FOR RENEWAL OF EXEMPTION AUTHORITY Pursuant to 49 U.S.C and Subpart C of the Department s Rules of Practice (14 C.F.R. Part 302), ( America West ) applies for renewal of its exemption authority to engage in scheduled foreign air transportation of persons, property, and mail between a point or points in the United States, via intermediate points, to a point or points in Jordan and beyond. In support of this Application, America West respectfully states as follows: 1. America West is a Delaware corporation with its principal office at 111 West Rio Salado Parkway, Tempe, Arizona, America West is a citizen of the United States within the meaning of 49 U.S.C (a)(15)(C) and is fit, willing, and able to provide the services contemplated by this renewal application. America West holds various certificates of public convenience and exemption authorities. See, e.g., Notice of Action Taken, August 3, 2006, Docket (granting America West s exemption authority to provide scheduled air service between various points in the U.S. and various points in

3 Application of America West for Renewal of an Exemption Mexico both with its own aircraft and pursuant to its codeshare relationship with Mesa Air Group, Inc.). Pursuant to Rule 24 of the Department s Rules of Practice, America West requests that the Department take official notice of all information previously filed to establish America West s fitness. 3. By Notice of Action Taken (October 18, 2004), the Department granted America West a two-year exemption from 49 U.S.C to engage in scheduled foreign air transportation of persons, property, and mail between a point or points in the United States, via intermediate points, to a point or points in Jordan and beyond. See Docket OST America West currently provides scheduled air service between the United States and Jordan pursuant to its code-share relationship with Royal Jordanian Airlines. Renewal of America West s exemption authority will greatly serve the public interest by providing substantial competition to other carriers serving Jordan from the United States, while supporting commerce and enhancing the options available to the traveling public. 5. The Department has previously determined that the exemption authority sought in this renewal application is consistent with the aviation agreement between the United States and Jordan. See Notice of Action Taken, October 18, 2004, Dockets OST and Pursuant to 14 C.F.R , America West intends to rely on the Administrative Procedures Act, 5 U.S.C. 558(c) implemented by Part 377, to continue in effect its current exemption authority pending a final determination 2

4 on this renewal application. America West s current exemption is effective through October 18, Application of America West for Renewal of an Exemption WHEREFORE, on the basis of the foregoing, requests that the Department renew its exemption authority to engage in scheduled foreign air transportation of persons, property, and mail between a point or points in the United States, via intermediate points, to a point or points in Jordan and beyond. A waiver of the 60-day requirement for America West would not prejudice any party. 3
