1 The following minutes will not become official until they are approved at the next Supervisors Meeting, December 12, 2011 November 14, 2011 The Supervisors met in Regular Session at 6:00 p.m. at Eagles Park. The meeting was called to order by Mr. Ketterman, Chairman. Supervisor Valko was also present. Staff Members present were Susan Hansen, Secretary/Treasurer, Carroll Dell, Planning Chairman/Special Project Coordinator, Bill Ridinger, Roadmaster and Attorney David James. Supervisor Bitzel was absent. Guests present: Kathy Grudberg, Dale Miller, Dorothy & John Voyta, Terri Divers, Glenn Miller, Mr. & Mrs. Jack DiGangi, Tom Osborne, Carl and Mary Ann Cookerly and Jess Haines from the Gettysburg Times. Mr. Valko made a motion to approve the October Minutes and Treasurers Report and the October Workshop Minutes as presented. Mr. Ketterman seconded the motion. The Public Comment Mr. Tim Waltz asked the Supervisors about a flier that was being handed out at the election poling site. The Supervisors explained that the information on the flier was incorrect. Planning Commission Carroll Dell, Planning Chairman gave the planning commission report: S& A Homes is now being reviewed by the Planning Commission, Adams County Planning and Gettysburg Engineering. Final review of SALDO. Mr. Valko made a motion to appoint John Voyta to the Planning Commission replacing Andy Witkowski. Mr. Ketterman seconded the motion. The Mr. Valko made a motion to re appoint Terri Divers to the Planning Commission for another four (4) year term. Mr. Ketterman seconded the motion. The Correspondence Attorney James presented the Board with the Order of Court with regards to the Steven A. Bitzel v. Germany Township. The Order of Court found in favor of the Township on two (2) issues; 1.) credibility and 2.) even if the photos existed, the court concluded they would not constitute a public record. Mr. Bitzel has thirty (30) days to appeal this decision. Administrative Actions Mr. Valko made a motion to approve Ordinance #46 Per Capita Tax. Mr. Ketterman seconded the motion. The 1

2 Mr. Valko made a motion to approve Ordinance #47 Earned Income Tax. Mr. Ketterman seconded the motion. The Mr. Valko made a motion to approve Resolution Real Estate Tax Rate. Mr. Ketterman seconded the motion. The Mr. Valko made a motion to make an offer to purchase 136 Ulricktown Road in the amount of $657, the average of the two appraisals. Mr. Ketterman seconded the motion. The Mr. Valko made a motion to approve payment of the budgeted contributions for Mr. Ketterman seconded the motion. The Road Master Mr. Ridinger advised the Supervisors that two thirds (2/3) of Bittle Road has been completed. The Township also received free millings from West Manheim Township and PennDot. Old Business Mr. Valko made a motion to approve releasing the eighteen (18) month maintenance securities for the roads in the Rosewood Development. Mr. Ketterman seconded the motion. The Mr. Valko made a motion to approve reducing the letter of credit for Pipers Choice Development in the amount of $116, leaving the required remaining public improvement security in the amount of $105, Mr. Ketterman seconded the motion. The Mr. Ketterman made a motion to approve reducing Gates of Praise letter of credit in the amount of $16, leaving the required remaining public improvement security in the amount of $ 101, Mr. Valko seconded the motion. The Mr. Valko made a motion to approve the current bond for Kingsdale Storage Units in the amount of $30, dated June 12, 2011 and start the eighteen month maintenance period as of October 6, 2011 contingent upon M & T Bank amending the performance bond to state maintenance bond. At the expiration of the current bond, June or now Mr. Smith can reduce the bond to the required fifteen percent (15%) of construction which would be $4, Mr. Ketterman seconded the motion. The Mr. Valko made a motion to approve reducing the bond for Bethel Assembly of God s Landscaping and starting the eighteen month maintenance period starting November 1, The new letter of credit will need to be fifteen percent (15%) of the landscaping construction cost of $19, The new letter of credit in the amount of $ will need to be approved by Attorney James before the Township releases the old bond with United States Surety Company. Mr. Ketterman seconded the motion. The Mr. Valko made a motion to re affirm approving the final Shanebrook Subdivision Plan contingent upon Attorney James approval of the Storm Water Management Agreement and the Subdivision Conditions Agreement. Mr. Ketterman seconded the motion. The Mr. Valko made a motion to approve the ninety (90) day extension for Steven s Restaurant Land Development Plan. Mr. Ketterman seconded the motion. The 2

3 New Business Mr. Ketterman made a motion to introduce the 2012 proposed Budget. Mr. Valko seconded the motion. The The proposed budget will be advertised and is available for public inspection. Payment of Bills Mr. Valko made a motion to approve the bills for the month. Mr. Ketterman seconded the motion. The Ms. Cookerly asked the Supervisors where Supervisor Bitzel was since he had not been in attendance at the last two Supervisors meetings. Mr. Dale Miller added since you are an elected official shouldn t you be required to attend the regular Supervisors meetings. The Supervisors had not heard from Supervisor Bitzel prior to the meeting.
