1 TERMA-TERMA DAN SYARAT-SYARAT CIMB PREFERRED 1. PELUASAN PERKHIDMATAN 1.1 Keahlian adalah melalui jemputan oleh Bank kepada individu-individu dan / mana-mana entiti berdasarkan kepada baki minima atau oleh mana-mana kriteria kelayakan lain yang ditentukan mengikut budibicara Bank. 1.2 Penerimaan dan penerusan keahlian CIMB Preferred akan sepenuhnya bergantung atas budi bicara Bank. 2. BAKI MINIMUM 2.1 Melainkan diputuskan sebaliknya oleh Bank, Pelanggan hendaklah mengekalkan pada setiap masa 'Baki Minimum' yang ditakrifkan sebagai: A. Suatu jumlah Deposit agregat minimum sebanyak RM200, atau sejumlah amaun lain sebagaimana yang Bank mungkin tentukan dari semasa ke semasa yang dikekalkan di bawah akaun tunggal atau akaun bersama Pelanggan di mana Pelanggan adalah pemegang akaun utama di dalam mana-mana satu atau lebih akaun Simpanan, Semasa dan Deposit Tetap Pelanggan dengan Bank, ATAU B. Suatu jumlah Pelaburan dan Deposit agregat minimum sebanyak RM200, atau sejumlah amaun lain sebagaimana yang Bank mungkin tentukan dari semasa ke semasa yang didepositkan di dalam mana-mana akaun pelaburan dan akaun deposit Bank atau dibuat dengan Bank di bawah akaun tunggal atau akaun bersama Pelanggan di mana Pelanggan adalah pemegang akaun utama, ATAU C. Suatu Gadai Janji individu minimum (Pinjaman Perumahan / Pinjaman Premis Perniagaan) sebanyak RM1,000, atau sejumlah amaun lain sebagaimana yang Bank mungkin tentukan dari semasa ke semasa yang diberikan kepada Pelanggan. (selepas ini dirujuk sebagai 'Baki Minimum') 2.2 Kecuali bagi item "C", Bank boleh mengenakan caj perkhidmatan suku tahunan sebanyak RM200 pada atau sejumlah amaun lain sebagaimana yang mungkin ditentukan oleh Bank dari semasa ke semasa setelah memberikan notis yang munasabah jika gabungan baki purata bulanan dalam akaun Pelanggan berada di bawah Baki Minimum. (Akaun Pelanggan yang dirujuk di sini dan didebitkan untuk caj perkhidmatan hendaklah bermaksud akaun pemegang akaun prinsipal) Bank mengikut budibicara mutlaknya boleh meluaskan keahlian CIMB Preferred kepada orang yang dinamakan ("Orang Yang Dinamakan") oleh Pelanggan. Orang Yang Dinamakan mesti memegang sama ada akaun Deposit atau Pelaburan bersama-sama dengan Pelanggan dan dengan syarat Pelanggan hendaklah mengekalkan pada setiap masa keperluan minimum seperti berikut: A. Suatu jumlah Deposit agregat minimum sebanyak RM250, atau sejumlah amaun lain sebagaimana yang Bank mungkin tentukan dari semasa ke semasa yang dikekalkan di bawah akaun tunggal atau akaun bersama Pelanggan di mana Pelanggan adalah pemegang akaun utama di dalam mana-mana satu atau lebih akaun Simpanan, Semasa dan Deposit Tetap Pelanggan dengan Bank, ATAU B. Suatu jumlah Pelaburan dan Deposit agregat minimum sebanyak RM250, atau sejumlah amaun lain sebagaimana yang Bank mungkin tentukan dari semasa ke semasa yang didepositkan di dalam mana-mana akaun pelaburan dan deposit Bank atau dibuat dengan Bank di bawah akaun tunggal atau akaun bersama Pelanggan di mana Pelanggan adalah pemegang akaun utama. Semua terma dan syarat yang ditetapkan kemudian daripada ini hendaklah turut terpakai sama kepada Orang Yang Dinamakan. 2.4 Bank berhak untuk mengenakan apa-apa fi, caj atau levi lain ke atas mana-mana perkhidmatan yang ditawarkan setelah memberikan notis yang munasabah kepada Pelanggan. Fi-fi, caj-caj dan levi-levi yang telah dibayar oleh Pelanggan atau telah dipotong daripada akaun Pelanggan tidak akan dikembalikan. 2.5 Pelanggan dengan ini membenarkan Bank untuk mendebitkan mana-mana akaun (akaun-akaun) Pelanggan yang ditetapkan untuk pembayaran fi-fi, caj-caj, atau levi-levi tersebut dari semasa ke semasa dan jika tiada akaun yang ditetapkan bagi tujuan ini atau jika akaun yang ditetapkan itu tidak mempunyai dana yang mencukupi, Bank dengan ini diberi kuasa oleh Pelanggan untuk mendebitkan mana-mana akaun lain Pelanggan untuk tujuan tersebut setelah memberi notis yang mencukupi kepada Pelanggan. Pelanggan mengakui bahawa keahlian adalah peribadi dan tidak boleh dipindah milik. 3. KOMUNIKASI UNTUK ARAHAN 3.1 Pelanggan dengan nyatanya bersetuju dan secara tanpa boleh mansuh memberikan kuasa kepada Bank untuk bertindak atas arahan-arahan Pelanggan yang diberikan melalui telefon dan / atau pos, faksimili, yang mana Bank mengikut budibicara tunggal dan mutlaknya percaya ia datang dari Pelanggan tertakluk kepada Pelanggan: (i) memberi suatu tanggung rugi kepada Bank dalam bentuk dan kandungan sebagaimana yang akan ditentukan oleh Bank; dan (ii) setelah pematuhan yang ketat ke atas terma-terma dan syarat-syarat tanggung rugi tersebut. 3.2 Pelanggan hendaklah mengambil segala langkah berjaga-jaga yang munasabah untuk menghalang penggunaan tanpa kebenaran dan penipuan penggunaan terhadap pin, kata laluan dan / atau mekanisme keselamatan yang lain, kod-kod akses, ciri-ciri atau peranti yang berkaitan dengan mana-mana akaunnya yang ada dengan Bank (selepas ini dirujuk sebagai 'kod-kod akses keselamatan'). Pelanggan hendaklah memastikan bahawa kod-kod akses keselamatan tidak didedahkan atau ditunjukkan kepada mana-mana orang lain. 4. PENAMATAN PERKHIDMATAN CIMB PREFERRED ( CP ) 4.1 Kegagalan untuk mengekalkan Baki Minima yang dinyatakan di atas boleh membawa kepada penamatan, sekatan atau penggantungan penggunaan perkhidmatan-perkhidmatan CP oleh Pelanggan atas budibicara tunggal Bank setelah notis yang mencukupi diberikan kepada Pelanggan dan / atau Orang Yang Dinamakan. 