1 The implementation and enforcement of the Safety of Life at Sea Convention (SOLAS) requirements regarding the verification of the gross mass of packed containers will enter into force on July the 1 st, The regulation concerns only packed containers aboard vessel under the SOLAS regime involved in international maritime traffic. The SOLAS regulation for weighing containers allows two ways for weighing packed containers in order to obtain the Verified Gross Mass (VGM) for each container by the shipper or his representative either by; Method 1: The shipper may weigh the packed container by using calibrated and certified equipment, or Method 2: The shipper may weigh all packages and cargo items, including the mass of pallets, dunnage and other securing material to be packed in the container and adding the tare mass of the container to the sum of the single masses, using a certified method approved by the competent authority of the State in which packing of the container was completed. The responsibility for obtaining and providing the VGM lies with the shipper. It is against international regulation to load a packed container without the VGM. Therefore CMA CGM Group will not load containers unless a VGM is provided. Shipper means a legal entity or person named on the bill of lading or sea waybill or equivalent multimodal transport document (e.g. through bill of lading, Sea waybill) as shipper and/or who (or in whose name or on whose behalf) a contract of carriage has been concluded with a shipping company. Calibrated and certified equipment means a scale, weighbridge, lifting equipment or any device, capable of determining the actual gross mass of a packed container or of packages and cargo items, pallets, dunnage and other packing and securing material, that meets the accuracy standards and requirements of the State in which the equipment is being used. ======================== For an overview of this regulation, a document has been jointly published by the WSC, TT Club, ICHCA and the Global Shippers Forum (GSF) ( Industry_FAQs_Dec_2015_US_letter_WEB.pdf). It is important to refer to it to get the main guidelines for the implementation of the SOLAS amendment regarding the Verified Gross Mass (VGM) of a container carrying cargo. The following FAQ has been compiled in response to questions received from some of our customers. This document will be regularly amended in relation to additional issues that may arise. Do you supervise the weighing equipment to ensure that it is certified and calibrated? The Group will not check the certification and the calibration of equipment used for the weighing. Do you permit a shipper to use method 2 for the VGM? The Group will not check if the shipper is entitled to use method 2 by the local competent authority.
2 Can we use method 2 for all commodities in containers? For scrap and other cargo in bulk, method 2 would be inappropriate and impractical and so method 1 should be used instead. Do you intend to re-weigh a packed container with a VGM? The Group will not re-weigh a container which already has a VGM unless terminal reports abnormal / excessive weight at time of handling which unable loading of such container. By providing the total gross weight including product, packaging, pallets, and tare of container what will you do with that information? The VGM will be used for better container stowage aboard to avoid incident, we do not expect all details about packaging, CMA CGM group expect to receive the total gross weight. How is the net weight of your Container equipment determined? Our containers are compliant with all ISO requirements. The Tare weight is displayed on each container, painted on the right door. Do you intend to publish the tare weight for each Container type on your webpage? It is planned to provide tare information for our fleet, including long and short term leased units for customers which will submit VGM information on our website through their connected workspace. It is already the case for customers submitting their Shipping Instructions (SI) on our website. Please note, for other customers, the information is displayed on each container. The packer who will use method 2 will be able to take into account this data for the global calculation of the VGM. If Maintenance and Repair (M&R) changes the weight of a container, is the changed tare weight reflected on the outside of the container? Yes, the outer tare weight information is always up to date and correct. Do you intend to offer a weighing service as a "value added service"? No. In some ports, the Group could inform Customers of terminal s capability to deliver VGM information (method1). If the shipper is not able to provide your company with the VGM for each packed container, do you still intend to load containers? It is against the international regulation to load a packed container without the associated VGM. CMA CGM Group will not load containers without the VGM.
