3 Wylie City Council Minutes Wylie City Council Meeting Tuesday, February 24, :00 p.m. Wylie Municipal Complex Council Chambers 300 Country Club Road, Bldg. 100 Wylie, TX CALL TO ORDER Announce the presence of a Quorum. Mayor Eric Hogue called the meeting to order at 6:00 p.m. City Secretary Carole Ehrlich took roll call with the following City Council members present: Mayor Eric Hogue, Mayor pro tem Keith Stephens, Councilman Bennie Jones, Councilman David Dahl, Councilman Todd Wintters, and Councilman William Whitney III. Councilman Nathan Scott was absent. Staff present were: City Manager, Mindy Manson; Fire Chief, Brent Parker; Planning Director, Renae Ollie; City Engineer, Chris Holsted; City Secretary, Carole Ehrlich; Public Information Officer, Craig Kelly; and various support staff. INVOCATION & PLEDGE OF ALLEGIANCE Mayor Eric Hogue gave the invocation and City Manager Mindy Manson led the Pledge of Allegiance. PRESENTATIONS The Wylie Way Students 2nd 9 Weeks Mayor Hogue and Mayor pro tem Stephens presented medallions to students demonstrating Shining the Wylie Way. Each nine weeks one student from each WISD campus is chosen as the Wylie Way Student. CITIZENS COMMENTS ON NON-AGENDA ITEMS Residents may address Council regarding an item that is not listed on the Agenda. Residents must provide their name and address. John W. Palmer, representing the Provision at Westgate Crossing project, thanked Council for their time and consideration of the proposal to build a mixed use project consisting of multifamily and retail/commercial uses through Texas Department of Housing and Community Affairs ( TDHCA ). Consider, and act upon, Ordinance No , amending the zoning from Agricultural (A/30) to Planned Development-Single-Family (PD-SF), for single-family residential development on approximately 38 acres, located at the northwest corner of Alanis Drive and S. Consider, and act upon, Ordinance No , amending Ordinance No ( Budget) and approving an appropriation of funds in the amount of $102, for the General Fund Police Department (Assistant Police Chief position); providing for a repealing, savings and severability clauses; and providing for an effective date. (J. Butters, Asst. City Manager) Councilman Dahl requested that Item B be removed from the Consent Agenda and considered separately. Consensus of the Council was to pull Item B from consent. Council Action A motion was made by Councilman Wintters, seconded by Councilman Dahl to approve the Consent Items with the exception of Item B as presented. A vote was taken and the motion passed 6-0 with Councilman Scott absent. REGULAR AGENDA B. Consider, and place on file, the Annual City of Wylie Storm Water Management Annual Report as sent to the Texas Commission on Environmental Quality. (M. Sferra, Public Services Director) Assistant Public Works Superintendent Albert Garza addressed Council identifying the accomplishments in Year 7 of the Storm Water Management Program. He noted the measurements addressed during the year included: Public Education and Outreach, Public Involvement Participation, Illicit Discharge Detection and Elimination, Construction Site Storm Water Runoff Control, Post Construction Storm Water Management, Pollution Presentation, and Good/Housekeeping in Municipal Operations. 5 Councilman Dahl thanked Garza as the team leader and the department for their time and commitment to the project. Mayor pro tem Stephens complimented, in particular, the public outreach measurements. Stephens also mentioned the volunteer groups used to keep costs down on this project which is mandated by the state but not funded by the state. Council Action A motion was made by Mayor pro tem Stephens, seconded by Councilman Dahl to approve Item B of the Consent Agenda. A vote was taken and the motion passed 6-0 with Councilman Scott absent. Public Hearing 1. Conduct the 2nd Public Hearing for the annexation of two tracts of land approximately 32 acres situated in the Francisco De La Pina Survey, Abstract No. A0688, Tract No. 127, and Tract 202, Collin County, Texas, generally located east of W.A. Allen Blvd. and north of Stone Road and immediately east of Stone Grove Addition A (R. Ollie, Planning and Zoning Director) Staff Comments Planning Director Ollie addressed Council stating that this annexation is at the request of property owners of two tracts of land. The subject tract is contiguous to existing City limits on the north, west, and south, while properties to the east are within unincorporated Collin County. This is the second of two public hearings required to be held prior to approval of the annexation. Public Hearing Mayor Hogue opened the second public hearing for Zoning Case No A (Annexation) at 6:15 p.m. asking anyone present wishing to address Council to come forward. No one was present wishing to address Council during the public hearing. Mayor Hogue closed the public hearing at 6:16 p.m. No action was required on this item. 2. Consider, and act upon, Ordinance No authorizing the annexation of approximately 32 acres situated in the Francisco De La Pina Survey, Abstract No. A0688, Tract No. 127, and Tract 202, Collin County, Texas, generally located east of W.A. Allen Blvd. and north of Stone Road and immediately east of Stone Grove Addition A (R. Ollie, Planning and Zoning Director) Staff Comments Planning Director Ollie addressed Council stating that this annexation is at the request of property owners of two tracts of land. The subject tract is contiguous to existing City limits on the north, west, and south, while properties to the east are within unincorporated Collin County. The applicant desires to bring the subject tracts into the City to create a residential development and provide connection to existing Stone Grove Phase I Addition to the west as well as the recently zoned 37 +/- acres immediately adjacent to the subject tracts as adopted by City Council on September 23, 2014 by Ordinance PD-SF to allow for a single family residential community. 