2 Proposed Design Guideline Revisions for Posting and Publishing December 15, 2016 The last major update of the SCLH Design Guidelines was in January of The Architectural Review Committee (ARC) has prepared the following proposed clarifications/revisions and forwarded them to the Board of Directors (BOD) for posting and publishing to obtain Owner comments. The proposed revisions fall into three categories: The reorganization of the document to group similar design guidelines together e.g. all items not requiring ARC approval have been grouped together in Section 2. Clarification of existing design guidelines. New design guidelines. Review Notes 1. Revisions are listed by Section and reflect the new organization of the Design Guidelines. Only the new; and existing design guidelines with changes, are included for review and comment. Existing guidelines with changes only have the effected portions of the design guideline shown. 2. Revisions are shown with redline and strikeout. i.e. new language is in red and underlined. Deleted language is in red with a line through it. 3. Numbering is based on the reorganized document and does not match the numbering from the previous Design Guidelines. THESE REVISIONS WILL ONLY APPLY TO FUTURE APPLICATIONS. 3 SECTION 1 - INTRODUCTION 1.7 Basis for Approval of Improvements. As stated in Section 5.06 of the CC&Rs, when a proposed Improvement is submitted to the ARC for review, the Committee shall grant the requested approval only if the Committee, in its sole discretion, makes the following findings regarding the proposed project: The Owner's plans and specifications conform to the CC&Rs and to the Design Guidelines in effect at the time such plans are submitted to the ARC The Improvement will be in harmony with the external design of other structures and/or landscaping within the Community The Improvement, because of its appearance, location or anticipated use, will not interfere with the reasonable enjoyment of any other Owner of his or her property The proposed Improvement, if approved, will otherwise be consistent with the architectural and aesthetic standards prevailing within the Community and with the overall plan and scheme of development within the Community The Architectural Review Committee (ARC) endeavors to identify any items in the applications that do not comply with the Design Guidelines and Governing Documents. However if something is missed during the review, it is still the Owners responsibility to meet all Design Guideline requirements. 1.8 Definitions. The following Definitions are to be used in conjunction with, and in addition to Definitions specified in Article 1 of the Sun City Lincoln Hills CC&Rs Entryway. The area open to the sky from the front wall of the home to the front door Grandfather Clause. As stated in Section 9.3 of these Design Guidelines, Not Retroactive, these Design Guidelines are NOT retroactively applied to previously approved Improvements or work in progress. This means that Owners with Improvements that were approved under previous versions of the Design Guidelines remain approved. The new Design Guidelines apply only to future Improvements. However if there is a major re-landscaping and a minor portion of the existing landscaping is being retained and does not meet the current design guidelines, that portion shall be made to comply with the current design guidelines Yard Area. 4 SECTION 2 - EXCEPTIONS NOT REQUIRING APPLICATION. Section 2 has been expanded to include all design guidelines from Section 10 that do not require ARC approval. These design guidelines remain unchanged except for the following. 2.6 Gutters/ Gutter Guards/ Downspouts. The replacement and installation of gutters, downspouts, and gutter leaf guards that conform in color and design to those installed originally, will be exempt from the design review process. Other gutter or downspout types shall be submitted for approval. Gutters and downspouts must be located to not adversely affect drainage onto neighboring properties. Black tubing used for additional drainage purposes must be buried underground and directed away from adjacent properties. 2.8 Lawn Replacement. Replacing existing lawn with new sod is permitted without ARC approval if it meets the requirements for the type of natural turf lawns as described in these design guidelines. 