1 DEVONPORT HIGH SCHOOL FOR GIRLS Gverning Bdy and Cmmittee Terms f Reference The Gverning Bdy needs t take a strategic rle, act as a critical friend t the schl and be accuntable fr its decisins. It shuld set aims and bjectives and review, agree and mnitr plicies, targets and pririties. Gverning Bdy meetings will be pen t the public with Minutes available except fr Part II business. In the event f a tied vte, the Chair r Acting Chair/Vice Chair will have a secnd r casting vte. The Gverning Bdy will: Hld at least 3 meetings per year plus an Admin meeting in September Appint r remve the Clerk Annually, elect a Chair and Vice Chair Annually, elect Chairs and Vice Chairs and agree memberships fr each f the fllwing cmmittees: Buildings & Catering, Finance & Persnnel, Pay, Plicies, Pupil Prgress, Welfare & Evaluatin Advise all parents f any parent gvernr vacancies, all staff f staff gvernr vacancies and t appint cmmunity gvernrs Annually adpt the SER Set dates f meetings fr the year ahead Nte term dates fr the academic year and agree the ccasinal days Receive Head Teacher reprts Review and mnitr examinatin/natinal test results Review the level f exclusins Mnitr attendance f pupils/staff/gvernrs Review, adpt and mnitr a Freedm f Infrmatin Publicatin Scheme Agree Curriculum plans Set pupil perfrmance targets If required, cnsider the suspensin f a gvernr Prvide inductin fr new gvernrs Encurage gvernrs t visit the schl and t review, adpt and mnitr a gvernrs visit plicy and feedback prcedure Review, adpt and mnitr the prcedures fr dealing with cmplaints frm parents/carers Review, apprve and mnitr the Schl Imprvement Plan Annually, elect gvernrs fr the fllwing respnsibilities: Attendance, Child Prtectin, Equality, Gifted & Talented, Health & Safety, Lked After Children, Special Educatinal Needs English (includes Literacy) Mathematics (includes Numeracy) Creative Arts (Art/Drama/Music/PE (includes Dance)) Humanities (Business Studies/Gegraphy/Histry/Psychlgy/Religius Studies) Languages (Chinese/French/German/Latin/Spanish), Science (Bilgy/Chemistry/Physics) Technlgy (Fd/ICT/Resistant Materials/Textiles) Ensure at least 3 gvernrs are appinted and trained t cmplete the Head Teacher s Perfrmance Management Maintain and update annually a file f pecuniary interest declaratins Review, adpt and mnitr a gvernrs expenses plicy and curriculum plicy
2 Review annually the delegatin f functins and cmmittee structure Organise supprt and training fr gvernrs Cmmittee Terms f Reference Membership Nt less than 4 gvernrs appinted by the Gverning Bdy plus any members appinted by the Gverning Bdy t the cmmittee The cmmittee may make recmmendatins t the Gverning Bdy fr c-ptin f nn-gvernr members The Cmmittee Chair shuld be appinted at the beginning f each schl year by the Gverning Bdy r by the cmmittee and shall nt be a member f staff at the schl r a nn-gvernr member The Chair f Gvernrs can be an ex-ffici member f each cmmittee and may attend each cmmittee meeting and vte The Head Teacher is a member f all cmmittees but cannt be present when the Pay cmmittee discuss the Head Teacher s salary Disqualificatin Any member f staff, ther than the Head Teacher, when the subject fr cnsideratin is the pay, perfrmance r discipline, f any ther member f staff. The Head Teacher r any gvernr may nt attend when s/he is the subject under discussin r there is a perceived cnflict f interest. Qurum 3 gvernrs, wh are appinted members f the cmmittee. Meetings At least 3 times in each schl year prir t rdinary full Gverning Bdy meetings Cmmittee meetings will nt be pen t the public but minutes are available except fr Part II minutes In the absence f the Chair, the Vice Chair will chair the meeting. In the absence f bth the Chair and Vice Chair, prvided the meeting will still be qurate, the cmmittee shall chse an Acting Chair fr that meeting frm amng their number In the event f a tied vte, the Chair, Vice Chair r Acting Chair shall have a secnd r casting vte It is advisable that each cmmittee shall be clerked by the Clerk t Gvernrs. In the absence f the Clerk, the cmmittee shall chse a Clerk fr that meeting frm amng their number (smene wh is nt a member f staff at the schl) The draft minutes f each cmmittee meeting will be circulated with the agenda fr the next rdinary meeting f the Full Gverning Bdy General Terms T act n matters delegated by the full Gverning Bdy T liaise and cnsult with ther cmmittees where necessary T cntribute t the Schl Develpment Plan Althugh primary respnsibilities fr plicies cncerning Health and Safety, Inclusin and Child Prtectin are delegated t the Plicies cmmittee, all cmmittees shuld cnsider relevant aspects f these