4.2 Penamatan penggunaan perkhidmatan-perkhidmatan CP yang diberikan kepada Pelanggan juga boleh disebabkan oleh yang berikut: (a) Apabilapelanggan memberikan notis bertulis kepada Bank untuk menamatkan keahlian; atau (b) Jika Pelanggan mungkir dalam apa-apa pinjaman atau kemudahan yang diberikan kepada Pelanggan oleh Bank atau oleh mana-mana institusi kewangan lain; atau (c) Apabila berlaku kematian atau ketidaksiuman Pelanggan atau jika Pelanggan melakukan suatu perbuatan kebankrapan (d) Jika terdapat apa-apa perubahan dalam undang-undang atau peraturan yang menjadikannya mustahil atau menyalahi undang-undang bagi Bank untuk terus menyediakan perkhidmatan-perkhidmatan CP. 4.3 Bank berhak mengikut budibicara tunggal dan mutlaknya pada bila-bila masa dan dari semasa ke semasa untuk menamatkan, meminda, mengubahsuai, menyemak, menyekat atau menggantung semua atau mana-mana perkhidmatan CP yang disediakan atau akan disediakan kepada Pelanggan setelah memberi notis yang mencukupi. 4.4 Tanpa mengambil kira perkara di atas, Bank berhak untuk menggantung atau menamatkan apa-apa atau semua perkhidmatan CP pada bilabila masa selepas memberi notis yang mencukupi kepada Pelanggan tanpa menanggung apa-apa liabiliti terhadap Pelanggan. 4.5 Sebaik sahaja selepas penamatan perkhidmatan-perkhidmatan CP sama ada oleh Pelanggan atau Bank, Kad Pengenalan yang berkaitan dan yang berhubung dengan peruntukan perkhidmatan-perkhidmatan CP hendaklah dikembalikan oleh Pelanggan kepada Bank. 1

2 4.6 Selepas penamatan perkhidmatan-perkhidmatan CP, Pelanggan hendaklah berhenti menggunakannya dan dengan ini bersetuju bahawa Bank mempunyai hak untuk mengenakan Pelanggan apa-apa levi atau fi yang ditentukan oleh Bank setelah memberi notis yang mencukupi, berkenaan dengan mana-mana perkhidmatan CP yang terus digunakan oleh Pelanggan walaupun berlaku penamatan tersebut. 4.7 Bank tidak boleh dalam apa jua keadaan dipertanggungjawabkan bagi apa-apa kerugian yang dialami atau kehilangan yang ditanggung oleh Pelanggan berkenaan dengan apa-apa pernyataan, representasi, komunikasi yang dibuat berhubung dengan atau yang timbul daripada penamatan, pindaan, pengubahsuaian, semakan, sekatan atau penggantungan semua atau mana-mana perkhidmatan CP yang disediakan oleh Bank kepada Pelanggan. 4.8 Penggunaan perkhidmatan-perkhidmatan CP oleh Orang Yang Dinamakan akan dengan secara automatiknya ditamatkan apabila tamatnya perkhidmatan-perkhidmatan CP yang diberikan kepada Pelanggan. 5. PENGELUARAN WANG TUNAI ATM CIMB PREFERRED 5.1 Di mana Pelanggan mempunyai Kad Mesin Juruwang Automatik (Kad ATM), di bawah perkhidmatan-perkhidmatan CP yang ditawarkan Pelanggan CIMB Preferred mempunyai pilihan untuk meningkatkan had pengeluaran ATM sehingga RM10,000 dan ini boleh dilakukan secara manual di mana-mana ATM CIMB Bank. 5.2 Pemindahan pihak ketiga bagi pemegang kad akaun CP akan dihadkan kepada maksimum RM5,000 setiap hari. 6. KAD KREDIT 6.1 Ahli CP boleh memohon kad kredit CIMB WORLD / CIMB VISA Infinite / CIMB Enrich Platinum MasterCard / CIMB Preffered Platinum tertakluk kepada syarat-syarat / keperluan-keperluan yang ditetapkan oleh Bank Negara Malaysia (BNM) dan oleh CIMB Bank Berhad. 6.2 Bagi kes akaun bersama, Pelanggan sebagai pemegang kad prinsipal akan berhak untuk menerima kad tambahan yang akan dikeluarkan kepada pemegang tambahan sepertimana yang dinamakan oleh pemegang kad prinsipal bebas daripada apa-apa fi pengeluaran kad. Kadkad kredit tambahan yang diminta oleh Pelanggan akan tertakluk kepada fi-fi dan caj-caj lazim Bank. Terma-terma yang sedia ada dan di masa hadapan yang mengawal penggunaan kad kredit yang dikeluarkan oleh Bank hendaklah terpakai kepada pemegang kad prinsipal / tambahan. 7. PENYATA YANG DISATUKAN 7.1 Akaun-akaun dalam penyata yang disatukan, adalah disatukan oleh alamat surat-menyurat yang sama bagi akaun masing-masing. 7.2 Hanya akaun-akaun yang menyertai sahaja di mana pelanggan adalah pemegang utama akaun atau pemegang utama bersama akaun adalah dimasukkan ke dalam penyata yang disatukan. 7.3 Penyata yang disatukan dihantar secara automatik kepada Pelanggan jika terdapat 2 atau lebih akaun-akaun yang menyertai dengan alamat yang sama. Jika Pelanggan tidak mahu menerima penyata yang disatukan, Pelanggan hendaklah memaklumkan kepada Bank dengan sewajarnya. 8. PERKHIDMATAN SMS ALERT 8.1 Pelanggan memberi kuasa kepada Bank untuk menghantar apa-apa maklumat akaun, kemaskini dan peringatan yang berkaitan dengan akaun Pelanggan dengan bank melalui perkhidmatan pesanan ringkas ("SMS") atau apa-apa bentuk lain yang dihantar ke nombor mudah alih yang diberikan oleh Pelanggan dalam rekod-rekod Bank termasuk baki tertunggak, baki tersedia, had overdraf, sepertimana menurut kesnya, dan sebarang kemaskini lain yang Bank mungkin sediakan dari semasa ke semasa. 8.2 Bank menyediakan perkhidmatan ini sebagai kemudahan kepada Pelanggan untuk tujuan maklumat sahaja. Ia tidak dianggap sebagai rekod bank untuk akaun yang berkaitan. 