2.9 Minor Landscape Changes. In general, landscape Improvements of a small scale, which do not materially alter the appearance of the lot, involve a change in topography or grade, and which are not of sufficient scale to constitute a natural structure, will be exempt from the design review process. Those exemptions include: The replacement of annuals or ground cover The replacement or refreshing of the same type and color of bark or rock landscape material, as originally installed by the Developer or as previously approved by the ARC Signs. All signs are regulated to maintain the appearance of the community. The ARC may restrict the posting or displaying of all commercial signs. Refer to Real Estate Signs. Contractor signs placed on the Lot for public view are prohibited. Noncommercial signs and posters that are more than nine (9) square feet in size and flags or banners that are more than fifteen (15) square feet in size are prohibited per Civil Code Unless more restricted by City of Lincoln, the following signs may be erected on any Lot: Security Alarm Sign. One sign from a security/alarm company providing services to the Resident or the home may be placed in the front yard within the setback criteria set forth in Section The sign shall not exceed two feet (2 ) in overall height from finished grade and/or seventy-two (72) square inches in size (i.e., eight inches by nine inches) if placed in the ground; or exceed sixteen (16) square inches in size (i.e., four inches by four inches) if placed in a window. One (1) decal supplied by the alarm company may be displayed in the corner of a front window. Homes on the golf course or open space may display an additional decal in one (1) rear window Political Signs. Political signs may not exceed, in the aggregate, a total of nine (9) square feet and a maximum height of four (4) feet. Typical political signs are 18 x 24 or 3 square feet. Therefore, up to 3 typical political signs are permitted. Signs may be displayed up to sixty (60) days before the election and shall be removed within seven (7) days after the election day as provided in City of Lincoln Municipal Proposed Design Guideline Revisions - December 15, 2016 Page 3 of 14

5 Code. Non-commercial banners that are larger than fifteen (15) square feet in size are prohibited. SECTION 3 - APPLICATION REQUIREMENTS 3.2 Approval by Golf Course Owner. As stated in the CC&Rs, Section 6.13, no Owner may construct or alter any Improvement to a Lot within fifteen feet (15 ) of any golf course without the express approval of the Owner of the golf course. However, the golf course Owner currently is NOT requiring Improvements to be submitted to them for approval. SECTION 4 - DESIGN REVIEW PROCESS There are no proposed clarifications or revisions to this Section. SECTION 5 - GENERAL STANDARDS There are no proposed clarifications or revisions to this Section. SECTION 6 - LANDSCAPE REQUIREMENTS 6.1 Design Requirements and Minimum Plant Quantities. All landscape designs shall be prepared by a Landscape Architect, Landscape Designer or Licensed Landscape Contractor. If an Owner is capable of preparing a design and drawing that meets the stated requirements, they may prepare and submit their own drawing. All landscape designs shall result in an integrated design solution. An integrated design solution shall accomplish the following: Incorporates elements and materials consistent with the home s architectural character Is in scale with the size of the home, lot and adjacent properties Exhibits a sensitive use of hardscape, walls, lighting and planting materials Carefully incorporates any existing plants that are to remain in the new design Plant material should be dispersed to provide a balanced design Plant and tree species should be selected for their location in the landscape, water usage, height, texture, color and eventual mature size Incorporates seasonal color If ground cover is used it shall be integrated into the overall design. 6 6.1.9 Invasive plants are prohibited Meets the minimum setback and plant quantity requirements When existing lawns are removed and replaced with new landscaping the existing mow curbs shall be removed. Required Plant Quantities. Each fifty (50) or (100) square feet of plantable area shall contain the following minimum plant quantities, with the goal of achieving fifty percent (50%) plant coverage at MATURITY. These quantities apply to Front Yards, Corner Lot Street Side Yards and Open Space/Golf Course Rear Yards. Minimum Plant Quantities for each 50 SF of Plantable Area Minimum Plant Quantities for each 100 SF of Plantable Area 2 5 Gallon Shrubs 4 5 Gallon Shrubs 2 Any Combination of 1 and 2 Gallon Shrubs 4 Any Combination of 1 and 2 Gallon Shrubs 4 Total 8 Total Fewer than the minimum plant quantities may be considered for approval if the design drawing clearly shows that the number of plants provided will achieve the stated goal of fifty percent coverage at MATURITY, as stated above. 