3 Specific Terms f Reference PUPIL PROGRESS, WELFARE AND EVALUATION COMMITTEE T review, adpt and mnitr an verall curriculum plicy In cllabratin with staff, t prvide infrmatin abut hw the curriculum is taught, evaluated and resurced T ensure that the Plicies cmmittee review and adpt and plicies fr Cllective Wrship and Sex Educatin, which will be mnitred by the Pupil Prgress, Welfare and Evaluatin cmmittee T ensure that the requirements f children with special needs are met, as laid ut in the Cde f Practice T mnitr and review the infrmatin abut schl perfrmance and reprt accrding t statutry requirements T ensure that the Plicies cmmittee review and adpt plicies cncerning inclusin, equality, drugs educatin, pupil behavir and discipline and child prtectin and the Pupil Prgress, Welfare & Evaluatin cmmittee shuld mnitr their implementatin T advise the Finance and Persnnel cmmittee n the relative funding pririties necessary t deliver the curriculum T versee the arrangements fr educatinal visits, including the appintment f a named C-rdinatr T prepare and publish the schl prspectus n the schl s website BUILDINGS AND CATERING COMMITTEE T prvide supprt and guidance fr the Gverning Bdy and the Head Teacher n all matters relating t the maintenance and develpment f the premises and grunds, including Health and Safety T inspect the premises and grunds annually and t review the Asset Management Plan in rder t prepare a list f pririties fr maintenance and develpment T advise the Finance and Persnnel cmmittee n the relative funding pririties necessary fr security, maintenance, repairs and decratin and t apprve the csts and arrangements within the budget allcatin. The Head Teacher is authrised t cmmit expenditure withut the prir apprval f the cmmittee in any emergency where delay wuld result in further damage r present a risk t the health and safety f pupils r staff. In this event the Head Teacher wuld nrmally be expected t cnsult the cmmittee Chair at the earliest pprtunity. T versee the preparatin and implementatin f cntracts T ensure that the Gverning Bdy s respnsibilities regarding litter, refuse and dg excrement are discharged accrding t Sectin 89 f the Envirnmental Prtectin Act 1990, s far as is practicable T establish and keep under review the Accessibility Plan T review, adpt and mnitr a Health and Safety plicy In cnsultatin with the Head Teacher and the Finance and Persnnel cmmittee t versee any premises related funding bid T ensure that the prvisin f fd fr sale and cnsumptin at the schl cmplies with the latest Gvernment regulatins in frce FINANCE AND PERSONNEL COMMITTEE Purpse: T assist the decisin making f the gverning bdy by enabling mre detailed cnsideratin t be given t the best means f fulfilling the gverning bdy s respnsibility t ensure sund management f the academy s finances and resurces, including prper planning, mnitring and prbity. T make apprpriate
4 cmments and recmmendatins n such matters, t the gverning bdy, n a regular basis. Majr issues will be referred t the full gverning bdy fr ratificatin. Persnnel In cnsultatin with the Head Teacher, t determine the staffing structure f the schl T versee the appintment prcedure fr all staff T cnsider frm the Pay cmmittee, recmmendatins n staff salaries made by the Head Teacher r the Head Teacher Perfrmance Management Grup T ensure that the Plicies cmmittee review and adpt a plicy statement n staff cnsultatin and t undertake any frmal cnsultatins which will be mnitred by the Finance and Persnnel cmmittee In cnsultatin with staff, t versee any prcess leading t staff reductins T ensure that the Plicies cmmittee annually review and adpt the prcedures fr dealing with staff discipline and grievances, ensuring that staff are infrmed f these and the Finance and Persnnel cmmittee will mnitr this T act as first cmmittee fr frmal disciplinary r cmplaints hearings T determine membership f the Head Teacher Perfrmance Management Grup. Membership f the HTPM grup need nt be drawn frm this cmmittee but the cmmittee shuld seek t ensure that HTPN grup members have received apprpriate training. The Chair f Gvernrs shuld nt be a Perfrmance Management Gvernr. T ensure that the Plicies cmmittee review and adpt the Equalities plicy. This plicy will be mnitred by the Finance and Persnnel cmmittee. The schl will