6 VDV-comments on the revision of Regulation 1370/2007 (1) COM s proposals are not only aiming at the liberalisation of domestic railway services (article 5.6 of regulation 1370) 6 new concept for awarding PSO While the new definition of competent authority reduces the flexibility of the member states, the current definition considers their various situations New, far too detailed rules on public transport plans and extensive control mechanisms for all PT modes Public tendering of PSO railway services is an important instrument, but: more flexibility for direct awards for PSO railway services needed, proposed thresholds are extremely low VDV has identified categories where direct awards can be beneficial for operators, authorities and customers (based on practical experience)

7 VDV-comments on the revision of Regulation 1370/2007 (2) Major expectation: stability and legal certainty is very important! Europe s legal framework for public transport has been discussed in difficult negotiations for more than 10 years (resulting in Regulation 1370/2007 which came into force in December 2009) In Germany the adapted national law on public transport by light rail and bus ( PBefG ) came into force in January days later the Commission presented their proposal for a major revision of Regulation 1370/2007 VDV: No need to immediately revise Regulation 1370/2007 (Art. 11 of Reg. 1370/2007 states: progress reports by 2014, after this revision if necessary). In our opinion the COM does not respect the will of EP and Council which they expressed in In addition, COM questions its own will ( venire contra factum proprium ). VDV expectation of discussions in EP and Council: guarantee of stability instead of massive extensions by the fourth RP 7
