4 P U R P O S E O F T H I S B O O K L E T The purpose of this booklet is to clarify the roles ad resposibilities of atioal sector departmets, their provicial couterparts, ad muicipalities, i the plaig, implemetatio ad moitorig of muicipal ifrastructure programmes. These roles ad resposibilities are critically importat to esure that muicipal ifrastructure projects result i sustaiable services. This publicatio also attempts to highlight the value that sector departmets ad their provicial couterparts ca brig to muicipal ifrastructure programmes. Itroductio to this booklet Govermet has put i place the legislative, policy ad istitutioal frameworks for muicipal ifrastructure provisio. These frameworks outlie what has to be doe i providig muicipal ifrastructure. This booklet focuses specifically o roles ad resposibilities of all the importat stakeholders i the process of muicipal ifrastructure delivery. These roles ad resposibilities have bee draw from the various legislative, policy ad ifrastructure frameworks ad cosolidated ito oe documet. Whilst four phases are illustrated, this booklet focuses o the first three phases which culmiate i commissioig. The service provisio phase is where operatio ad maiteace takes place which is the actual provisio of services. The Service Delivery Life Cycle should ot be cofused with the Project Life Cycle. The Service Delivery Life Cycle is all the phases ad processes from policy through to service provisio. It applies to all spheres of govermet ad is a iteractive process where policy is improved over time as lessos are leart through the cycle ad fed back ito the policy makig process. 8 P A R T O N E Itroducig Muicipal Ifrastructure What is muicipal ifrastructure? Muicipal ifrastructure is defied i broad terms as the capital works required to provide muicipal services. It icludes all the activities ecessary to esure that the works are delivered effectively, such as feasibility studies, project plaig ad capacity buildig to establish soud operatioal arragemets for the works. The term works is take to exclude readily movable assets such as specialised vehicles ad equipmet ad lad ot directly required for the costructio of muicipal ifrastructure. This defiitio excludes vehicles whether these be covetioal trucks or specialised vehicles such as fire egies. But it icludes the mechaical ad electrical equipmet that is required for, amogst others, water ad wastewater treatmet works. Who are the Role Players? 9 Who is the sector i terms of muicipal ifrastructure? The sector is all those govermet departmets, structures, spheres of govermet, muicipalities ad their represetatives that are directly ivolved i either the policy makig, co-ordiatio, plaig, developmet, implemetatio, moitorig, reportig or auditig of muicipal ifrastructure. Amogst these stakeholders a umber of structures have also bee formed for policy makig, plaig, co-ordiatio, moitorig ad reportig purposes. Istitutioal Framework for Muicipal Ifrastructure The purpose of havig a istitutioal framework for muicipal ifrastructure is to esure that the respective roles ad resposibilities of the differet spheres of govermet ad various sector departmets are clearly defied. It is also to esure that the imperative of both co-operative govermet ad sector collaboratio is recogised ad that overlappig madates are miimised. This booklet outlies the istitutioal priciples ad the roles ad resposibilities of the differet spheres of govermet for muicipal ifrastructure delivery. 10 Istitutioal priciples for muicipal ifrastructure The followig priciples guide the istitutioal framework for the delivery of muicipal ifrastructure where muicipal ifrastructure is decetralized to muicipalities withi atioal orms ad stadards. However, sice the delivery of muicipal ifrastructure ivolves all spheres of govermet ad a whole rage of sector departmets, there is a strog eed for both co-operative goverace ad cross sector collaboratio. The priciples are desiged to esure a eablig istitutioal eviromet for the delivery of muicipal ifrastructure, which istitutioalizes a collaborative approach. Co-operative goverace ad collaboratio Co-operative goverace. There are may stakeholders ivolved i the developmet of muicipal ifrastructure that cut across all three spheres of govermet. Co-operative goverace is therefore essetial to esure that the differet departmets ad spheres of govermet are workig towards commo goals ad objectives i the developmet of muicipal ifrastructure. The eed for structures to facilitate co-operative goverace, particularly cross sectoral structures is recogised. Muicipal ifrastructure sector leadership. This is the role of dplg ad etails leadig the cooperative goverace effort but does ot mea that dplg takes resposibility for the sustaiability of the differet types of sector ifrastructure. Dplg support to muicipalities relates to compliace with cross sectoral coditios ad criteria, programmatic issues ad, moitorig ad reportig requiremets. Multi-sector wide approach. Ifrastructure