6.2 Front Yard and Corner Lot Street Side Yard Landscaping Requirements. For front yards and corner lot street side yards, a minimum of fifty percent (50%) of the plantable area, must be covered with an approved living material such as shrubs and groundcover plants. The required coverage must be achieved when the plants reach MATURITY. Each individual non turf area of the yard shall have the required coverage. This includes both sides of the driveway. The remaining plantable area shall be covered with approved bark or a combination of approved bark and decorative rock No more than one-fourth (25%)twenty percent (20%) of the plantable area shall be covered with decorative rock All front yard landscaping shall include a minimum of one twenty four inch (24 ) box tree or an existing tree of equal size. All corner lot street side yards shall include a minimum of two (2) fifteen gallon (15 gal) trees Front yard landscaping along the property lines and driveways, excluding trees, shall be maintained at a maximum height of four feet (4-0 ), as required by the City Proposed Design Guideline Revisions - December 15, 2016 Page 5 of 14

7 Zoning Ordinances. Corner Lots shall maintain all landscaping and construction in accordance with the City of Lincoln Visibility Requirements document H-23 contained in Appendix E. The maximum TOTAL HEIGHT of all sloped ground, shrubs and landscape features in the Corner Controlled Area may not exceed three feet (3-0 ), 6.4 Interior Lot Rear Yard Landscaping Requirements. All interior lot rear yards require the installation of landscaping and living materials for appropriate maintenance and weed abatement All elements of the landscaping shall meet the specific design guideline requirements for each item No more than thirty percent (30%) of the plantable area shall be covered with decorative rock. 6.5 All Side Yard Landscaping Requirements. All side yards require the installation of landscaping and living materials for appropriate maintenance and weed abatement All elements of the landscaping shall meet the specific design guideline requirements for each item No more than twenty percent (20%) of the plantable area shall be covered with decorative rock. 6.9 Bark. See Checklist Bark/chipped wood shall be in neutral earth tone colors, such as Natural Rredwood bark, Cedar Dark Brown or Black Shredded, gorilla hair, red or other primary color barkthe use of red or other primary colored bark, shredded wood, gorilla hair, sawdust-like material, or rubber/artificial bark is prohibited Border Materials. See Checklist Mow curbs and bender board may be used as edging materials to separate lawn areas from bark or decorative rock areas. Mow curbs may not be used to separate bark and rock areas. Other edging materials are subject to review and approval Cobble borders are not encouraged, but may be used along sidewalks only, to retain bark. The use of cobble borders along driveways and walkways and adjacent to turf is prohibited.cobble borders shall be a minimum of six inches (6 ) and a maximum of twenty-four inches (24 ) in width Bender board or other plastic materials are prohibited as edging material along sidewalks and, driveways. and walkways. 8 Scalloped brick/concrete edging is prohibited Boulders. See Checklist 18. The use of accent boulders is permitted with ARC approval A minimum of twenty five percent (25%) of the boulder shall be buried in the ground.boulders shall be grouped together and set into the ground to create the look of a natural out cropping of rock Dry Creek Beds and Rock Landscape Features. See Checklist 18. Dry creek beds are permitted as a minor landscape feature and must be included in the total decorative rock calculations Dry creek beds shall meet the following requirements: a. Follow a natural meandering path through the landscape. b. Take advantage of the natural contours of the site. c. Have varying widths and be depressed into the ground to simulate a natural creek s depth. The maximum width shall not exceed fifty-four inches (54 ).four feet (4-0 ) and the maximum length shall not exceed fifteen feet (15-0 ) 6.18 Plant Containers and Permanent Planters. See Checklist 23. Permanent raised planter boxes are to be a maximum of two feet (2 ) in height. Acceptable materials include concrete, redwood or other material approved by the ARC and must be compatible with the architectural design of the home. Acceptable colors will be the home s main body or trim color, redwood, or earth tones Freestanding Portable Plant Containers, e.g. pots and planters, may be maintained outside of Private Space in front yards and on Open Space/Golf Course lots, provided the following criteria are met: a. All Containers, plantings, and locations must be approved by the ARC. b. All Containers must be properly maintained with live plants. c. Number of Containers in the front yard, outside of Private Space, shall