1 STUDENT BEHAVIOR POLICIES PHILOSOPHY STATEMENT Martinez Junior High School is committed to providing a quality educational environment that is safe, secure and peaceful. It is also a commitment of Martinez Junior High School to help all students develop to the maximum of their capacities, and to function as responsible members of a democratic society. As students grow towards responsible citizenship and independence, they must develop acceptable behavior traits that show progress toward an understanding of both the respect for constituted authority, and the rights of others. As part of this learning process, students must be held accountable for their actions and recognize that there are consequences for their choices, both good and bad. The following behavior infractions and consequences have been developed with the participation, views and advice of parents, teachers, school administrators, school security personnel, and students. This document is a true joint effort that defines the behavioral expectations for students and provides information to pupils and their parents relating to these expectations and the penalties for violations. Please note that the following policy is a guideline, subject to any mitigating or aggravating circumstances. Under the doctrine of progressive discipline, a comprehensive review of any specific incident in relation to a student s past behavior may result in a different penalty being assessed than that outlined below, should the facts of the case warrant a different disciplinary action. In all cases the principal retains the right to make the final decision regarding any disciplinary action at the school. BEHAVIORAL POLICY Martinez Junior High School has a clearly defined student behavior policy that was developed by students, parents and staff, and is reviewed and revised each year by a committee made up of all stakeholders in our school community. In addition to being clearly posted in all classrooms, behavioral policies are reviewed with all students in homeroom. Our school behavior policy is as follows: Be responsible for your own behavior and accept the consequences for that behavior. Be courteous and respectful to fellow students and adults at all times. Do not threaten, put-down, tease, or bully other students or adults. Behave properly in your speech and actions. Do not swear or make offensive comments or gestures. Keep your hands and feet to yourself at all times. Be on time to class. Come to class with all necessary materials and prepared to follow teacher directions. Show respect for school property and the personal property of others. Dress appropriately for school and in a manner that is not disruptive to learning. Leave hats and other head coverings at home; they are not allowed at school. Gum is not allowed at school. Food and drink is not allowed in classrooms or buildings without staff approval. Bring to school only things that are necessary for school. Personal items, including games, toys, laser pens, or even money (over $10) should be left at home. TEACHER DISCIPLINE AND TEACHER-ASSIGNED DETENTION It is expected that the first level of student discipline will come from the teacher within the classroom. The typical sequence of consequences for student misbehavior in the classroom is: warning, name on board /call home, teacher-assigned detention with parent notification, and sending a student to the office with a referral. If a student does not attend a teacher-assigned detention within two school days, s/he will be assigned an administrative detention. LUNCH DETENTION Students may be assigned lunch detention for rule violations, classroom disruptions, or other disturbances to the learning environment.

2 ADMINISTRATIVE DETENTION Administrative detention is assigned by the principal or vice principal. The rules of administrative detention are listed below: Days: M,T,TH,F- Times: 2:40pm 3:30pm. Students must be on time or will not be admitted. Students must bring homework or other reading material. Students will be assigned a seat, and are to be working silently, or face dismissal and/or further detention. NO TALKING OR FOOD in detention. Failure to behave appropriately will cause immediate dismissal and a referral to Wednesday School. Failure to show for detention will result in assignment to Wednesday School. Note: Teacher detention is not the same as administrative detention. Teacher detentions are assigned by the classroom teacher for infractions of classroom rules, and do not count towards LOP status. WEDNESDAY SCHOOL An administrator, as a result of certain disciplinary or attendance violations, assigns Wednesday School. Wednesday School is an alternative to school suspension. The rules and policies of are as follows: Scheduled hours are from 1:40pm 3:30pm on Wednesdays. Students must bring 2 hours of work to do during Wednesday School. Students are assigned seats, and must remain busy the entire time! Students who fail to behave appropriately will be immediately dismissed from Wednesday School and suspended the next day. The Wednesday school will be reassigned for the next week. Students may be assigned to only two Wednesday Schools in advance. After that, any further infractions will result in a day of suspension. Students who do not show up for Wednesday School will be suspended and earn another Wednesday School, to make up the missed one. SUSPENSION (OFF CAMPUS) Suspension is a disciplinary action, which excludes a pupil from regular classroom instruction for adjustment purposes for a period of time not to exceed five consecutive school days. Suspension by an administrator shall be preceded by an informal conference between the pupil and administrator. A phone call is placed to the parent, and within 24 hours of the beginning of a suspension, a notice will be mailed home. Any student receiving 20 or more suspension days within in single school year will be recommended for expulsion. During the suspension, the student is not to return to any Martinez School campus without prior administrative approval. Upon return to school, the pupil and parent or guardian may be requested to attend a conference with the school administrator regarding the student's behavior. CLASS SUSPENSION Class suspension is a disciplinary action which may be imposed by the teacher. A teacher may suspend a student from class for a maximum of two class periods. A parent/teacher/administrator conference must then be arranged to discuss the problem. EXPULSIONS Expulsion means the removal of a student from enrollment in the Martinez Unified School District, as ordered by the Board of Education, when all other means of correction have failed or the continued presence of the student causes danger to the physical safety of others. State law provides for full due process rights in any order of expulsion. An expelled student may be ineligible to participate in any 2

