2 I. POLICY TERM & INSTALLMENT OPTIONS Policies will be written for 12-month terms only. Direct bill premium invoicing is available. A premium invoice will be mailed directly to the insured 20 days prior to the monthly policy anniversary date. A $10.00 service fee is added to all installments. The following three (3) payment plans are available: 1) Pay-in-Full 2) 3-Pay Plan 1/3 Down Payment (plus fees): 2 subsequent installments due at 60 and 120 days from effective date. 3) 5-Pay-Plan 1/5 Down Payment (plus fees): 4 subsequent installments due at 30, 60, 90 and 120 days from effective date. II. COVERAGES AVAILABLE The following is a breakdown of the ONLY coverages offered under our program. LIABILITY (BI & PD) - limits available are as follows (includes Guest Passenger Coverage): $25,000/$50,000/$20,000 $50,000/$100,000/$25,000 $100,000/$300,000/$50,000* BI/PD is a required coverage. All vehicles listed on the same policy must carry the same limit of liability. Guest Passenger Coverage is included. On off-road vehicles, limits of $25,000/$50,000/$20,000 only are available. *$100,000/$300,000/$50,000 limits are not available: If named insured or any operator is under the age of 30; or If the motorcycle is defined as a sport bike or high performance motorcycle regardless of age of named insured or any/all operators(s). MEDICAL PAYMENTS (MP) - limits available are as follows: $1,000 per person $2,000 per person Medical Payments is applied to all policies unless specifically rejected in writing by the insured. All vehicles listed on the same policy must carry the same limit of Medical Payments. UNINSURED/UNDERINSURED MOTORIST BODILY INJURY (UM/UIM) limits available are as follows: $25,000/$50,000 $50,000/$100,000 $100,000/$300,000 UM/UIM is a mandatory coverage. UM/UIM limits must match BI liability limits unless specifically rejected and lowered by the insured. The insured may choose any lower limits on file by the company if they reject limits equal to BI liability limits. UM/UIM limits not to exceed BI liability limits. All vehicles listed on the same policy must carry the same limit of UM/UIM. VA-09/07 Page 1
3 UNINSURED MOTORIST PROPERTY DAMAGE (UMPD) limits available are as follows: $20,000 $25,000 $50,000 Deductible Options: $200 (applied when the operator of the other vehicle is unknown in a hit-and-run accident) UMPD is a mandatory coverage. UMPD limit must match PD liability limit unless specifically rejected and lowered by the insured. The insured may choose any lower limit on file by the company if they reject the limit equal to PD liability limit. UMPD limit not to exceed PD liability limit. All vehicles listed on the same policy must carry the same limit of UMPD. INCOME LOSS (IL) - limit available is as follows: $100 per week up to 52 weeks from the date of the accident. Income Loss is an optional coverage. RENTAL REIMBURSEMENT (RR) - limit available is as follows: $600 per occurrence Rental Reimbursement is an optional coverage. COVERAGE FOR DAMAGE TO YOUR VEHICLE: COMPREHENSIVE - Deductible amounts are indicated in the motorcycle type section on page 7 of the manual. COLLISION - Deductible amounts are indicated in the motorcycle type section on page 7 of the manual. Comprehensive and Collision may not be written separately, except for off-road vehicles where Comprehensive Only policies are acceptable. ACCESSORY COVERAGE: Deductible amounts are the same as physical damage $2,000 of coverage for insurable special equipment (accessories) is included free of charge with the purchase of comprehensive and collision coverage. Additional accessories may be insured at a premium charge of 5%. Accessories are equipment not part of the factory standard motorcycle which include, but is not limited to, sissy bars, saddle bags, chromed parts, tanks bags, custom seats, fairings and crash bars/sliders. As motorcycles age and are sold or traded, the closer the vehicles are to their original stock configuration the more valuable they become. VA-09/07 Page 2
4 The Liability BI (including guest passenger) and Liability PD, Medical Payments, Uninsured/Underinsured Motorist Bodily Injury limits and Uninsured Motorist Property Damage limits must be the same for ALL of the motorcycles on the policy. PRODUCERS ARE ENCOURAGED TO FULLY EXPLAIN AND SELL ALL AVAILABLE COVERAGES WHENEVER POSSIBLE. III. CERTIFICATE OF INSURANCE FILINGS In the event that a motorist is convicted of operating a vehicle without insurance, we will file a "certificate of insurance" with the Department of Motor Vehicles. The fee for this filing is $20. Filings can be issued only when we insure all the vehicles in the same household registered to the Named Insured. We do not issue "certificate of insurance" filings for states other than Virginia. IV. MOTORCYCLE TYPES Pacific Specialty Insurance Company groups motorcycles into the following categories: A - BMWs (Except Sport Bikes) B - Sport Bike C - Dual Sport D - Standard Bike E - Standard Bike (High Performance) F - Scooters G - Sport Touring H - Cruisers I - Harleys (Other than XL s) and Similar Cruisers J - Harleys XL (or Similar Sportsters) K- Off-Road Vehicles (Not Street Legal) Motorcycles are manufactured with very diverse purposes in design. To a non-cyclist it may be more difficult to decipher, however, they are as diverse as automobiles. The underwriting results from the various classes are as diverse as the cycles themselves. Below we have outlined the above referenced categories: Grp A- Grp