publish annually infrmatin demnstrating hw the schl is meeting the aims f public sectr equality duty. Finance T cnsider the academy s indicative funding, ntified annually by the DfES and t assess its implicatins fr the academy, in cnsultatin with the Head Teacher, in advance f the financial year, drawing any matters f significance r cncern t the attentin f the gverning bdy T cnsider and recmmend acceptance/nn-acceptance f the academy s budget at the start f each financial year T cntribute t the frmulatin f the academy s develpment plan, thrugh the cnsideratin f financial pririties and prpsals, in cnsultatin with the Head Teacher, with the stated and agreed aims and bjectives f the academy T receive and make recmmendatins n he brad budget headings and areas f expenditure t be adpted each year, including the level and use f any cntingency fund r balances, ensuring the cmpatibility f all such prpsals with he develpment pririties set ut in the develpment plan T liaise with and receive reprts frm the Pupil Prgress, Welfare and Evaluatin cmmittee which deals with curriculum issues as apprpriate and t make recmmendatin t the cmmittee abut the financial aspects f matters being cnsidered by them The academy s Finance and Persnnel cmmittee deals with finance as well as staffing/remuneratin issues T mnitr and review expenditure n a regular basis and ensure cmpliance with the verall financial plan fr the academy and with the financial regulatins f the DfES, drawing any matters f cncern t the attentin f the gverning bdy T mnitr and review prcedures fr ensuring the effective implementatin and peratin f financial prcedures n a regular basis, including the implementatin f bank accunt arrangements and, where apprpriate t make recmmendatins fr imprvement T prepare the financial statement t frm part f the annual reprt f the gverning bdy t parents and fr filing in accrdance with Cmpanies Act and Charity Cmmissin requirements
5 Finance Plicy and Lcal Scheme f Delegatin T ensure that the Plicies cmmittee review and adpt a Finance Plicy in accrdance with the Handbk fr Academies, which will be mnitred by the Finance and Persnnel cmmittee T ensure that the Plicies cmmittee review and adpt a Charging and Remissins plicy which will be mnitred by the Finance and Persnnel cmmittee T ensure that the Plicies cmmittee review and adpt a lettings and charges plicy, which will be mnitred by the Finance and Persnnel cmmittee in respect f its implementatin Financial Planning T establish a 3 year budget plan, taking int accunt the agreed pririties f the Schl Develpment Plan T draft and adpt a detailed annual budget plan (revenue and capital expenditure), taking int accunt the agreed pririties f the Schl Develpment Plan T make any decisins in respect f the service level agreement with the Lcal Authrity (Services4Schls) and ther prviders T determine whether sufficient funds are available fr pay increments, as recmmended by the Head Teacher and the Head Teacher Perfrmance Management Grup T cnsider and apprve recmmendatins made by the Buildings and Catering cmmittee n all aspects relating t the schl premises Financial Mnitring Public Funds T mnitr the incme and expenditure thrughut the year f all revenue and capital funds against the annual budget plan T reprt t the Gverning Bdy any significant anmalies in the perfrmance f the schl against the annual budget plan T apprve any budgetary adjustments that will frm time t time be necessary in respnse t the evlving requirements f the schl T prepare the financial statements t frm part f the annual reprt f the gvernrs t parents and fr filing in accrdance with the Cmpanies Act and Charity Cmmissin requirements T receive auditrs reprts and t recmmend t the full gverning bdy actin as apprpriate in respnse t audit findings T recmmend t the full gverning bdy the appintment r re-appintment f the auditrs f the academy T review cmparative financial statistics T receive a reprt frm the Head Teacher fllwing the annual inspectin f the schl assets as recrded in the asset registers/inventries Nn-public Funds T receive reprts and mnitr the incme and expenditure thrughut the year T appint an external auditr f these funds T receive and respnd t the audit reprt n these funds Financial Management and Gvernance Evaluatin T review the schl s self-assessment prir t submissin T annually review Gvernrs cmpetencies in regards t cntinued prfessinal develpment T receive and respnd n any reprt issued by the Educatin Funding Agency (EFA).