3 What if the vendor (ultimate shipper) is not able to determine the VGM by using "Method 2" but its Forwarder instruct you to perform the pre-carriage in carrier's haulage? CMA CGM Group has no owned weighbridge. We cannot provide this service for inland transport. Certain Competent Authorities introduced different tolerance values for the weighing. Do you take into account these tolerances? The Group will not take into account these tolerances values. It is the responsibility of the Competent Authority which may carry out checks. What (if any) tolerance will you accept for the VGM of a container? Tolerance is fixed by certain competent authorities in case of controls. CMA CGM Group might consider a variance of 1 ton between the VGM communicated by the shipper and what the terminal operator could observe. No correction to the VGM should be made if the variance is less than 1 ton. Will you accept VGM data to be transmitted as part of the electronic Shipping Instructions (SI)? Yes and provided that CMA CGM Group will receive the SI, in that case, before the preparation of the stowage plan. VGM has to be clearly mentioned in the SI. Do you keep the VGM as information only i.e. there is no mention on the Bill of Lading (B/L)? The VGM will be used for the preparation of the stowage plan and so, for operations purposes to prevent accidents aboard, damages and/or containers lost at sea. By extension, the VGM will contribute for more safety along the supply chain. Do you use the VGM to establish the Bill of Lading (B/L)? The Group uses data in the shipping instructions received to edit the bill of lading. If the VGM is mentioned in the SI then the same VGM will appear on the BL. What are the available formats available to obtain the VGM? (Paper, electronically ) All formats are acceptable except receiving the VGM by telephone. In what format should we send the VGM? VGM should be part of a shipping document. This shipping document could be dedicated for the VGM (Text or Electronic Data Interchange EDI) or the VGM could be included in the shipping instructions. By what method should the VGM be submitted? The VGM is normally submitted by our regular ecommerce channel (our website, via Direct EDI connection with us or via Service Provider (INTTRA, GT Nexus, CargoSmart ), by and generally in written form. The Group will not accept the VGM communicated by phone or in verbal form.
4 How will the submission be imbedded into the existing work flow? At any time, between the booking and the VGM cut-off. What is the deadline to provide the VGM? The Group will provide our customers with a the operational cut-off. When is the Verified Gross Mass (VGM) information expected to be transmitted in the booking process? The VGM should be sent at any time but before the operational cut off and provided that the VGM is in link with a container number. When will the VGM be communicated to you? Same time as the Documentation Cut-off? In certain ports of loading, the cut-off could be the same time as the Documentation cut-off. To whom should the VGM be communicated? The VGM must be communicated to the shipping line and not to the terminal. What happens if there is no weight at the gate-in? CMA CGM Group cannot be held responsible if a packed container, without VGM, enters into a terminal which has no calibrated and certified equipment for weighing. All costs resulting to the stoppage of the container and to exit the container from the terminal lie with the shipper. Generally speaking no VGM = no Gate-in. What costs may arise at the Port Of Loading (POL) if a container could not be loaded due to a missing VGM? Generally speaking no VGM, no gate-in. This should not happen since containers should enter the gate with the VGM. But there are two exceptions; 1. If the terminal is able to weigh the container, these following charges could be applied: additional THC + trucking + weighing depending on the configuration and the organization of the terminal. 2. If the terminal has no equipment to provide a VGM by using method 1, all costs related to storage and trucking the container outside the terminal lie with the shipper, same for detention until customer has confirmed ability to weigh the container. Which VGM data elements are required to be transmitted? The below elements should be transmitted for each container: VGM = figures (mandatory) UOM = (unity of measurement) Standard local UOM, to be managed under Kgs (mandatory) Weighing type = Code (Method 1 or Method 2) (optional) Signature = free text to contain a name in capital letters (mandatory) VGM certificate reference (optional) Booking Number (mandatory if weighing coming from a weighing station or delegate by the shipper. Optional otherwise) or BL Number if applicable (optional)
5 Container number (mandatory) What is the actual effective date for your company to enforce the VGM transmission (example: container being loaded before July 1, 2016, with subsequent transshipment after July 1, 2016)? We will communicate as soon as possible on this topic, which is not fixed yet. There may be 2 options : - Option 1 we take only into account the date of the original loading. Before July 1 no VGM even if there are transshipment ports after July 1 st. - Option 2, we will inform the shipper that we will need a VGM before July 1 st because a transshipment is scheduled after July 1 st. What message type(s) will be used / accepted for VGM transmission? VERMAS (booking) and IFTMIN (shipping instruction EDI) messages. For IFTMIN, specific VGM data should be added accordingly.