8.3 Pelanggan tidak boleh meminta Bank bertanggungjawab terhadap sebarang kehilangan atau kerugian yang mungkin ditanggung oleh pelanggan secara langsung atau tidak langsung yang timbul daripada atau berkaitan dengan perkhidmatan-perkhidmatan CP termasuk tetapi tidak terhad kepada kerosakan atau kepincangan tugas komputer, talian sambungan terminalnya, sistem pemprosesan data atau talian penghantaran atau apa-apa kelengkapan lain sama ada dimiliki oleh Bank atau tidak, percubaan atau tindakan-tindakan sebenar pengganas, wabak, apa-apa keadaan bencana alam yang di luar kawalan Bank. 8.4 Bagi keselamatan pihak Pelanggan sendiri, Bank boleh menggantung SMS Alerts dengan serta-merta dan memberi notis selepas itu jika Bank mempunyai sebab yang munasabah untuk mengesyaki Pelanggan tidak menerima SMS atau terdapat orang lain yang menerima SMS. 8.5 Adalah menjadi tanggungjawab Pelanggan untuk memaklumkan kepada Bank jika telefon Pelanggan hilang atau dicuri. Setelah pemberitahuan itu, SMS Alert akan digantung sehingga Pelanggan memberitahu Bank mengenai penemuan semula telefonnya atau penggantian nombor telefonnya. 8.6 SMS Alerts akan terus dihantar kepada telefon bimbit Pelanggan melalui rangkaian telefon asing jika Pelanggan membawa telefon bimbitnya ke luar negara. Walaubagaimana pun, Bank tidak menjamin keselamatan jika maklumat dihantar melalui operator-operator rangkaian ketiga. 9. PUSAT PANGGILAN DAN PERBANKAN TELEFON CIMB PREFERRED 9.1 Bagi memastikan bahawa Bank menjalankan arahan-arahan dengan tepat, semua panggilan telefon antara Bank dan Pelanggan direkodkan. Bank juga boleh memantau panggilan-panggilan bagi tujuan meningkatkan perkhidmatannya. 9.2 Pelanggan tidak boleh meminta Bank bertanggungjawab terhadap sebarang kehilangan atau kerugian yang mungkin ditanggung oleh pelanggan secara langsung atau tidak langsung yang timbul daripada atau berkaitan dengan apa-apa perkhidmatan disebabkan oleh apa jua alasan termasuk tetapi tidak terhad kepada kerosakan atau pincang tugas komputer, talian sambungan terminalnya, sistem pemprosesan data atau talian penghantaran atau apa-apa peralatan lain sama ada dimiliki oleh Bank atau tidak, percubaan atau tindakan-tindakan sebenar pengganas, wabak, apa-apa keadaan bencana alam yang di luar kawalan Bank. 9.3 Apabila diminta oleh Pelanggan, Bank dengan ini diberi kuasa atas budibicara tunggalnya untuk memberikan maklumat yang berkaitan dengan akaun Pelanggan, kadar pertukaran asing, atau kadar faedah melalui telefon, telex atau faksimili. Apa-apa maklumat / kadar jika diberi melalui telefon, tidak boleh mengikat Bank melainkan jika kemudiannya disahkan secara bertulis oleh Bank. 9.4 Bank diberi kuasa untuk bergantung dan melaksanakan arahan yang diterima oleh Bank daripada Pelanggan melalui telefon, telefon mudah alih (termasuk SMS atau MMS yang dihantar daripada telefon mudah alih yang diberikan oleh Pelanggan dalam rekod-rekod Bank), telex, faksimili atau kaedah-kaedah telekomunikasi lain (secara kolektifnya, arahan-arahan telekomunikasi") dan Pelanggan bersetuju bahawa pihak Bank dibenarkan untuk bertindak melakukan apa-apa arahan telekomunikasi yang mana Bank mengikut budibicara tunggalnya percaya ianya datang dari Pelanggan (selepas mengambil langkah-langkah yang munasabah untuk mengesahkan identiti orang yang memberi atau sumber arahan-arahan telekomunikasi tersebut) sebagaimana yang diberi kuasa penuh oleh Pelanggan dan untuk bergantung dan 2

3 melaksanakannya dengan sewajarnya, dan Bank tidak akan bertanggungjawab kepada Pelanggan terhadap sebarang kehilangan atau kerugian yang timbul sekiranya arahan-arahan telekomunikasi itu sebenarnya datang daripada individu-individu yang tidak diberi kuasa Pihak Bank boleh (tetapi tidaklah menjadi tanggunjawabnya untuk) melaksanakan Arahan tanpa menyelidik identiti atau kuasa seseorang yang memberi atau yang dikatakan memberi Arahan tersebut atau kesahan mana-mana pesanan telefon atau atau faksimili dan boleh menganggap yang ianya sebagai telah diberikuasa sepenuhnya oleh dan mengikat ke atas Pelanggan tanpa mengambil kira keadaankeadaan semasa pada masa Arahan tersebut atau jumlah transaksi dan tanpa mengambil kira mana-mana kesilapan, salah faham, kurang penjelasan, penipuan, pemalsuan atau kekurangan kuasa yang berkaitan dengannya, dan tanpa mengkehendaki pengesahan yang selanjutnya dalam apa jua bentuk, dengan syarat bahawa pegawai Bank yang bertanggungjawab percaya bahawa Arahan tersebut adalah Arahan yang tulen pada masa ianya diberikan. 9.6 Pihak Bank boleh (tetapi tidaklah menjadi tanggungjawabnya untuk) menentusahkan Arahan tersebut dengan mengenal pasti T-pin dan mana-mana kod pengenalpastian atau soalan yang lain sebagaimana yang pihak Bank boleh dari semasa ke semasa tentukan dan Pelanggan hendaklah bertanggungjawab terhadap mana-mana penyalahgunaan T-pin atau kod pengenalpastian tersebut. 9.7 Pelanggan mengakujanji untuk menanggungrugi pihak Bank dan pengarah-pengarah, pegawai-pegawai, pekerja-pekerja, ejen-ejen dan wakil-wakilnya ( Wakil-wakil Bank ) terhadap semua permintaan, tuntutan, tindakan, prosiding, ganti rugi (sama ada secara langsung atau tidak langsung), kerugian (termasuk kerugian-kerugian berbangkit daripada), kos dan perbelanjaan yang ditanggung oleh Bank dan/atau Wakil-wakil Bank yang timbul daripada apa-apa yang telah dilakukan atau ditinggalkan berkenaan dengan mana-mana arahan yang diberikan oleh Pelanggan. 