2 The director-general's foreword The year 2013 was characterised by positive development of communications markets, launching of the National Cyber Security Centre at FICORA, intelligence activities within electronic communications in the United States covered in the media in June, as well as an auction for the 800 MHz frequency band. The positive development of communications markets continued. The number and speed of broadband subscriptions continued to grow. At the end of 2013, there were nearly 1.7 million fixed broadband subscriptions in Finland, and 16% of them had a nominal data transfer speed of at least 100 Mbps from the network to the user. Also, data transfer services in the mobile network became livelier, since there was a clear increase in both the use of data and the number of data transfer subscriptions. The popularity of mobile communications network subscriptions without restrictions on the use of data transfer grew the most. The number of such subscriptions was already nearly 3.4 million at the end of the year. In January 2013, the Government approved Finland's Cyber Security Strategy. The National Cyber Security Centre Finland (NCSC- FI) was established under FICORA in compliance with the guidelines presented in the strategy. In June 2013, the media reported on widescale intelligence activities of the United States security authorities. The activities concerned electronic communications. Due to an eventual information security threat caused by the activities to Finnish users, FICORA investigated the effects that the activities could have on the information security of the communications services provided and transmitted by telecoms operators. The Finnish legislation guarantees everyone the right to confidential communications. As further investigation work, FICORA sent device manufacturers a request to declare that their devices do not contain such functionalities and components that reveal the user's confidential communications to external parties without the user's knowledge and permission. The investigation work continues in The 800 MHz frequency range was released from television operations and, in accordance with international agreements, it was assigned to mobile broadband. The frequency range was shared between three telecoms operators in an auction arranged by FICORA. The frequencies were obtained by TeliaSonera Finland Oyj, Elisa Oyj and DNA Oy who paid a little over 108 million in total for the frequencies. The building of 4G networks has got started quickly. The promotion and effective supervision of communications markets will continue intensively also in the coming year. Examples of the key targets are the market for local loops, as well as the market for call termination on the mobile network and TV broadcasting transmission services. The year will be NCSC-FI's first year in operation. The development of NCSC-FI's operations is outlined by a recently completed action plan. In terms of frequency issues, FICORA prepares for the World Radio-communication Conference 2015 and continues the frequency coordination in the 700 MHz frequency range with neighbouring countries. The goal is to guarantee effective and disturbance-free use of the frequency range appointed for the use of mobile broadband from the beginning of Our goal is to ensure secure and easy communications for everyone in Finland. 3 FICORA - Easy and reliable communications for everyone in Finland FICORA's policy strategy extending to the year 2020 consists of FICORA's strategic goals and related priority areas and measures, critical success factors, and guiding principles. Minor changes were made to the strategy in the autumn of Efficient management and sharing of information was included as a new critical success factor. The new organisation was introduced in early The preparatory work for the National Cyber Security Centre Finland (NCSC-FI) as part of the FICORA began in March. NCSC-FI is responsible for monitoring cyber security risks, collecting information related to cyber security from various sources, as well as processing and communicating the information to various players. NCSC-FI began operating at the beginning of The operations of the Television Fees Division ceased on 31 May The debt collection and invoicing of unpaid TV fees, as well as the responsibilities concerning the development of information systems and processes, continue within the Administration Division. 4 Operations The key activities of 2013 are discussed below based on the following three strategic goals: the provision of communications services will be more versatile in Finland, the availability of basic communications services will improve, and the functionality and security of communications networks and services will develop. The provision of communications services will be more versatile FICORA boldly intervenes if defects appear in the communications markets In 2013, FICORA continued to develop pricing and cost accounting methods. In addition, FICORA defined standardised components in the copper network, as well as prices for standardised components in both the copper network and the fibre network. FICORA also collected operator-specific information on the volume, age and costs of the network in order to define price caps for local loops. FICORA gave its regulatory proposition on the markets for