be limited to no more than three (3) Containers.The number of Containers in Corner Lot Street Side Yards shall be limited to no more than three (3) Containers Rock. See Checklist 18. Rock and stone are approved landscape materials for covering ground surface around plants. Determination of whether any rock material is acceptable in any specific situation shall be made by the ARC Decorative rock and stone shall be as found in native form and will be consistent with native rock of the region including, but not limited to, Cobble Rock, River Rock, or Salt & Pepper. Rock will be a minimum of one inch (1 ) size or larger in a blend for landscaping Pea gravel may be considered on a case by case basis, if used sparingly in a specialized design e.g. Japanese garden. Use in the front and corner lot street side yards is prohibited. Proposed Design Guideline Revisions - December 15, 2016 Page 7 of 14

9 Lava rock of any color or artificially colored rock is prohibited Crushed rock such as California or Sonoma Gold is prohibited Decomposed granite and pea gravel may be used on walkways in rear yards only, but not as a landscape material around plants or trees Trees. See Checklist 19. Installation or replacement of trees requires application and ARC approval. All trees shall be set back from property lines a minimum of five feet (5 ) to fifteen feet (15 ) one half of the based upon tree height and the spread of the canopy at maturitymaturity. Refer to the Acceptable Plant List in Appendix A Fruit bearing trees are prohibited in Front Yards and Corner Lot Street Side Yards. SECTION 7 - WALLS & FENCES 7.3 Fences / Walls Adjoining Open Space and/or Golf Courses. Owners of Lots adjacent to the Golf Course or Open Space shall be entitled to construct a wrought iron fence along the top of a knee wall separating the Lot from an adjacent Golf Course fairway or Open Space, so long as the project and its materials are first approved by the ARC Owners may install a knee wall up to two feet in height, as stated in Section 6.06 of the CC&Rs If such a wall is constructed, a standard wrought iron fence may be installed on top of the solid wall The total height of the wall and fence shall not exceed six feet (6 ) Owners shall obtain an Open Space Indemnification Agreement from the Community Standards Department, and submit a signed copy with the Application. This requirement applies to Open Space Lots only Fences (Wrought Iron). See Checklist 09. Repair or replacement of fencing of the same construction, materials, dimensions and color as original does not require ARC approval A joint Wrought Iron Fence License Agreement shall be included with Owners of the adjacent lots for a side yard perimeter fence to be installed on the property lines A side yard perimeter fence may be installed six inches (6 ) inside of the side yard property line and no Wrought Iron Fence License Agreement is needed New fences that are to be installed perpendicular to an existing fence that has been installed six inches (6 ) or more onto an adjacent property may not attach to that fence. The new perpendicular fence shall stop at the property line with a typical end post Front courtyard fences may be a maximum height of four feet (4 ). 10 The solid block knee wall, at the perimeter of the rear property line, shall be no more than two feet (2 ) in height and if standard wrought iron fence is installed on top of the knee wall, the total height of the wall and fence shall not exceed six feet (6 ) Perimeter gates to the Community Property, Open Space or Golf Course are prohibited Pet Fence Barriers. See Checklist 10. Upon approval by the ARC, pet security barriers for the control of a small pet may be installed along the wrought iron perimeter fence and adjoining gates in the rear and side yards. Barriers shall meet the following requirements The security guard barrier will not be allowed if it does not meet the requirements of the CC&Rs and local ordinances for fencing on lots with pools, spas, or other open bodies of water with a depth of twenty-four (24 ) inches or greater The security guard barrier shall not be attached to any wrought iron fences or gates on front courtyard walls It is the Owners responsibility to secure proper permits and or inspections to ensure that the modification meets all requirements as stated in the CC&Rs and City of Lincoln Municipal Code The Owners of contiguous Lots who have a common fence along their common boundary line shall submit a Checklist 10 with the Agreement to Install a Pet Barrier on a Common Wrought Iron Fence on the reverse side, Fence Agreement signed by adjoining lot Owners agreeing to the installation of the pet barrier. The agreement is not required if the fence is not a common fence and is installed within the Owner s lot as stated earlier in this section. SECTION 8 - ENFORCEMENT OF ARC REQUIREMENTS AND GOVERNING DOCUMENTS There are no proposed clarifications or revisions to this Section. SECTION 9 - CHANGES AND AMENDMENTS TO THE DESIGN GUIDELINES There are no proposed clarifications or revisions to this Section. Proposed Design Guideline Revisions - December 15, 2016 Page 9 of 14