B- European Luxury Design Motorcycles. Primarily BMW Motorcycles (except BMW Sport Bikes). Similar to Expensive European Luxury Automobiles. Café design motorcycles. Sport fairinged racing style cycles with all emphasis on performance and handling. Similar in design and purpose as the new extremely high performance Chevrolet Corvettes, Dodge Vipers, Porches and Ferraris. Grp C- On/Off road design motorcycles. Enduro type cycles designed to be ridden off road, however, still perform safely on public road ways. Dual purpose cycles. Design emphasis on durability for off road use. Similar in purpose to 4x4 off-road sport utility vehicles. Grp D- Standard design cycles designed to utilitarian, not specializing in any one area. Higher performance engines and suspension systems, however, no aero dynamic fairing and body panels have been added. These units are similar to sport performance sedans. Grp E- These cycles are manufactured with extremely high performance engines. They are designed with more emphasis on acceleration and raw power as well as VA-09/07 Page 3
5 handling. No or limited aero dynamic fairings. Similar to the Ford V-8 Mustang and similar muscle cars. Grp F- Scooter Design motorcycles. Step through design scooters with emphasis on inexpensive reliable short distance transportation. Not designed for freeway use or other high speed long range usage. Basic errand running capabilities. Grp G- Grp H- Touring Design motorcycles. Cycles designed specifically for long range touring, including full touring fairings and a full compliment of luggage compartments to carry necessary clothing and other necessities. Most similar to customized conversion vans. Recent touring design motorcycles also designed with an emphasis on handling and performance ( Sport Touring ). Cruiser Style motorcycles. Cycles designed with an upright relaxed riding position with much less emphasis on performance and handling and more on rider comfort and style. Almost exclusively two cylinder lower performance motorcycles. Grp I- Harleys Other. American Made Cruiser Design. Specifically and limited to motorcycles manufactured by Harley Davidson (except XL models) and select companies manufacturing Harley-type clones. US made expensive cruiser style cycles. Grp J - Grp K - Harleys XL. Specifically and limited to the XL (Sportster) models manufactured by Harley Davidson and select companies manufacturing Harley (XL)-type clones. Off-Road Any motorcycle that is not licensed for road use, such as dirt bikes, ATVs, golf carts and similar vehicles. 6 V. MOTORCYCLE AGE The age of the motorcycle is determined by taking the current model year less the model year of the motorcycle. The current model year shall change effective October 1 of the calendar year regardless of the actual introductory date of new model year motorcycles. VI. MINIMUM PREMIUMS AND FEES The minimum written premium for each motorcycle on the policy is as follows: Minimum Written Coverage Premium Bodily Injury and Property Damage $35 Guest Passenger Liability $23 Medical Payments Coverage $35 Uninsured/Underinsured Motorist Bodily Injury Coverage $18 Uninsured Motorist Property Damage $4 Income Loss $29 Rental Reimbursement $18 Comprehensive and Collision Coverage $100 Minimum Written Premium (per vehicle): $100 Policy fees are $25 per policy (this fee is not fully earned). VII. DISCOUNTS A. ASSOCIATION DISCOUNT A 10% discount applies if the named insured is a member of one of the following: 1. ABATE (A Brotherhood Aiming Towards Education) 2. AMA (American Motorcycle Association) 3. Blue Knights 4. BMWMOA (BMW Motorcycle Owners of America) 5. BLUE KNIGHTS 6. BRAG (Buell Riders Adventure Group) 7. CMA (Christian Motorcycle Association) 8. COG (Concours Owners Group) 9. GWRRA (Gold Wing Road Riders Association) 10. GWTA (Gold Wing Touring Association) 11. HOG (Harley Owners Group) 12. HRCA (Honda Rider's Club of America) 13. IRG (Indian Rider's Group) 14. MSF (Motorcycle Safety Foundation) Instructor 15. MGNOC (Moto Guzzi National Owners Club) 16. RAT (Rider's Association of Triumph) 17. Red Knights 18. STAR Touring & Riding Association 19. USCA (United Sidecar Association) 20. VMC (Venturers Motorcycle Club) 21. VRA (Vulcan Riders Association) 22. VTS (Venture Touring Society) 23. 7 Proof of membership must accompany application. B. MOTOR VEHICLE ACCIDENT PREVENTION COURSE DISCOUNT For each insured 55 years of age or older who has successfully completed a motor vehicle accident course approved by the Department of Motor Vehicles, the cycle will receive a 5% discount. The discount will apply for a period of three years after the completion of the course. A copy of the certificate must accompany application. C. MULTI-CYCLE DISCOUNT A discount applies to all cycles on a multi-cycle policy. To qualify for this discount the policy must meet the following requirements: 1. Only cycles owned by the Named Insured and Resident Spouse may be combined on a multi-cycle policy. 