delivery ad service provisio are premised o a multi-sector wide approach. This approach will be istitutioalised through multi-sectoral forums which will be resposible for co-ordiatig policy ad implemetatio thereof. Co-ordiatio. I as far as practical ad feasible, support ad moitorig related to muicipal ifrastructure will be co-ordiated so that there is o duplicatio of activities which may egatively impact o muicipalities i terms of additioal effort. Policy developmet Muicipal ifrastructure policy. Dplg is resposible for developig overall policy for muicipal ifrastructure that addresses the visio for muicipal ifrastructure ad the plaig, fiacial, istitutioal, regulatory, moitorig ad support frameworks to achieve this visio. This policy provides the overall co-ordiatig framework for sectoral policy for muicipal ifrastructure Sectoral policy for muicipal ifrastructure is the resposibility of sector departmets ad must be cosistet with the muicipal ifrastructure policy. Sector departmets are resposible for esurig that muicipalities uderstad the implicatios of their policies i terms of muicipal ifrastructure delivery ad muicipal service provisio Settig orms ad stadards Norms ad stadards related to muicipal systems, procedures ad structures are the resposibility of dplg ad the purpose of these orms ad stadards is to eable the efficiet ad effective delivery of muicipal ifrastructure. Sector departmets are resposible for settig orms ad stadards for their sector ad for esurig that muicipalities have a good uderstadig of how to achieve these orms ad stadards i muicipal ifrastructure delivery. 11 Plaig Plaig ad implemetig muicipal ifrastructure is the resposibility of local govermet. Developmetal ad democratic local govermet is i the best positio to make accoutable decisios related to how services should be provided, takig ito accout the eeds of their costituecies as well as social, ecoomic ad evirometal aspects withi their areas of jurisdictio. Roles ad resposibilities are guided by the plaig framework. The Natioal Spatial Developmet Perspective, the Provicial Growth ad Developmet Strategies, Provicial Sector Plas ad IDPs are all key developmet plas that form part of the plaig framework across the differet spheres ad sectors of govermet. Role players must udertake their plaig resposibilities withi the plaig framework to esure that they provide the ecessary iputs for muicipal ifrastructure developmet. All muicipal ifrastructure projects (i.e. ot just MIG projects) must be part of the muicipality s IDP ad the appropriate sectoral pla. Support Co-ordiatio of support ad providig support to the establishmet of efficiet ad effective systems for muicipal ifrastructure delivery is the resposibility of dplg ad its provicial couterparts. Itegrated developmet plaig support to esure that sector plas are brought together ito a holistic IDP where muicipal ifrastructure projects are appropriately prioritised is also the resposibility of dplg ad its provicial couterparts. Support to local sector plas (such as the WSDP, Itegrated Trasport Pla, etc.), ad project plaig is the resposibility of sector departmets. Support to esure the delivery of sustaiable muicipal ifrastructure is the resposibility of sector departmets. This meas that sector departmets must esure that muicipalities are able to access the type of expertise ad techical capacity they require to pla ad implemet muicipal ifrastructure projects. Support beyod MIG projects. Sector departmets are resposible for providig support to all muicipal ifrastructure projects ad ot oly those that are subsidised by the MIG. Regulatio ad moitorig Regulatig ad moitorig muicipal systems is the resposibility of dplg. With regards to muicipal ifrastructure, dplg is resposible for esurig that muicipalities have the ecessary systems i place to idetify, pla, implemet ad operate ad maitai muicipal ifrastructure. Regulatig ad moitorig ifrastructure delivery is the resposibility of the differet sector departmets for their sector area. Sector departmets must esure that muicipal ifrastructure projects result i sustaiable services ad thus they have a moitorig ad regulatory role throughout the service delivery cycle to esure that plaig ad implemetatio complies with sectoral orms ad stadards. Departmet of Provicial ad Local Govermet (dplg) The Departmet of Provicial ad Local Govermet is the leader of the muicipal sector ad thus the custodia departmet of muicipal ifrastructure. Dplg fulfils a overall muicipal ifrastructure policy makig ad implemetatio support role (icludig admiisterig the MIG programme), which ivolves all those activities related to policy developmet, facilitatig cross sectoral co-ordiatio, ad esurig collaboratio across the spheres of govermet. It is also resposible for puttig i place the ecessary structures ad systems to esure efficiet ad effective moitorig, idetificatio of itervetios eeded, reportig, ad auditig. Whilst it does ot get ivolved i the actual plaig ad implemetatio of muicipal ifrastructure projects, it