6 Before a municipality may begin annexation proceedings, the governing body of the municipality must conduct two (2) public hearings at which persons interested in the annexation are given the opportunity to be heard. The notice for each hearing must be published at least once on, or after, the 20th day but before the 10th day before the date of the hearing, and must remain posted on the municipality s website until the date of the hearing. In compliance with state law, the following schedule has been adhered to: Notice published for Public Hearings January 21, 2015 and February 4, 2015 First Public Hearing February 10, 2015 Second Public Hearing February 24, 2015 Adoption of Ordinance February 24, 2015 Council Action A motion was made by Councilman Wintters, seconded by Councilman Jones to adopt Ordinance No authorizing the annexation of approximately 32 acres situated in the Francisco De La Pina Survey, Abstract No. A0688, Tract No. 127, and Tract 202, Collin County, Texas, generally located east of W.A. Recommendation Motion to approve Resolution No (R) authorizing the appointment of Terry Douglas as Associate Municipal Court Judge for the City of Wylie effective April 1, 2015 setting terms and stipend of service. Discussion Article IV, Section 3c of the City of Wylie Charter states the city council shall, in the absence or disability of the appointed judge of the municipal court, appoint an acting judge to serve during such absence or disability. The acting judge may be compensated by the city council for his performance of required duties. The current two year term of the City of Wylie Associate Municipal Court Judge expires March 31, 2015 and is renewable for subsequent two (2) year terms. The appointment of the Associate Municipal Court Judge is for a two year term effective April 1, 2015 through March 31, 2017 and may be renewed for another two (2) year term. Compensation for services provided by the Associate Municipal Court Judge is a set monthly rate of $ This reflects an increase in his monthly rate of $ Associate Municipal Court Judge Terry Douglas (part-time) works approximately 24 hours per month (signs warrants, does prisoner arraignments, and has four court dockets per month). His hours and dockets have increased with the addition of the Failure to Attend School filings from Wylie ISD. In addition the Police Department (PD) takes warrants to him in the evening or on weekends for his signature. PD also calls him to do phone or video arraignments after hours and sometimes he comes in to do Emergency Protective Orders. Judge Terry Douglas has served the City for 14 years as the Associate Municipal Court Judge. Judge Douglas serves in the capacity of the City of Wylie Associate Municipal Court Judge. It is recommended that Judge Douglas continue to provide service to the City as the City of Wylie Associate Municipal Court Judge. Page 1 of 1

8 RESOLUTION NO (R) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS, HEREBY AUTHORIZING THE APPOINTMENT OF TERRY DOUGLAS AS CITY OF WYLIE ASSOCIATE MUNICIPAL COURT JUDGE. WHEREAS, the City of Wylie has determined that an Associate Municipal Judge is necessary to perform the judicial functions of the Municipal Court of the City of Wylie in the absence of the Municipal Court Judge; and WHEREAS, the City desires to appoint Terry Douglas as the Associate Municipal Court Judge for the City of Wylie; and WHEREAS, the effective term of service for the Associate Municipal Court Judge shall be April 1, 2015-March 31, 2017 with subsequent two year term; and WHEREAS, reimbursable services of the Associate Municipal Court Judge by the City of Wylie shall constitute all time spent on any matters assigned including conference telephone calls, investigation, drafting of documents, correspondence, negotiations, legal research and travel to conduct City of Wylie municipal court business; and WHEREAS, a monthly stipend of $ will be provided by the City of Wylie for such services; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WYLIE, TEXAS: SECTION 1: That the City Council authorizes the appointment of Terry Douglas as City of Wylie Associate Municipal Court Judge for a two year term effective April 1, 2015-March 31, 2017 with a monthly stipend of $ for services as the City of Wylie Associate Municipal Court Judge with subsequent two year terms provided. Discussion The current two year term of the City of Wylie Associate Municipal Court Prosecutor expires March 31, 2015 and is renewable for subsequent two (2) year terms. The appointment of the Municipal Court Prosecutor is for a two year term effective April 1, 2015 through March 31, 2017 and may be renewed for another two (2) year term. Compensation for services provided by the Municipal Prosecutor is at an hourly rate of $130.00, with time billable in units of one-tenth hour each. This reflects an increase in his hourly rate of $5.00 per hour. Prosecutor High has not had an increase since 2011 and has served the City for almost nineteen years. A budget amendment will be forthcoming at midyear to provide the additional funding. Prosecutor High is currently serving as the City of Wylie Municipal Prosecutor. It is recommended that Prosecutor High continue to provide service to the City as the City of Wylie Municipal Prosecutor. Page 1 of 1

Discussion Owner: Barway Enterprises The purpose of the Final Plat is to record a legal lot of record and establish boundary lines for the subject property. The subject tract was originally a part of an unapproved plat known as McCord s Little Six. The owner of the subject tract is now platting Lot 3 separately and will file with Collin County in accordance with codes and ordinances in place. This Final Plat complies with all applicable technical requirements of the City of Wylie. Discussion The offices of City Council positions, Places 2 and 4 will expire in May of Resolution No (R) ordering the General Election was approved by council during the January 27, 2015 City Council meeting. Mike Phelps was approved to serve as alternate election judge for early voting at the Wylie Smith Public Library and as an alternate judge at First Baptist Church on Election Day. Mr. Phelps has notified the City that he has relocated his residence outside the City making him ineligible to serve as an election judge or alternate. Priscilla Puz, who has served as a bi-lingual judge in the past has agreed to serve in place of Mike Phelps as alternate judge for Early Voting and Linda Davis has agreed to serve as alternate judge on Election Day at the First Baptist Church. By amending Resolution No , the City Council will approve and replace the alternate election judges for these locations for the May 9, 2015 General Election. Resolution No (Order of Election) stipulates that in the event the appointed judges/alternates are unable to execute or complete their duties for any reason, the Rockwall County Elections Administrator may identify additional judges/alternate judges that the City Council shall appoint as soon as possible.