2. All cycles must have the same coverages and limits with the exception of comprehensive and collision, which may vary by cycle. The discount schedule is as follows: a. 2 motorcycles: 10% discount b. 3 motorcycles: 25% discount c. 4 or more motorcycles: 35% discount D. MULTI-POLICY DISCOUNT A 5% discount will be applied to the policy if the named insured has another in-force policy with Pacific Specialty Insurance Company. E. MAXIMUM DISCOUNT 35% (Does not apply to Motor Vehicle Accident Prevention Course Discount) VIII. SURCHARGES A. INEXPERIENCED OPERATOR A 25% surcharge (all coverages) applies to any operator on the policy who does not have a valid Class M motorcycle license. B. ACCIDENTS The surcharge applies to all coverages and is shown below: Accidents Surcharge 0 0% 1 30% 2 50% 3 100% % Please refer to pages 9-10 for further explanation. C. YOUTHFUL OPERATOR If the motorcycle is defined as a sport bike or high performance motorcycle and the operator is under the age of 21, then the Youthful Operator Surcharge is 50% and applies to all coverages. Any motor vehicle conviction or accident cannot be used to surcharge rates for individual risks for a period longer than thirty-six months. This period shall begin no later than twelve months after the date of conviction or accident. ACCIDENTS: Any accident shall be considered chargeable if the facts indicate that the accident was caused either wholly or partially by the named insured, a resident of the same household, or other operator listed on the Declarations Page. An operator shall not be considered principally at-fault if: (a) (b) (c) (d) (e) (f) (g) (h) The vehicle was lawfully parked at the time of the accident. A vehicle rolling from a parked position shall not be considered lawfully parked and shall be considered in the operation of the last operator; The vehicle was struck in the rear by another vehicle, and the driver has not been convicted of a moving violation in connection with the incident; Operator of a vehicle was not convicted of a moving violation, and the operator of another vehicle involved in the accident was convicted of a moving traffic violation; The driver s vehicle was damaged as a result of contact with a vehicle operated by a hit and run operator of another vehicle, and the accident was reported to the legal authorities within a reasonable time after the accident; The accident resulted from contact with animals, birds or falling objects; The driver was responding to a call of duty as a paid or volunteer member of any police or fire department, first aid squad or any law enforcement agency, while performing any other governmental function in a public emergency; The accident was a solo vehicle accident that was principally caused by a hazardous condition of which a driver, in the exercise of reasonable care, would not have noticed (for example, black ice ). The operator causing the accident is a principal operator insured under a separate policy. VA-09/07 Page 7
9 (i) The insured is a law-enforcement officer and an accident occurred in the course of the insured s employment as a law-enforcement officer while the insured was driving a motor vehicle provided by the employing law-enforcement agency and was engaged in a lawenforcement activity at the time of such accident. MAJOR CONVICTIONS: Driving under the influence of alcohol Driving while impaired Refusal of alcohol test (implied consent) Open container All other alcohol-related convictions All drug related convictions Exhibition of speed (other than normal speeding) Operating a vehicle without owner s consent Attempting to elude a police officer Any felony involving a motor vehicle Speed contest Hit and run Altering driver s license Unlawful use of driver s license Violation of anti-theft laws MINOR CONVICTIONS: All other moving convictions. IX. ADDITIONAL PREMIUMS The following schedule designates the required down payment for any additional premium generating endorsements or up rates due MVR inaccuracies. FOR POLICIES NOT UTILIZING OPTIONAL INSTALLMENT PAYMENT PLAN: VA-09/07 Page 8
10 The insured will be mailed an additional premium notification for the outstanding additional premium balance. If the additional premium is not paid the policy will be cancelled by direct notice. Information required to delete the additional premium may be faxed to PSIC for review and processing as appropriate. X. CANCELLATIONS A. No flat cancellations are allowed after the inception date except when an insured's credit/debit card transaction is denied, or proof of double coverage is provided. PSIC or GENERAL AGENCY (whichever is applicable) must receive a copy of duplicate coverage within 30 days of binder date. B. A $10 fee will be assessed for all NSF checks. C. Cancellations may be requested by return of the original policy or written reques t signed by the insured. B. Return premiums for all company cancellations will be calculated on a prorated basis. Return premiums for cancellations at the Insured s request may be calculated utilizing the standard short-rate tables. XI. MILITARY SUSPENSION We shall suspend any coverage for any motorcycle at the request of a named insured ordered to military duty outside this Commonwealth, or his personal representative, during any period that the motor cycle is impounded in a motor vehicle impound lot on a military base of the United States Armed Forces or the National Guard. However, we may decline to suspend such coverage (i) unless satisfactory evidence of such impoundment is furnished to it, or (ii) if the period for which coverage suspension is requested is less than thirty (30) days. The suspended coverage shall be reinstated upon request of the named insured, or his personal representative, effective not earlier than the receipt of such request by the insurer or any of its authorized representatives. If we suspend coverage pursuant to this section we shall refund any unearned premium to the named insured, or his personal representative, on a pro rata basis. VA-09/07 Page 9