has a overarchig resposibility for co-ordiatig muicipal ifrastructure policy ad implemetatio thereof. It is also resposible for overseeig the muicipal ifrastructure activities of all sector istitutios ad muicipal service delivery support structures with respect to muicipal ifrastructure. It leads the collaboratio effort to esure that the delivery of muicipal ifrastructure is plaed ad implemeted withi a sector wide approach. Muicipal Ifrastructure (MI) Uit for Programme Maagemet The dplg has a Natioal MI Uit to admiister the Muicipal Ifrastructure Grat ad overall muicipal ifrastructure related matters. Its fuctios have bee broadeed to moitor progress across all muicipal ifrastructure. Its fuctios iclude: Co-ordiate the IDP reviews i terms of ifrastructure; Moitor the DoRA ad cross cuttig coditios as well as overall progress i the implemetatio of the programme; Moitor progress ad impact of the MIG programme through the Key Performace Idicators (KPI) reports received from muicipalities; Commuicate the achievemets, challeges ad itervetios related to muicipal ifrastructure to various stakeholders, icludig the socio-ecoomic impact of the MIG programme o commuities ad muicipalities; Build the capacity of muicipalities to esure that they fulfil their capital programme ad project fuctios; Auditig the local programmes to esure compliace; Preparig reports to the Techical Task Team o Ifrastructure ad Sustaiable Huma Settlemet, Youth Commissio, Huma Rights Commissio ad all provicial ad atioal govermet departmets. Other Natioal Departmets (Sector Departmets) Natioal departmets (ad their provicial couterparts) retai their policy makig ad regulatory fuctios i terms of muicipal ifrastructure. They also retai their costitutioal rights to itervee directly i the affairs of muicipalities where it pertais to their sector madate. I additio, each departmet has specific resposibilities i terms of muicipal ifrastructure. Withi this cotext, a key role player i this process at provicial level is the departmet resposible for local govermet which is resposible for coordiatig the moitorig ad support. The role of provicial departmets of local govermet i terms of muicipal ifrastructure is to: Esure proper co-ordiatio betwee all muicipal ifrastructure programmes ad sector departmets at the provicial level Moitor the performace of muicipalities with regard to ifrastructure delivery Esure that plaig for regioal scale ifrastructure is guided by provicial govermet workig collaboratively with muicipalities ad the relevat sector departmets Esure that IDPs properly address muicipal ifrastructure requiremets Support muicipalities to develop their capacity to effectively maage the delivery of ifrastructure Assist muicipalities to establish ad maitai programme maagemet systems. Local sphere Whilst atioal ad provicial govermet are resposible for creatig a eablig policy, fiacial ad istitutioal (support) eviromet for muicipal ifrastructure, muicipalities are resposible for plaig ad implemetig muicipal ifrastructure. This is reflected i the various policies, which support the devolutio of resposibility for muicipal ifrastructure developmet to the lowest possible level. Ifrastructure developmet at a local level is depedat o both programme based ad project based activities. Both types of activities are depedet upo adequate resources i terms of skills ad fudig. This sectio deals with both programme ad project based activities sice they are both relevat to the delivery of muicipal ifrastructure. 17 Programme based activities refer to those activities which are cyclical i ature, where the processes are repeated periodically. These activities iclude: Itegrated Developmet Plaig (IDPs) Ifrastructure Ivestmet Plas (IIPs) Multi-year budgets (Capital ad Operatios ad Maiteace). O the other had project-based activities happe oce-off for a particular project ad iclude activities such as the pre-feasibility study, feasibility study, project desig, teder process, costructio ad commissioig. These activities have a begiig ad a ed ad are aimed at addressig a particular eed of a commuity. Withi the local sphere there are differet levels of resposibility that impact o muicipal ifrastructure. These are described below. Muicipal level (multi sectoral ifrastructure programme) This is where programme-based activities take place as metioed above. The overall muicipal level is where itegrated developmet plaig takes place that brigs together all sectoral plaig ito a programmatic approach. Muicipalities eed to esure that they have programme ad project maagemet capacity for the overall maagemet of the muicipal ifrastructure programme. Local sector level The local sector level is where sectoral plaig ad provisio takes place, for example water services developmet plaig ad the provisio of water services, trasport plaig, ad the provisio of trasport services, ad so o Sectoral plaig feeds ito the itegrated developmet plaig (IDP) Sectoral provisio icludes decidig the most appropriate service provider to operate ad maitai the muicipal ifrastructure. 