3 MUSD program, including independent study. LOSS OF PRIVILEGE (LOP) Loss of Privilege, or L.O.P., is a status assigned to students who have significantly violated the disciplinary or behavioral expectations of the school. Students on the LOP list are denied participation in school dances, assemblies, and field trips for up to one quarter following their LOP infraction. There are several ways to go onto LOP status: Suspension. Three or more referrals within one quarter (including missed detentions, and gum tickets). Poor citizenship / work habits grades (one or more U s or three or more N s in a quarter). Truancy: Every 6 tardies count as a mark towards LOP. IMPACT OF L.O.P FOR: SPORTS, CLUBS, AND DRAMA PRODUCTIONS Any student who is placed on LOP prior to the start of the sport/club/production will be able to tryout, or sign up for participation with the group. However, if the student does make a team, earn a role in a production, or gain membership to a club, he/she will be unable to participate in the first game, production, or meeting of the club. If a student is placed on LOP during the duration of a sport, club, or production the student will miss the next production, game, or event as it relates to the club. Further participation in such activities will be determined by the instructor or teacher in charge, in conjunction with the administration. If a student is on LOP at any point in the duration of a sport, production, and or club, and they earn three more referrals, or reaches LOP status again based on work habits/citizenship the student will be removed from participation in the sport, production, or club for the remainder of its duration. LOP will be in effect for one quarter (nine weeks) after a student is placed on the list. A student cannot work themselves off of LOP. HARRASSMENT/BULLYING In accordance with Board Policy, Martinez Junior High administration and staff members are sensitive and concerned about any kind of harassment. We can only effectively stop harassment when we are made aware of the situation when it develops. Students and parents are to report any situation involving harassment, or bullying to a staff member immediately! The information will be forwarded to an administrator so that the harassment can be terminated immediately! LUNCH RULES Lunch is an important time for the school and its environment. Students are expected to be on their best behavior whenever they are in the cafeteria or on the lunch yard. Expectations include: Students must eat sitting at a table, facing in. No eating while walking! After students finish lunch, they may go to the Courts/Track, or other designated lunch-time areas. Students are not to be in the main hall or anywhere else on campus, as classes for other students are in session at this time. No student is to take food from the designated eating areas. No student is to loiter along the path to the lower level. Students are given enough time to reach their destinations both before and after lunch. For the safety of all, no running! Students are not to throw food or other objects. Students are expected to clean up their own mess, and not to litter! 3