call termination and origination on the public network at a fixed location. The market for call origination was deregulated in early 2014, but the European Commission ruled against the deregulation in the wholesale market for fixed voice call termination by its veto decision. The work that was started in 2012 for developing the assessment method for the pricing of mobile termination was completed. FICORA continued to supervise how the speed rate variation of fixed-line broadband services is specified in telecoms operators' contractual terms. FICORA provides frequencies for new purposes of use During the reporting year, FICORA held the 800 MHz spectrum auction by means of an electronic auction system. The spectrum auction started in January and it ended at the end of October. All paired frequency blocks that were subject to the auction were sold for a total sum of EUR 108,010,000. The frequencies were evenly allocated to three telecoms operators. FICORA collects licence fees in five equal annual instalments and enters them as income to the State. FICORA was actively involved in the working group preparing the next technology transition of terrestrial television operations (DVB-T2). At the end of the year, FICORA launched a communications project in cooperation with other players. The target group of the project are consumers in aerial households, retail trade, antenna contractors and real estate buildings with a joint antenna system. The communications emphasises high definition broadcasts enabled by the technology transition, and that the right kind of devices are used. The goal is to provide consumers with sufficient information, assistance and guiding services related to the matter. To ensure the resources of television operations, FICORA continued negotiations with neighbouring countries and achieved the desired result with both Russia and Estonia. FICORA implemented extensions to the coverage areas of commercial radios. 55 new frequencies were assigned to the use of licensed commercial radio operations. Aalto University is planning Finland's first satellite Aalto-1. FICORA promoted the international frequency coordination of the satellite. The coordination enables the satellite to be launched and taken into use possibly already next FICORA'S ANNUAL REPORT[vvvv] 4

5 year. The study of cognitive radio networks still continues. FICORA increases transparency in the markets A service bundle providing regional information on the functionality, quality and availability of the internet, telephone, TV and radio was created as part of FICORA's Situation Awareness project. The first service published in the service bundle in November was a disruption map service called MONITORi which describes the geographical coverage area of severe faults and disruptions reported to FICORA by telecoms operators. FICORA's steering and supervision duties, as well as the collection of availability and quality information, which serve public communication, were also developed in connection with the Situation Awareness project in cooperation with telecoms operators. The information will be launched as a map format in The new Stakeholders Division processed all in all about 35,000 customer contacts which were divided by subject as follows: domain names 80%, information security approx. 12%, and communications services approx. 8%. FICORA developed the publication and collection of the information concerning the sector e.g. by drafting plans for the publication and information collection. The availability of basic communications services will improve FICORA promotes the construction of high-speed broadband infrastructure During the reporting year, the Broadband 2015 project was promoted by issuing more than 30 state aid decisions and by granting almost EUR 16 million worth of aid, of which approximately EUR 8.5 million was paid. In addition, FICORA issued 16 opinions to regional Centres for Economic Development, Transport and the Environment (EDTEs) in favour of granting aid. By the end of the year, more than a third, i.e. about EUR 23 million, had been granted of the financial aid for broadband. Fibre-optic network has been built less than 10,000 kilometres and over 25,000 new households in sparsely populated areas have been connected to the coverage area of highspeed broadband. For the first time, FICORA examined the situation concerning the availability of high-speed broadband, as well as the development of the situation, with regard to the entire Finland. From the nationwide perspective, the availability of high-speed broadband of over 30 Mbps improved over the course of the year almost by 10%. In addition to the extension of fibre-optic networks, this was affected by the development of the availability of high-speed wireless broadband. FICORA ensures that the minimum requirement for postal, telephone and broadband services is met Telephone and broadband services In June, FICORA issued new designation decisions on universal service providers with regard to telephone services and broadband universal services. Three universal service providers were designated for telephone services in a total of 92 areas. Ten universal service providers were designated for broadband services in a total of 304 areas. In addition, FICORA issued for the first time decisions on universal services for the users with speech and hearing impairment: ten service providers were designated for internet access services FICORA'S ANNUAL REPORT[vvvv] 5