18 Co-operative goverace betwee the three spheres of govermet The framework for the roles ad resposibilities of atioal sector departmets, their provicial couterparts, ad muicipalities i terms of the delivery of muicipal ifrastructure are based o Chapter 3 of the Costitutio of South Africa (1996) o co-operative govermet. The Costitutio states that the three spheres of govermet are distictive, iterdepedet ad iterrelated. Thus the priciples that uderlie the relatios betwee the spheres are that of co-operative govermet ad itergovermetal relatios. I terms of sectio 41(i) of the Costitutio, each sphere must, amogst other thigs: a) respect the costitutioal status, istitutios ad powers ad fuctios of govermet i the other spheres; b) exercise their powers ad perform their fuctios i a maer that does ot ecroach o the geographical, fuctioal or istitutioal itegrity of govermet i aother sphere; c) co-operate with oe aother i mutual trust ad good faith by: assistig ad supportig oe aother; cosultig oe aother o matters of commo iterest; co-ordiatig their actios ad legislatio with oe aother; adherig to agreed procedures This meas that all atioal departmets ad their provicial couterparts retai their policy makig ad regulatory fuctios. However, the importace of co-ordiatig such activities, with the objective of creatig a commo approach to local govermet, is imperative. Towards achievig this objective, co-ordiatig structures such as the Techical Iter-Miisterial Committee (TechIMC) have bee established ad assiged co-ordiatig fuctios. I additio, sector departmets ad provices retai their costitutioal rights to itervee directly i the affairs of muicipalities where ecessary. Multi-sectoral istitutioal arragemets for collaboratio I order to istitutioalise a collaborative approach to policy developmet, co-ordiatio, moitorig ad the overall support of muicipal ifrastructure delivery, a umber of iter-sectoral structures have bee established. The Techical IMC may also make recommedatios to the IMC as well as Cabiet Committees o ay of these issues ad is resposible for moitorig progress ad ublockig ay challeges that may emerge i the delivery of muicipal services. It is supported by a multi sectoral techical task team. Muicipal Ifrastructure Techical Task Team (MIT3) The Multi-Sectoral Techical Task Team comprises represetatives from the same departmets as the Techical IMC. The Techical Task Team reports directly to the Techical IMC. PCSs specific resposibilities iclude: Recommed to the Techical IMC the muicipal ifrastructure policy issues for review to esure efficiecy, effectiveess ad cosistecy i the delivery of ifrastructure by muicipalities; Moitor progress ad ublock ay challeges that may emerge i the delivery of ifrastructure services i muicipalities; Report to Techical IMC ad Premiers Itergovermetal Forums about progress o the implemetatio of ifrastructure i muicipalities; Alig sector departmets growth, developmet ad plaig strategies i muicipal IDPs, resultig i aligmet of these sector strategies with ifrastructure delivery ad service provisio; Coordiate the support ad capacity buildig of muicipalities to esure that they are able to perform effectively i maagig the ifrastructure provided. Muicipal Coordiatig Structures Premier s Itergovermetal Forums fulfil a co-ordiatig role at the provicial muicipal iterface. At muicipal level the co-ordiatig structure is the IDP Steerig Committee ad the Ifrastructure Committee. These structures are resposible for esurig that muicipal ifrastructure delivery is addressed i a holistic maer to achieve itegrated developmet. The life cycle comprises the differet phases from policy goverig muicipal ifrastructure, through to plaig muicipal ifrastructure, to implemetig ifrastructure projects, ad fially to the provisio of sustaiable muicipal services. Withi this cycle each sphere of govermet, atioal, provicial ad local has a role to play. The major phases of the cycle are Policy, Plaig, Implemetatio ad Operatios. It is importat to ote that this service delivery life cycle is differet from the project life cycle, which is addressed later i this chapter. Roles ad Resposibilities through the Phases I order to gai a full perspective o roles ad resposibilities, muicipal ifrastructure eeds to be viewed withi the overall framework of: a) the sustaiable service delivery life cycle, as well as b) the differet spheres of govermet withi which muicipal ifrastructure must be implemeted, icludig the project level. Natioal sector departmets have a role to fulfil throughout the service delivery cycle from policy, to plaig, to implemetatio, to supportig service provisio. Provicial Departmets also have a role to play throughout the service delivery cycle. These roles eed to be complimetary ad ot result i duplicatio of efforts. Muicipalities also eed to have a clear uderstadig of the type of support that Sector Departmets will provide to local govermet to esure the successful implemetatio of muicipal ifrastructure.