4 ZERO TOLERANCE The Zero Tolerance Program is an agreement among participating Contra Costa schools, law enforcement agencies, the juvenile justice system, parents, guardians, and students. The Zero Tolerance Program states: guns and other weapons will not be tolerated on school grounds. When a student is found to be in possession of a weapon on school grounds, at school activities, or when coming to or going home from school, the following will occur: The school administrator will immediately remove the student from school activities and notify police and parents. The student will be suspended for the maximum allowable days. The administration will initiate expulsion proceedings to remove the student from all Martinez Unified School District programs and services. In addition, the Zero Tolerance Policy applies to any student caught providing drugs, alcohol, or any other intoxicant while on campus or during a school activity, or who has committed a second offense for possession of drugs or alcohol. DISCIPLINE: CAUSES FOR SUSPENSION AND/OR EXPULSION According to California State Educational Code, the following are causes for suspension. They can also be causes for expulsion if they are severe in nature, continue chronically, or create an unsafe campus. Fighting Possession of a dangerous object Possession/sale/furnishing of any controlled substance, including alcohol and tobacco Attempted robbery or extortion Vandalism Obscenity, vulgarity, or obscene act Possession of drug paraphernalia Disruption of school activities and/or defiance Receipt of stolen property Possession of an imitation firearm Sexual harassment or battery Harass, threaten, or intimidate a student to prevent or retaliate for being a witness Participate or contribute to an act of hate violence Engaging in harassment, threats, or intimidation that creates a hostile educational environment According to California State Educational Code, the following activities must result in mandatory suspension, plus expulsion (with principal s exception). Causing serious intentional physical injury to another person Possession of a knife Possession of drugs beyond alcohol or tobacco Robbery or extortion Assault or battery on any school employee In addition, the following activities must result in mandatory suspension and expulsion without exception: Possession of a firearm Brandishing a knife Sale of drugs Sexual battery In addition, Martinez Unified School District reserves the right to pursue expulsion against any student deemed dangerous or habitually disruptive to the school. 4

5 MARTINEZ UNIFIED SCHOOL DISTRICT & MARTINEZ JUNIOR HIGH SCHOOL STUDENT DISCIPLINE POLICIES 1. Pretenses, possession or use of alcohol and/or illegal drugs - First violation. 2. Continued pretense, use or possession of alcohol or other drugs - Second violation and subsequent violations (cf Discipline) (cf Suspension and Expulsion/Due Process) 3. Selling or providing alcohol, drugs, or drug imitation substances A. Parent/Guardian contact. B. Referral to site CARE Team. C. Contact law enforcement authority. D. Five day suspension to be reduced to three days with parental involvement in the student s drug/alcohol abuse assessment. F. Parental involvement in student s drug/alcohol abuse assessment by a state licensed agency. Verification of assessment participation will be provided to the school by the agency. The district will provide a list of agencies agencies/services to the parents. A. When intervention efforts fail and the student continues to use, possess or pretend to use/possess alcohol or other drugs at school or any school activity, he/she shall be recommended for expulsion. B. Law enforcement contact. A. Parent/guardian contact and distribution of support/intervention services information. B. 5 days suspension C. Recommendation of expulsion D. Law enforcement contact 4. Tobacco - use and/or possession (cf Questioning and Apprehension) (cf Search and Seizure) A. 1st violation Parent contact + Wednesday school + Referral to Tobacco Awareness Program B. 2nd violation Parent contact + Suspension C. 3rd and subsequent violations Parent contact and possible referral to SARB for continued defiance 5. Gang related activity A. 5 days suspension/police referral, recommendation for expulsion 6. Possession/sale of fireworks, including stink bombs Explosive devices: cherry bombs, etc. 7. Causing/attempting/threatening physical injury to another student, fighting A. 1st violation 1 to 5 days suspension/lop/possible expulsion from MUSD A. 1st violation 1 to 3 days suspension/lop B. 2nd violation 5 days suspension, possible police referral, possible recommendation for expulsion 5

6 8. Malicious or aggressive horseplay and/or confrontational behavior 9. Steal or attempt to steal school or private property Knowingly receive stolen property 10. Possession of drug paraphernalia Ordering, arranging, or negotiating to sell drug paraphernalia A. 1 st violation Wednesday School B. Students may be scheduled for no more than two Wednesday Schools in advance; additional Wednesday School assignments will be converted to suspension days. Students who chronically miss assigned Wednesday Schools, will be given off-campus suspension and either referred to the SARB panel or recommended for expulsion. Students who reach 20 days of collective off-campus suspension during the course of the school year will be recommended for expulsion. Excessive suspensions/detentions may result in a Student Attendance Review Board (SARB) referral. 8
