2 Experience with: Study of conditions and directions of spatial development for polish marine areas Prepared by Maritime Institute in Gdańsk Ministry of Infrastructure and Development responsible for gathering and delivering all data/information

3 No law regarding input data for MSP Regulation on MSP in polish marine waters (5 august 2013, currently to be slightly amended) describes the required scope of spatial plans for internal marine waters, territorial sea and EEZ in regard to text and graphical parts of the plan, also prepared in the form of database, requirements for used source materials, scales of the plans, used cartographic signs, naming standards and the method of documenting the planning work

4 The text part of the plan includes, in particular: 1 ) description of the location of spatial objects shown in the graphic part of the plan; 2 ) the destination of the areas, particular for : a) maritime transport, b ) sports, tourism and recreation, c) marine aquacultures, d ) fishing, e) artificial islands, installations and structures, f ) technical infrastructure, g ) ensuring the security and public order; 3) restrictions and approvals in using of the marine areas. In particular in the field of research, sailing, fishing, diving and use of artificial islands, installations, equipment and technical infrastructure, swimming and sports; 4) localizations: a) protected areas, b) public investments, c ) areas of documented mineral deposits, d ) licensed mining areas, e) boundaries of the zones closed to shipping and fishing and, if possible, periodically zones dangerous for sailing and fishing, f ) protected circuits and temporary protected circuits.

5 Graphic part of the plan includes In particular: 1 ) preview specifying the location of the maritime area covered by the plan in relation to the coast; 2 ) scale of the plan; 3) boundaries of the maritime area covered by the plan; 4) administrative boundaries in the area covered by the plan; 5) areas of water designated for a specific purpose and their markings; 6 ) constructions, including underwater; 7 ) boundaries and markings for protected areas and protected zones, 8) boundaries and markings for closed zones; 9 ) infrastructure for shipping; 10 ) technical infrastructure occurring in the area plan; 11 ) mining areas; 12 ) markings of the land and sea areas adjacent to the area of the plan.

9 Information and general analysis on gathered data are subject of Report from 1st stage of preparing Study of conditions and directions of spatial development for polish marine areas submitted by Maritime Institute. Considering, that there was about 900 datasets in different forms, and Report takes 80 pages (report also lists the applicable legislation, policy, strategic documents, national and international msp-related projects, references) only general overview will be presented below.

17 Data ownership and availability In purpose of preparing Study of conditions and directions of spatial development for polish marine areas Ministry of Infrastructure and Development managed to get all requested data without any fee; In Poland there are two acts of law which allows to deliver data/information from one administration body to another without charges; It s possible to obtain some data as a request for access to public information; But: All gathered data were obtained exclusively for preparing Study In 3 (on 30) cases was obligation to sign license agreement Many of those datasets are available for a fee only Some of data (especially descriptive ones like reports, summaries) were available via Internet for free

18 Data accessibility All request for data delivery were made by official letter, signed by minister responsible for maritime economy. In most cases data came as an attachment to response letter (on CD, DVD, Hard drive, ) In some cases response letter informed where requested data should be found (usually on the website of relevant authority). In few cases response letter informed how to request for those data in a proper way (for example by filling special form). In no case datasets were collected via web services like WFS. For now in Poland there is no platform nor existing infrastructure for such data exchange.
