8 LITTLE BIG ENTRY TERMS AND CONDITIONS OF PARTICIPATION TERMS AND CONDITIONS 1. For the purpose of these terms and conditions of participation, the person who registers online a team to participate in the Little Big Dash 2016 is deemed the team captain ( the Team Captain ). By registering a team, the Team Captain warrants that they have obtained the consent of a parent or guardian of a child or ward that is not their own to register that child or ward in the event. If applicable, when a Team Captain registers a team member that is not their child or ward, the Team Captain will be required to provide the details of the parent or guardian of that child or ward, so that a copy of these terms and conditions can be sent to that parent or guardian by . By providing these details, the Team Captain warrants that they have obtained the consent from the parent and guardian for this to occur. Notwithstanding the foregoing, by registering a team the Team Captain warrants that they have made the parent or guardian of a child in their team that is not their own aware of these terms and conditions and that parent or guardian accepts these terms and conditions. The Team Captain indemnifies all persons or corporations associated directly or indirectly with the conduct of the event for any claim that arises as a result of failing to obtain the consent of the parent or guardian of a child that is not their own. 2. A parent or guardian of a child or ward may nominate another adult aged 16 years or over to participate in the event with their children/wards in the event ( Nominated Adults ). If the parent or guardian nominates a Nominated Adult, they accept that the Nominated Adult is to participate with their children/ward and accepts all risks that flow from that decision. The Nominated Adult accepts that they are responsible for participating with the relevant children/wards, and participate as a Participant (as defined below). 3. These terms and conditions apply to each person participating in the LITTLE BIG 2016 ( Participant ). By agreeing to participate the Participant (or where applicable the parent or guardian on behalf of the child or ward Participant) accepts these terms and conditions of participation. If a Participant (or where applicable the parent or guardian on behalf of the child or ward Participant) does not agree to these terms and conditions of participation they must not participate. 4. Any child or ward participating in the LITTLE BIG 2016 must be aged 5-15 (as at the date of the event). 5. Participants acknowledge that this event involves the real risk of serious injury or even death from various causes including over exertion, equipment failure, dehydration, accidents with other participants, spectators, course or weather conditions and other causes. 6. Participants understand that they should not participate in this event unless they have prepared appropriately. 7. Participants participate and accept all risks necessarily flowing from their participation, which could result in death, physical or mental injury, or the contraction or aggravation of a disease, including during the event or any training undertaken in preparation for the event. Accordingly, to the extent permitted by law, Participants release and will not hold liable all persons or corporations associated directly or indirectly with the conduct of the event, or training program offered in connection with the event, from all claims, demands and proceedings arising out of the Participant s participation and the Participant hereby indemnifies them against all liability (including liability for their negligence and the negligence of others) for all injury, loss or damage arising out of or connected with their participation in this event. This release and indemnity, shall extend to and include the event organisers, X-Tri Australia, as well as, Sanitarium Health & Wellbeing Company and their respective directors, partners, managers, officers, agents, contractors, employees and volunteers, including medical and paramedical personnel appointed for the event, the owners, licensees and occupiers of land upon which the event or any part of it is conducted, or any other person or organisation, which is involved directly or indirectly with the conduct of the event in any manner whatsoever, including promoters, and sponsors. This release and indemnity continues forever and binds the Participant s heirs, executors, personal representatives and assigns. 8. Participants consent to receiving any medical treatment that the event organisers think reasonable during or after the event. Participants understand that medical and paramedical personnel are appointed for this event. 9. Safety precautions undertaken by the organisers (including without limitation course supervision and participation safety briefings) are a service to Participants but are not a guarantee of safety. Participants acknowledge and accept that while the organisers take reasonable precautions to supervise children during their attendance at the event, the parents or guardians (or where applicable the adult nominated by the parent or guardian) are ultimately responsible for their childs /wards supervision and agree to attend the event to ensure appropriate supervision. 10. Participants will be fully responsible for the security of their personal possessions at the event. 