6 in a total of 304 areas and three service providers for text message services in 93 areas. A project with the goal of developing a faster and more efficient designation procedure with regard to universal services was started at the end of the year. The supervision of universal services will also be renewed. New methods will be planned for the communications related to universal services because citizens are still rather unaware of their rights concerning universal services. Postal services A consumer survey commissioned by FICORA in late 2013 showed that consumers en bloc were rather satisfied with postal services. Consumers were most critical about the pricing of parcel services. The survey on satisfaction with universal services assessed, among others, consumers' satisfaction with pricing, speed of letter delivery, and the distance of service points from consumers home. The functionality and security of communications networks and services will develop Information security deviations in the public communications network In 2013, telecoms operators reported FICORA of 37 information security incidents or information security threats of which they had become informed and which exceeded the reporting threshold. 14 reports pertained to deviations causing denial-of-service, ten were related to suspected data break-ins, eight concerned personal data breach, and five concerned a threat or vulnerability that had occurred. In one case, two persons had used the same address for several years. As an individual incident, a denial-of-service attack against the website mtv3.fi in April can be mentioned. Faults and disturbances in public communications network The usability of communications networks and services was at a good level in Six long-lasting faults of class A, i.e. they lasted over six hours, were reported in Telecoms operators reported of 218 faults and disturbances, which of 20 were class A faults, i.e. they had the highest severity classification. Three of these faults concerned television broadcasts, six public radio channels, seven mobile network services, two fixed broadband services, and three and other communications services. Four faults in the mobile network and a disturbance in Radio Vega's programme transmission were long-lasting (over 6 hours). The faults in the mobile network were due to disruptions in electricity distribution which were caused by the storms Eino and Seija. FICORA'S ANNUAL REPORT[vvvv] 6

7 FICORA strengthens national information security During the spring of 2013, FICORA actively participated in the preparation of the national cyber security strategy. The authority also drafted a proposal on NCSC-FI's operational model in the cyber security working group of the Ministry of Transport and Communications. By an agreement between the Ministry of Finance and FICORA, a pilot project was carried out in order to arrange the handling and detecting of information security incidents threatening the public administration (GovCERT activities). In addition, the GovHAVARO system was also piloted. On the basis of positive experiences, the projects will be continued. HAVARO is an alert and detection system FICORA has created. The system was previously implemented in cooperation with the National Emergency Supply Agency for businesses important to the national emergency supply. GovHAVARO was piloted for eight governmental players. During 2014, the number of the governmental organisations connected to GovHAVARO will grow to several dozens. Security of the public administration's information systems FICORA performed, either partially or completely, audits for all government and corporate information systems requiring accreditation with regard to international information security obligations. In addition, FICORA evaluated national cryptographic products to ensure that they are in compliance with national and international requirements. In cooperation with FINAS, FICORA has continued a process that was started in 2012 and is related to the accreditation of the first information security inspection body. The goal is to complete the process in early FICORA has published on its website guidelines for inspection bodies that wish to apply for accreditation. The guidelines describe the role and duties of the bodies assessing information security, the requirements concerning the operations, the assessment procedure, and the procedures related to the supervision of the bodies. FICORA applies the guidelines also when accrediting new information security inspection bodies. Supporting the international accreditation of information security systems FICORA has made cooperation agreements with international partners. The agreements enable that international classified information can be exchanged electronically. FICORA has also supported the Ministry for Foreign Affairs of Finland in the preparation of international general security agreements at treaty level. FICORA has participated in the projects that aim at a more extensive recognition of product approvals. FICORA has also participated in the work that defines practical security requirements. In addition, FICORA has examined the need to develop its product approval operations in order to even better support the access of Finnish cryptographic products to international markets. 