9.8 Tanpa mengambil kira walauapapun di sini, Bank tidak diwajibkan untuk menerima dan bertindak atas arahan-arahan telekomunikasi untuk: - - pertukaran dalam mandat akaun - pertukaran penandatangan yang diberi kuasa - pemberian Kuasa Wakil kepada orang / entiti lain - arahan-arahan pembayaran - penutupan akaun (akaun-akaun) dan pemindahan baki. 10.BUTIRAN KESELAMATAN 10.1 Atas budibicara Bank, Bank boleh memperkenalkan langkah-langkah keselamatan tambahan untuk memastikan setakat mana yang boleh bahawa arahan-arahan telekomunikasi telah diberi kuasa oleh Pelanggan. 11.AKAUN BERSAMA DAN PIHAK KETIGA 11.1 Pemegang-pemegang akaun bersama akan mana-mana akaun di dalam CIMB Bank tidak diberi kuasa untuk melaksanakan apa-apa transaksi / pertanyaan melalui perbankan telefon CIMB Preferred. 12.NOTIS PENTING 12.1 Bank boleh atas budi bicara tunggal dan mutlaknya setelah memberi notis yang mencukupi dari semasa ke semasa mengubah, menambah atau meminda Terma-terma dan Syarat-syarat ini Pemberitahuan kepada Pelanggan berkenaan dengan apa-apa perubahan, penambahan, atau pindaan tersebut ( Pindaan ) hendaklah dilaksanakan atas budibicara mutlak Bank melalui mana-mana satu kaedah komunikasi berikut, iaitu, melalui cara elektronik atau melalui mel biasa kepada alamat terakhir Pelanggan yang diketahui atau dengan menyiarkan satu notis mengenai Pindaan di setiap cawangan Bank dan laman web atau dengan menyiarkan satu iklan berkenaan dengan Pindaan di dalam satu akhbar pilihan Bank, atau dengan apa-apa cara pemberitahuan lain yang Bank boleh pilih dan Pindaan tersebut hendaklah disifatkan sebagai mengikat ke atas Pelanggan dari tarikh pemberitahuan Pindaan atau daripada apa-apa tarikh lain sebagaimana yang mungkin ditentukan oleh Bank dalam pemberitahuan tersebut Semua penyata akaun, notis atau apa-apa komunikasi lain yang dihantar melalui pos kepada Pelanggan di alamat terakhir Pelanggan yang diketahui yang dinyatakan dalam rekod Bank hendaklah dianggap telah diterima oleh Pelanggan dalam tempoh tiga (3) hari pengeposan Pelanggan hendaklah dengan segera memberitahu Bank secara bertulis dalam tempoh 14 hari dari tarikh Pelanggan menerima atau dianggap telah menerima penyata-penyata akaun dari Bank tentang apa-apa tinggalan, kemasukkan yang tidak betul, debit yang salah dibuat, kesilapan, percanggahan atau apa-apa ketidaktepatan walauapapun jua dalam penyata-penyata akaun. Sekiranya gagal berbuat demikian, Pelanggan akan dianggap telah menerima catatan yang terkandung di dalamnya sehingga tarikh kemasukan terakhir dalam penyata-penyata akaun itu sebagai betul, muktamad, konklusif dan mengikat ke atas Pelanggan, wakil di sisi undang-undang dan penggantinya. Pelanggan tidak boleh membuat apa-apa tuntutan terhadap Bank dengan mendakwa bahawa penyata-penyata akaun yang dikeluarkan oleh Bank mengandungi peninggalan, kemasukan yang tidak betul, debit yang salah dibuat, kesilapan, percanggahan atau ketidaktepatan Masa hendaklah menjadi intipati di sini tetapi kegagalan Bank dalam melaksanakan atau kelewatan dalam melaksanakan atau menguatkuasakan hak-hak, kuasa-kuasa, keistimewaan-keistimewaan atau remedi-remedinya terhadap Pelanggan tidak akan beroperasi sebagai suatu penepian begitu juga dengan apa-apa pelaksanaan sebahagian daripada mana-mana hak, kuasa, keistimewaan atau remedi tidak akan memprejudiskan atau menjejaskan hak-hak Bank untuk kemudiannya bertindak tegas selaras dengannya Ketidaksahan, ketidaksahihan atau ketidakbolehkuatkuasakan mana-mana Terma-terma dan Syarat-syarat ini tidak akan menjejaskan kesahan, kesahihan atau kebolehkuatkuasaan mana-mana Terma-terma dan Syarat-syarat lain di sini Terma-terma dan Syarat-syarat ini hendaklah tertakluk kepada, dikawal oleh dan ditafsirkan menurut undang-undang Malaysia dan undangundang, peraturan-peraturan dan garis panduan Bank Negara Malaysia, Persatuan Bank-Bank di Malaysia dan badan-badan lain yang relevan, yang berkuatkuasa dari semasa ke semasa. Pelanggan berserah kepada bidang kuasa eksklusif Mahkamah-mahkamah Malaysia Tanpa mengambil kira walauapapun jua di sini, hak-hak Bank di bawah Terma-terma dan Syarat-syarat ini akan terus berkuatkuasa dan memberi kesan dan akan terus berkekalan setelah sebarang penamatan atau penggantungan perkhidmatan-perkhidmatan CP oleh Bank Terma-terma dan Syarat-syarat di sini akan terus sah dan mengikat tanpa mengambil kira sebarang pindah milik atau penyerahan hak ke atas perniagaan, operasi-operasi, aset-aset atau liabiliti Bank atau sebarang perubahan dalam Bank atau mana-mana syarikat yang mana perniagaan Bank mungkin pada masa itu dijalankan dan / atau kematian Pelanggan Terma-terma dan Syarat-syarat yang dinyatakan di sini hendaklah sebagai tambahan kepada dan tidak mengurangkan apa-apa perkiraan tertentu mengenai penggunaan perkhidmatan-perkhidmatan CP yang sekarang atau selepas ini wujud antara Bank dan Pelanggan atau mana-mana terma dan syarat sebagaimana yang mungkin dinyatakan dalam mana-mana surat atau notis yang diberikan oleh Bank kepada Pelanggan dari semasa ke semasa Terma-terma dan Syarat-syarat ini hendaklah mengikat waris-waris, wakil-wakil peribadi dan pengganti-pengganti hak milik Bank dan Pelanggan masing-masing dan hak-hak dan obligasi-obligasi Pelanggan di sini tidak boleh diserahhak atas apa-apa jua sebab sekalipun. 3

