1 APPENDIX 1 PERMIT TO OCCUPY - ASSET MAINTENANCE AGREEMENT HENRY ZIEGENFUSZ PARK, CLEVELAND (LOCATION No. 5237) HENRY ZIEGENFUSZ PARK (Facility) is described as Lot 1 CP857140, Lot 33 RP and Lot 2 SP with a total area of 131,496 m 2. The land is owned by Redland City Council under a freehold title. Refer to Appendix 2 for the Site Plan of the area to which this Permit To Occupy Agreement applies. The sporting clubs which occupy this site (Users) are known as: Cleveland Thornlands Cricket Club () activities include training and playing of competition cricket; Redlands Hockey Association (RHA) activities include training and playing of competition hockey; and Redlands Aero Model Soarers Club (RAMS) activities include the flying of model planes. The Cleveland Thornlands Cricket Club currently has a lease of facilities on this site under a Lease agreement which includes some of the following: Lease area of total 443 m 2 for clubhouse only; Tenure period 01/04/1995 to 31/03/2015; Annual rental - As per Councils Annual Fee s and Charges; Poker machines Nil; Liquor licence Restricted Licence; Food licence Nil. This Permit to Occupy Asset Maintenance Agreement is to relate specifically to all constructed infrastructure and the playing field that exist within the Facility outside of the Lease area. Table 1 below lists all the known assets registered on the Redland City Council Maximo asset data base within the site area. Within Table 1 are the listed agreed accountable actions by Redland City Council as land owner and the Cleveland Thornlands Cricket Club and Redlands Hockey Association Club as the Users of the Facility in relation to the management and maintenance of the recorded assets. At any time by an approved application process assets can be added to or removed from Table 1. Maintenance of built assets is to be defined as the following actions: A minimum weekly inspection of each asset to ensure that each is in a safe condition to minimise the risk to all users. Users being defined as any member of the public who may enter the area and make use of that asset whether it is in association with a Users event/activity or any other casual use not associated with a Users event/activity. Keeping of records related to the inspection process undertaken. This is in the form of a Hazard Inspection Form. The undertaking of immediate repairs to all identified hazards associated with a particular asset. Repairs are to be carried out to make the asset safe for public use or the asset removed from site to eliminate the hazard. The Users are to notify Council with-in 5 days of any assets being removed due to its hazardous condition. 1

2 The cleaning and removal of graffiti from any surface of an asset in line with Council s Graffiti Policy GL The immediate removal of litter and other associated rubbish that is deposited within the Facility following a Users event/activity. Keeping all assets in an aesthetically good & clean appearance by maintaining paint work and removal of dirt & grime. Maintaining all sports field lighting (Lamps & Fittings only) in good working order to meet the specific standards expected for the respective codes of sport played. The Australian Standards that apply to this Facility are AS , AS and AS To immediately report to Council any incidences of vandalism. Report can be made to the Recreation Officer on In the event that the repairs to a Users maintained asset (Table 1) are identified by Council during interim inspections and the Users do not respond to undertaking those repairs following receipt of written notice from Council, Council may at its sole discretion perform the repair work and recover the costs of such work from the Users as debt due and owing. The Mowing Maintenance condition of this Permit to Occupy applies only to the Cleveland Thornlands Cricket Club. The following conditions apply: Maintenance shall constitute: litter removal, mowing, edging and trimming field and clubhouse surrounds on a weekly basis as per the boundary shown on attached plan (Appendix 2). Any hazards that are encountered during the course of maintenance must be either rectified by the User or immediately reported to Council s Turf Services Officer on Council s Turf Services Officer will also be arranging an inspection of the equipment to be used by the User to carry out maintenance services. Any equipment considered defective will not be permitted to carry out maintenance for Council at the Facility. The agreed amount payable to the User for undertaking this work will be evaluated on an annual basis, in negotiation with Council s Turf Services Officer. At the completion of each month, the User shall send an invoice to Council s Parks and Conservation Services Unit seeking payment. Council will pay the agreed amount to the User subject to the work being carried out to the satisfaction of Parks and Conservation Services. The User is to nominate a contact person and supply contact details to allow Council s Turf Services Officer to contact the correct person quickly in relation to this Mowing Maintenance. Evidence of current Queensland Work Cover Certification and Public Liability Insurance equal to the value of $10,000,000 is required to formalise this Mowing Maintenance.