11 SECTION 10 - ARCHITECTURAL STANDARDS 10 Additions to Homes. See Checklist 01. Refer to Section 5 of these Design Guidelines. The architectural design of any and all additions, alterations, and renovations to the exterior structure of an existing home shall strictly conform to the design of the original home in style, detailing, materials, and current color. Any such addition, alteration or renovation shall be made only after application to and approval by the ARC All sun rooms, screened/enclosed patios and other additions to homes shall be built within the setback lines originally established for Sun City Lincoln Hills as set forth in part in Section of these Design Guidelines 10.2 When any additions, alterations, or renovations are performed to an existing home, the established Lot drainage shall not be altered. As provided for, without limitation, in Article VII, Section 7.07(c) of the CC&Rs, any Owner or Resident who changes the existing grading or drainage shall be strictly liable for all costs and expenses of repairing such changes, or any costs, liabilities, damages or causes of action arising out of such changes All new or altered roofs shall drain to the ground solely within the deeded lot A site visit by the ARC is required to review the potential location before an application may be submitted. 11 Addresses Painted on City Curbs. The painting of addresses on City street curbs is prohibited by the City Engineering Department. 17 Barbeques. See Checklist 11. Refer to Fire Pits and Exterior Fireplaces of these Design Guidelines. As stated in Section 8.05(d) of the CC&Rs, fires are permitted in equipment in use for cooking purposes, provided the fires are not located in a manner that directs an unreasonable amount of smoke onto a neighbor's property. Built-in BBQ units require ARC approval. Portable BBQ s do not require ARC approval. All units must comply with local government regulations. 31 Fountains. See Checklist 13. Refer to Water Features, Ponds, and Waterfalls of these Design Guidelines. Fountains are permitted in the front yards, corner lot street side yards, rear yards, and courtyards of all homes Fountains and decorative components shall be limited to fifty-four inches (54 ) above the adjacent grade. If the fountain is located on a mound, the mound height shall be included in the maximum height of (54 ). Proposed Design Guideline Revisions - December 15, 2016 Page 10 of 14

12 37 Hardscape. See Checklist 16. All concrete, stone, brick, or other landscape material used for patios and walkways must conform to the overall architectural character of the home Excessive use of concrete or pavers in front and corner lot street side yardsall yards is prohibited The use of unformed concrete is prohibited All hardscape shall be setback a minimum of one foot (1-0 ) from side and rear property lines. 39 Lighting. See Checklist 20. Replacement or the addition of fixtures on the home s exterior, or in the landscape, regardless of the power source ( 110 volt, low voltage or solar) requires ARC approval. The following lighting applications will be allowed:are permitted: 39.1 Exterior building and decorative walkway fixtures must be compatible in style and scale with the home Exterior low-voltage accent lighting may be installed to highlight architectural or landscape features as long as light glare is minimized on adjacent residences Decorative strings of lights and rope lighting shall be installed in a neat and orderly fashion with the wiring concealed from view. Draping of string lighting is prohibited. 45 Patio Covers. See Checklist 21. The following requirements apply only to patio covers that are attached to the home, open on the sides and have open beam or solid roofs, and do not apply to patio enclosures The solid roof patio cover shall have a slope of no less than one-quarter (1/4 ) inch/running foot to no greater than three-quarter (3/4 ) inch/running foot The open beam roof patio cover shall be flat, or have a slope the same as solid roof Upright supports constructed of redwood shall be a minimum six inches by six inches (5½ x 5½ ). Supports shall be in scale with the size of the lot and home Upright supports constructed of embossed metal shall have a minimum finished size of at least six and one-half inches by seven and one-quarter inches (6½ x 7¼ ). Supports shall be in scale with the size of the lot and house Upright supports constructed as columns, shall have a minimum finished size of at least eight inches, square or ten inches in diameter. 