4 12.12 Semua terma dan syarat, peraturan dan undang-undang, perjanjian atau perkiraan yang terdahulu, sekiranya ada yang telah dibuat antara Bank dan Pelanggan, sama ada secara bertulis atau lisan berkenaan dengan perkhidmatan-perkhidmatan CP adalah dengan ini dibatalkan dan digantikan dengan Terma-terma dan Syarat-syarat ini Terma-terma dan Syarat-syarat ini adalah sebagai tambahan dan tertakluk kepada perjanjian dan / atau undang-undang dan peraturanperaturan yang mengawal operasi, perkhidmatan-perkhidmatan, faedah-faedah dan keistimewaan-keistimewaan berhubung dengan dan / atau yang berbangkit di bawah akaun (akaun-akaun) Pelanggan yang dikekalkan dengan Bank Dimana konteks mengizinkan, perkataan yang memaksudkan bilangan tunggal hendaklah termasuk bilangan jamak dan sebaliknya, perkataan yang bermaksud jantina lelaki hendaklah termasuk jantina perempuan serta neutral dan sebaliknya Sekiranya terdapat apa-apa yang tidak konsisten, konflik, keraguan atau percanggahan antara versi Bahasa Inggeris atau mana-mana versi lain Terma-terma dan Syarat-syarat ini, versi Bahasa Inggeris akan diguna pakai. 5 CIMB PREFERRED TERMS AND CONDITIONS 1. EXTENSION OF SERVICES 1.1 Membership is by way of invitation by the Bank to individuals and / any entity based on the minimum balance or by any other eligibility criteria determined at the discretion of the Bank. 1.2 The acceptance and continuance of CIMB Preferred membership will be entirely at the discretion of the Bank. 2. MINIMUM BALANCE 2.1 Unless decided otherwise by the Bank, the Customer shall maintain at all times a Minimum Balance defined as: D. A minimum aggregated total Deposit of RM200, or such other amount as the Bank may determine from time to time maintained under the Customer s sole account or joint account where the Customer is the primary account holder in any one or more of the Customer s Savings, Current and Fixed Deposits accounts with the Bank, OR E. A minimum aggregated total Investment and Deposit of RM200, or such other amount as the Bank may determine from time to time deposited in any investment and deposit account of the Bank or made with the Bank under the Customer s sole or joint account where the Customer is the primary account holder, OR F. A minimum individual Mortgage (Housing Loan / Business Premise Loan) of RM1, 000, or such other amount as the Bank may determine from time to time which is granted to the Customer. (hereafter referred to as Minimum Balance ) 2.2 Except for item C, the Bank may impose a quarterly service charge of RM200 on or such other amount as the Bank may determine from time to time upon giving reasonable notice if the monthly average combined balance in the Customer's accounts fall below the Minimum Balance. (Customer s account referred to herein and debited for service charge shall mean the principal account holder s account) The Bank may in its absolute discretion extend the CIMB Preferred membership to the person nominated ( the Nominated Person ) by the Customer. The Nominated Person must hold either a Deposit or Investment account jointly with the Customer and provided the Customer shall maintain at all times the minimum requirement as follows: C. A minimum aggregated total Deposit of RM250, or such other amount as the Bank may determine from time to time maintained under the Customer s sole or joint account where the Customer is the primary account holder in any one or more of the Customer s Savings, Current and Fixed Deposits accounts with the Bank, OR D. A minimum aggregated total Investment and Deposit of RM250, or such other amount as the Bank may determine from time to time deposited in any investment and deposit account of the Bank or made with the Bank under the Customer s sole or joint account where the Customer is the primary account holder. All terms and conditions stipulated hereinafter shall apply equally to the Nominated Person. 2.4 The Bank reserves the right to impose any other fees, charges or levies on any of the services offered upon giving reasonable notice to the Customer. Fees, charges and levies paid by the Customer or deducted from the Customer s account are not refundable. 2.5 The Customer hereby authorizes the Bank to debit any of the Customer's account(s) designated for the payment of such fees, charges or levies from time to time and if no account has been designated for this purpose or if the account designated has insufficient funds, the Bank is hereby authorized by the Customer to debit any other account of the Customer for the aforesaid purpose upon giving adequate notice to the Customer. The Customer acknowledges that the membership is personal and non-transferable. 3. COMMUNICATION OF INSTRUCTIONS 3.1 The Customer expressly consents and irrevocably authorizes the Bank to act on the instructions of the Customer given by telephone and/or post, facsimile, which the Bank in its sole and absolute discretion believes emanate from the Customer subject to the Customer: (i) giving an indemnity to the Bank in such form and contents as shall be determined by the Bank ; and (ii) upon strict compliance to the terms and conditions of the said indemnity. 