4 CHULA VISTA ELEMENTARY SCHOOL DISTRICT GOVERNING BOARD AGENDA ITEM Prepared by: Superintendent s Office ITEM TITLE: Overview of Form 700, Statement of Economic Interests Action X Information BACKGROUND INFORMATION: Until 1974, when California voters imposed a ballot initiative measure on the state s political arena, laws governing the conduct of public officials and campaign committees were few, weak, and mostly ignored. The overwhelming passage of Proposition 9 created the Political Reform Act of 1974 (the Act) and a new, independent agency, the Fair Political Practices Commission (FPPC). The FPPC administers, interprets, and enforces the law s provisions. The FPPC and the Act have served as a model for the nation ever since. The Act governs disclosure of political campaign contributions and spending by candidates and ballot measure committees, sets ethics rules for state and local government officials, and imposes strict limits on decisions or votes that affect the officials financial interests. It also regulates lobbyists financial disclosures and lobbying practices related to the legislature and state agencies. The Act is designed to assure that: State and local government serve all citizens equally, regardless of status or wealth. Public officials perform their duties impartially and without bias generated by personal financial interests or the interests of their financial supporters. Public officials disclose income and assets that could be affected by official actions and disqualify themselves from participating decision making when they have conflicts of interest. Election campaign receipts and expenditures are fully and truthfully disclosed in order to inform voters and prevent improper practices. Elections are fair. No laws or practices favor incumbents. The state ballot pamphlet provides useful information about state measures so voters can be less dependent on paid advertising for information. The activity of those who lobby the state legislature is regulated and their finances are disclosed to prevent improper influence on public officials. Page 1 of 2 Agenda Item 4.A. March 23, 2015
5 Public officials and private citizens are given the means to vigorously enforce political reform. Form 700, Statement of Economic Interests is part of the Act. It is a document that public officials and certain government employees, consultants, and volunteer board members are required to complete in order to disclose financial interests. ADDITIONAL DATA: Today, District Counsel Peter Fagen from Fagen Friedman & Fulfrost, LLP, will provide an overview of Form 700. 6 CHULA VISTA ELEMENTARY SCHOOL DISTRICT GOVERNING BOARD AGENDA ITEM Prepared by: Superintendent s Office ITEM TITLE: Overview of Charter Schools Action X Information BACKGROUND INFORMATION: With the 1992 passage of Senate Bill (SB) 1448, sponsored by Senator Gary Hart (D-Santa Barbara) and known as the Charter Schools Act (CSA) of 1992, California became the second state in the country to enact charter school legislation. By the school year, California was first in the nation in the number of students enrolled in charter schools and second in the number of operating charter schools. Charter schools are tuition-free, nonsectarian, nondiscriminatory, public schools that provide instruction in any of Kindergarten through Grade 12 and have voluntary student enrollment. Charter schools are usually created or organized by groups (or a combination) of teachers, parents, and community leaders or by community-based organizations and are typically sponsored by an existing local public school board or county board of education. Specific goals and operating procedures for the charter school are detailed in an agreement (also known as charter ) between the entity authorizing the charter and charter organizers. The charter is a contract that details the school s mission, goals, program, students it serves, methods of assessment, and ways it uses to measure success. In exchange for operational freedom and flexibility, charter schools are subject to higher levels of accountability than traditional public schools. Charter schools offer quality and choice in the public education system. In California, charters are granted for a term of five years. At the end of each term, the entity authorizing the charter may renew the charter. Charter schools are accountable to their authorizer, and to the students and families they serve, to produce positive academic results and adhere to the charter contract. The authorizer retains the right to revoke the charter if the charter school does not meet its goals or adheres to the contract. Page 1 of 3 Agenda Item 4.B. January 21, 2015

Start-up charters Schools that did not previously exist and essentially were created as charters. Conversion charters Schools that were previously non-charter public schools and converted to charters. The conversion requires that 50 percent of the permanent teachers sign a petition supporting the charter and this petition must contain a statement indicating that the signers are meaningfully interested in teaching at the charter. FISCAL IMPACT/FUNDING SOURCE: Like traditional public schools, charters receive state funding based on a formula for each child enrolled in the school. Many charters also apply for additional grants and donations or organize supplementary fundraising to pay for programs that are not fully funded by state or school district formulas. Charters may contract with the authorizing entity for services such as transportation, special education, or professional development. STAFF RECOMMENDATION: This is an information item. 9 CHULA VISTA ELEMENTARY SCHOOL DISTRICT GOVERNING BOARD AGENDA ITEM Prepared by: Superintendent s Office ITEM TITLE: Overview of the Local Control and Accountability Plan Action X Information BACKGROUND INFORMATION: On July 1, 2013, California Governor Jerry Brown signed into law the Local Control Funding Formula (LCFF), the most comprehensive reform to the state s school funding system in 40 years. LCFF was passed with bi-partisan support as part of the California State Budget. Transition to LCFF began during and full implementation is expected to be complete by the school year. The goal of the LCFF is to significantly simplify how state funding is provided to local educational agencies (LEAs). Under the new funding system, revenue limits and most state categorical programs are eliminated. LEAs will receive funding based on the demographic profile of the students they serve and gain greater flexibility to use these funds to improve outcomes of students. The LCFF creates funding targets based on these student characteristics. For school districts and charter schools, the LCFF funding targets consist of grade span-specific base grants plus supplemental and concentration grants that reflect student demographic factors. LCFF is expected to: Restore K-12 funding to pre-recession levels over time and to provide an investment of nearly $10 billion (at full implementation) that will benefit all students, including those defined as Low-Income, English Learners, and Foster Youth. Ensure state funding is more consistent among California schools by providing 20 percent more funding for students with high needs. Districts with concentrations of at least 55 percent of high-needs students will receive 50 percent more funding for unduplicated students over that threshold.
