2 What is GHS? The United Nations Globally Harmonized System of Classification and Labeling of Chemicals (GHS) is: An international system for harmonizing classifying and labeling of hazardous chemicals Approach for: Defining health, physical, & environmental hazards Applying hazard criteria to classify chemicals based on hazardous effects Communicating hazard information thru labels & safety data sheets

3 Why is GHS needed? No country has the ability to identify and specifically regulate every hazardous chemical product. In the United States alone, 945,000 chemical products. Adoption of GHS addresses safety, health, and environmental issues universally.

4 How was GHS developed? International mandate was adopted in the 1992 United Nations Conference: A globally harmonized hazard classification and compatible labeling system, including material safety data sheets and easily understandable symbols, should be available, if feasible, by the year 2000.

5 Who is responsible for implementing GHS? GHS is considered to be is a non-mandatory recommendation. The GHS provisions are only mandatory in countries or regions that adopt the GHS. There is no international body that monitors implementation for compliance.

6 Why does the US need it? The US has regulatory requirements that address concerns in different sectors (EPA, DOT, OSHA, etc.) Agencies were not domestically harmonized Each has pursued independent regulations differing from one another Domestic producers have to classify and label multiple times for the same product

10 How We Got Here Commitment in HazCom preamble UN mandate adopted First Edition of GHS in 2003 OSHA published an ANPR GHS System as it is now 2010 (4th Edition). Final Revised HazCom Standard became effective May 25, 2012

11 GHS & HCS OSHA adopted the provisions in GHS in its Final Rule Effective May 25, 2012 Made GHS mandatory Phased in compliance Many of the original standards provisions remain intact Compliance not all that different from Employer standpoint Changes mostly affect Importers, Mfg., etc.

12 GHS & OSHA Hazard Communication HazCom = Right to Know an update of the "Right to Know & Understand" Four most significant changes will impact: hazard classification (criteria based definitions), labeling, safety data sheets (16 required sections in particular order) and training

14 HCS Hazard Classification No requirement to test chemical to determine hazard or category class May rely on scientific data already established. Appendix A consulted for health hazards (27 pgs) Appendix B consulted for physical hazards (9 pgs) Hazard Classification guidelines were non-existent previously.

16 Mixture Provisions Mixture approach for providing data remains unchanged Based on either test data for the mixture as a whole, or a one percent cut-off approach Greatly changes in the classification requirements of chemical mixtures

31 HCS Secondary Container Labeling Same requirements as previous: All primary containers must be labeled Can not deface original labels Stationary Process Containers must be labeled Alternatives to providing identical info as original product label Method must be able to convey the same information as that of the original label. All secondary container must be labeled with same info. as original product label UNLESS immediate use by employee who transferred from labeled container Used to be same shift

34 Compliance Deadlines December 1, 2013 June 1st, 2015 Employees must be trained on the new label and SDS formats. Re-author current MSDSs into the GHScompliant SDS format. June 1st, 2016 All written programs, training programs and alternative labeling must be compliant with the new HazCom Standard.