8 Improvement in the reliability of the fidomain name service The reliability of the fi-domain name service was developed considerably in For example, a log system improving the information security of DNS queries was introduced during the year. The system enables that the analysis of DNS queries is more diverse than before. Moreover, the reliability of the primary name server A.fi was improved by means of various measures. One of the two F.fi:s servers was renewed. FICORA also launched a project in order to place a new name server for the top-level domain name.fi in FICIX. Because of this, FICORA became a member of FICIX ry. During the year, there were no disruptions related to the availability of services in the fi domain name service. A domain name project was started at the end of the year. The purpose of the project is to recognise, define and implement all the changes that the Code for Information Society and Communications Services will cause to fi-domain name activities when it enters into force. If the Code for Information Society and Communications Services is passed as planned, FICORA will no longer deliver fi domain names directly. As of 2016, fi domain names can only be purchased via FICORA's registrar partners. The three-year project consists of eight sub-projects, one of which covers the development of the current domain name system so that it corresponds the requirements of the new registry-registrar model. FICORA sharpens technical steering and supervision FICORA specifies and outlines technical steering and supervision in order to ensure the key functions of communications networks and services. As a key measure in 2013, FICORA prepared for the entry into force of the Code for Information Society and Communications Services, drafted by the Ministry of Transport and Communications, by revising its regulations. FICORA has actively supervised the compliance with legislation and technical regulations. FICORA performed 11 inspections on telecoms operators. The inspections focused especially on the supervision of the regulations 54 (on resilience of communications networks and services), 57 (on maintenance of communications networks and communications services, procedures and notifications in the event of faults and disturbances), and 58 (on the quality and universal service of communications networks and services). The detected defects should be corrected by the set time limit. FICORA has achieved the goals set for inspecting the compliance with the regulations in question. Therefore, the inspections will not be continued in Changes in regulations FICORA has actively supported the preparation of the Code for Information Society and Communications Services. The preparatory work was completed during At the same time, plans have been made in order to carry out the changes in regulations required by the entry into force of the Code for Information Society and Communications Services in such a manner that FICORA and telecoms operators can allocate the necessary resources after the final content in the Code for Information Society and Communications Services has been confirmed. In connection with the planning, it has been assessed whether it is possible to clarify the grouping of the regulations and to reduce the number of them. FICORA has expanded the old working group for technical regulations for communications networks to cover the FICORA'S ANNUAL REPORT[vvvv] 8

9 technical steering of the entire authority. The working group acts as a forum for the cooperation between FICORA, telecoms operators, and other stakeholders. During 2014, the regulation changes will be carried out and the work of the working group will start. Improving steering and supervision activities FICORA has developed its internal steering and supervision activities. The purpose of the work has been to unify and enhance FICORA's activities related to these duties, as well as improving the possibilities of FICORA's executive to steer the activities. In order to achieve these goals, internal coordination groups for both steering and supervision were formed. The duty of the groups is to unify FICORA's operational models and to coordinate FICORA's activities at a practical level. As part of the technical supervision, FICORA investigated and removed radio interference from emergency and security services and public authority networks, and radio networks vital to society's functions and public telecommunications networks. In accordance with FICORA's new operational model, three requests for police investigation were submitted of unauthorised repeaters which cause interference to communications networks. The use of frequencies was supervised and steered at such sports events that were internationally broadcast on TV. FICORA investigated several individual cases related to broadcast reception interferences. The authority gave special attention to the facilitation of TV reception interference by including, for the first time, the requirements on antenna systems for TV reception in the new regulation 65 which will take effect at the beginning of FICORA also contributed to that the 800 MHz mobile operators will develop at the end of the year an operational model for removing TV interference when the networks start operating in