welcome to the 2012 Fall Convention here in San Antonio, TX! You should know that this is the first time that the CPPC and AMSA have scheduled their events at the same location, and we are very excited about this joint venture. You will find this a great opportunity to meet AMSA members and find out first-hand what AMSA is all about. When the opportunity presents itself, I know that you will introduce yourself to any AMSA members and help them feel welcome. The Convention is jam packed with information, including the newest session on the Better Business Bureau. Given that most of us, if not all of us, have had to respond to complaints from the BBB, this session should prove to be helpful in our claims handling. Other sessions include: Status of the Moving Industry; Claim Trends & Relationships; Transportation Law/Claim Resolutions; A message from Linda Bauer of AMSA; Carriers, Insurance Underwriters and Repair Firms-Just Whose Side Are You On?; breakout sessions on Military/GSA Claims Handling; Small Business Advisor and Social Media; as well as an Interactive Round Table on Claim Resolution. You will find the complete agenda with times and panelist information in your program. Please consider attending as many sessions as you can. For those of you who are first time attendees, please take time to introduce yourselves to your Board of Directors; and if you are looking to meet someone in particular, let one of us know and we will be happy to make introductions for you. 6 Guest Speaker Bio s Timothy M. Baer Senior Director, Cargo Litigation UniGroup, Inc. Tim Baer is Senior Director, Cargo Litigation for UniGroup, a $1.6 billion dollar household goods relocation and logistics company, and parent company to United Van Lines and Mayflower Transit. In his role at UniGroup, Baer is one of the nation s leading experts on Carmack household goods loss and damage claim litigation. Since he joined UniGroup in 1988, Baer has served in various roles in the Law Department, as well as the Vice President of the Claims Department. In his current role, he leads UniGroup s Cargo Litigation team and manages a nationwide network of defense counsel in the handling of litigated cargo loss and damage disputes and tariff collection matters. Baer also has responsibility for UniGroup s arbitrated claims, customer service disputes, and the investigation and response to regulatory inquiries. Baer is a past Chairman of the Conference of Freight Counsel, a national association of transportation attorneys primarily representing air, motor, ocean and railroad carriers in transportation matters. He is also a member of the Transportation Lawyers Association. Baer, a member of Phi Beta Kappa, received his Juris Doctor in 1988 from St. Louis University School of Law, and graduated summa cum laude from St. Louis University in He and his wife, Kelly, reside in Ballwin, Missouri and are the parents of four children. Linda Bauer Darr President and CEO American Moving & Storage Association Linda Bauer Darr is President and CEO of the American Moving & Storage Association (AMSA), Executive Director of the Moving and Storage Institute, and Publisher of Direction magazine. The leading trade association for the moving and storage industry, AMSA is a result of a merger of three associations the American Movers Conference (AMC), the Household Goods Carriers Bureau, and the National Moving and Storage Association, the oldest of which dates back to Linda was chosen to lead AMSA in April of Ms. Darr has almost 21 years of experience in transportation policy, association management and government relations. Her experience includes senior positions with the American Trucking Associations and the American Bus Association, as well as serving during the Clinton Administration at the U.S. Department of Transportation. As Deputy Assistant Secretary for Budget and Programs, she oversaw the development of a $60 billion annual budget for the department and interacted regularly with senior officials in the Administration and at the White House and with members of Congress and their staff on a wide range of transportation policy matters. Ms. Darr serves on the Board of the American Highway Users Alliance, the Eno Transportation Foundation s Advisory Board, the Industry Advisory Panel of the Employee Relocation Council, and was appointed to the U.S. Chamber of Commerce s Committee of 100 Top Association Executives. Ms. Darr graduated from the University of Maryland and has studied and taken courses at Salisbury State University, University of Virginia and Harvard Kennedy School of Government. Erin Dufner Senior Vice President of Communications Erin Dufner is Senior Vice President of Communications for BBB serving Central, Coastal, Southwest Texas and the Permian Basin. She oversees all internal and external communications, including marketing and media outreach. Erin was born in Southern California and earned a degree in Business and Management from the University of Redlands. Erin began her BBB career in 1996 at the San Diego BBB where she had many responsibilities including media and government relations, advertising ethics, charitable accountability, dispute resolution and community outreach. She was also named Secretary of the BBB s Foundation. Before she left California in October 2004 to join BBB serving Central, Coastal, Southwest Texas and the Permian Basin, she had been named the Director of Ethics and Communications. In 2009 and 2011, Erin led BBB serving Central, Coastal, Southwest Texas and the Permian Basin in receiving the Marshall A. Mott Award for outstanding communications, the highest honor a local BBB can achieve. Erin has also led her BBB staff in winning awards for targeted media campaigns and new programs. Erin has trained BBB professionals across the country in several areas of BBB work, as well as served on many national BBB committees. Erin and her husband Jeremy live in Round Rock, Texas with their daughter, Olivia. 5