13 46 Patio Furniture. See Checklist 30. Refer to Section 2 of these Design Guidelines. Unless in the private space, patio furniture in the front of the home must be approved by ARC if visible from neighboring properties. Folding chairs, webbed patio chairs/chaises, traditional indoor furniture and hammocks are prohibited. All patio furniture will be evaluated in terms of size, location, and compatibility with the architectural character of the home. 47 Pergolas. See Checklist 22. A pergola may be an entirely freestanding structure or it may be attached to a freestanding wall, or other improvement, with posts that support cross members to form a shaded area or passageway. If attached to the building, refer to Patio Cover, Checklist Upright supports constructed of redwood shall be a minimum six inches by six inches (5½ x 5½ ). Supports shall be in scale with the size of the lot and home Upright supports constructed of embossed metal shall have a minimum finished size of at least six and one-half inches by seven and one-quarter inches (6½ x 7¼ ). Supports shall be in scale with the size of the lot and house Upright supports constructed as columns, shall have a minimum finished size of at least eight inches, square or ten inches in diameter. (88 x 88 or 108 Ø). Supports shall be in scale with the size of the lot and home. 49 Pools and Spas. See Checklist 24. Refer to CC&Rs, Article VI, Section A detailed plan shall be submitted depicting the proposed location of the pool and/or spa, property lines, materials, and an estimated completion date. As stated in Section 6.03 of the CC&Rs, any Owner of a Lot constructing a swimming pool, spa, or other man-made body of water on the Lot, must comply with any local ordinances and obtain ARC approval A site visit by the ARC is required to review the potential location before an application may be submitted It is the Owners responsibility to secure proper building permits/inspections and to ensure that plans conform to the ARC and local government Guidelines Grading shall provide positive drainage The ARC shall review the location and screening of pool cleaning pumps and apparatus. In areas without solid walls or fencing in rear yards of Lots, pool equipment shall be screened with either landscaping or approved screening material if the equipment is visible from other Lots or the Golf Course. See Equipment and Machinery. As stated in Section 6.03 of the CC&Rs, screening material shall not extend more than six inches above the top of the equipment Reasonable efforts shall be made to locate pool equipment on a Lot so as to minimize adverse noise impacts on neighboring Owners or Residents, however, other factors such as the need to locate the equipment in reasonable proximity to the pool may also be considered It is recognized that all pool and spa equipment produces some noise, as does use of the pool by residents and guests. 14 or operation of a swimming pool is not a basis, in and of itself, for denying approval to a pool Improvement project The ARC may grant waivers of the wall/fence height requirements to the limited extent necessary to comply with minimum legal requirements for pool fence enclosures under applicable law All pools, spas and Jacuzzi type tubs must be installed according to City of Lincoln Municipal Code and these Design Guidelines and will be subject to certain setbacks measured from the edge of the water. 66 Wall ArtDecorations. See Checklist 31. Wall decorations are allowed in all yards. with ARC approval on the front of the property and may be viewable from any direction. is required if they are visible from neighboring properties, streets, common areas, open space or the golf course Decorative wall objectswall decorations will be evaluated in terms of size, location, number, and compatibility with the architectural character of the home and the community. 67 Water Features, Ponds and Waterfalls. See Checklist 13. Water features include, but are not limited to, ponds, waterfalls, and any other installation using water as a garden feature. The minimum setback to the waterline is three feet (3 ). Other setbacks and equipment issues will be reviewed by the ARC when application is made for these projects All water features are limited to fifty four inches (54 ) above the adjacent grade Water features shall be installed in rear yards only and be finished on all sides Landscaping shall be installed as a buffer between the water feature and the Open Space or Golf Course. Appendices The following Appendices have been added.