3.2 The Customer shall take all reasonable precautions to prevent the unauthorized and fraudulent use of his pin, password and/or other security mechanism, access codes, features or device related to any of his accounts maintained with the Bank (hereafter referred to as security access codes ). The Customer shall ensure that the security access codes are not revealed or disclosed to any other persons. 4. TERMINATION OF CIMB PREFERRED ( CP ) SERVICES 4.1 Failure to maintain the Minimum Balance specified above may lead to termination, restriction or suspension of usage of the CP services by the Customer at the Bank s sole discretion upon adequate notice given to the Customer and/or the Nominated Person. 4.2 Termination of usage of the CP services granted to the Customer may also be brought about by the following: (a) By the Customer giving written notice to the Bank to terminate the membership; or (b) If the Customer defaults in any loans or facilities granted to the Customer by the Bank or by any other financial institutions; or (c) Upon death or insanity of the Customer or if the Customer commits an act of bankruptcy (d) if there is any change in law or regulation which makes it impossible or unlawful for the Bank to continue to make available the CP services. 4.3 The Bank reserves the right at its sole and absolute discretion at any time and from time to time to terminate, amend, modify, revise, restrict or suspend all or any of the CP services made available or to be made available to the Customer upon giving adequate notice. 4.4 Notwithstanding the above, the Bank reserves the right to suspend or terminate any or all of the CP services at any time upon giving adequate notice to the Customer without incurring any liability to the Customer. 4.5 Immediately upon termination of the CP services whether by the Customer or the Bank, the Recognition Card, relating to and connected to provision of the CP services shall be returned by the Customer to the Bank. 4.6 Upon the termination of the CP services, the Customer shall cease to use the same and hereby agreed that the Bank shall have the right to charge the Customer such levies or fees determined by the Bank upon giving adequate notice, in respect of any CP services continued to be used by the Customer notwithstanding the said termination. 4.7 The Bank shall not in any circumstances be held liable for any damages suffered or loss incurred by the Customer in respect of any statement, representation, communication made in relation to or arising from the termination, amendment, modification, revision, restriction or suspension of all or any of the CP services made available by the Bank to the Customer. 4.8 The usage of the CP services by the Nominated Person will be automatically termination upon termination of the CP services granted to the Customer. 5

6 5. CIMB PREFERRED ATM CASH WITHDRAWAL 5.1 Where the Customer maintains an Automated Teller Machine Card (ATM Card), under the CP services offered Tthe CIMB Preferred Customer has the option to increase the ATM withdrawal limit up to RM10,000 and this can be done manually at any CIMB Bank ATM. 5.2 Third party transfer for CP account cardholders will be capped at a maximum of RM5,000 per day. 6. CREDIT CARD 6.1 CP member may apply for a CIMB WORLD/ CIMB VISA Infinite/ CIMB Enrich Platinum MasterCard / CIMB Preferred Platinum credit card subject to the conditions / requirements set by Bank Negara Malaysia (BNM) and by CIMB Bank Berhad. 6.2 In case of joint accounts, the Customer as principal card holder will be entitled to receive a supplementary card to be issued to the supplementary holder as nominated by the principal card holder free of any card issuance fee. Additional credit cards requested by the Customer will be subject to the Bank s prevailing fees and charges. The existing and future terms governing the use of credit cards issued by the Bank shall apply to the principal/ supplementary card holder. 7. CONSOLIDATED STATEMENT 7.1 The accounts in the consolidated statement are consolidated by the same mailing address of the respective accounts. 7.4 Only participating accounts where the customer is the primary or joint primary holder of the account are included into the consolidated statement. 7.5 The consolidated statement is sent automatically to Customer if there are 2 or more participating accounts with the same address. If the Customer does not wish to receive the consolidated statement, the Customer is to inform the Bank accordingly. 8. SMS ALERT SERVICE 8.1 The Customer authorizes the Bank to send any account information, updates and reminders pertaining to the Customer s account with the bank via short messaging service ( SMS ) or any other form sent to the mobile number advised by the Customer in the Bank s records including outstanding balance, available balance, overdraft limit, as the case may be, and any other updates that the Bank may make available from time to time. 8.2 The Bank provides this service as a convenience to Customer for information purpose only. It does not constitute a bank record for the account to which it pertains. 