As part of the supervision of the compliance with network licence terms, five new terrestrial TV shadow areas were reported to FICORA for investigation. In cooperation with the network operator, FICORA is looking for a solution to the problem. FICORA ensures that all radio and telecommunications terminal equipment complies with the requirements. This was performed by means of inspections and measurements. If problems occurred, they were attended to quickly. In order to prevent disruptions caused to weather radars, the authority participated in a European monitoring campaign that investigated the compliance of WLAN equipment with requirements. The regulation on inspection of radio transmitters with high interference risk was revised. In addition to sound broadcast transmitters, the inspection procedure is now applied to television transmitters and radars, for which the radio licence holder can also choose a document-based inspection. A total of 87 inspections of sound broadcast transmitters were performed during the year, indicating that the number of the inspections remained high. FICORA's investigations on information security FICORA studied the effects of international intelligence activities on the information security of communications services provided by Finnish telecoms operators. As further work, FICORA has also sent five device manufacturers in Finland a request to submit a declaration of the information security of their devices. The purpose of the request was to collect information that can be utilised when assessing the information security of devices. The surveys showed FICORA'S ANNUAL REPORT[vvvv] 9

10 that there is a need to increase authoritative communication and to unify telecoms operators' practices to ensure the security of communications services implemented abroad, in particular. FICORA continues to assess the information security of devices during FICORA published on its website guidelines on the protection of communications. During 2014, FICORA drafts in cooperation with telecoms operators guidelines on the implementation of international information security services and the communication on the information security features the services. The security of communications services is one of the priorities within the supervision activities during the year. 11 Operational environment All parties benefit from shareholder cooperation FICORA collaborates actively with its stakeholders in several expert groups. The advisory committee consisting of FICORA's key stakeholders had two meetings during the year. The Stakeholders Division, which began operating at the beginning of the year, carried out a survey. On the basis of the survey, FICORA creates definitions for stakeholders during 2014 and continues to develop its operations. In 2013, FICORA held three extensive seminars for stakeholders: the Tietoturva Nyt! seminar, focusing on information security matters, was held in May, the Communications Market Day in October, and the Radio Spectrum Day in December. Expertise and cooperation ranked high by stakeholders For the first time, FICORA participated in a stakeholder survey within administrative sector of the Ministry of Transport and Communications together with the Ministry, the Finnish Transport Agency, the Finnish Transport Safety Agency (Trafi), and the Finnish Meteorological Institute. According to the survey carried out in October and November, FICORA's strength lied, as before, in professional staff and ability to cooperate. In the stakeholder survey, FICORA's overall score was 3.7 on a scale of 1 to 5. International cooperation opens channels for influencing FICORA works closely with cooperation partners at European as well as global level. FICORA participated actively in the work of the EU's Communications Committee, Radio Spectrum Committee and Spectrum Policy Expert Group. During the year, the European Council's working group for technical harmonisation drafted the new Radio Equipment Directive. The group aimed at and succeeded in including television and radio receivers in the scope of technical requirements concerning radio equipment. FICORA participated in the work of the EU's evaluation committee of market surveillance and conformity assessment of radio and teleterminal equipment. FICORA also participated in the working groups of CEPT, European Conference of Postal and Telecommunications Administrations. FICORA held two workshops for its partners providing services corresponding the Autoreporter system. Participants arrived from nine European countries and from the EU Commission. CERT-FI helped the Commission's CERT-EU activities in introducing the system. CERT-FI worked closely with the European Government CERTs (EGC) group, especially with regard to malware analysis and situational awareness coordination related to malware. Furthermore, FICORA participated in the cooperation practices held by the EU and NATO, and continued close cooperation with the Nordic CERT-FI cooperation network. The personnel of FICORA's NCSA-FI represented Finland in several bodies of the European Council and of the Commission, as well as in other international bodies and expert groups with- FICORA'S ANNUAL REPORT[vvvv] 11

