2 SECTION 2 INTRODUCTION t Goals of this lecture According to the FAA s UAS Airman Certification Standards, a Remote PIC should be able to demonstrate knowledge of: The eligibility requirements for a Remote Pilot Certificate with a Small UAS Rating Aeronautical knowledge recency The waiver policy and requirements Lecture text & additional notes In this last lecture on the Part 107 regulations, we ll be talking more specifically about Remote Pilot Certificate eligibility, the recurring Aeronautical Knowledge testing, and the Waiver application process.

3 SECTION 2 ELIGIBILITY Eligibility for a Remote Pilot Certificate with a Small UAS Rating According to the language of Part 107, a person applying for a remote pilot certificate with an suas rating must meet and maintain the following eligibility requirements: Be at least 16 years of age. Be able to read, speak, write, and understand the English language. However, the FAA may make an exception if the person is unable to meet one of these requirements due to medical reasons, such as a hearing impairment. Be in a physical and mental condition that would not interfere with the safe operation of an suas. Pass the initial aeronautical knowledge test at an FAA-approved knowledge testing center (KTC). Pass a background check by the Transportation Security Administration (this is done automatically when you submit your application for a Remote Pilot Certificate). Obtain a Remote Pilot Certificate with a small UAS rating (like existing pilot airman certificates, it never expires). Pass a recurrent aeronautical knowledge test every 24 months. Make available to the FAA, upon request, the small UAS for inspection or testing, and any associated documents/records required to be kept under the proposed rule. Report an accident to the FAA within 10 calendar days of any operation that results in serious injury or property damage over $ Conduct a preflight inspection that includes specific aircraft and control station systems checks, to ensure the small UAS is safe for operation. One more thing. A Remote Pilot in Command does NOT need a Designated Pilot Examiner to fill out an application for a Remote Pilot Certificate this may be completed by an FAA Safety Inspector, DPE, or a CFI (Certified Flight Instructor) He or she just needs to pass the Aeronautical Knowledge Test, and then he or she is eligible to apply. BUT, the Designated Pilot Examiner and an FAA Safety Inspector are the only two people that are able to issue a temporary certificate. A CFI is allowed to complete the paperwork but is not authorized to issue a temporary certificate. If you use a CFI to complete your paperwork you will have to wait to receive an notification to print and sign a temporary certificate through IACRA (Integrated Airman Certification and/or Rating Application). 4 SECTION 2 TEST RECENCY Aeronautical Knowledge Recency After a person receives a Remote Pilot Certificate with an suas rating, that person must retain and periodically update the required aeronautical knowledge to continue to operate a small UA in the NAS. To continue exercising the privileges of a Remote Pilot Certificate, the certificate holder must pass a recurrent aeronautical knowledge test within 24 calendar months of passing either an initial or recurrent aeronautical knowledge test. 5 SECTION 2 WAIVERS Waivers In the last lecture, we covered a number of operating limitations under Part 107. If the Remote PIC determines that the operation cannot be conducted within the regulatory structure of Part 107, he or she is responsible for applying for a Certificate of Waiver (CoW) and proposing a safe alternative to the operation. This Certificate of Waiver will allow an suas operation to deviate from certain provisions of Part 107 as long as the FAA finds that the proposed operation can be safely conducted under the terms of that Certificate of Waiver. List of the waivable sections of Part 107: Operation from a moving vehicle or aircraft Daylight operation Visual line-of-sight aircraft operation Visual observer Operation of multiple small unmanned aircraft systems Yielding the right of way Operation over people Operation in certain airspace Operating limitations for small unmanned aircraft To apply for a CoW, an applicant must go to and follow the instructions. The application must contain a complete description of the proposed operation and a justification, including supporting data and documentation (as necessary) that establishes that the proposed operation can safely be conducted under the terms of a CoW. The FAA says it will strive to complete review and adjudication of waivers within 90 days; however, the time required for the FAA to make a determination regarding waiver requests will vary based on the complexity of the request and the FAA resources available. The amount of data and analysis required as part of the application will be proportional to the specific relief that is requested.