8.3 The Customer shall not hold the Bank responsible for any loss or damage which the customer may incur directly or indirectly arising out of or in connection with the CP services including but not limited to breakdown or malfunction of the computer, its terminal connection lines, data processing system or transmission line or any other equipment whether or not belonging to the Bank, attempted or actual acts of terrorism, outbreak of epidemics, an act of God of any circumstances beyond the Bank s control. 8.4 For the Customer s own security, the Bank may suspend SMS Alerts with immediate effect and give notice thereafter when it is reasonably possible if the Bank has reason to suspect the Customer is not receiving the SMS or that someone else is receiving the SMS. 8.5 It will be the Customer s responsibility to notify the Bank if the Customer s mobile phone is lost or stolen. Upon such notification, the SMS Alert will be suspended until the Customer informs the Bank of his phone s return or replacement number. 8.6 SMS Alerts will continue to be transmitted to the Customer s mobile telephone via foreign telephone networks if the Customer takes his mobile phone abroad. However the Bank does not guarantee the security if the information is transmitted via third network operators. 9. CIMB PREFERRED CALL CENTRE & PHONE BANKING 9.1 To ensure that the Bank carries out instructions accurately, all telephone calls between the Bank the Customer are recorded. The Bank may also monitor calls with the objective of improving its service. 9.2 The Customer shall not hold the Bank responsible for any loss or damage which the customer may incur directly or indirectly arising out of or in connection with any service due to any reason whatsoever including but not limited to breakdown or malfunction of the computer, its terminal connection lines, data processing system or transmission line or any other equipment whether or not belonging to the Bank, attempted or actual acts of terrorism, outbreak of epidemics, an act of God of any circumstances beyond the Bank s control. 9.3 Upon request by the Customer, the Bank is hereby authorized at its sole discretion to release information relating to the Customer s account, exchange rates or interest rates via telephone, telex or facsimile. Such information / rates if given via telephone, shall not be binding on the Bank unless subsequently confirmed in writing by the Bank. 9.4 The Bank is authorized to rely and act on the instructions received by the Bank from the Customer via telephone, mobile phone (including SMS or MMS sent from the mobile phone advised by the Customer in the Bank s records), telex, facsimile or other means of telecommunication ( collectively, telecommunication instructions ) and the Customer agrees that the Bank is authorized to treat any telecommunication instructions which the Bank in its sole discretion believes emanated from the Customer (after taking reasonable steps to verify the identity of the person giving or the source of, the telecommunication instructions) as fully authorized by the Customer and to rely and act on it accordingly, and the Bank shall not liable to the Customer for any loss or damage arising in the event such telecommunication instructions in fact emanated from unauthorized individuals. 9.5 The Bank may (but shall not be obliged to) act on the Instruction without inquiring the identity or authority of the person giving or purporting to give such Instruction or the authenticity of any telephone or or fax message and may treat the same as fully authorized by and binding on the Customer regardless of the circumstances prevailing at the time of the Instruction or amount of the transaction and notwithstanding any error, misunderstanding, lack of clarity, fraud, forgery or lack of authority in relation thereto, and without requiring further confirmation in any form, provided that the Bank officer concerned believed the Instruction to be genuine at the time it was given. 9.6 The Bank may (but shall not be obliged to) verify the Instruction with T-pin identifying and such other identification code or questions as the Bank may from time to time specify and Customer shall be responsible for any improper use of such T-pin or identification code. 9.7 The Customer undertakes to keep the Bank and its directors, officers, employees, agents and correspondents ( the Bank s Representatives ) indemnified against all claims, demands, actions, proceedings, damages, (whether direct or indirect), losses (including consequential losses), costs and expenses incurred by the Bank and/or the Bank s Representatives arising out of anything done or omitted pursuant to any instruction given by the Customer. 9.8 Notwithstanding anything herein, the Bank is not obligated to accept and act upon telecommunication instructions to:- - change in account mandate - change of authorized signatories 6