11. Each Participant s registration is not transferable to any other person. Participants accept that if their entry and payment are not received by Sanitarium Health & Wellbeing Company by the relevant and stated registration closing date for the event entered into, the Participant may not be able to participate in the Little BIG event. If Sanitarium Health & Wellbeing Company chooses to accept late entries for any reason, a $10 late fee will occur per team entry. 12. Participants understand that the entry fee may be refunded if the event is cancelled due to war, state of emergency, disaster, flood, torrential rain or other like ACT OF GOD, or for any other health and safety reason, as determined by Sanitarium Health & Wellbeing Company. 13. If the event is cancelled by Sanitarium Health & Wellbeing Company, for any reason other than listed in Condition 11, Participants understand that the entry fee is fully refundable. The amount refunded is in accordance with what was actually paid. Participants will abide by the decision of Sanitarium Health & Wellbeing Company to cancel the event if they feel it is necessary. 14. Participants acknowledge and agree that if they wish to cancel their already completed registration for the Little BIG 2016 event, after the relevant stated registration closing date, for any reason whatsoever, then the Participant will not receive any refund. Participants understand that there will be a cancellation fee payable if the Participant cancels their registration before the relevant stated registration closing date. 15. While the event organisers will use all reasonable efforts to ensure that event is conducted as advertised, Participants acknowledge that by reason of circumstances beyond the control of the event organisers, it may become necessary or desirable to change the form of the event and if that occurs, Participants consent to the changes and agree that each and everyone of the conditions set out herein shall apply to that changed event. 16. Participants acknowledge and agree that as part of the registration process their telephone number and information about the Participant s medical, physical, dietary conditions and/or allergies, from which they may suffer, and that might affect their performance, or be relevant if medical treatment is needed, or if drinks or food are provided. Participants acknowledge and agree that this information their address details can appear on their registration number, which they will be required to wear during the event. 17. Participants acknowledge that it is a condition of entry that images and photographs of Participants may be taken by official Sanitarium photographers, and Participants agree that such images can be used for promotional purposes for an indefinite period, without any further remuneration. Participants grant Sanitarium Health & Wellbeing Company the right to also provide their details to official Sanitarium photographers for the purposes of promoting photographs taken at the event, for an indefinite period, without any further remuneration. 18. The Team Captain acknowledges and agrees that they have given permission to pay for the fee via the Team Captain s credit card (if paying via credit card) and take full responsibility for such payment. 19. Participants (or the Participant s parent or guardian s) personal information is used for the purpose of conducting the event, and such other purposes as set out in our privacy policy, and this information may be shared with third parties who are involved in conducting the event, including those located in New Zealand, and you consent for this to occur. While overseas parties are subject to privacy obligations, you accept that such obligations may differ from and be less stringent than the requirements of the privacy laws of Australia. If the personal information is not provided then, Participants may not participate. Participants understand that their name and postcode will appear on the Little BIG website once they are registered. Participants consent, unless otherwise advised, to Sanitarium Health & Wellbeing Company using each Participants personal details including name, and also image and photograph before, during or after the event, for promotional, marketing, broadcasting, reporting or surveying purposes in any media worldwide, including but not limited to, for the purpose of promoting current and future events held in Australia and New Zealand. To opt out of direct marketing from Sanitarium, or to access, update or correct any information contact Sanitarium Health & Wellbeing Company on Sanitarium s privacy policy is available at The event will be conducted in waves (a series of start times when teams compete), the Team Captain may nominate which wave they start at, subject to there still being spaces for that wave. 21. Participants acknowledge and agree that Participants must abide by, and Participants agree to abide by all participation rules and directions issued by Sanitarium Health & Wellbeing Company and the event organisers. 22. Participants (or where applicable the parent or guardian on behalf of the child or ward Participant) acknowledge and agree that they have read this document and understand and accept the terms and conditions it contains.