7 Guest Speaker Bio s C P P C Larry Esparza Certified Financial Planner Practitioner Larry has been a financial advisor for 15+ years with Ameriprise Financial. He is married to Joyce Esparza, living in Brownsville, TX. He is an avid hunter, fisherman and outdoorsman. He graduated from Texas A & I. Steven R. Kelly Chief, Personnel Claims Branch Mr. Kelly has been the Chief, Personnel Claims Branch, since July He also served as Acting Chief of the Division after the death of the Division chief from May through November Mr. Kelly served on active duty in the Judge Advocate General s Corps from 1982 through He was defense counsel and senior defense counsel at Fort Belvoir, Virginia from 1982 to 1985, followed by assignment as the 2nd Infantry Division Artillery (DIVARTY) trial counsel at Camp Stanley, Korea from 1985 to He next served as trial counsel and, then, Chief of Legal Assistance and Claims, in the Schweinfurt Branch Office of the 3rd Infantry Division OSJA from August 1986 until leaving active duty in July Following active duty, Mr. Kelly joined the law firm of Sweeney, Sheehan and Spencer in Philadelphia as an associate. He left private practice in 1994 for an eight month temporary tour of active duty with the Multi-National Force and Observers in Sinai, Egypt. Following that deployment, he worked as an attorney advisor at the Devens Reserve Forces Training Area from October 1995 until coming to USARCS in March After a year as an attorney advisor in the Legal Analysis Branch, Mr. Kelly was appointed and served as the Deputy Chief, Recovery Branch, and later the Chief, Recovery Branch. Upon being mobilized in June 2004, he served a one year tour as the trial defense counsel at Fort Dix, New Jersey. Mr. Kelly retired in the grade of lieutenant colonel from the JAG Corps Reserve in February Mr. Kelly graduated from Temple University School of Law in 1981 and is admitted to practice in Pennsylvania and New Jersey. He is married to his class mate from the 98th JAG Basic Course, Colonel Wendy Kelly, who retired in December Her last assignment was with the Military Commissions Agency, where she now is employed as the Chief of the Operations Department. They have two children, Edward, 25, and Erika, 22. Keith McFarland Regional Manager for Agency Development for UniGroup Keith McFarland is the Regional Manager for Agency Development for UniGroup, global transportation and logistics provider with best known domestic brands United Van Lines and Mayflower Transit. Keith oversees a 15 state area comprising the Eastern seaboard and New England states. He and his fellow managers support UniGroup s quality process by combining the roles of corporate compliance, risk management and loss control by performing on-site inspections of agents in their network. His department s function is to constantly improve the quality of service delivery to the relocating public by assisting agents and van operators succeed in performing on-time and problem free interstate relocations. Jeffrey R. Simmons Ryley Carlock & Applewhite Phoenix, AZ Jeff Simmons is a shareholder with the Phoenix, Arizona office of Ryley Carlock & Applewhite. He practices in the areas of transportation and commercial litigation. Jeff s transportation practice is devoted to representing motor, rail and air carriers, brokers and intermediaries. He frequently handles freight loss and damage claims, and also the collection of tariff and transportation charges. Jeff also negotiates and drafts transportation contracts and advises clients on regulatory issues. He is a past Chairman of the Conference of Freight Counsel (a national assoclation of attorneys primarily representing air, motor, ocean and railroad carriers in transportation matters) and is an active member of the Transportation Lawyers Association and the Trucking Industry Defense Association. Jeff has been named in the 2011 and 2012 editions of the Best Lawyers in America in the field of Transportation Law. 6

Some records tell us the property is haunted. Hopefully the spirits will not bother us while we are here. Hopefully, your time here will give you a little time to check out this incredible property and many other historic sites around the immediate area. Steven Kelly, has offered to share his knowledge on the historic Alamo, if anyone is interested. Hopefully the positive summer moving season has begun to have a positive impact on your work flow. If not, maybe you can assist with that through networking at this event. I spoke to several members that stated they were simply too busy to be able to attend this year. Ironically, two years ago I heard from members that stated they could not afford to attend because work simply wasn t there to support their attendance. So, I sit scratching my head to find the appropriate level of work that works? But realistically there is not a perfect formula to establish attendance to our events. However, your feedback on what is important to warrant your involvement is something that does interest the entire CPPC Board. So take a moment during your attendance to share your thoughts for future events. The more feedback that is received, the better we can plan for the future and serve more of our members while doing so. Changes are constant in everything we do. Be it the way we do business to the many and varied ways of communication that we now have available. Status quo for business is definitely not the same as it was even 3 to 5 years ago. Yet many have not changed the way they do business. The results of such nonchange can be devastating depending on many factors. If your business has changed, even if not significantly; you might need to re-evaluate how you are doing business. Maybe some of the education sessions here, or the time you find networking, will give insight in what you may need to do to earn or keep more business. There is always something to learn from someone else, if you take the chance to really listen. Regardless of where you believe you are in business success, you may learn something or have something you can share with others. The rewards you can gain from this inperson contact are immeasurable.