7 - grant of Power of Attorney to another person/entity - - closure of account(s) and transfer of the remaining balance. 10. SECURITY DETAILS 10.1 At the Bank s discretion, the Bank may introduce further security measures to ensure, as far as possible that the telecommunication instructions have been authorized by the Customer. 11. JOINT ACCOUNTS AND THIRD PARTY 11.1 The joint account holders of any accounts within CIMB Bank is not authorized to perform any transactions/inquiries through CIMB Preferred phone banking. 12. IMPORTANT NOTICE 12.1 The Bank may at its sole and absolute discretion upon giving adequate notice from time to time vary, add to or amend the Terms and Conditions herein Notification to the Customer in respect of any such variation, addition or amendment ( the Amendment ) shall be effected at the Bank s absolute discretion through any one of the following means of communication, namely, via electronic means or by ordinary mail to the Customer s last known address or by posting a notice regarding the Amendment at each of the Bank s branches and website or by effecting an advertisement regarding the Amendment in one newspaper of the Bank s choice, or by any other means of notification which the Bank may select and the Amendment shall be deemed as binding on the Customer as from the date of notification of the Amendment or from such other date as may be specified by the Bank in the notification All statements of account, notices or any other communication sent by post to the Customer at the Customer s last known address stated in the Bank s records shall be deemed to have been duly received by the Customer within three (3) days of posting The Customer shall promptly notify the Bank in writing within 14 days from the date the Customer receives or is deemed to have received the statements of account from the Bank of any omission, incorrect entries, debits wrongly made, error, discrepancy or inaccuracy of any kind whatsoever in the statements of account. Failing which, the Customer shall be deemed to have accepted the entries contained therein made up to date of the last entry in the statements of account as correct, final, conclusive and binding on the Customer of his legal representative and successor. The Customer shall be precluded from making any claims against the Bank by alleging that the statements of account issued by the Bank contained omission, incorrect entries, debits wrongly made, error, discrepancy or inaccuracy Time shall be the essence herein but the Bank s failure in exercising or delay in exercising or enforcing its rights, powers, privileges or remedies against the Customer shall not operate as a waiver thereof nor shall any partial exercise of any rights, powers, privileges or remedies prejudice or affect the Bank s rights to subsequently act strictly in accordance therewith The illegality, invalidity or unenforceability of any Terms and Conditions shall not affect the legality, validity or enforceability of any other Terms and Conditions herein The Terms and Conditions herein shall be subject to, governed by and construed in accordance with the laws of Malaysia and the rules, regulations and guidelines of Bank Negara Malaysia, the Association of Banks in Malaysia and other relevant bodies, in force from time to time. The Customer submits to the exclusive jurisdiction of the Courts of Malaysia Notwithstanding anything herein, the Bank s rights and entitlement under this Terms and Conditions shall continue to remain in force and effect and shall survive any termination or suspension of the CP services by the Bank The Terms and Conditions herein shall continue to be valid and binding notwithstanding any transfer or assignment of business, operations, assets or liabilities of the Bank or any change in the Bank or any company by which the business of the Bank may for the time being is carried on and/or the Customer s death The Terms and Conditions herein stated shall be in addition to and not in derogation of any specific arrangement with regards to the use of the CP services now or hereafter subsisting between the Bank and the Customer or any terms and conditions as may be specified in any letter or notice given by the Bank to the Customer from time to time This Terms and Conditions shall be binding upon the heirs, personal representatives and successors-in-title of the Bank and the Customer respectively and the rights and obligations of the Customer herein cannot be assigned for any reasons whatsoever All previous terms and conditions, rules and regulations, agreements or arrangements, if any made between the Bank and the Customer, either in writing or verbal in respect of the CP services are hereby cancelled and superseded by this Terms and Conditions This Terms and Conditions are in addition and subject to the agreement and/or rules and regulations governing the operation, services, benefits and privileges in relation to and /or arising under the account(s) of the Customer maintained with the Bank Where the context so admits, word importing the singular number shall include the plural number and vice-versa, words importing the masculine gender shall include the feminine and neuter genders and vice-versa In the event of any inconsistency, conflict, ambiguity or discrepancy between the English version or any other versions of these Terms and Condition, the English version shall prevail.