12 in information security, either alone or as a support for a national security authority. During the year, FICORA was an active participant of BEREC (Body of Independent Regulators for Electronic Communication). The key themes in BEREC's work were the handling of the Commission's proposal on the regulation on the internal market, as well as the participation in the drafting of recommendations related to relevant markets, non-discrimination, and cost accounting. BEREC also had a significant role in the implementation of the third roaming regulation. BEREC published guidelines on separate sale required by the roaming regulation. During the year, BEREC gave several opinions on the investigations of Phase II according to Article 7 of the framework directive. The opinions concerned proposed decisions on significant market power which the national regulatory authorities had notified. FICORA worked closely with the European Regulators Group for Postal Services (ERGP). As in previous year, the priorities were the determination of net costs, VAT effects in the postal market, rules for allocation of shared costs, and regulatory situation of access to the postal network. The European Telecommunications Standards Institute ETSI strongly influenced, for example, the introduction of pan-european requirements for transmitting 112 emergency text messages and targeted announcements by public authorities. Neighbouring countries were consulted in matters related to radio frequencies so that mobile operators could build their networks in border districts without too many restrictions. In addition, the aim of the coordination agreement is to ensure that the systems located in Finland are not interfered by the neighbouring countries. FICORA worked closely with ENISA, the European Network and Information Security Agency, in the working groups determining information security notifications and minimum information security requirements within the Directive on privacy and electronic communications. In April, FICORA hosted a cooperation meeting for Nordic media regulators. Topical issues related to the regulation of audiovisual services in each country were discussed in the meeting. The switch in the media sector from traditional, linear viewing to web-based viewing is a topical issue in all Nordic countries. FICORA cares about the environment FICORA published an updated version of the memorandum of energy-efficient broadband networks. FICORA takes environmental viewpoints into consideration in its operations. In addition, FICORA separately reports the measures in the climate policy programme to the Ministry of Transport and Communications. FICORA'S ANNUAL REPORT[vvvv] 12

13 Economy and resources Investment in staff well-being is beneficial The number of FICORA's staff members decreased by approximately 30 persons as a result of the cooperation consultations regarding TV fee operations in June The reorganisation of the FICORA staff continued in The second phase of the reorganisation, based on FICORA's new strategy, concerned the authority's support operations which were revised in FICORA's organisational structure. The new organisational structure was adopted in early The purpose of the reorganisation was to ensure that the authority's new strategy is implemented efficiently. It also aims at increasing and ensuring the flexibility of FICORA's operations and the use of its resources, as well as increasing cooperation throughout FICORA. FICORA's personnel strategy was completed during the year. The primary goals for the personnel strategy were competent and active personnel, courageous and inspiring leadership, as well as work community well-being and cooperation within the community. The personnel's well-being at work was assessed as being good. On the basis of the results from the work atmosphere survey VM Baro, the personnel's work satisfaction was at a higher level compared with the rest of the public administration. The personnel's work satisfaction was 3.6 on a scale of 1 to 5. The FICORA staff amounted to man-years in Balanced economy The majority of FICORA's expenses are covered by its income. In the 2013 budget, the forecast of income from operations subject to a fee was EUR 26.9 million and the actual income was EUR 28.4 million. The largest sources of income from operations subject to a fee were frequency fees for radio transmitters, numbering fees of communications networks and domain name fees. In addition, FICORA receives contractbased income from the provision of information security services, in accordance with the agreement concluded with the National Emergency Supply Agency, and from the provision of information security services to governmental players, in accordance with the agreement concluded with the Government. The list of fee-based operations also includes the compensation invoiced from the State Television and Radio Fund for the collection of fees. In 2013, the revenue estimate for parafiscal charges and the actual revenue was EUR 6.6 million. Examples of parafiscal charges are communications market fees, information security fees, postal supervision fees and supervision fees of television and radio operations. In 2013, operating expenses amounted to a total of 32.5 million euro whereas the sum total of last year s expenses was 34.7 million euros. The shutdown of TV fee operations decreased personnel and service purchase expenses, and the new rental agreement resulted in smaller rental expenses per square metre.
